In this paper we analyze some of the major difficulties of informed consent. We consider insufficient to base IC on the principle of autonomy. We must not forget that the patient may be in a situation of extreme vulnerability and the good doctor should assume a degree of commitment and responsibility with his/her decisions. Our aim is to introduce the ethics of responsibility of Levinas in practice and theory of IC in order to generate a beneficent medical practice in which (...) the supervision and overseeing of the patient do not undermine his/her autonomy. We start from an understanding of the human person as a communicative and symbolic reality. We emphasise the more subjective aspect of education, as showing the best of the person (educere) by creatively appropriating the treasures of history (educare). With these premises, we approach narratives that are surprising for the heterodoxy (resistance) they manifest, with respect to the social reality in which they were written, in the 1st century, in which they were written. In this approach it becomes evident that (...) the interruption of the silence of women, which appears in these narratives, shows the radical value of the human personal reality, opening an egalitarian educational space. Corporate, Social, Ethical and Environmental Reporting should ideally discharge the accountability of an organisation to its stakeholders. Voluntary reporting has been characterised by a dearth of neutral and objective information such that the advocates of SEER recommend that it be made compulsory. Their underlying rationale is that legally specified disclosure requirements and enforcement mechanisms will enhance the quality of such reporting. This paper sets out to explore how realistic this scenario actually is, in view of the conflicting interpretations in the (...) literature on this subject. To that end, a survey of the reporting patterns of 78 of the largest Spanish companies between 2001 and 2003 examines the extent of their compliance with the ICAC-2002 standard, which obliged them to make environmental disclosures in their financial statements. The results suggest that progressive and improved regulation could increase the volume and quality of SEER disclosures. They also suggest, however, that persistent non-compliance means that the problems associated with voluntary disclosure still exist. Finally, through an impression management perspective, the study reveals, the diverse strategies, ranging from dismissal to concealment, that are employed by companies to avoid transparency. As regulation improves and enforcement expectations rise, it becomes more difficult to dismiss compulsory reporting norms. As a result, some firms engage in more complex concealment strategies to attain corporate legitimacy, depriving stakeholders of regulatory information. The latter point serves to reconcile apparently contradictory explanations in the literature as to whether legitimacy theory might explain partial compliance with SEER regulation. (shrink)

In a range of peace process scenarios, the expert’s knowledge has become a fundamental tool for generating information systems as a mechanism for the storage and circulation of data. These information artifacts are supposed to faithfully document situations of human rights violations and contribute to the design of public policy and the construction of collective memory. Following Latour’s (1993) original coinage of the term coproduction, this paper analyzes how the Inter-Institutional System of Information for Justice and Peace (SIIJYP)1 was designed (...) to define victims of war and means of reparation from the State in Colombia. From an actor network theory perspective, we explain how victimizers become the main beneficiaries of the application of the SIIJYP. To comprehend this unintended social impact of the technological artifact and how it becomes an artifact that functions as an aseptic mediator of the historical-judicial truth, and the policy of transitional justice, we examine the relations between human and nonhuman actors, how information is collected, organized, hierarchized, and negotiated, as well as the consequences of the technical and legal construction of the notion of victims of war. This paper investigates experimentally the effects of communication in distinct games with complete information. We design four games resulting from the interaction between two incentive elements: strategic complementarity and coordination. These incentive elements allow to analyse the use of cheap talk as an efficiency-enhancing and coordinating device. We implement a restricted communication protocol in repeated settings with fixed partners. Our findings provide robust evidence about how cheap talk interacts with incentives to explain strategic behaviour in a dynamic way. As expected, (...) cheap talk increases efficiency under complementarity incentives, and the coordination level under coordination incentives. As novelty, the use of limited communication in repeated interactions has led to identify specific time-varying message profiles as the most effective messages in the coordination games. While the content of messages is explained by the complementarity incentives, faithfulness to credible messages is determined by the coordination incentives. (shrink)

