Šiame straipsnyje nagrinėjamos teorinės bei praktinės mediacijos taikymo prielaidos sprendžiant administracinius ginčus Lietuvoje. Remiantis mokslininkų darbais, teisės aktuose įtvirtintomis nuostatomis, administracinių teismų praktika vertinama, ar Lietuvoje galėtų būti taikoma mediacija, sprendžiant administracinius ginčus, ar šiuo metu egzistuojančiame teisiniame reguliavime galima pastebėti taikaus administracinių ginčų sprendimo galimybes. Straipsnyje pirmiausia akcentuojama galimybė kilusį administracinį ginčą išspręsti taikiai taikant mediaciją, t. y. suderinant skirtingus, konkuruojančius interesus, todėl būtent taikaus administracinių ginčų išsprendimo prielaidų ir buvo ieškoma analizuojant mokslininkų darbus, teisės aktus (...) bei teismų praktiką. Šiame darbe remiantis atliktu tyrimu vertinama, kokie administraciniai ginčai ir tarp kokių subjektų galėtų būti sprendžiami taikant mediaciją. (shrink)

Some computational phenomena rely essentially on pragmatic considerations, and seem to undermine the independence of the specification from the implementation. These include software development, deviant uses, esoteric languages and recent data-driven applications. To account for them, the interaction between pragmatics, epistemology and ontology in computational artefacts seems essential, indicating the need to recover the role of the language metaphor. We propose a User Levels (ULs) structure as a pragmatic complement to the Levels of Abstraction (LoAs)-based structure defining the ontology and (...) epistemology of computational artefacts. ULs identify a flexible hierarchy in which users bear their own semantic and normative requirements, possibly competing with the logical specification. We formulate a notion of computational act intended in its pragmatic sense, alongside pragmatic versions of implementation and correctness. (shrink)

We will be concerned with intentionally misleading someone or hindering their ability to properly discern a situation. Thus, we mean communicative acts that are both verbal and non-verbal in nature; they are undertaken both by individuals and on larger human collectives, but also by organizations or institutions; the entities to which these actions are directed may also vary. Most often we stigmatize them as wrong, although in many specific cases we are ready to recognize their rightness. Our goal is to (...) make visible the need to organize these acts from the perspective of a philosophically defined person-society relationship. This article presents an analysis of the journey of the Dutch Reformed Church back into the ecumenical fellowship of the World Council of Churches. The first part contains a brief historical review of the relationships between the WCC and the Dutch Reformed Church family, underlining the fact that the Dutch Reformed Church family in South Africa is a founding member of WCC and that it was never excluded from WCC fellowship; rather, this church itself resigned membership in the WCC after (...) the Cottesloe Consultation at the pressure of the South African government of that time. The last part presents in detail the process of the readmission of the Dutch Reformed Church into the WCC fellowship as well as the way this church was active in the WCC after readmission. (shrink)

In the first part I focus on the issue of progress, in particular progress in philosophy. Philosophical progress has a special property that it shares with the process of becoming a better person. It is constantly finding yourself “on the way”. This path is not only anchored in the Absolutely Perfect but it conditions and stimulates the reflection towards the truth about the relationship between Him and us. We can assume that the core of this reflection is philosophy. The second (...) part is devoted to the paradoxical nature of the most generally understood memory. I assume that the condition of awareness of a certain content is its outdatedness, that is, its transfer to the sphere of memory. Memory is a constantly updated and constantly re-ordered picture of everything that the subject has ever relegated from being, so that it can be replaced by something else. The foundation of this order is a certain axiology. In the third part I show how the sketched concept of memory is used to describe the mechanism of the evolution of philosophical thought. The “on the way” philosophy would consist of two constantly repeated activities: on reconstructing what is to be denied, and thus on the recognition of the previous philosophical achievements in its totality, and on its negation. This denial would concern the whole of this achievement as an axiologically reconstructed unity. The new system is only realized as a series of consequences of the negation of the current state. The vast majority of philosophical reflection focuses on the constitution of this current state, its supposed unity. In the short part of the fourth, I draw up prospects for further deliberations. In the first part, the author discusses the methodological status of interdisciplinary research. Some general issues may be problematized within various disciplines; each of them only examines a certain aspect of the issue. Philosophical categories represent some ideas par excellence, while the terms used by the specific sciences represent models of some of their aspects. The second part recalls the most important problems signaled by engineers and programmers of machines, which are to operate in an external, changing environment, realizing autonomously (...) the objectives set for them. In parts three and four, the author attempts to specify the essential operations that the decision making machine performs. The nature of these operations should be adapted to the requirement that the machine should focus on what is important for the task it performs. (shrink)

