The goal of this article is to show that mainstream liberal accounts of civil disobedience fail to fully capture the latter’s specific characteristics as a genuinely political and democratic practice of contestation that is not reducible to an ethical or legal understanding either in terms of individual conscience or of fidelity to the rule of law. In developing this account in more detail, I first define civil disobedience with an aim of spelling out why the standard liberal model, while providing (...) a useful starting point, ultimately leads to an overly constrained, domesticated and sanitized understanding of this complex political practice. Second, I place the political practice of civil disobedience between two opposing poles: symbolic politics and real confrontation. I argue that the irreducible tension between these poles precisely accounts for its politicizing and democratizing potential. Finally, I briefly examine the role of civil disobedience in representative democracies, addressing a series of recent challenges made in response to this radically democratic understanding of disobedience. Haji Mustafa Efendi, also known as Şeyh-i Şirani, is a Sufi and scholarly figure. He was born in 1254/1838 in Sarıca village of Şiran district of Gümüşhane province. His father's name was Ömer Efendi and his mother was Havva Hatun. After receiving madrasah education in his hometown for about fifteen years, he continued his education in Trabzon, Tokat and Uşak. While advancing on the path of knowledge, he was inclined towards Sufism and went to Mecca, where he became affiliated with (...) Yahya Dagestani (d. 1319/1899), one of the sheikhs of the Naqshbandi sect. He served his sheikh for seven years and received Sufi training from him. Then, with the sign and permission of his sheikh, he returned to Anatolia and carried out guidance activities first in Niksar and then in Çorum. In Çorum, where he came in the 1870s, he built a lodge, trained dozens of khalifas and sent these students to various parts of Anatolia on a mission of guidance. Sultan II. Abdulhamit wanted to give him a gift, but since he did not accept this offer, he was exiled from Çorum to Afyon. Haji Mustafa Efendi from Şiran, who died in Medina in 1317/1899 as a result of his sixth pilgrimage, was buried in the Cennetü’l-Baki cemetery. In addition to his qualities as a scholar, murshid and guardian, Haji Mustafa Efendi was also interested in literature. There are ghazals, rubai and some couplets attributed to him. However, there is a lineage belonging to the Naqshbandi sect. Silsile, whose dictionary meaning is "succession, continuation of each other, genealogy", is a concept in Sufism that refers to the list of sheikhs of an order who continue by taking the icazet from each other. The document in which the nâmes that make up the lineage are recorded is called silsile-nâme. The tradition of writing silsile-nâme first appeared in Arab culture, and then passed on to Turkish culture. The first known example of this type in the history of Sufism is the silsila linking Ja'far al-Huldī (d. 348/959) to the Prophet (pbuh). In our culture, verse and prose series of orders belonging to various sects have been written. One of these is the verse series listing the genealogy of the Nakşibendî sect belonging to Haji Mustafa Efendi from Şiran. In the paper, after giving information about the life of Haji Mustafa Efendi from Şiran and his spiritual activities in Çorum, his lineage will be examined in terms of form and content. (shrink)

This study is an attempt toexamine the critiques of Mu‘tazilites in general and Rukn al-Dīn Abū Ṭāhir al- Ṭuraythīthī in particular, of “ta’yēen by naṣṣ”(appointment by text or direct proclamation) which has long been discussedwithin the intellectual history of Islam. The concept of ta’yēen by nass is a case which has been attemptedto be grounded on the basis of Qur’ān and Ḥadith. Although it is thought to bepeculiar to the Shiite circles, it has also been expressed in some Sunnischools as (...) well. Despite the fact that it is generally discussed in regard tothe imamate of the fourth Caliph ‘Ali,some also argued that ta‘yēen by ṇass was to be the case for the imamateof Abū Bakr. Concerning this theory, Mu‘tazilalevelled a great number of essential critiques at the Shiites’ understanding ofmatter. Since it has been discussed in direct relation to the textual evidencesfrom the Qur’ān, a re-examination of the subject in the Qur’anic context is required. In this regard, themethodological approach of Mu‘tazilitescholar al-Ṭuraythīthī is an important component to take into consideration.