From an early age, exposure to a spoken language has allowed us to implicitly capture the structure underlying the succession of speech sounds in that language and to segment it into meaningful units. Statistical learning, the ability to pick up patterns in the sensory environment without intention or reinforcement, is thus assumed to play a central role in the acquisition of the rule-governed aspects of language, including the discovery of word boundaries in the continuous acoustic stream. Although extensive evidence has (...) been gathered from artificial languages experiments showing that children and adults are able to track the regularities embedded in the auditory input, as the probability of one syllable to follow another syllable in the speech stream, the developmental trajectory of this ability remains controversial. In this work, we have collected Event-Related Potentials while 5-year-old children and young adults were exposed to a speech stream made of the repetition of eight three-syllable nonsense words presenting different levels of predictability to mimic closely what occurs in natural languages and to get new insights into the changes that the mechanisms underlying auditory statistical learning might undergo through the development. The participants performed the aSL task first under implicit and, subsequently, under explicit conditions to further analyze if children take advantage of previous knowledge of the to-be-learned regularities to enhance SL, as observed with the adult participants. These findings would also contribute to extend our knowledge of the mechanisms available to assist SL at each developmental stage. Although behavioral signs of learning, even under explicit conditions, were only observed for the adult participants, ERP data showed evidence of online segmentation in the brain in both groups, as indexed by modulations in the N100 and N400 components. A detailed analysis of the neural data suggests, however, that adults and children rely on different mechanisms to assist the extraction of word-like units from the continuous speech stream, hence supporting the view that SL with auditory linguistic materials changes through development. Spain’s Roma community has its own cultural and moral values. These values influence the way in which end-of-life decision-making is confronted. The objective of this study was to explore the perspective of Roma women on end-of-life decision-making. It was a qualitative study involving thirty-three Roma women belonging to groups for training and social development in two municipalities. We brought together five focus groups between February and December 2012. Six mediators each recruited five to six participants. We considered age and care (...) role to be the variables that can have the most influence on opinion regarding end-of-life decision-making. We considered the discussion saturated when the ideas expressed were repeated. Data analysis was carried out according to five steps: describing, organizing, connecting, corroborating/legitimating, and representing the account. The main ideas gleaned from the data were as follows: the important role of the family in end-of-life care, especially the role of women; the large influence of community opinion over personal or family decisions, typical of closed societies; the different preferences women had for themselves compared to that for others regarding desired end-of-life care; unawareness or rejection of advance directives. Roma women wish for their healthcare preferences to be taken into account, but “not in writing.” The study concluded that the success of end-of-life healthcare in Roma families and of their involvement in the making of healthcare decisions depends upon considering and respecting their idiosyncrasy. Se levantan cada vez más puentes sobre ambos períodos y a diario se publican estudios que desgranan detalles fascinantes. La enorme influencia que tuvieron los antiguos sobre los filósofos idealistas, la mirada de los poetas que anhelaban ese ancestral esplendor, las ideas del pasado y su vigencia en el presente son algunas de las cuestiones estudiadas sobre la Grecia Antigua y la filosofía clásica alemana. ¿Por qué, entonces, surgió la idea de una monografía relacionada con la naturaleza? El propósito principal de este artículo es ofrecer una primera respuesta a dicha pregunta con base en una revisión preliminar de periódicos y revistas que permiten considerar el problema planteado desde una perspectiva más amplia.En breve, el argumento central que se va a desarrollar es que la construcción de esa autoría pasó por tres etapas: en la primera, durante las décadas de 1840 (...) y 1850, tal proceso se basó en la redacción de anuncios comerciales; en la segunda, centrada en los decenios de 1860 y 1870, predominaron los discursos de alumnas y maestras relacionados con actividades de enseñanza; y en la tercera, ubicada a partir de 1885, se dieron dos tendencias paralelas. Por un lado, algunas docentes comenzaron a dar a conocer sus producciones literarias; y por el otro, el Estado, en vísperas de la reforma educativa de 1886, implementó una política para que las educadoras oraran informes de sus actividades