The importance of the adolescence in the value orientations formation as a stable personality trait associated with the shaping of worldview has always been a matter of special research attention. This article seeks to investigate the formation of teenagers’ value orientations through creolized texts. The creolized text is a text in which verbal and nonverbal components form a visual, structural, semantic and functional wholeness, aimed at a complex impact on the recipient. The authors cleared out cognitive, emotional, and behavioural criteria (...) for the formation of students’ value orientations. To determine students’ instrumental and terminal values, M. Rokeach’s method of value orientation diagnostics was used. Educational workshops aimed at altering teenagers’ values with the use of creolized texts were arranged. Examples of motivational posters and comics created by students in the process of these extracurricular activities are provided. The reflexive component is presented through students’ impressions of working with creolized texts. (shrink)

World Trade Organization (WTO) Agreement includes the Annex 2 Dispute Settlement Understanding (DSU) that reveals with WTO dispute settlement rules and procedures. The Dispute Settlement Body (DSB) is hereby established to administer these rules and procedures. The article analyses the problematic issues of the direct effect of the DSB decisions in the European Union (EU) legal order. ECJ concluded that an individual does not have the right to challenge, the incompatibility of Community measures with WTO rules, even if the DSB (...) had previously declared the EU legislation to be incompatible with those rules. The position of the ECJ is based on the WTO dispute settlement system specifics—the importance of the negotiation between the parties, even after the DSB decision-making and lack of reciprocity, which means that major commercial partners of the EU does not recognize the direct effect of DSB decisions. Collective labour disputes are inevitably related to the institutes of a dispute, since the employees and employers often fail to reach a consensus on a particular issue. Moreover, the employers do not always follow the agreed terms and conditions of the collective agreement. In order to disclose the problems of the settlement of collective labour disputes in Lithuania, it is necessary to analyse the conception and classification of the institutes of dispute, distinguishing the conception of collective labour disputes, the procedure (...) of settlement of such disputes, and possible methods of settlement with the emphasis on the institutes of a strike. This article also seeks to reveal the peculiarities of the cases that settle individual labour disputes, the subject of which at least partially includes the provisions of the collective agreement, and collective labour disputes regarding the legality of strike. The main purpose of this article is to share the main insights and experience about the out-of-court proceedings in various countries and present main trends of ADR development. First of all, in this article, ADR is presented and its main advantages or disadvantages, (...) main reasons of its origin are outlined. For example, ADR institutions are indeed a low-cost and quick alternative for consumers to settle disputes with businesses. These are the main reasons why ADR originated and developed so fast in the United States of America. Secondly, it is important to analyse various definitions used to describe ADR and its characteristics, because it is a very complicated and complex phenomenon. ADR and the principle of legal accessibility are also very closely related issues which are deeply analysed in this article. (shrink)

There are public and private institutions as well as institutions established on the basis of cooperation between the public sector and the industry or consumer organizations and the industry. Although there is a high correlation between the nature of the institution and the funding, i.e. private institutions are usually financed by the industry and public institutions by public funds, ADR bodies established by public law can also be financed by the industry (especially in highly regulated markets). In the majority of the institutions, the participation of the industry in the ADR procedure is voluntary. (shrink)

