İbn Arabî’nin Fusûsü’l-hikem’in Âdem Fassı’nda yer verdiği umûr-ı külliye kavramı, Fusûs şârihleri tarafından muhtelif şekillerde alımlanmıştır. Kimi sufîler bu kavramı küllilere kimisi de zihnî varlık tartışmalarına hasretmek suretiyle ele alma taraftarı olmuştur. Yakın dönemde yapılan araştırmalar bunun izinden giderek söz konusu kavramla külliler tartışması arasında irtibat kurmaya çalışmaktadır. Biz bu çalışmamızda, Meşşâî felsefe geleneğinde metafiziğin ilm-i küllî kısmının temel meselelerine karşılık gelen umûr-ı âmme kavramı ile Fusûs’da yer alan umûr-ı külliye arasında bir irtibatın imkânını sorgulayacağız. Bunu yaparken (...) özellikle ilk şârih Cendî’nin umûr-ı külliyeyi umûr-ı âmme kavramı ile karşılamasından hareket ederek bu bakış açısının sonraki dönem şârihleri arasında nasıl yankı bulduğunu Afîfüddin Tilimsânî, Abdürrezzâk el-Kâşânî, Davud el-Kayserî, Sâinüddin İbn Türke, Yazıcıoğlu Mehmed Efendi, Molla Câmî gibi düşünürlerin yorumları eşliğinde ele alacağız. Bu bağlamda umûr-ı külliyenin Tanrı ile âlem arasındaki irtibatı kurma-daki metafiziksel yönü ve ikinci akledilirler olarak değerlendirilmesi gibi on-tolojik ve epistemolojik cihetleri dikkate alınarak, umûr-ı âmme kavramı etrafında yapılan tartışmalarla benzer yönleri ortaya konulmaya çalışılacaktır. Bu sayede söz konusu yorum ve benzerliklerden yola çıkarak, bu kavram çiftinin, dile getirildikleri düşünce geleneklerinin yakınlaşmasına bir zemin teşkil edip etmeyeceği tartışılacaktır. (shrink)

al-ʾUmūr al-ʿāmma refers to the introductory chapter heading for concepts and topics which address the issues of metaphysics, the science of the universal. This introductory heading which encompasses general topics, concepts, and cases, is the most distinctive feature that differentiates the kalām in the Muta’akhkhirūn period from the Kalām in the Mutaqaddīmūn period. This is because the science of Kalām inherited these topics as the result of its interaction with peripatetic philosophy represented by Islamic philosophers, such as al-Kindī, al-Fārābī, and (...) Avicenna. Before Fakhr al-Dīn al-Rāzī, theologians addressed various concepts such as mawjūd, maʿdūd, maʿdūm, qadīm, muḥdāth, shayʾ by including them in their works as commonly used nouns and adjectives in a disorganised manner or without devoting a separate chapter heading to them. It was al-Rāzī, who discussed al-ʾumūr al-ʿāmma under a separate heading with original content and through a combined method based on the relationship between Kalām and philosophy by using the previously available literature, that helped al-ʾumūr al-ʿāmma acquire an important status in the science of Kalām. This is because this tittle, which examine abstract and general concepts such as existence, non-existence, mawjūd, maʿdūm, quiddity (māhiyyah) and its appendages such as unity, multiplicity, necessity, possibility, impossibility, ḥudūth, eternity a parte ante (qidam), substance (jawhar), accident (ʿaraḍ), cause (ʿilla), and maʿlūl, were reconsidered by the theologians after al-Rāzī and became a point of departure for their works. Later theologians largely followed al-Rāzī’s framework and organisation of al-ʾumūr al-ʿāmma and/or based their new organisations on it. Besides using his framework, they tried to define al-ʾumūr al-ʿāmma in different ways and from different perspectives, and, at times, allowed for debates of sorts. One of the debates that emerged as a result of these defining endeavours is why these concepts were included within the scope of al-ʾumūr al-ʿāmma discussions or what aspects of these concepts were discussed within al-ʾumūr al-ʿāmma. This debate revolves around such notions as quiddity, impossibility, and non-existence in relation to the aforementioned notions. Among these concepts, non-existence takes the lead. This is because existence is both the most general concept and one of the most commonly addressed concepts in al-ʾumūr al-ʿāmma due to its direct relationship with other concepts. This has brought non-existence, which has a close relationship with existence, to the forefront. In these discussions, the concept of non-existence is sometimes examined alone, sometimes together with the concept of impossibility, both directly and indirectly. In fact, the reason for the inclusion and evaluation of the concept of non-existence in al-ʾumūr al-ʿāmma per se has turned into topic of discussion by itself over time. In this context, after discussing the conceptualisation process of al-ʾumūr al-ʿāmma, this study examines how philosophers and theologians, who, it must be reiterated, define al-ʾumūr al-ʿāmma in different ways, examine the concept of non-existence under that chapter heading, and it goes on to determine the aspects that led them to include non-existence therein. That Ibn Sīnā’s “Canon of medicine” figures among the major classics of the history of medicine is doubted by no serious historian of medicine, eastern or western, Islamic or non-Islamic alike. It is therefore all the more surprising that so far no serious critical edition of this text was available. Certainly, a first, very timid step toward a really critical edition was made at the Institute of the History of Medicine and Medical Research, under the direction of Hakeem Abdul Hameed. (...) It compared the four existing editions: Rome 1593; Būlāq 1877; Tehran 1878; and Lucknow 1905. In addition it used an ancient manuscript of Aya Sophia, dated 618, i. e. MS Aya Sophia 3686. With this new edition a further important step toward a full critical edition is made. Even if it is obvious that it does not yet present a “critical edition” in the full sense of the word, it has important merits. (shrink)