Ṭāhir al- Ṭuraythīthīcriticizes the sects for their understandings of the notion of ta‘yēen by naṣṣ, in his prominent book “Mutashābihal-Qur’ān” inwhich he tries to understand the subject at stake within the boundaries of languageand reason. Kur’ân ve hadislerde geçen müteşâbih ifadelerin nasıl anlaşılacağına dair kelâm geleneğinde ciddi tartışmalar yaşanmış ve farklı ekollere mensup âlimler tarafından birçok eser yazılmıştır. Mâtürîdî bir âlim olan Nâsırüddîn es-Semerkandî de bu çalışmada tenkitli neşri sunulan Fethu’l-ğalak fi’t-tevhîd adlı eseri kaleme almıştır. Günümüze ulaşan Arapça elyazması Süleymaniye Kütüphanesi Fatih koleksiyonunda 3142 demirbaş numarasıyla bulunmaktadır. Bildiğimiz kadarıyla bu alanda müstakil olarak kaleme alınmış olup günümüze ulaşan tek Mâtürîdî eser olma özelliğine sahiptir. Akıl ve şeriatten hareketle yapılması gerektiğini savunduğu te’vîlin belirli ilkeler çerçevesinde (...) özellikle de luğavî anlamın dışına çıkmadan müteşâbih ifadelerin muhkemlere hamlederek yapılması gerektiğini belirtmektedir. Bu noktada çizdiği çerçevede olmayan ve uç noktalar olarak gördüğü Bâtinîlerin ve Hanbelîlerin te’vîl anlayışlarını da eleştirmektedir. Müteşâbih ifadeleri te'vîl etmeyi uygun gören Mâtürîdî-Hanefî geleneğin yaklaşımını ortaya koymasının yanında geç bir dönemde yazılan eser bu konuda ele alınan ifadelerin yorumuna dair zengin ve bilgilendirici bir içerik sunmakta ve müteşâbihlerin bütünsel anlaşılması yönünde imkân sağlamaktadır. This article argues that, far from being a merely defensive act of individual protest, civil disobedience is a much more radical political practice. It is transformative in that it aims at the politicization of questions that are excluded from the political domain and at reconfiguring public space and existing institutions, often in comprehensive ways. Focusing on the reconstitution of the political community also allows us to reconceptualize constituent power. Rather than portraying it as a quasi-mythical force erupting only in extraordinary (...) moments, constituent power can be conceptualized as a dynamic situated within established orders, transgressing their logic and reconfiguring them from within. Civil disobedience as a transformative and potentially comprehensive practice aimed at reconstituting the political order can then be seen as an internal driving force keeping this dialectic in play. This book discusses possible solutions to theodicy and the problem of evil through the early philosophy and theology of Islam as well as through a semantic analysis of evil in the Qur’ān. Reflecting on Said Nursi’s magnum opus, the Risale-i Nur Collection (Epistles of Light), Yesilhark Ozkan puts Nursi’s theodicy into discourse with so called ‘secular’ theodicy or ‘anthropodicy’. Inquiries about existence in Mesopotamia started with the Sumerians. They set an example for the civilizations established in this geography and affected them deeply. According to Sumerian mythology, they are cosmic forces identified with fresh water, salt water and mist that are eternal. With the combination of these cosmic elements, the sky and the earth, which are symbolized by the gods, were formed. The whole they formed was separated from each other by Enlil, who was identified with air, and celestial (...) bodies were formed with the expansion of air. The Semites continued this understanding with its main lines. In the Babylonian Epic of Creation, the beginning of the cosmic process is based on the generational conflict between the gods and is explained with the sacrifice of Tiamat, one of the first cosmic forces. The Chief God Marduk shattered Tiamat and created the universe from her remains, and man from the remains of Kingsu. According to the Mesopotamian mythological tradition, gods were derived from the first