Budizm, Hinduzim’e tepki olarak ortaya çıkan bir inanç sistemidir. Buda, bu dinin kurucusudur. Budizm daha çok Buda’nın hayatı ve görüşleri çerçevesinde şekillenir. Özellikle Buda’nın vaazları bu dinin yayılmasını sağlayan önemli konuşmalardır. Bu çerçevede Ateş Vaazı Budistler arasında önemli bir yere sahiptir. Ateş simgesi ile özdeşleşen bu vaaz, Budizm için bir kırılma eşiğidir. Bu vaazdan sonra yüzlerce keşiş Buda’nın yolunu izler. Genel olarak dini ve felsefi bir içeriğe sahip olan vaaz, keşişleri kurtuluşa davet eder. Buda bu vaaz aracılığıyla kendi yaşam serüvenini (...) ve ulaştığı sonuçları takipçilerine anlatır. Budizm’in inanç hayatı hakkında derli toplu bilgiler veren Ateş Vaazı, insanın bu dünyada yanılma nedenlerini ortaya koyar. Arzu, tutku ve nefretin acılara neden olduğundan söz eder. Tenasüh sürecinin insanı yıprattığını dile getiren vaaz, keşişler için kurtuluş yolu olarak Nirvana’yı önerir. Buda incir ağacının altında Nirvana’ya ulaşır. Burada pişer ve hakikati keşfeder. Buda bu vaaz aracılığıyla takipçilerinin de pişerek olgunlaşmasını önerir. Bu çerçevede bu çalışmada önce Budizm’in kısa bir geçmişi sonra Buda’nın hayatına yer verildi. Böylece Ateş Vaazı’nın ortaya çıkma süreci ve zemini ele alındı. Son olarak bu vaazın neyi, nasıl anlattığı ve ne gibi mesajlar verdiği ortaya konuldu. (shrink)

The objective here is to present that, in most of Europe, in the medieval and modern periods, the imaginary impressions of Indian fables and the religious life of Buddha, which had already existed for almost two thousand years before in Greece, became recurring. All of the medieval novels, for example, with their heroic knights, as well as modern fables, have a significant mark, rather plagiarism, of popular or classical Indian literature. In fact, as we methodologically base ourselves in the history (...) of ideas, we find that India was the faraway and literary source of the tales, the fables, the romances of chivalry etc., which gave much charm to medieval European times. This is confirmed by Theodor Benfey, one of the translators of the Pañcatantra , our main Indian fable exposed here, who pronounced the dictum , in 1859, that most of the world's fables, which were produced in the West, had originated in magical world of India, of which a small number had actually arrived in Europe as oral stories even before the tenth century. Buda não ergueu uma religião; fez filosofia e ciência. Foi o precursor do realismo científico, da psicanálise, da filosofia analítica, do existencialismo, do feminismo, da epistemologia, da teoria e crítica do conhecimento, da psicologia social, da psicologia positiva, do preservacionismo ecológico e de conceitos relativos à matéria e à energia que só muito recentemente a física quântica pôde comprovar. Saber adequadamente o que é Budismo é essencial para a formação e cultura de qualquer pessoa que não queira ser simplesmente mais (...) um alienado numa manada que caminha às cegas em meio a uma revolução tecnológica. É possível compreender o budismo de raiz através da linguagem e do conhecimento modernos, e estabelecer suas relações com o pensamento contemporâneo e suas referências. Com isso se torna possível aprofundar e ampliar nossa percepção a respeito da compatibilidade desses princípios milenares com nossas formas modernas de vida e conhecimento. O estudo necessário para isso é bastante trabalhoso. Budismo é um tema subjacente a uma gigantesca montanha literária e cultural. Quanto mais próximos estivermos do seu conceito original, mais profunda e volumosa será a escavação que temos que fazer. (shrink)