Human beings pass through a series of life stages since birth. These stages beginning at the infancy even in the mother’s womb are accompanied with a period extending to the senescence and the last stages of the life. Creation of human beings and various stages of the life are mentioned in the Qurʾān. Besides, it is referred to the senescence. In addition to the expressions sheikh, shayb, ʽajūz and kibar indicating to the senescence, ardhal al-ʿumur is also pointed out in (...) the Qurʾān in this regard. This article aims to identify in which context and meaning the wording regarding ardhal al-ʿumur and senescence are used in the Qurʾān and to reveal the relation between these terms. Since, the term ardhal al-ʿumur and senile dementia are directly correlated in the commentaries usually and the interpretations build the perception that these two expressions are almost synonyms. Are ardhal al-ʿumur and dementia closely associated with each other? Are the other terms in the Qurʾān indicating to the senescence correlated with the dementia? Our study aims to explain the expression ardhal al-ʿumur in the Qurʾān in this regard. Furthermore, the other terms regarding the senescence expressed in the Qurʾān are reviewed in this respect. SUMMARY The Qurʾān tells the creation of human beings and refers to the various stages of their lives as well. The explanations beginning with the creation state the prenatal period, infancy and childhood, adolescence and adulthood of human beings. The Qurʾān refers to the senescence as well, the last stage of the life. In this regard, ardhal al-ʿumur, sheikh, shayb, ʽajūz and kibar are the terms in the Qurʾān associated with the senescence. Especially nowadays, the senescence is a considerable focus of the science, besides being mentioned in the Qurʾān. This article discusses the subject scientifically as well. The senescence is defined with various aspects since it expresses a period having physical, psychological and social dimensions. Furthermore, certain classifications regarding the senescence are made and physiological changes associated with the chronological age are more emphasized. It has been indicated that the senescence is divided into two: biological and chronological aging. According to this chronological aging is the same for everyone while biological aging varies from individual to individual. The senescence is acknowledged as the last development stage of the human life in terms of social sciences and considered as an on-going universal process between birth and death. Therefore, the senescence is interpreted relatively while the aging is interpreted universally. So, everyone gets old; however, the senescence means a life period varying from individual to individual. The senescence affects the individual both health-wise and psychologically, sociologically and economically. In other words; the senescence, a tough period, is a phenomenon which deeply affects the human beings and all their characteristics making them exist. The senescence is addressed in the Qurʾān with various expressions. Ardhal al-ʿumur, foremost among these, is mentioned twice in the Qurʾān (al-Nakhl 16/70, al-Ḥac 22/5). The exegetes generally consider ardhal al-ʿumur as the physiological exhaustion of an individual due to aging and as the period when dementia is experienced. The characteristics of the stage called as ardhal al-ʿumur in the Qurʾān are explained with the following statement: turning into a person who does not know anything from the person who used to know many things. Just because of this sentence, ardhal al-ʿumur is construed with dementia. Are arzali’l-ʽumur and dementia directly interrelated? This article also reviews the other terms stated in the Qurʾān regarding the senescence from this aspect. Sheikh, another expression stated in the Qurʾān regarding the senescence, is mentioned four times (Hūd 11/72, Yūsuf 12/78, al-Qaṣaṣ 28/23, al-Muʼmin 40/67) and it is described with the word kabīr in two of them. The lexical meaning of sheikh is an old person in terms of age and appearance. Moreover, sheikh is used as an adjective to describe the individuals who have wisdom in customs. So, the word sheikh both means an individual who is well on in life and is the expression of supremacy in terms of knowledge and experience. Shayb, another