Straipsnio tikslas – ištirti Latvijos filosofijos istoriografijos tendencijas per pastaruosius tris dešimtmečius. Autoriaus dėmesio centre dvi pagrindinės filosofijos istorijos rašymo prieigos – idėjų istorija ir intelektinė istorija. Iširus Sovietų Sąjungai Latvijos kultūriniame diskurse išpopuliarėjo terminas „idėjų istorija“. Filosofijos istorikai ėmėsi nušviesti glaudžius ryšius tarp Vakarų šalių ir Latvijos kultūrų. Tačiau pastarąjį dešimtmetį Latvijos filosofijos istorikai vis labiau renkasi intelektinės istorijos prieigą.

The academic History of Philosophy in Lithuania in three volumes will be published by the Institute of Culture, Philosophy and Art. The first presented volume covers the development of Lithuanian philosophy from the 16th to the 18th centuries. It includes late medieval and Renaissance philosophy, the second scholasticism and modern philosophy. The first Lithuanians to be introduced to philosophy were young members of the gentry who studied in European universities at the end of the 14th century. The recently baptized Lithuania (...) strove to adopt Western culture and to present itself as a Western state. Some graduated from the universities as bachelors or masters of philosophy and returned to their country. At the end of the 14th century, Vilnius Cathedral School was founded. The elements of logic were probably taught there. The growth of the political and economic power of the Grand Duchy of Lithuania brought about the need for higher education. That need was significantly increased by the growing activity of various religious orders. In 1507 the Dominicans started teaching philosophy and theology to their novices. They were able to teach late medieval philosophy in its thomistic interpretation. We can regard 1507 as the year Lithuania benefited form a new phenomenon, professional philosophy, and the Dominicans as its initiators. They taught not only the disciplines of late medieval philosophy but also the basics of the other sciences. The Dominicans, and later the Jesuits, Franciscans, Bernardines, Carmelites, Trinitarians and other monastic orders, enriched intellectual life in Lithuania by teaching philosophy in their schools. [straipsnis ir santrauka lietuvių kalba; santrauka anglų kalba] Straipsnyje pristatomas svarbių M. Heideggerio technikos filosofijos elementų formavimosi kontekstas tarpukario Vokietijos autorių tekstuose. Aptariamos paralelės tarp Heideggerio ir E. Cassirerio, E. Jüngerio bei O. Spenglerio industrializacijos proceso filosofinių apmąstymų. Nagrinėjant šių mąstytojų moderniosios technikos koncepcijų ryšius išryškėja, kaip vystėsi Heideggerio tekstams būdinga industrializacijos proceso artikuliacija bei jo technikos filosofijai svarbi problematika, liečianti planetarinį moderniosios technikos išplitimą ir poveikį bei technikos, kaip Vakarų ir šiuolaikinės žmonijos apskritai lemties, sampratą.

