Ultimately, he argues, immanence is an infinite task, and transcendence the opposition with which philosophy will always need to reckon.

En este trabajo se lleva a cabo un estudio filosófico-jurídico del derecho al debido proceso reconocido en el artículo 24 de la Constitución Española, a fin de adaptarlo a la Era algorítmica. Para la consecución de este objetivo, el trabajo se divide en tres puntos. En el primero se hará un repaso por la historia y la fundamentación jurídica del debido proceso en el sistema jurídico español. En el segundo se considerarán las garantías y los principios que habrían de conformar (...) un derecho al debido proceso tecnológico, derecho necesario en esta nuestra Era algorítmica. En 1934, Aniceto Olano (1896-1966), alias Miguel de Alzo, publicó un folleto titulado Filosofía vasca, donde se defiende la existencia de una filosofía nacional para Euskal Herria. Esta obra debe estudiarse como un ejemplo de la historiografía nacionalista de la filosofía, paralelo a los casos de la filosofía nacional alemana, francesa, polonesa, etc. En la península Ibérica, encontramos los precedentes de la filosofía nacional española (Menéndez y Pelayo), la filosofía nacional andaluza (Federico de Castro) y la filosofía nacional (...) catalana (Torras i Bages, Bové, Pujols, etc.). Es esta última donde se encuentran las influencias directas de Olano, quien estudió en la Universidad de Barcelona entre 1920-1922 junto con algunos de los mayores representantes de la historiografía nacionalista de la filosofía en Cataluña: Tomàs Carreras i Artau y Jaume Serra Hunter. En su Filosofía vasca, Olano describe las presuntas características que definen y diferencian los pensadores vascos del resto del mundo filosófico. Identifica sus orígenes en Quintiliano, confecciona una primera historia de la filosofía en Euskal Herria y concluye que el pensamiento vasco estaría máximamente encarnado por Francisco de Vitoria, filósofo nacional vasco. La cristología de la carta a los Hebreos está determinada por el sacerdocio de Cristo. Esa presentación magistral viene precedida por el principio de “Cristo como kerygma del Padre” (cc. 1-2), en que se pone de manifiesto el papel profético de Jesús, lo que debe ser valorado en su justa medida. Aunque es verdad que el sacerdocio de Cristo, lo más exclusivo de todo el NT, pone de manifiesto una visión particular y original de lo que se quiere afirmar. Es (...) un sacerdocio de solidaridad con sus hermanos; se trata de un sacerdocio misericordioso y, por ello, no estamos simplemente ante un título exótico que el autor rescata exegéticamente de Gn 14; la cristología del sacerdocio de Cristo nos hace asomarnos al papel kenótico de su sacerdocio: compasivo y semejante a sus hermanos. No es un sacerdocio de casta, sino de solidaridad fraternal para acercarnos al misterio de Dios. Se debe entender que estamos ante un sacerdocio compasivo, humano, que es lo que llevará a la exaltación de ese sacerdocio,. La comparación con el himno de Filipenses (Flp 2,5-11) es muy sugerente. Y no menos decisivo es que ese sacerdocio trae para la humanidad un “alianza nueva” que implica para los cristianos una conciencia de salvación y liberación; una nueva concepción de la santidad de Dios y de lo divino; y, en definitiva, se quiere mostrar una religión de absoluta confianza en Dios y en la obra salvífica de Cristo. La crisis multidimensional por la que atraviesa actualmente la humanidad coloca en primer plano la cuestión, más que de «la salida de la crisis», de la superación de los condicionamientos negativos que han conducido a ella. Más allá de las causas próximas reconocibles se hallan las apuestas paradigmáticas, la Weltanschauung dominante que inspira las conductas erróneas. En el artículo se sostiene que a la metafísica materialista —que el autor distingue del ateísmo—, en tanto que idea-guía principal de la modernidad, corresponde (...) gran parte de la responsabilidad por las patologías de la sociedad actual, a cuyo clímax estamos asistiendo. Se asume que el mundo ha experimentado tales transformaciones que ninguna de las concepciones metafísicas o criptometafísicas a las que estamos acostumbrados sirve para fundamentar una guía de actuación capaz de sacarnos del atolladero. Y se propone una idea de fondo que se estima que sí podría hacerlo: un noocentrismo, la consideración de la consciencia como la realidad fundamental y, por supuesto, referencial. Un neoespiritualismo, si se quiere, capaz de fundamentar una Ética universal, y orientado a la liberación individual y colectiva del ser humano, en armonía con una Naturaleza entendida como de igual importancia, y dejando atrás el espejismo pseudocientífico —y en realidad sojuzgador y bloqueante— del materialismo metafísico. Ultimamente bastante atençáo vem sendo dispensada ao estudo do ceticismo moderado na modernidade. O famoso historiador da filosofia Richard Popkin, em sua História do Ceticismo de Erasmo a Espinosa , cunhou a denominaçáo de ceticismo epistemológico para qualificar os membros desta corrente e nela inseriu os filósofos setecentistas Gassendi e Mersenne, considerando-os seus principais representantes. Além disso, no século XVIII temos o denominado ceticismo mitigado de Hume, que chamou a atençáo dos filósofos modernos para definir os limites do ceticismo. Este (...) artigo procura contribuir para o estudo do ceticismo moderado na modernidade, mostrando náo só que Hume, Mersenne e Gassendi podem fazer