expression stated in the Qurʾān regarding the senescence, is mentioned three times (Maryam 19/4, al-Rūm 30/54, al-Muzzammil 73/17) and means hair greying and describes a physiological change in the senescence. ʽAjūz stated in the Qurʾān for the senescence is mentioned in four different chapters (Hūd 11/72, al-Shuʽarā’ 26/171, al-Ṣāffāt 37/135, al-Dhāriyāt 51/29) and expresses incapacity of performing many actions. ʽAjūz is another expression in the Qurʾān meaning elderliness. The senescence is implied with this expression too; however, the dementia is not mentioned. Kibar, the last wording associated with the senescence, is mentioned in six verses (al-Baqara 2/266; Āl-i-ʽImrān 3/40, Ibrāhim 14/39, al-Hicr 15/54, al-Isrā 17/23, Maryam 19/8). The word kibar means the senescence and physical power loss; nevertheless, is not interpreted as dementia. To our knowledge, the explanations regarding the senescence and dementia in most of the commentaries cannot be corresponded in the Qurʾān as if they are synonyms. This perception can be generated due to the statements pointing out the dementia in the lexical meaning of ardhal al-ʿumur. It is understood in the light of the data acquired by today’s science that the dementia is not a natural result of the senescence but rather one of its risks, which is already proved by the fact that the science discusses the dementia separately from normal aging process. Therefore, there is not a general picture of dementia including all elders. Thus, it is possible to define ardhal al-ʿumur as a later part of life which includes some elders and affects them physiologically, psychologically, sociologically, etc., in addition, they lose their mental faculties in that period. Each expression regarding the senescence in the Qurʾān reveals the picture of the senescence pursuant to the integrity of the Qurʾān. The senescence in the Qurʾān is an ineluctable reality. The fact that this period is clearly expressed in the verses aims that this reality can be perceived by human beings and they can be prepared for this period. Some problems that elders experience are also mentioned in the Qurʾān. When the other terms in the Qurʾān associated with the senescence apart from ardhal al-ʿumur are reviewed, it is seen that the aforementioned problems that may be observed at later ages are hair greying, bone diseases, incapability and weakness in doing some actions. Today, there are various disciplines concerning the elders and the information obtained from these disciplines shows that these problems are a lot more than the ones mentioned in the Qurʾān. However, it is not expected that the Qurʾān discusses the facts as a science book since it is a holy book. When ardhal al-ʿumur is evaluated in the light of scientific data, it appears as a sickness period when some elders experience mental problems such as dementia/blackout. On the one hand, there will be elders who experience these problems; on the other hand, there will be some who do not. All expressions regarding the senescence in the Qurʾān do not lead to the fact that the aging leads to the dementia directly. Ardhal al-ʿumur within the integrity of the Qurʾān expresses that senile dementia affects some individuals while it has not any impact on the others. Therefore, ardhal al-ʿumur is one of the life stages affecting not every elder but some of them. The fact that different terms are stated in the Qurʾān regarding the elders points out various aspects of the aging process creating different effects. The second important reason why the aging is mentioned in the Qurʾān is to emphasize the value of the elders and the respect that should be showed to them. Besides, it is also underlined in the Qurʾān that the elders are so precious that they cannot be left alone socially and psychologically. Furthermore, the elders are the individuals worthy of love and being valued. Thus, it is suggested in the Qurʾān to love, respect and honour the elders and to live with them regardless of whether they will experience ardhal al-ʿumur or not. Therefore, the human beings are reminded to look after the elders, esteem them materially and morally, as they deserve, and to act considering the characteristics of this period. (shrink)