Straipsnyje nagrinėjamas Lietuvos Respublikos darbo ginčų instituto reformavimas ir kaita Nepriklausomybės laikotarpiu atskirų Europos Sąjungos valstybių patirties kontekste. Darbo ginčų reforma Lietuvoje minimu laikotarpiu vyko keliais etapais, iš jų paskutinysis, prasidėjęs 2013 m. sausio 1 d., pakeitė darbo ginčų komisijų organizavimo tvarką, šias komisijas pradėjus kurti teritoriniu principu, prie veikiančių Valstybinės darbo inspekcijos teritorinių padalinių, nustačius, kad į darbo ginčų komisiją su skundu gali kreiptis ne tik darbuotojas, bet ir darbdavys, įvedus kitas naujoves. Tačiau šie pokyčiai (...) vis dar neatspindi europinių tendencijų, kiek įmanoma mažiau institucionalizuoti ikiteisminę individulių darbo ginčų nagrinėjimo tvarką. Straipsnyje akcentuojama mintis, jog darbo ginčų instituto reforma laikytina nebaigta ir, tikėtina, bus tęsiama, remiantis pažangiausia kai kurių ES valstybių praktika šioje srityje, tačiau išlaikant nacionalinį teisinio reguliavimo ypatumą. In this article the influence of scientific attitudes of Prof. Mykolas Romeris upon modern administrative justice of Lithuania is investigated by historic and comparative aspects. In the first part of article the Professor’s ideas, stated in the fundamental monograph “Administrative Court”, published in Kaunas, in 1928, about the foundation of the Administrative court are reviewed. Here are also pointed out Prof. M. Romeris’ principal,alternative and critical notes concerning the draft of the Law of Administrative Court, made by the Seimas (Parliament) (...) Committee on April 1940. As due to historical circumstances of that time the Law was not passed, in the second part of this article the author proposes the analysis of which ideas of Prof. M. Romeris and to what ambit they were reflected in the Republic of Lithuania Law on the Proceedings of Administrative Cases enacted in 1999, and improved in 2000. The conclusion is made that in this case almost all principle attitudes of Prof. M. Romeris on the organizing the Administrative court and its competence were realized in this Law. It is also stated that the Law mentioned also embedded some other norms, e.g. the possibility to settle a dispute in a pretrial way in Administrative Disputes Commissions. (shrink)

RESUMO Este artigo objetiva ser uma breve introdução à práxis soteriológica budista, enfatizando, num primeiro momento, as quatro nobres verdades, aquele conjunto de intuições fundamentais formuladas pelo Buda desde o seu primeiro sermão; depois se descreve o nobre óctuplo caminho, o conjunto de práticas ensinadas pelo Buda para a consecução da experiência do despertar; finalmente, descrevem-se os estágios do caminho tanto no ambiente theravādin quanto na tradição mahāyāna. ABSTRACT This article aims at being a brief introduction to the soteriological praxis (...) of Buddhism, underscoring, firstly, the four noble truths, that set of cornerstone intuitions propounded by the Buddha since his first sermon; then, the noble eightfold path, the set of practices that aims at the experience of awakening taught by the Buddha is described; finally, the stages of the way are described, both in the theravādin tradition as well as in mahāyāna's. Straipsnyje nagrinėjama dvejopa machinacijos (Machenschaft) samprata Martino Heideg-gerio technikos filosofijoje. Pirmoji susijusi su Vakarų metafizikos destrukcija (Destruktion) ir jos kulmi-nacija reflektuojama moderniosios technikos plotmėje. Pirmiausiai machinaciją Heideggeris pristato kaip pačios Būties atsivėrimo būdą „pirmoje pradžioje“ (ersten Anfang). Machinacija lemia μετά judesio pamatą, nurodantį į nuolatinę transcendencijos aspiraciją bei „techninį“ esinių atvėrimo pobūdį, nors savo „pajėgumų“ prasme machinacija graikų metafizikoje dar glūdi implicitiškai. Eksplicitiškai machi-nacija pasirodo tik moderniojoje technikoje. Kiek kitokią machinacijos sampratą galime aptikti Heideg-gerio „Juoduosiuose sąsiuviniuose“ (Schwarze Hefte), rašytuose 1931–1938 (...) m. Juose pačią modernybės epochą filosofas pristato kaip machinaciją. Taigi straipsnyje siekiama išryškinti šių dviejų Heideggerio sampratų jungtį, kuri yra machinacijos galios (Macht) augimo tikrovės atžvilgiu nuoroda. (shrink)