parte do assim chamado ceticismo epistemológico ou mitigado, mas também que há certos elementos comuns em suas filosofias destinados a mitigar os argumentos dos céticos de seu tempo. Richard Popkin, no capítulo VII de sua “História do ceticismo de Erasmo a Spinoza”, apresenta uma tendência predominante na filosofia moderna de rejeitar o ceticismo pirrônico, por ser demasiado destrutivo, e o dogmatismo extremo, por ser questionável. A solução para esses partidários foi a de adotar um ceticismo que Popkin denomina mitigado ou construtivo, isto é, uma teoria que reconheça a impossibilidade de alcançarmos as verdades absolutas acerca da natureza e realidade, mas que admita a possibilidade de um certo conhecimento, (...) que possa ser convincente e provável, embora não metafisicamente inquestionável. Esta espécie de dúvida filosófica ganhou força com o advento da filosofia cartesiana, mas só tornou-se definitivamente respeitável com a sua formulação por David Hume, sustenta ainda Popkin. Neste trabalho mostraremos que os filósofos Pierre-Daniel Huet e Simon Foucher, além de Hume, poderiam entrar nesta categoria, que também pode ser definida de ceticismo acadêmico. (shrink)

O pensamento de Hume pode ser comparado ao dos céticos modernos em muitos aspectos. Com relação ao tópico da racionalidade dos animais, Hume parece seguir de perto a leitura de alguns céticos modernos e se afastar consideravelmente da de Descartes. Por outro lado, diferente de filósofos como Montaigne, Charron e La Mothe Le Vayer, Hume não tinha por finalidade colocar a racionalidade humana num nível próximo dos animais para apenas provar a fraqueza do intelecto diante do desconhecido, mas intentava comparar (...) o nosso modo de proceder ao do animal para avaliar, com mais precisão, as suas teorias acerca da natureza humana. Neste artigo analiso o modo como os primeiros céticos da modernidade trataram da questão da razão dos animais e o comparo com as ideias de Hume sobre o assunto, sem deixar de mencionar as contribuições de Descartes e de Pierre Bayle. Mediante una investigación teórica y de trabajo de campo en relación a la adaptación de la titulación de arquitectura al EEES y con el objetivo de hacer efectivo un despliegue gradual del desarrollo de las competencias del submódulo de dibujo, se exponen los resultados de la coordinación entre asignaturas y una selección crítica y comparativa de actividades de aprendizaje. Se indaga además en la dispar distribución de las materias de dibujo de la adaptación al plan de bolonia, concluyendo con una (...) propuesta de despliegue independiente y mejorada del submódulo desvinculado de las materias que no le son afines. IntroductionIncorporating technology in cognitive interventions represents an innovation, making them more accessible, flexible, and cost-effective. This will not be feasible without adequate user-technology fit. Bearing in mind the importance of developing cognitive interventions whose technology is appropriate for elderly people with cognitive impairment, the objective of this systematic review was to find evidence about usability and user experience measurements and features of stimulation, training, and cognitive rehabilitation technologies for older adults with mild cognitive impairment or dementia.MethodThe Medline, PubMed, Scopus, ScienceDirect, (...) and PsycINFO databases were searched for literature published in the last 10 years, and three researchers independently reviewed potentially eligible studies, following specific inclusion criteria. A systematic review of the studies was conducted, presenting a qualitative synthesis of usability and UX measures with their outcomes, study characteristics and features of the cognitive intervention technologies.ResultsTen studies were selected: five were cognitive stimulation and five were cognitive training. Most of them were computer-based programs with a serious game format. Efficiency and effectiveness were the most frequent measurements used for collecting objective usability data, showing that elderly people with cognitive impairment require more time and help but can complete tasks. Regarding UX or subjective usability data, questionnaires and scales were the most used methods, reporting positive experience despite certain difficulties with the interface in five studies.ConclusionMeasuring usability and UX in cognitive intervention technologies for older adults with MCI or dementia provides an integrated view that can contribute to their development according to the needs and characteristics of the target population. More research is required to include this population group in usability and UX studies, as well as standardized tools and consensus on the relationship of these terms to guarantee the future effectiveness of cognitive intervention technologies.Review registrationThis review was registered in the PROSPERO International Register of Systematic Review Protocols. Liberalism, Miguel de Beistegui argues in The Government of Desire, is best described as a technique of government directed towards the self, with desire as its central mechanism. Whether as economic interest, sexual drive, or the basic longing for recognition, desire is accepted as a core component of our modern self-identities, and something we ought to cultivate. But this has not been true in all times and all places. For centuries, as far back as late antiquity and early Christianity, (...) philosophers believed that desire