Ali’ye atf edilen Nehcu’l-Belağa kitabından sonra gelen üçüncü önemli kitaptır. Toplam 54 dua metninden oluşan bu eser, sadece bir dua kitabı olarak ele alınmamış aynı zamanda ahlak, akide, fıkıh, sosyoloji, psikoloji ve edebiyat alanlarına da kaynaklık etmiştir. Eser üzerine onlarca şerh, haşiye, makale, akademik araştırmalar yapılmış ve eser, Türkçe, İngilizce, Farsça, Urduca gibi birçok dile çevrilmiştir. (...) One of the fundamental debates that theologians have held to discuss the possibility of and to facilitate understanding of the bodily resurrection is iʿādat al-maʿdūm; that is, the restoration of the non-existent. Despite some differences in their perspectives, theologians, including the Muʿtazilites, have considered iʿādat al-maʿdūm possible. Avicenna, who opposed the classical views of theologians by rejecting iʿādat al-maʿdūm, provoked a new discussion and fuelled controversy about this issue. Later Islamic philosophers and theologians who were influenced by him took his (...) path and reformulated his arguments about the impossibility of iʿādat al-maʿdūm. Likewise, the theologians of the mutaʾakhkhirūn period, who defended the possibility of iʿādat al-maʿdūm, in support of the classical view, voiced new criticisms against these recontructed arguments. Thus, the debate turned into a highly controversial issue between Islamic philosophers and theologians. In fact, unlike the theologians who included the issue of iʿādat al-maʿdūm in the subsections of the samʿiyyāt chapters as an extension of the resurrection debates, Islamic philosophers did not consider it possible and preferred to address it under the subheadings of the umūr al-āmma chapters on existence and non-existence, in which metaphysical issues were discussed. This is because Avicenna considered iʿādat al-maʿdūm a metaphysical issue related to non-existence. On the one hand, some philosophers, who considered iʿādat al-maʿdūm impossible, deployed the new argument that things that existed and then disappeared could not be recreated in the same way. On the other hand, others expressed their criticisms against these arguments in the disputatious style (jadali) and tried to defend the restoration of the non-existent in the same way. Therefore, the theologians who addressed these issues in their works helped answer the question of whether it is possible to recreate the non-existent. This is because the texts provided detailed and important information about the course of the debate, such as who rejects and accepts iʿādat al-maʿdūm, the background and context of the debate between philosophers and theologians, the proofs put forward for the rejection of recreation, the criticisms in response to these proofs, and the evidence put forward for recreation. Therefore, the present study aims to discuss the arguments for iʿādat al-maʿdūm; that is, whether maʿdūm can be recreated in the same way, and the criticisms against these arguments, which have become a subject of debate between theologians and philosophers. Avicenna’s ideas are also highlighted in the study as he is the source of the arguments for the impossibility of iʿādat al-maʿdūm. In terms of its scope, the present study is based on the major works of the prominent theologians of the mutaʾakhkhirūn period and the main commentaries written on these works. (shrink)

The subject of general utterances (al-lafdh al-āmm) being certain or presumptive in their usage as an indication to all their members is controversial amongst the methodists. Ḥanafī methodists suggest that the indication of general utterances to all of their members as certain and unless they are specified with a certain evidence, they can’t be specified with a presumptive evidence. Like the ḥanafī methodists, the ẓāhirī methodists also suggest that the general utterance is certain indicant for all of its members and (...) can be specified only with another evidence in the same rank. The main difference between the two groups focuses on whether al-khabar al-wāhid (single prophetic narration) is a certain or a presumptive evidence in terms of certitude. According to ḥanafīs, al-khabar al-wāhid is a presumptive evidence and unless the general utterances in Qur’ān are specified initially with another certain evidence, they can’t be specified with al-khabar al-wāhid. However, al-khabar al-wāhid is a certain evidence according to ẓāhirīs and it can specify general utterances in Qur’ān. In this study, the comparison of the views of the methodists of two schools regarding the indication of general utterances in Quran and their specification (takhsīs) with al-akhbar al-wāhid is made and their influence on Islamic Law regulations is studied afterwards. In this study, the two sect’s approaches are compared over the provision of reading al-Fatehah during prayer, the number of milk sucking to establish the kinship, the rights of women divorced with bain talaq and the execution of the death penalty in the Harem region.Summary: The purpose of this study is to try to demonstrate that an assertion in the Ph.D. thesis, The History and Doctrine of Ẓāhirī Madhhab, completed by Amr Osman in 2010 is incorrect. It can be summarized that in his study, Amr Osman claims that the affiliation of the schools to ahl-al-hadith and ahl-al-ra’y in conventional classification is wrong. According to him, contrary to what is known, the School of Ẓāhiriyya is closer to School of Ḥanafiyya rather than schools coming out of ahl-al-hadith. In this study, one of the arguments that he relied on to support his claim is studied in order to prove that his claim was inaccurate. Osman claims that ẓāhirīs are closer to ḥanifīs, based on the view that in both schools the general utterances embrace all of their