cosmic elements, which were eternal, and then they created the universe and man from these cosmic remains. According to Egyptian mythology, the eternal is the ocean. The primary gods, who existed in the eternal ocean, created the universe and humans with their natural secretions. According to many mythological narratives, the dominant god has performed the act of creation by expressing his thoughts or the imagination of the heart. As in Mesopotamian mythology, gods and natural beings were identified with a symbolic language in Egyptian mythology. Greek mythological approaches are gathered in outlines in the works of Homer and Hesiod, who are considered to be the founders of religion. Homer stated that the eternal, the divine ocean, is the source of everything. According to Hesiod, in the beginning, chaos (emptiness) occurred, and then the universe, gods and human beings emerged from this chaos, respectively. These understandings of existence also contain a significant amount of philosophical content. There is a parallelism between the understanding of being in myths and those of philosophers. (shrink)

Bu çalışmada İslam düşünce tarihinde çokça ele alınan yönetime gelmede “nass ile tayin” anlayışına yönelik genelde Mu‘tezile’nin özelde ise bir Mu‘tezilî âlim Ebû Tâhir Rüknüddin et-Tureysisî’nin eleştirileri konu edinilmektedir. “Nass ile tayin” anlayışı Kur’ân âyetleri ve hadisler üzerinden temellendirilmeye çalışılan bir husustur. Şii çevrelerle özdeşleşen bu anlayış bazı Sünnî ekollerde de dillendirilmiştir. Genelde dördüncü halife Ali’nin imâmeti çerçevesinde konu tartışılsa da bazı çevrelerde birinci halife Ebû Bekir’in imâmeti için de nass ile tayin iddia edilmiştir. Mu‘tezile temelde Şîa’nın imâmet anlayışına birçok (...) eleştiri yöneltmiştir. Bu iddialar doğrudan Kur’ân metni üzerinden yapıldığı için âyetler bağlamında yeniden konunun değerlendirilmesi gerekmektedir. Bu noktada Mu‘tezilî bilgin Tureysisî’nin yaklaşımı önem arz etmektedir. O, mezheplerin görüşlerini temellendirmede esas aldıkları âyetleri dilin ve aklın sınırında anlama çabası içerisinde olduğu Müteşâbihü’l-Kur’ân adlı eserinde “nass ile tayin” fikrine yönelik eleştirilerini sürdürmektedir. Hem İmâmiyye’nin hem de Bekriyye’nin iddialarını âyetler bağlamında ele almakta ve bu fırkaları tenkid etmektedir. (shrink)

It can be said that both Plato's tripartite soul and Hippocrates' theory of temperament were influential in Galen's perception of ethics. In this respect, Galen, who presents a kind of composition of the effective philosophical and medical traditions of his day, is outside the tradition with his understanding of physicalist psychology. Considering the capacities of the soul as depending on the temperament of the body, Galen generally displays a deterministic attitude towards ethics, that is, the development of the soul. This (...) is because the natural and physical structure is difficult to change. On the other hand, Galen, whom we can call both a physician and a "philosophical therapist", argues that character traits (ethos) can be changed "to the extent that nature allows" through education and habituation at an early age. This article will try to determine and evaluate the possibility Galen ascribes to ethical change and development in humans in the context of character traits. (shrink)

Tanto en su Iǧāza como en su Fihrist, Ibn al-ʿArabī se refirió a Risāla ilà aṣḥāb al-Šayḫ ʿAbd al-ʿAzīz al-Mahdawī como a una obra separada. Este documento es una carta escrita a los discípulos del Šayḫ ʿAbd al-ʿAzīz al-Mahdawī de Túnez por el propio Ibn al-ʿArabī, y recientemente se ha determinado que también sirve como una especie de prólogo de Mašāhid al-asrār. Este prólogo cubre temas tales como quién debe estudiar el Mašāhid y cómo debe hacerlo, las explicaciones de las (...) palabras difíciles que se encuentran en él y las defensas de posibles críticas contra él. La carta de Ibn al-ʿArabī es importante por derecho propio: desarrolla los conceptos de ḫatmiyya, walāya, nubuwwa y wirāṯa en sus formas originales y hace referencia a discusiones en los círculos académicos de al-Andalus y el norte de África. Este artículo mostrará cómo debe entenderse la Risāla con los Mašāhid y explorará su contenido a la luz de las obras de Ibn al-ʿArabī y su medio social e intelectual. (shrink)