was an impulse that needed to be suppressed in order for the good life, whether personal or collective, ethical or political, to flourish. Though we now take it for granted, desire as a constitutive dimension of human nature and a positive force required a radical transformation, which coincided with the emergence of liberalism. By critically exploring Foucault’s claim that Western civilization is a civilization of desire, de Beistegui crafts a provocative and original genealogy of this shift in thinking. He shows how the relationship between identity, desire, and government has been harnessed and transformed in the modern world, shaping our relations with others and ourselves, and establishing desire as an essential driving force for the constitution of a new and better social order. But is it? The Government of Desire argues that this is precisely what a contemporary politics of resistance must seek to overcome. By questioning the supposed universality of a politics based on recognition and the economic satisfaction of desire, de Beistegui raises the crucial question of how we can manage to be less governed today, and explores contemporary forms of counter-conduct. ​Drawing on a host of thinkers from philosophy, political theory, and psychoanalysis, and concluding with a call for a sovereign and anarchic form of desire, The Government of Desire is a groundbreaking account of our freedom and unfreedom, of what makes us both governed and ungovernable. Digital COVID certificates are a novel public health policy to tackle the COVID-19 pandemic. These immunity certificates aim to incentivize vaccination and to deny international travel or access to essential spaces to those who are unable to prove that they are not infectious. In this article, we start by describing immunity certificates and highlighting their differences from vaccination certificates. Then, we focus on the ethical, legal, and social issues involved in their use, namely autonomy and consent, data protection, equity, and (...) international mobility from a global fairness perspective. The main conclusion of our analysis is that digital COVID certificates are only acceptable if they meet certain conditions: that they should not process personal data beyond what is strictly necessary for the aimed goals, that equal access to them should be guaranteed, and that they should not restrict people’s autonomy to access places where contagion is unlikely. We conclude that, if such conditions are guaranteed, digital COVID certificates could contribute to mitigating some of the most severe socioeconomic consequences of the pandemic. (shrink)

This paper aims to analyse how the discourse of CEO letters and other factors influence community involvement and Social Licence to Operate (SLO) in the mining industry. The analysis is based on qualitative information disclosed in sustainability reports and CEO letters from 32 mining firms. Content analysis was undertaken to obtain data for the study, and then a regression analysis and a multiple correspondence analysis were used to test the hypotheses defined in the study. The results indicate that the CEO (...) discourse influences how a firm expresses the importance of gaining its SLO, the philanthropic activities in which companies become involved and the destinations of the investments in the communities in which they operate. The results also show changes in the discourse between 2011 and 2015, which are, in part, explained by the difficult situation experienced by the sector during this period. The paper contributes to the Corporate Social Responsibility literature by integrating different theories from this field into the SLO framework. The analysis carried out and the results obtained are useful for both CEOs and Sustainability Managers, especially in managing their relationships with the communities where they operate or intend to operate. Resumo: Abordamos a interpretação nietzschiana sobre “liberdade” e “necessidade” e como o filósofo contesta noções da tradição, vinculadas a essa problemática: “causa e efeito”, “sujeito”, “vontade”, etc. Ele assinala como esses conceitos seriam construtos antropomórficos que não conseguem desvendar as ações geridas apenas pela dinâmica da vontade de potência. Mostramos que Nietzsche, mesmo com sua crítica aos conceitos da tradição, continua empregando noções como “fatalidade”, “necessidade”, que parecem reeditar uma conceituação antropomórfica. Indicamos como ele ultrapassa objeções passíveis de serem feitas (...) a um pensamento oscilante, que parece negar e afirmar a liberdade. Concordamos com intérpretes que destacam como seu estilo suscita deliberadamente paradoxos e aporias, já que seu objetivo, antes que estabelecer uma doutrina ou uma teoria consolidada, visa instigar novas reflexões e experiências de pensamento sobre o agir do homem.: We address nietzschiana interpretation on the issue of freedom and necessity. We show how the German philosopher disputes notions of philosophical tradition, linked to this problem, as “cause and effect”, “subject”, “i”, “will” etc. He points how these concepts would be just anthropomorphic constructs that cannot unravel the nature of the actions; managed only by the power control game of the will of power. We show that Nietzsche, even with this radical criticism of the concepts of tradition, continues to employ notions such as “fatality”, “necessity” that seem to resend to the anthropomorphic conceptualization