members in their usage and they are a certain indicant to all of their members. At this stage, although the views of both schools are common, the ḥanifīs don’t accept the idea that the general statements of Qur’ān can be established with al-khabar-al-wāhid, those which they acknowledge as presumptive as of certitude. However, according to the ẓāhirīs, the certitude of al-khabar al-wāhid is as precise as the narrated report, so it can specify the general statements of Qur’ān which are in equal power. The related dispute between the schools has been reflected on many Islamic law regulations. Some of them are:1. Ḥanafīs state that the correct Quranic prayer may be performed by reading any or a few verses of the Qur’ān in prayer, which is a practice based on the verse “Read what you can read from the Qur’ān now”. On the other hand, the ẓāhirīs have established the related order based on the report “There is no prayer without reading Umm Al-Quran (Surah al-Fatehah)” and it is obligatory (fardh) to read Surah al-Fatehah in prayers.2. Because that the terms milk-mother and milk sister are in general form in the verse “It is forbidden to you to marry these people...Your milk-mothers who nursed you, your milk-sisters who nursed you” the ḥanafīs clarify that it is sufficient for a child to breastfeed only one time in order to form a milk-kinship. They do not act in accordance with the solitary report (al-khabar-al-wāhids) which indicate that the milk kinship specifying the verse shall only be formed with at least three or five breastfeeding. However, one of the ẓāhirīs, Dāwūd al-Ẓāhirī, has specified the verse with the report indicating that the kinship shall not be formed with less than three breastfeeding by the child, and Ibn Ḥazm has specified it with Salim hadith which indicates that the kinship shall be formed with five breastfeeding.3. According to ḥanafīs, there is an alimony and inhabiting right of the widow woman to be procured by the husband within the period of delay who divorced her either with irreversible divorce (talāq al-bāin) or reversible divorce (talāq al-ric‘ī) according to the generalization of the verse “Give shelter to them (the women you have divorced) in some part of your household within your capacity.” They did not act with the report of Fātima binti Qays, who specified the generalization of the verse. On the other hand, the ẓāhirīs recognize the abovementioned rights only for the women who got divorced with irreversible divorce or the ones who are pregnant, specifying the verse with the report indicating that His Holiness the Prophet does not grant alimony and inhabiting to the woman who was divorced with reversible divorce.4. According to ḥanafīs, the criminal who committed a crime that would require a death penalty and took refuge in the Harem region could not be executed while in Ḥarem, according to the common statement of the verse, “Whoever enters there, will be safe.” Dāwūd al-Ẓāhirī, one of the ẓāhirīs has specified the verse with the report indicating that His Holiness the Prophet has authorized the execution of the sentence to Ibn Khattal in Ḥarem on the day of the conquering of Mecca and he states that the death sentence can be executed wherever the criminal is caught, even if it is inside the Harem. Ibn Ḥazm shares the same view with ḥanafīs regarding the provision of this issue. However, the reason for his opinion stems from the fact that the report about Ibn Khattal was an event specific to that day. As it is seen, even though the ḥanefīs and ẓāhirīs share the same opinion about the general utterances being a certain indicant to all their members, they have disagreements upon the argument about the general utterances of Quran being specified by al-khabar al-wāhid and many Islamic Law regulations have been issued by these schools based on such disagreements. According to us, in the final analysis, Amr Osman’s claim must be met with caution. (shrink)

Al-Qāḍī Ḥusayn al-Marwarrūdhī is one of the important representatives of Khurāsān Shāfi‘ī School. Al-Ta‘līḳa is his famous work, which is one of the first commentaries of al-Muzanī’s Mukḫtaṣar. One of the important features of this work is the introduction to some of the subjects of ijtihād (process of juristic legal reasoning), taqlīd (acting upon the word of another without asking for specific proof), ijmā‘ (consensus of jurists) and view’s of the companions of the Prophet. The first systematic, complete and detailed (...) works of uṣūl al-fiqh (Islamic legal theory) that belonged to the Khurāsān Shāfi‘ī School have reached to the present day belong to the second half of the V./XI. century. Making research on the studies which were done about uṣūl al-fiqh and formed the basis of this period is essential to follow the development of uṣūl al-fiqh of the Khurāsān Shāfi‘ī School. Transfer of the uṣūl al-fiqh in al-Qāḍī Ḥusayn al-Marwarrūdhī’s al-Ta‘līḳa make it possible to determine the literatüre, which was formed in Khurāsān region in the