Aprincipios de nuestra era se inicia en el budismo indio un nuevo género literario dentro de la propia comunidad monástica. Esta nueva literatura, que se reivindica como buddhavacana («palabra de Buda»), se produce en minorías desperdigadas a lo largo de la geografía india y en un contexto monástico y se denomina a sí misma mahāyāna. En ella se resalta la figura del bodhisattva como ideal supremo. En el siglo II o III, Nāgārjuna equipara saṁsāra y nirvana, elevando esta literatura, mayoritariamente (...) devocional, a rango filosófico. El nirvana deja de ser el lugar central para dar paso a una determinada actitud filosófica: el discernimiento de la vacuidad, y a una determinada actitud altruista: la identificación afectiva y solidaria con aquellos que sufren. Kai kurios šiuolaikinio kognityvinio mokslo teorijos teigia, kad žmogaus prote veikia dvi sistemos: sistema, vykdanti greitą intuityvų mąstymą, bei sistema, vadovaujanti lėtam logiškam mąstymui. Būtų galima manyti, kad šių sistemų egzistavimą patikrinti sudėtinga. Šiame straipsnyje pateikiamas būdas palaipsniui patvirtinti šių dviejų sistemų egzistavimą. Pasitelkiamas dviejų sistemų, pasireiškiančių per mentalinių modelių teoriją, principas. Be to, laikantis Carnapo redukcijos idėjos, straipsnyje aprašomos dvi procedūros, kuriomis hipotezė patvirtinama palaipsniui. Viena iš jų tyrinėja, kaip žmogaus protas nagrinėja žmogaus proto veiklą darant išvedimus pagal (...) modus tollendo tollens. Kita hipotezė tyrinėja išvedimus iš griežtosios disjunkcijos su trimis disjunktais. (shrink)

Kokie veiksmai yra kognityviškai raiškiausi, labiausiai prototipiški moralės transgresijų pavyzdžiai? Deja, šiuo metu yra labai nedaug tyrimų, siekiančių sistemiškai nagrinėti šį klausimą. Šiuo straipsniu siekiame prisidėti prie šio klausimo sprendimo pristatydami preliminarius tyrimo duomenis apie tai, kurie veiksmai tyrimo dalyviams lietuviams buvo raiškiausi. Pirmajame tyrime pritaikius kognityvinės antropologijos metodus buvo nustatyti tyrimo dalyviams iš Lietuvos raiškiausi moralinių transgresijų atvejai. Antrajame tyrime dalyvių buvo prašoma šiuos veiksmus suskirstyti į kategorijas, paimtas iš Haidto moralės pagrindų teorijos. Paėmus kartu, šie tyrimai suteikia (...) preliminarių duomenų, paremiančių idėją, kad labiausiai kognityviškai raiškioms moralės transgresijoms būdinga tai, kad jos susijusios su žala ir šiek tiek mažiau – su neteisingumu. Rezultatai aptariami skirtingų moralės sritį aprašančių teorijų kontekste. (shrink)