questioned. We indicate how the author of Zaratustra manages to overcome the objections that may be made to an oscillating thought, which sometimes seems to deny and affirm freedom at different times of his work. We agree with interpreters who point out that Nietzsche’s style deliberately chooses to raise paradoxes and apparent apores, since his goal, before establishing a doctrine or a consolidated theory about freedom and necessity, is an attempt to instigate new reflections, new thought experiences, new paths of meditation on the action of man. In this article we aim to support the thesis that Nietzsche, from his first work The Birth of Tragedy, to his last texts, such as Twilight of the Idols, in What I owe to the ancients, proposes a radical transvaluation of the meaning of suffering human. He adopts a completely different perspective from Western metaphysical and religious conceptions, which considered suffering as an objection to life, arising from faults, failures, “sins”, which must be expiated through countless constraints, until inexorable death. The nietzschean transvaluation, with its unique tragic perspective, inaugurated in The Birth of Tragedy and sustained throughout his entire work, far from considering suffering as an objection or imperfection of existence, values it and even exalts it as another modality of becoming. vital, consubstantial and inherent in every affirmation, every pleasure, every possibility of joy. In their recent article, Brown et al analyse several ethical aspects around immunity passports and put forward some recommendations for implementing them. Although they offer a comprehensive perspective, they overlook two essential aspects. First, while the authors consider the possibility that immunological passports may appear to discriminate against those who do not possess them, the opposite viewpoint of immune people is underdeveloped. We argue that if a person has been tested positive for and recovered from COVID-19, becoming immune to it, (...) she cannot be considered a hazard to public health and, therefore, the curtailment of her fundamental rights is not legitimate. Second, they omit that vaccine distribution will create similar problems related to immunity-based licenses. Vaccine certificates will de facto generate a sort of immunity passport. In the next phases of the pandemic, different immunity statuses will be at stake, because the need to identify who can spread COVID-19 is unavoidable. If a person does not pose a threat to public health because she cannot spread the infection, then her right to freedom of movement should be respected, regardless of how she acquired that immunity. We conducted three studies aimed at showing that one-to-one translations between emotion terms might be comparing independent or barely overlapping categories of emotional experience. In Study 1 we found that the speakers' most accessible features of two supposedly equivalent emotions terms (shame and vergüenza) were very different. In Study 2, American and Spanish speakers' typicality ratings of 25 out of 29 constitutive features of “shame” or “vergüenza” were significantly different. In Study 3, these important differences in the content and internal (...) structure of “shame” and “vergüenza” were also reflected in the affective meaning of their corresponding terms. We conclude that “shame” and “vergüenza” do not share the same cluster of central features, and cannot be treated as identical categories of emotional experience. This finding raises serious questions about the one-to-one translation practices not only of most cross-cultural studies on “shame”, but also of other emotion concepts. We suggest an alternative method of translation based on Diachronic Prototype Semantics (Geeraerts, 1997). (shrink)

Should we use human germline genome modification only when serious diseases are involved? This belief is the underlying factor in the article written by Kleiderman, Ravitsky and Knoppers to which I now respond. In my opinion, the answer to this question should be negative. In this paper, I attempt to show that there are no good reasons to think that this technology should be limited to serious diseases once it is sufficiently proven to be safe and efficient. In fact, opting (...) otherwise would negatively harm human beings’ right to the highest standard of health that unmodified embryos could promote. Therefore, the issue should not be so much to define adequately what a serious disease is, but rather to elucidate whether this concept should play any role beyond the context of preimplantation genetic testing. This paper argues that we should not accept the similarity between technologies such as PGT and HGGM because they face different challenges and offer totally different possibilities. Therefore, we are in urgent need to build a completely new ethical architecture that covers the application of germline editing in human embryos. As a part of that process, a much deeper debate on the necessity of distinguishing different disease types is required. (shrink)

Many recent discoveries have confirmed the importance of Orphism for ancient Greek religion, philosophy, and literature. However, its nature and role are still very controversial. The key problem of its relationship to Christianity has been discussed by ancient and modern authors from many different viewpoints, albeit too often tainted with apologetic interests and unconscious projections.