period from the death of Shāfi‘ī to the first half of the V./XI. century until the first half of the Khurāsān region, which allows the determination of the uṣūl al-fiqh. In this study, on the basis of ijmā‘, al-Qāḍî Ḥusayn al-Marwarrūdhī’s method in al-Ta‘līḳa will be examined.Summary: Al-Qāḍī Ḥusayn al-Marwarrūdhī is considered to be one of the most important representatives of the Khurāsān Shāfi‘ī School. In addition to receiving fiqh education from al-Qaffāl al-Marwazī, who is accepted as the founder of the Khurāsān Shāfi‘ī School in Shāfiʿī fiqh circles. Al-Qāḍī Ḥusayn, one of the most distinguished students of al-Qaffāl al-Marwazī, has become one of the important bearers of the fiqh heritage of Khurāsān Shāfi‘ī School. The fact that the epithet “el-kāḍî” is used in the works of Khurāsān Shāfi‘ī School to absolutely refer to al-Qāḍî Ḥusayn, is another issue that shows his being authority on fiqh. Al-Qāḍī Ḥusayn al-Marwarrūdhī has accomplished many works in the field of fiqh. The most famous and most important work of al-Qāḍī Ḥusayn is the al-Ta‘lîḳa, written according to the Mukḫtaṣar arrangement style of al-Muzanī. He is often cited as the author of the well-known work al-Ta‘lîḳa in the sect. Al-Ta‘lîḳa, commonly cited in fiqh studies to refer to the views of al-Qāḍī Ḥusayn, is one of the first commentary on Mukḫtaṣar by Muzanī. With these characteristics, al-Ta‘lîḳa is one of the outstanding manuscripts for exploring the fiqh legacy of the Khurāsān Shāfi‘ī School. Another important feature of this text is that uṣūl al-fiqh issues such as ijtihād, taqlīd, ijmā‘ and view’s of the companions of the Prophet (qawl al-ṣaḥābah) have been covered in the introduction of the work. Al-Qāḍī Ḥusayn discusses the issues of evidentiality and types of ijmā‘ and ijmā‘ of ṣaḥābah in the chapter on ijmā‘ in al-Ta‘lîḳa. Al-Qāḍī Ḥusayn also handles the debates on view’s of the companions of the Prophet in the section on ijmā‘ of ṣaḥābah. It is also seen that the proofs proposed for evidentiality of ijmā since Shāfiʿī’s period became more versatile and differed. The fact that the arguments al-Qāḍī Ḥusayn cites in the chapter of the evidences of ijmā‘ were also mentioned by his contemporary, al-Māwardī, an Iraqi Shāfiʿī jurist, points out the accumulation of knowledge in terms of proofs of ijmā. Al-Qāḍī Ḥusayn makes two related distinctions that are fundamentally related to the types of ijmā. The first is the division between ijmā supporters, those who argue for knowability of ijmā, and their opponents. According to this, ijmā is divided into two parts as ‘āmm (general public) ijmā‘ and khāṣṣ (scholars) ijmā‘. Opposition to ‘āmm ijmā‘, such as fardhs (obligations) in prayer, rawātib sunnah (the practice that the Prophet regularly performed) and feast prayer requires kufr (blasphemy). Al-Qāḍî Ḥusayn, who considers issues such as ‘awl (a sharing method in Islamic inheritance law), mut‘a marriage (a type of temporary marriage) and riba’l-faḍl (interest in exchange or sale transactions) which are seen as controversial ijmā‘ issues in literature, as khāṣṣ ijmā‘ and evaluates opposition to this type of ijmā‘ as fisq (impiety). The second division al-Qāḍī Ḥusayn makes is between ijmā‘ based on the text and apparent comparison, and the ijmā‘ based on hidden comparison. Al-Qāḍī Ḥusayn thinks that the opposition to ijmā‘ that is based on ijtihād or the text in terms of sanad (chain of narrators), requires blasphemy. In a sense, this is to accept ijmā‘ as a provision on an equal basis and to reduce the distinctions of ijmā‘ to literary level. Al-Qāḍī Ḥusayn also discusses evidentiality of qawl al-ṣaḥābah in connection with the issues of ijmā‘. Al-Qāḍī Ḥusayn opposes the thesis that ijmā‘ is only limited to companions’ era and argues that it can be realized in any century after the Prophet. Al-Qāḍī Ḥusayn, who discusses ṣaḥābah’s ijmā‘ under two categories: the views of ṣaḥābah that have gained prevalence among other ṣaḥābahs and those that have not gained prevalence among other companions, argues for evidentiality of qawl al-ṣaḥābah, which have gained prevalence and known not to be opposed. He provides significant information on ijmā‘ discussion in Shāfi‘ī fiqh methods with regard to the evidentiality of this type of qawl al-ṣaḥābah, which is referred ijmā‘ al-suqūtī (consensus based on lack of opposition-silence). The knowledge al-Qāḍī Ḥusayn cites with regard to the evidentiality of qawl al-ṣaḥābah which have not gained prevalence among other ṣaḥābahs differs from Māwardī, one of his contemporary, and his predecessors. The fact that he cites Shāfi‘ī’s previous and latest views with regard to the state of such qawl al-ṣaḥābah in the face of qiyās (legal analogy) enables him to make comparison using uṣūl material available in his era. Al-Qāḍī Ḥusayn, who mentions debatable issues among ṣaḥābah, makes controversial narrations. While al-Qāḍī Ḥusayn reports that there is not any conflict on the argument that it is legitimate to express a third