Straipsnyje nagrinėjama analitinės kalbos ir mokslo filosofijos raida Lietuvoje. Konstatuojama, kad analitinė filosofija Lietuvoje pradėta plėtoti XX amžiaus aštuntajame dešimtmetyje, kai Evaldas Nekrašas ir Rolandas Pavilionis paskelbė savo pirmųjų mokslo filosofijos ir kalbos filosofijos tyrinėjimų, kuriuose remiamasi analitine tradicija, rezultatus. Straipsnyje analizuojami jų ir kitų tyrėjų, kurie rėmėsi ta pačia tradicija, pirmiausia Algirdo Degučio ir Albino Plėšnio darbai. Analitinė filosofija buvo pirmoji nemarksistinės filosofijos kryptis, pradėta plėtoti pokarinėje Lietuvoje, todėl aštuntajame ir devintajame dešimtmečiuose ji atliko svarbų (...) vaidmenį plečiant šalyje filosofinių tyrinėjimų tematiką ir keičiant jų metodologinius pagrindus. Nors pastaruoju metu jos įtaka Lietuvos filosofijoje kiek sumažėjo, ji aiškiai juntama kai kuriuose pastarojo meto darbuose, kuriuose nagrinėjamos sąmonės filosofijos, priežastingumo, humanitarinių ir socialinių mokslų metodologijos problemos. Ji padarė nemažą poveikį ir pozityvizmo raidos bei politinės filosofijos problemų tyrimui. The article describes the problematic spots of the court system ordained by the temporary law during the inter-war period in Lithuania and the prolonged attempts of the authority to transform it into the permanent one. It demonstrates that there has been a constant involvement in this situation among the authority representatives and the institutions until the issue of the Judiciary Act in 1933. The new legislation has been prepared, even though not all of it has been implemented. The first legislation (...) on judiciary of an independent Lithuania was enacted in 1918 as the Temporary Act on Lithuanian Courts and their Operation. It acknowledged the weak spots such as the procedure for assigning peace judges, no provision for cassation, elimination of jury as well as no limitations of guarantees during assignment and dismissal of judges, etc. Current imperfections resulted from lack of knowledge and no possibility to have an election as well as the limited financial potential of the state. It has been intended to solve these problems in the near future. The legal regulation of the fundamental points on court organization and operation, that lacked in the Temporary Judiciary Act, has been supported by the provisions incorporated into the Constitution of Lithuania of 1922. The distinct laws have let the colegially operating courts to temporary incorporate the advocate under oath as a member of the judicial board. Also, considerably transcendent salaries of the court official workers as compared to other civil servants has been established. The bill ascertaining the court system and their operation has finally been drawn and hereafter for several years it has been refined by various legal institutions and experts. This situation ended with enactment of the new Judiciary Act in 1933. Although it retained the assignment of judges and finally eliminated the institution of the jury, it solved the majority of questions related to the court organization and operation that had not been regulated by law before. Vytautas Raudeliūnas is Lithuanian law historian, expert of the history of the Great Duchy of Lithuania, pedagogue and Lithuanian patriot. He spent his youth in exile and finished his studies in Russia and in Vilnius. He worked as a fellow in Lithuanian Science Academy, in the Monument Defence Office, the Institute of Culture, Philosophy and Art. V. Raudeliūnas lectured at Vilnius Pedagogical University. He was one of the establishers and publishers of periodical publications “The monuments of Lithuanian law”, “The studies (...) of Lithuanian law history”. The article describes biography of V. Raudeliūnas, collects and disputes his bibliography and evaluates his contribution to the history of Lithuanian law. The article analyzes V.Raudeliūnas’ biography and scientific activity, as well as the main directions of his research: publications and transcriptions of Lithuanian Statutes; development of law institutes in the Great Duchy of Lithuania; peculiarities of development of Vilnius University. The object of this research is the law created and enforced by different selfgoverning institutions such as the Church, the town, province and village communities in Lithuania in the Middle Ages. The author examines what was the contribution of this law to the realization of the law-governed state model in the Grand Duchy of Lithuania. The author believes that this problem can be viewed through the prism of the competition of these communities and their law with the aristocratic Lithuanian state (...) and the law created and ruled by noblemen. This aspect is not considered in the known scientific studies. Pluralism of law is highly preferable as an idea and in practice in law-governed states, because some regress of this conception in one community can be compensated by a progress in any other community. The author thus aimed to advance the hypothesis that favourable conditions for the law-governed state conception in Lithuania in the Middle Ages potentially existed. (shrink)

This discussion paper considers how seldom recognised theories influence clinical ethics committees. A companion paper examined four major theories in social science: positivism, interpretivism, critical theory and functionalism, which can encourage legalistic ethics theories or practical living bioethics, which aims for theory–practice congruence. This paper develops the legalistic or living bioethics themes by relating the four theories to clinical ethics committee members’ reported aims and practices and approaches towards efficiency, power, intimidation, justice, equality and children’s interests and rights. Different approaches (...) to framing ethical questions are also considered. Being aware of the four theories’ influence can help when seeking to understand and possibly change clinical ethics committee routines. The paper is not a research report but is informed by a recent study in two London paediatric cardiac units. Forty-five practitioners and related experts were interviewed, including eight members of ethics committees, about the work of informing, preparing and supporting families during the extended process of consent to children’s elective heart surgery. The mosaic of multidisciplinary teamwork is reported in a series of papers about each profession, including this one on bioethics and law and clinical ethics committees’ influence on clinical practice. The qualitative social research was funded by the British Heart Foundation, in order that more may be known about the perioperative views and needs of all concerned. Questions included how disputes can be avoided, how high ethical standards and respectful cooperation between staff and families can be encouraged, and how minors’ consent or refusal may be respected, with the support of clinical ethics committees. Background: The law and literature about children’s consent generally assume that patients aged under-18 cannot consent until around 12 years, and cannot refuse recommended surgery. Children deemed pre-competent do not have automatic rights to information or to protection from unwanted interventions. However, the observed practitioners tend to inform young children s, respect their consent or refusal, and help them to “want” to have the surgery. Refusal of heart transplantation by 6-year-olds is accepted. Research question: What are possible reasons to explain (...) the differences between theories and practices about the ages when children begin to be informed about elective heart surgery, and when their consent or refusal begins to be respected? Research design, participants and context: Research methods included reviews of related healthcare, law and ethics literature; observations and conversations with staff and families in two London hospitals; audio-recorded semi-structured interviews with a purposive sample of 45 healthcare professionals and related experts; interviews and a survey with parents and children aged 6- to 15-years having elective surgery (not reported in this paper); meetings with an interdisciplinary advisory group; thematic analysis of qualitative data and co-authorship of papers with participants. Ethical considerations: Approval was granted by four research ethics committees/authorities. All interviewees gave their informed written consent. Findings: Interviewees explained their views and experiences about children’s ages of competence to understand and consent or refuse, analysed by their differing emphases on informed, signified or voluntary consent. Discussion: Differing views about children’s competence to understand and consent are associated with emphases on consent as an intellectual, practical and/or emotional process. Conclusion: Greater respect for children’s practical signified, emotional voluntary and intellectual informed consent can increase respectful understanding of children’s consent. Nurses play a vital part in children's practitioner-patient relationships and physical care and therefore in all three elements of consent. (shrink)

