The debate over judicial review of legislation is profuse. But differences are often due to the lack of a common methodology. This article discusses the proper way to evaluate judicial review and confronts central challenges raised against it. It develops the two main models that can be used for analyzing the intersection between democracy and constitutional decision-making and shows that judicial oversight may not be rejected, regardless of how we interpret that connection. The article discusses in detail the model developed (...) by Jeremy Waldron. A nice attempt to answer methodological questions, Waldron's model wrongly tips the balance against judicial review. Its excessive level of abstraction and idealization renders it inoperable. Few systems meet its standards, and those that do pay a high price: they contradict the concept of democratic legitimacy that underlies the model. Paradoxically, a system with judicial review may end up being more legitimate than one without it. (shrink)

In this article, we study Latin American populist constitutions and their uses, seeking to analytically understand whether populist constitutionalism is, indeed, a thing. We posit that Latin American populist constitutionalism is a particular form of mixed constitutionalism in three senses: first, as a specific combination of substantive traits that includes both empowering and constraining devices; second, as a peculiar politics of constitutional change that incorporates popular mobilization against pre-existing institutions as a key trait; and third, as a particular practice of (...) constitutional enforcement that involves weak and selective implementation, often through institutional capture. By considering not only the texts of constitutions but also the ways in which they are changed and implemented, we hope to complement legal perspectives of mixed constitutions with a sociopolitical analysis of practices and contexts. By capturing the distinctive contribution of Latin American populism to the discussion of mixed constitutions, we seek to challenge both legal conceptions of constitutionalism that reduce it to negative or constraining features, and political conceptions of populism that simply equate it to authoritarian rule. SummaryThis paper analyses the development of three methods for detecting bloodstains during the first half of the nineteenth-century in France. After dealing with the main problems in detecting bloodstains, the paper describes the chemical tests introduced in the mid-1820s. Then the first uses of the microscope in the detection of bloodstains around 1827 are discussed. The most controversial method is then examined, the smell test introduced by Jean-Pierre Barruel in 1829, and the debates which took place in French academies and (...) learned societies during ensuing years are surveyed. Moving to the courtrooms a review is conducted of how the different methods were employed in criminal trials. By reviewing these cases, the main arguments against Barruel's test during the 1830s are explored as well as the changes making possible the return of the microscope to legal medicine around 1840. By reconstructing the history of these three methods, the paper reveals how the senses of smell and vision were employed in order to produce convincing evidence in both academies and courts. The paper questions two linear master narratives that are organized in terms of progress and decline: the development of forensic science as a result of continued technological progress; and the supposed decline of smell in the history of the senses, particularly in the realm of chemistry and medicine. En este escrito me propongo mantener un diálogo con María Julia Bertomeu a propósito de la lectura sobre la hibridación de liberalismo y republicanismo contenida en una contribución de A. Pinzani y N. Sánchez Madrid y publicada en el volumen Kant and Social Policies. Mi intención principal es esclarecer lo que Kant parece entender en la Doctrina del Derecho como la protección jurídica que el Estado debe conceder a los ciudadanos en su totalidad y señalar la dualidad de perspectivas (...) que este pensador abre para resolver problemas de enorme incidencia social y política como es la pobreza, como un ejemplo de su planteamiento de la injusticia social. Finalmente, se recogen algunas conclusiones sobre la disparidad de ópticas que Kant y nuestro presente adoptan acerca del sufrimiento social y la noción de responsabilidad jurídica y política. En este trabajo intento hacer algunos aportes al diálogo entre María Julia Bertomeu y Nuria Sánchez Madrid publicado en Con-Textos Kantianos en 2019. Me interesa establecer que la teoría kantiana de la propiedad es una teoría crítica que no justifica los derechos de propiedad privada y las relaciones de propiedad existentes sino que sirve para señalar el carácter no absoluto de los derechos de propiedad privada y la necesidad normativa de modificar las relaciones de propiedad existentes.

Summary This paper presents a case study that contributes to the current debate among historians of chemistry concerning the role and influence of pedagogy in science. Recently, Bernadette Bensaude-Vincent and her colleagues concluded that in nineteenth-century France, ?textbooks played an important role in discipline building and in creating theories?.1 Developing this idea further, this paper examines the dissemination of knowledge through face-to-face chemical lectures, showing that the influence of pedagogical strategy on theoretical content of the science is far from negligible. (...) The pedagogy of William Cullen was essentially responsible for the prevalence of the doctrine of affinity in British chemistry from the 1760s onwards. Cullen used his affinity theory as a pedagogical tool that to a large extent defined his discipline, and the pedagogical pyramid that he headed similarly ensured that the doctrine would remain at the heart of British chemistry. From a pedagogical tool, the doctrine of affinity was transformed over time into a chemical tool, offering British chemists a disciplinary common ground that both set and reinforced the boundaries to their discipline. 1A. A pesar de que no podría afirmarse que constituyen una filosofía ambiental propiamente tal, los escritos de Rodolfo Kusch podrían hacer una contribución significativa a un pensamiento ambiental anclado en las peculiaridades de nuestra cultura. Alicia Irene Bugallo ha trabajado en (...) temas de ecofilosofía, y ha introducido estos temas a jóvenes, educadores y el público en general. Alcira Bonilla ha introducido un tipo de eco-humanismo ético, que se mueve lejos del antropocentrismo a la vez que evita un fisiocentrismo o sacralización de la naturaleza. A diferencia de Bugallo y Bonilla, cuyas posiciones se acercan a la ecología profunda, María Julia Bertomeu ha enfatizado la necesidad de una clarificación normativa de reglas generalizables orientadas hacia la protección medioambiental. La Escuela Marina Vilte de la Confederación deTrabajadores de la Educación de la República Argentina ha sido un auténtico catalizador formando una nueva generación de educadores con un enfoque en temas ambientales. Un grupo de colaboración de intelectuales que trabaja en pensamiento crítico, encabezado por su coordinador Guido Galafassi, ha creado la revista Theomai y elaborado una crítica de nuestra actual situación socio-ambiental. En cuanto a nuestros medios de comunicación de masas, durante varias décadas Miguel Grinberg y Antonio Brailovsky han sido figuras inspiradoras que han difundido los temas ambientales. (shrink)

In recent decades, Spanish feminist praxis has diversified its theoretical proposals and objectives, presenting the use of the new virtual communities from perspectives that bring it closer both to cyberfeminism and to technofeminism. The purpose of this article is to consider and explore in depth the construction and the use of the new technologies and internet in the new spaces for relationships in this feminist praxis. The article analyses the theoretical and agency proposals presented by two of the founders of (...) the most significant portals in recent years in Spain: E-leusis, founded by María Angustias Bertomeu, and Mujeres en Red, founded by Montserrat Boix. From a position closer to the essential utopia defended by Bertomeu, Spanish feminist praxis has advanced towards a kind of technofeminism that Montserrat Boix herself has transformed into what she has denominated social cyberfeminism.