view with regard to issues on which ṣaḥābah is divided in two groups and fall into conflict, his contemporary al-Māwardī and other Shāfi‘ī jurists report that it is not legitimate to propose a third view on such an issue as there is ijmā‘ on these issues. The early period Ismaili jurist Al-Qādî al-Nu'mān appears as an important figure in the formation of Ismaili jurisprudence. There is very little information about Kadı Nu'mân's family, childhood, education and intellectual environment. His full name is Abû Hanîfah Nu'man b. Muhammad b. Mansûr al-Qādî at-Tamîmî Al Qayrawānî. He was born around 290/903 (late 3rd (9th) century) into an educated family in Qayravan in North Africa. There are different opinions about the sect he belonged to when he was growing up. On (...) the other hand, it is difficult to say for certain whether Nu’mān received education in the Ismaili sect due to the understanding of taqiyya in the madhhab. However, it is understood from the basic jurisprudence texts Nu’mān wrote that he most likely did not receive a Sunni education. Historians refer to him as 'Qadi Nu’mān or Abu Hanifah al-Shi'i' in order not to confuse him with the imam of the Hanafi school. Qādî Nu’mān served at different levels of the Fatimid State. Around 313/925, he entered the service of the first Fatimid caliph, Mahdi (r. 909-934 CE/297-322 AH), as a copyist and secretary. During the reigns of the third caliph Mansur and the fourth Fatimid caliph Mu’izz (d. 365/975), Qādî Nu’mān first served as a judge in Tripoli and then in Mansouriya, the Fatimid capital. After the Fatimids conquered Egypt and the center of government was moved to Cairo, Qādî Nu’mān was appointed by the fourth caliph Mu’izz as the head of the appellate courts (maẓālim). Qadi Numans career was at the peak in the period of Caliph Muiz. Qādî Nu’mān worked as a judge in the Fatimid State for about twenty-six years and continued this duty until his death in 363 (973). After the fall of the Fatimid caliphate, there haven’t been any other Fatimid or Ismaili jurists. Qādî Nu’mān is considered by contemporary Ismaili writers as a figure who systematically transformed Ismaili fiqh into an independent sect of fiqh. It can be said that Ismaili fiqh was developed through his works in the Fatimid period. His works continued as the main references in the fiqh studies and after the Fatimid period. With the death of Qādî Nu’mān, the period of ijtihad in Ismaili fiqh and its the establishment phase of Ismaili fiqh came to an end; The sect, in which esoteric interpretations were at the forefront, emerged as a distinctive school of fiqh by discarding ambiguity. Qādî Nu’mān was a very productive writer. He wrote important works related to the field of furu al-fiqh and usûl al-fiqh. Among his works, Ikhtilāf uṣūl al-madhāhib is undoubtedly one of the most important works in the early history of fiqh methodology. The work in question, which was originally written with the aim of rejecting the Sunni fiqh method, discusses the approaches of the Sunni schools of fiqh on ikhtilāf, taqlid, ijma, nazar, qiyas, istihsan, ijtihad and ra’y in a polemical manner. It reveals the differences of the Ismaili method from the Sunni method in terms of the sources on which the fiqh is based, the authority to make ijtihad and the theory of interpretation of the texts. Qādî Nu’mān examined the relationship between reason and revelation in general and the role of religious authority in comprehending and interpreting the texts while criticizing Sunni methods. Ikhtilāf uṣūl al-madhāhib has the characteristics of the works of development period as a form. It is possible to observe the question-answer and dialectic form which can be seen in the works of the development period throughout the work in question. Qādî Nu’mān endeavoured to persuade his opponents with a dialectical and argumentative style. Again, he replied to the Sunnis, who were his interlocutors, with their own proofs. In addition to these, Ikhtilāf uṣūl al-madhāhib has a unique feature in the matter of content. Because it is not very familiar to any Sunni handbook of usûl al-fiqh. It does not mention the hâss, âmm, ijma, qiyas, amir, nahy, alfaz bets, etc. The text is very similar to the Ahbari movement of the Jafari sect for it rejects all forms of ijtihad. It was written at a time when fiqh was not yet stable. Ikhtilāf uṣūl al-madhāhib gives us crucial information about the development of different usûl and fiqh sources in the middle of the fourth century. However, what is interesting here is that the information he gives about Ismaili method and fiqh is very little compared to the one about Sunni method and fiqh. Much of it centered on Sunni thought and its rejection. However, his ultimate goal was to defend the Ismaili doctrine. (shrink)

