Australian prisons are overpopulated with people suffering from numerous health problems. COVID-19 presents a significant threat to prisoner health. This article examines the current regulatory responses from Australian state and territory governments to COVID-19 and a recent case which tested the human rights of prisoners during a pandemic.

The doctrine of consent is built upon presumptions of mental capacity. Those presumptions must be tested according to legal rules that may be difficult to apply to COVID-19 patients during emergency presentations. We examine the principles of mental capacity and make recommendations on how to assess the capacity of COVID-19 patients to consent to emergency medical treatment. We term this the CARD approach.

Five different forms of truth skepticism are examined and defused: the view that truth is indefinable, that it is unattainable and unknowable, that it is inextricably metaphysical and hence not scientifically respectable, that there is no such thing as truth, and that truth is inherently paradoxical, and so must either be abandoned or revised. An intriguing formulation of the last of these views is owing to Alfred Tarski, who argued that the Liar paradox shows natural languages to be inconsistent because (...) they contain defective, and ultimately incoherent truth predicates. Here, it is argued in response that on a plausible interpretation of his puzzling notion of an inconsistent language, Tarski's argument is, though logically valid, almost certainly unsound, since one of its premises is highly problematic. Similar results are achieved for other forms of truth skepticism. (shrink)

Can Tarski's definition of truth be taken to be an analysis of truth – i.e., a method of defining formal truth predicates that are capable of playing the role of truth in all theoretical contexts in which that notion is needed? It is argued that although Tarski's truth predicates can play many of the roles demanded of truth, they cannot play the role of truth in theories of meaning and interpretation. Crucial to the argument is the observation that there is (...) a conceptual connection between our ordinary notions of truth and meaning, in virtue of which statements of the truth conditions of sentences provide some information about their meanings. Since there is no corresponding connection between Tarski's notion of truth and the notion of meaning, statements of the Tarski‐truth conditions of sentences provide no information about meaning. The chapter closes with a detailed defense of Tarski's model‐theoretic analysis of logical truth and logical consequence against John Etchemendy's objections to it. (shrink)

W.V.O. Quine's doctrines of the indeterminacy of translation and the inscrutability of reference are among the most famous and influential theses in philosophy in the past fifty years. Although by no means universally accepted, the arguments for them have been widely regarded as powerful challenges to our most fundamental beliefs about meaning and reference — including the belief that many of our words have meaning and reference in the sense in which we ordinarily understand those notions, as well as beliefs (...) about the particular things meant and referred to in specific cases, such as my belief that in the past my son Brian often referred with affection to his pet rabbit Bigwig. If Quine's doctrines, and the arguments for them, are correct, then beliefs such as these cannot be accepted as true.One might expect that with consequences like these Quine's theses would widely be regarded as obviously incorrect. This paper addresses issues of agency and self-identity on the basis of a phenomenology of embodiment. It considers a tension in accounts of embodiment between, on the one hand, the body as the locus of subjectivity, lived experience, and agency, and, on the other hand, the body as constructed, as the site where discursive regimes of power are inscribed. In exploring this tension I consider Frantz Fanon’s and Sarah Ahmed’s phenomenological accounts of racism to illustrate the ways in which social (...) power and violence come to be implicated in these conflicts within our embodied identities. I also consider Foucauldian “power” in relation to Merleau-Ponty’s concept of “institution.” I argue that only the phenomenological concept of institution, by drawing our attention to the ambiguities of lived embodiment, succeeds in offering us resources for thinking about the interplay between passivity and agency in the life of the subject, and, in particular, about a form of agency not wholly reducible to the effects of power. One of the lingering questions for development economists is that of economic transition and whether development can be promoted by a strong political leader. Earlier writings on leadership and economic development tend to fall into one of two camps: leaders matter and can contribute positively to economic growth, or leaders seldom have positive effects and, at best, can avoid doing a great deal of harm. This article establishes a third option—a middle-ground position—between these two views. Good leadership can, indeed, have (...) a positive effect on economic growth but only during the initial moment when economic reform is up for grabs. Once the opportunity to implement sweeping reform has passed, interests become entrenched, and the opportunity for growth-enhancing reform passes. Bad leaders, on the other hand, can hamper economic growth in periods well beyond the ideal reform moment. (shrink)

Beyond Rigidity is divided into two parts. Part 1 is devoted to the semantics and pragmatics of names, and the sentences, including attitude ascriptions, that contain them. In part 2, the model developed in part 1 is extended to natural kind terms, and simple predicates in which they occur. The model is then used to explain the necessity of certain aposteriori statements containing such predicates.

Contra Ezcurdia, it is argued that my thesis --that substitution of coreferential names or indexicals in attitude ascriptions preserves truth values of propositions semantically expressed, although it often changes truth values of propositions asserted-- is compatible with the fact that belief ascriptions play important explanatory roles. This book systematically elaborates Scott Eacott's "relational" approach to organizational theory in education. Contributing to the relational trend in the social sciences, it first surveys relational scholarship across disciplines before providing a nuanced articulation of the relational research program and key concepts such as organizing activity, auctors, and spatio-temporal conditions. It also includes critical commentaries on the program from key figures such as Tony Bush, Megan Crawford, Fenwick English, Helen Gunter, Izhar Oplatka, Augusto Riveros, and Dawn Wallin. As such, (...) the text models an approach to, or social epistemology for building knowledge claims in relation rather than through parallel monologues. Eacott's relational approach provides a distinctive, post-Bourdieusian variant of the relational sociological project. Shifting the focus of inquiry from entities (e.g., leaders, organizations) to organizing activity and recognizing how auctors generate - simultaneously emerging from and constitutive of - spatio-temporal conditions unsettles the orthodoxy of organizational theory in educational administration and leadership. By presenting its claims in the context of other approaches, the book stimulates intellectual debate among both relational sociologists and opponents of relational approaches. Beyond Leadership provides significant insights into the organizing of education. As it does not fit neatly into any one field, but instead blends educational administration and leadership, organizational studies, and relational sociology, among others, it charts new territory and promotes important dialogue and debate. A large part of the ambitious project that Grisez sketches in his paper can reasonably be thought of as developing and extending in interesting ways ideas of Thomas Aquinas. But in Part IV of the paper Grisez dramatically parts company with Aquinas on what might seem a fundamental issue. Aquinas famously holds that human beings find their ultimate fulfillment in beatific vision of God. Grisez tells us that, as he understands that claim, it is false.