Plato argued that knowledge of human nature can be reached through dialogue and dialectical method in accordance with the Socratic heritage. In his philosophy, man can be defined as being capable of rationally answering a rational question. By giving rational answers to himself and others, human also becomes a moral subject. Issues related to human nature are discussed in the process of applying Plato's theory of ideas to the (...) field of morality, art, politics and education. What emerges in practice, for example, right and fair behavior is a manifestation of the principle of truth and justice. According to Plato, man reflects the character of the state he lives in. To understand a person, it is necessary to consider the society in which he lives. The state is not an institution that people come together and establish with their own will, but an organism, a whole. According to Plato, in order to grasp the true meaning of human society and to arrange it properly, one must first comprehend the astronomical cosmos. Because, knowing the meaning of the concepts of harmony and order is possible only by understanding the astronomical cosmos, which is the expression of an eternal order. While studying the astronomical cosmos, a man comes to the idea of harmony and order itself. Indeed, the infinite canonical and harmonious movements of the stars in this pre-eternal order on their perennials lead to the concept of law itself. People who admire this harmony and order in the sky want to realize a model of it on earth. He concludes that the laws that will rule over the human world must be continuous and compatible, just like the laws in the world of stars. Thus, the state must be an earthly model of the astronomical cosmos. If a person lives in the state, he should realize this harmony and order in the state in his own spirit. (shrink)

Türkiye-Suriye ilişkilerinin son 40 yıllık seyrine baktığımızda en önemli kırılma anlardan birinin 1998 yılının Ekim ayında yaşandığını söylemek mümkündür. 1990’lı yılların ilk yarısında imzalanan güvenlik protokollerine rağmen Suriye’nin PKK faaliyetlerine desteğini sürdürmesi ve Abdullah Öcalan’ın Suriye topraklarında ikamet ediyor olması, 1998 sonbaharında iki ülkeyi savaşın eşiğine getirmiştir. Ekim 1998 Krizi'nin Adana Mutabakatı'nın imzalanması ile son bulması, iki ülke ilişkilerinde yeni bir dönemin kapılarının aralanmasına neden olmuştur. Bu çalışmada PKK faaliyetlerinin Türkiye-Suriye ilişkilerinde oynadığı inşa edici rol, Ekim 1998 Krizi üzerinden analiz (...) edilmektedir. Ekim 1998 Krizi’nin Suriye yönetiminin PKK faaliyetlerine destek vermeyeceğini resmen taahhüt ederek sonlanması, iki ülke ilişkilerinde uzlaşmazlıktan her alanda işbirliği dönemine geçişin başlangıç noktası olmuştur. Amacımız, Türk filozof Yunus Emre’nin “gönül yıkma” ve “gönül yapma” ifadelerinin kötülük problemi açısından felsefedeki anlamını sorgulamak ve felsefi anlamlarını ortaya koymaktır.

Maz’ûn’un vefat tarihi ile ilgili rivayetler bağlamında onun Bakī’ Mezarlığı’na ilk defnedilen kişi olup olmadığı konusu ele alınmaktadır. (...) Bu makalede ele alınacak rivayetler çerçevesinde ortaya konulacak bilgiler, Bakī’ Mezarlığı’nın teşekkül tarihine ışık tutmuş olacaktır. Rızâeddîn bin Fahreddîn, 19.-20. yüzyıllarda İdil-Ural bölgesinde ceditçilik hareketi içerisinde yer almış en önemli düşünürlerdendir. Rusya müslümanlarının uyanışına katkı sunmak için birçok İslam düşünürünün biyografisini kaleme almıştır. Bunlardan birisi de İbn Arabî hakkındadır. Eserinde İbn Arabî’nin fikirlerini amelî, ilmî ve felsefî başlıkları altında inceler. Amelî görüşler başlığında içtihat, kıyas ve icmâ meseleleriyle ilgilenir. İlmî görüşler başlığı altında şumûl-i rahmet, ricâlu’l-gayb ve firavunun imanı konularını inceler. Felsefî görüşlerde ise âlem-i misâl ve vahdet-i vücûd hakkındaki tartışmaları öne çıkarır. Rızâeddîn bin Fahreddîn, eserinde (...) İbn Arabî hakkında gelişen tarihsel münakaşaları yeniden değerlendirir. Bu konuda üç tutum ve gruptan bahseder. İlk grup onu kafir, ikinci grup ise büyük bir veli olarak görür. Üçüncü grup onun büyük bir veli olduğunu