Discipleship is a responsibility of the Church. It is an outlet in which the regeneration of Church leadership to the younger generation is conducted. Before the COVID-19 pandemic, discipleship and mentoring of youth leaders, especially key persons of GKII (Gereja Kemah Injil Indonesia) youth were provided by means of in-person activities. During the pandemic, digital media has been utilised for various church activities, including mentoring these key persons. Hence, this research intends to explore: (1) the method by which key persons (...) practise digital discipleship and (2) the benefits of digital media in youth discipleship to facilitate faith growth. This research is a qualitative research. Data were collected by means of interviews and observations on several key persons’ digital media accounts. The research shows that social media significantly benefits the discipleship process. It was found that digital discipleship was quite often carried out during the pandemic, especially in urban areas, with WhatsApp and Zoom meetings as its two primary means. However, it slightly declined along with the lifting of social gathering restrictions. The main themes explored in the mentoring sessions were discipleship, soteriology, spiritual life, motivational and digital media materials, and youth ministry in the digital era. The discipleship practice used was the NM-SM (Nurtured, Matured, Served, Mission) pattern.Contribution: The results of this research contribute to the development of knowledge, especially in the field of youth discipleship, and digital media-based discipleship. This research also shows that digital media has become an effective theological space during the pandemic and post-pandemic periods. (shrink)

In our papers on the rationality of magic, we distinghuished, for purposes of analysis, three levels of rationality. First and lowest (rationalitYl) the goal directed action of an agent with given aims and circumstances, where among his circumstances we included his knowledge and opinions. On this level the magician's treatment of illness by incantation is as rational as any traditional doctor's blood-letting or any modern one's use of anti-biotics. At the second level (rationalitY2) we add the element of rational thinking (...) or thinking which obeys some set of explicit rules, a level which is not found in magic in general, though it is sometimes given to specific details of magical thinking within the magical thought-system. It was the late Sir Edward E. Evans-Pritchard who observed that when considering magic in detail the magician may be as consistent or critical as anyone else; but when considering magic in general, or any system of thought in general, the magician could not be critical or even comprehend the criticism. Evans-Pritchard went even further: he was sceptical as to whether it could be done in a truly consistent manner: one cannot be critical of one's own system, he thought. On this level (rationalitY2) of discussion we have explained (earlier) why we prefer to wed Evans Pritchard's view of the magician's capacity for piece-meal rationality to Sir James Frazer's view that magic in general is pseudo-rational because it lacks standards of rational thinking. Analysis of various Buddhist philosophical views.

This article utilises Gadamerian hermeneutics method and Freirean theory of the purpose of Religious Education to explore how Religious Education can contribute to achieving United Nations Sustainable Development Goal (SDG) 4, emphasising education for sustainable development. The study contends that Religious Education in Lesotho occupies a distinctive position in the education system, surpassing other countries in its extensive integration. Due to historical factors, Religious Education is taught in nearly all religiously affiliated schools, comprising about 90% of all educational institutions in (...) Lesotho, and even in certain public schools. The curriculum of Religious Education in Lesotho aligns directly with the educational objectives of SDG 4. Additionally, Lesotho’s Religious Education corresponds to three levels of school education for sustainable development: whole school approach, classroom approach, and community approach. Nevertheless, the study asserts that for Religious Education in Lesotho to better align with education for sustainable development, various enhancements are required. Firstly, inclusivity across all religious traditions is essential, moving beyond a sole focus on Christianity. Secondly, there is a need for wider dissemination and implementation of Religious Education in all schools, irrespective of their affiliation. Lastly, a shift from traditional pedagogies to transformative approaches is recommended to boost the effectiveness of Religious Education in advancing sustainable development.Contribution: This article contributes by analysing Lesotho’s case and its implications for enhancing Religious Education teaching to effectively address SDGs. It broadens existing knowledge on Religious Education’s potential as a platform for sustainable development and provides recommendations for its improved implementation in a specific context. (shrink)