The motive for late eighteenth-century proto-technics of photography and cinema was never quite mimetic representation: it was generating autonomous impressions of natural phenomena within the tradition ofNaturphilosophie. The article analyses a series of connections between ‘natural hieroglyphs’ (von Lichtenberg), Jacques-Alexandre-César Charles’s ‘megascope’, Wedgwood’s pre-photography, Lavater’s silhouettes and antecedents of Marey’s ‘graphic method’. The goal is to document precursor ideas, devices, setups and frameworks of photoimaging medias to show that the genealogy of photography and cinema intersected through many polymath transverses within (...) the ambit of natural philosophy (and the context of slavery). This article uses the current ‘refugees/migrants crisis’ and Brexit as illustrative of the numerous challenges the European Union faces today when it comes to its identity and the construction of a ‘European citizenship’. By discussing the proliferation of borders on the European continent and by analysing the sociological significance of such proliferation, the article argues that Europe is experiencing an ontological and epistemological rather than an existential crisis that relates to its incapacity to acknowledge, and critically engage with, its fundamental (...) neo-colonial and neo-liberal matrix. The article argues that the stalemate experienced by the European Union with respect to its regional and global relevance can only be overcome by bringing to the surface buried or disqualified knowledges about ‘who counts as European’ beyond whiteness. The topic of safeguarding against sickness grew in importance during the COVID-19 pandemic. People’s health was more at risk, yet not all had the same capacity and options to deal with it. Therefore, this article focuses on the under-researched topic of choice of strategies and individual practices for safeguarding against one’s sickness among micro-entrepreneurs (with 1–10 employees) before and during the pandemic, namely on the example of Czechia. We analyse 30 qualitative interviews with micro-entrepreneurs to demonstrate how their social location (...) affects the attainability of strategies and individual practices for that purpose. It is primarily their family role (breadwinner vs caregiver) that, along with socioeconomic status, either limits or opens choices of strategies and individual practices or combinations thereof. Although the COVID-19 pandemic posed a high health risk to the entire society, it did not bring the micro-entrepreneurs to revise their often-risky choices in safeguarding against sickness. In contrast, it highlighted some specifics of micro-enterprises, e.g. their unclear organisational structure, which proved a high risk in the context of the health crisis. (shrink)

In classical Latin, luxuria means 'desire for luxury'; it is linked with the ideas of excess and deviation from a standard. It is in most cases labelled as a vice which contrasts with the innate frugal nature of the Romans. Latin authors do not see it as endemic but as an import from the East in the aftermath of military conquests--and as a cause of fatal decline. Following these etymological and semantic origins, Roman Luxuria: A Literary and Cultural History discusses (...) the influence of Greek culture on the Roman concept and the peculiar characteristics of Roman luxuria. It analyses Roman views on luxuria through close readings in historical order from Cato the Elder, who regards luxuria as the opposite of the ideal Roman way of life, to the Christian poet Prudentius, who represents it in an allegorical fight with Sobriety. The book attends both to key authors and to wider literary genres, such as historiography and satire. Particular consideration is given to the rhetorical device of personification, which can be traced from the first appearances of luxuria in Latin literature to those of late antiquity. Berno devotes detailed attention to Seneca the Younger, whose work is often preoccupied with this passion. Seneca both defends himself from the charge of luxuria and violently attacks it in others, describing it as the archenemy of a philosophical life. Along the centuries, the focus on luxuria shifts from the economic sphere (and the waste of money) to the erotic, to the extent that in the Christian world it becomes one of the Seven Capital Sins representing the vice of lust.