kabul eder fakat eserlerinin okunmasının sakıncalı olduğunu söylerler. Rızâeddîn bin Fahreddîn bunlara ek olarak eserinde İdil-Ural müslümanları arasında da İbn Arabî etkilerinden bahseder. Eserinin sonunda İbn Arabî ile ilgili zikrettiği görüşleri değerlendirir. The Turkish market of Qur'an translations and studies is exceedingly oversaturated. Critics find some of these lacking in proper hermeneutical judgement, impelling them to reflect on the conditions of judicious Qur'anic exegesis. These reflections have remained relatively unexplored in English academic literature. In Critical Hermeneutics, Celik explores and compares the hermeneutical philosophies of three Turkish intellectuals, namely Alpyagil, Cündioglu, and Öztürk. By exploring their philosophical views on subjectivity and objectivity in the context of interpreting the Qur'an, Celik draws major implications (...) for reading the Qur'an in new and different ways. In political economy, the seminal contribution of the Baron–Ferejohn bargaining model constitutes an important milestone for the study of legislative policy making. In this paper, we analyze a particular equilibrium characteristic of this model, equilibrium uniqueness. The Baron–Ferejohn model yields a class of payoff-unique stationary subgame perfect equilibria in which players’ equilibrium strategies are not uniquely determined. We first provide a formal proof of the multiplicity of equilibrium strategies. This also enables us to establish some important properties of SSPE. Almost every state has its own legal system and there is a legal system in accordance with the social norms of the state. However, although states have autonomy with their own legal systems, the legal system of each state unites under larger legal systems. From this point of view, three major legal systems can be accepted; Anglo-Saxon Legal System (English Legal System, Common Law), Continental European Legal System (Legal system of European states based on Roman law), Social Legal System on (...) which Russian Federation is based. Apart from these systems, there is also an Islamic legal system with its unique structure. The reason why the Islamic legal system is unique is that it is based on both religious and rational sources. In general, the case-based method is used in the Anglo-Saxon Legal System, and the rule-based method is used in the Continental European Legal System. Which one of these two method used by Islamic law which takes its source from Qur’an and hadith well? Or is it use both methods? Our aim in this study, in addition to analysing the operation of these two methods in Islamic law from a logical point of view, is to analyse the integration of the rule-based method into the case-based method and the case-based method with the rule-based method. With this research it is to provide a logical proposal to extend the intended use of analogy in Islamic law. Bu çalışmamızdaki amacımız, Türk filozof Yunus Emre’de en çok karşılaştığımız kavramlardan biri olan Gönül kavramının felsefi bir kavram olarak ne olduğunu sorgulayarak Yunus Emre’nin genel olarak hakikat anlayışını bu kavram çerçevesinde ortaya koymaktır. Böyle bir çalışmanın ortaya çıkışında en temel etmen, ‘Gönül kavramı neden felsefi bir kavramdır?’ sorusudur. Bu soruyu felsefi bilinçle birlikte entelektüel ve kültürel kökenimizde izi sürülen felsefenin en zengin örneklerden biri olan Yunus Emre’de ele almaya çalışacağız.

Fabian Freyenhagen's impressive reconstruction of Adorno's ‘practical philosophy’ provides a convincing defence of the possibility of making normative claims about the social world we live in without justifying these claims in terms of the right, the good, or human nature. More specifically, and more controversially, Freyenhagen argues that the normative resources Adorno's critique relies on are provided by a negative Aristotelianism. In this paper, I argue that this approach underestimates the extent to which Adorno follows the model of immanent critique, (...) I highlight the socio-theoretical underpinnings of what Freyenhagen calls Adorno's ‘ethics of resistance’, and I discuss the risk of overstating the danger of co-optation that collective political action faces.