ABSTRACT 'The Duologue of King/Governor Pāyāsi' has long been recognised as a source for the proto-materialism current at the time of the Buddha. What needs to be stressed is the significance of the text as a pointer to the development of Logic in India. Perception, which is an accepted method of experimental enquiry, and reasoning from analogy, which can lead at best to a probable conclusion - these two are the only means employed to settle the dispute concerning the existence (...) of the other-world. The Jain version of the same duologue-cum-parable, though varying in minor details regarding the name and identity of the monk refuting the king/governor, contains the same contrast, namely, perception versus analogical reasoning. There can be little doubt that the original parable was conceived with a view to asserting the existence of the other-world. In the Kaṭha Upaniṣad, an earlier Brahmanical text, however, instead of argument by analogy, verbal testimony was invoked to settle the same point. Naciketas is assailed by doubt about the existence of a person after his or her death. The authority of Yama, the Pluto of Indian mythology, is invoked to convince him that the other-world does exist. Thus, the three parables taken together exhibit three means of knowledge in operation: verbal testimony and argument by analogy pitted against perception. RESUMO 'O duólogo do rei/governador Pāyāsi' há muito tempo é reconhecido como uma fonte da corrente protomaterialista da época do Buda. O que é necessário ressaltar é o significado desse texto como um indicador do desenvolvimento da lógica na Índia. Percepção, aceita como método de investigação experimental, e raciocínio por analogia, que no máximo pode conduzir a uma conclusão provável - apenas esses dois são os meios utilizados para dirimir a disputa que diz respeito à existência do outro-mundo. A versão jaina do mesmo duólogo-cum-parábola, mesmo com variações que concernem ao nome e à identidade do monge que se opõe ao rei/governador, contém o mesmo contraste, a dizer, percepção contra raciocínio por analogia. Não há muita dúvida de que a parábola original foi concebida com o intuito de afirmar a existência do outro-mundo. Entretanto, na Kaṭha Upaniṣad, um texto bramânico mais antigo, em vez do argumento por analogia, o testemunho verbal foi invocado para resolver o mesmo ponto. Naciketas é tomado pela dúvida sobre a existência da pessoa depois da sua morte. A autoridade de Yama, o Plutão da mitologia indiana, é invocada para convencê-lo que o outro-mundo existe. Portanto, as três parábolas juntas exibem três meios de conhecimento em função: testemunho verbal e argumento por analogia opostos à percepção. (shrink)

Straipsnyje tiriamos dvi XX a. viduryje iðplëtotos funkcionalistinio sàmonës aiðkinimo kryptys: D. Armstrongo ir D. Lewiso analitinis funkcionalizmas ir H. Putnamo komputacinis funkcionalizmas. Siekiamaparodyti, kad ðios dvi kryptys ið esmës sutampa metodologiniu poþiûriu, taèiau jø atstovai suteikiasavøjø teorijø metodologiniam pagrindui skirtingas ontologines interpretacijas. The article aims at resolving the issue whether the Court of Justice of the European Union (CJEU) has an exclusive jurisdiction under Article 344 of the Treaty on Functioning of the European Union (TFEU) to resolve disputes between Member States, stemming from provisions of an international treaty, a party to which is the EU. This problem is especially relevant in cases when a mixed international agreement envisages independent institutions of dispute resolution. The position of the CJEU is expressed in the (...) case of Mox Plant. The European Commission applied to the CJEU against Ireland, because it considered that Ireland, which started an arbitration procedure against United Kingdom under the UN Convention on the Law of the Sea, has infringed the exclusive jurisdiction of the CJEU under Article 344 of the TFEU. The EU is also a Contracting Party to the UN Convention on the Law of the Sea. Therefore according to the consistence case practice of the Court, the provisions of the Convention that fall under the competence of the Union constitute an indivisible part of the EU legal system. Only in such case when a provision of a treaty is attributed to exclusive competence of the Member States, the jurisdiction of the CJEU regarding that provision can be negated. Thus, when deciding on the issue of exclusive jurisdiction of the CJEU in principle, a problem of attribution of the EU and Member States’ competences arises. (shrink)