escolares y los enviaran a una revista especializada para ser publicados. Este artículo se centra en un aspecto comparativamente poco estudiado de la literatura sobre comunicación política en México relativo al análisis de los cambios significativos en la organización, las tácticas y las estrategias de campaña del Partido Revolucionario Institucional en elecciones presidenciales que han ocurrido durante las últimas dos décadas, y explora sus causas. El estudio muestra que la profesionalización e hibridación de las campañas del PRI no sólo dependió de cambios estructurales a gran escala en el sistema político y (...) en el sistema de medios de comunicación durante los noventas, sino también de los recursos y las características organizativas del partido. El desarrollo de la argumentación en el proceso de alfabetización académica cobra especial importancia debido a que el conocimiento académico es esencialmente argumentativo. Por esto, el objetivo de esta investigación es, por un lado, relevar, a partir del discurso de los docentes en un programa de Biología e Historia, las representaciones sociales acerca de la enseñanza-aprendizaje de la argumentación y, por otro, generar un modelo explicativo de este fenómeno. La recolección de datos se realizó por medio de entrevistas a docentes (...) de ambas disciplinas y el análisis de ellos, mediante la técnica de análisis de contenido, la que busca formular inferencias reproducibles y válidas que puedan aplicarse a un contexto determinado. The development of argumentation in the process of academic literacy is particularly important because scientific knowledge is essentially argumentative. For this reason, the purpose of this research is to elicit social representations about teaching and learning of argumentation from the discourse of teachers in a program of Biology and History, as well as to generate an explanatory model for this phenomenon. The data collection instrument used was an interview to teachers in both disciplines, and the data was analyzed using content analysis, a technique that seeks to develop replicable and valid inference that can be applied to a given context. Bourrat and Griffiths :33, 2018) have recently argued that most of the evidence presented by holobiont defenders to support the thesis that holobionts are evolutionary individuals is not to the point and is not even adequate to discriminate multispecies evolutionary individuals from other multispecies assemblages that would not be considered evolutionary individuals by most holobiont defenders. They further argue that an adequate criterion to distinguish the two categories is fitness alignment, presenting the notion of fitness boundedness as a criterion that (...) allows divorcing true multispecies evolutionary individuals from other multispecies assemblages and provides an adequate criterion to single out genuine evolutionary multispecies assemblages. A consequence of their criterion is that holobionts, as conventionally defined by hologenome defenders, are not evolutionary individuals except in very rare cases, and for very specific host-symbiont associations. This paper is a critical response to Bourrat and Griffiths’ arguments and a defence of the arguments presented by holobiont defenders. Drawing upon the case of the hologenomic basis of the evolution of sanguivory in vampire bats, I argue that Bourrat and Griffiths overlook some aspects of the biological nature of the microbiome that justifies the thesis that holobionts are evolutionarily different to other multispecies assemblages. I argue that the hologenome theory of evolution should not define the hologenome as a collection of genomes, but as the sum of the host genome plus some traits of the microbiome which together constitute an evolutionary individual, a conception I refer to as the stability of traits conception of the hologenome. Based on that conception I argue that the evidence presented by holobiont defenders is to the point, and supports the thesis that holobionts are evolutionary individuals. In this sense, the paper offers an account of the holobiont that aims to foster a dialogue between hologenome advocates and hologenome critics. (shrink)

Fue para ellos, sobre todo ejemplo, ejemplo de vida, de orientación vital, de sinceridad intelectual en su quehacer filosófico. En este artículo no analizamos la filosofía de Ortega, lo que hemos hecho en otros textos, sino el impacto que causó la «persona» Ortega en sus colaboradores y discípulos. Este estudio es una aproximación al tema del trabajo desde el pensamiento sociológico de Zygmunt Bauman. Uno de los textos más conocidos de Bauman al respecto es Trabajo, consumismo y nuevos pobres; sin embargo, este es un tema que el sociólogo trata en otras obras. Aquí se pretende dar una visión en la que se tienen en cuenta la globalidad de sus escritos. Además, se dan unas claves que permiten comprender el enfoque que Bauman tiene del trabajo: se hace una (...) breve explicación de su perspectiva sociológica y de la importancia de la modernidad en su pensamiento. The German word Destruktion was used by Heidegger in the sense that philosophy should destroy some ontological concepts and the everyday meanings of certain words. Tradition allows the transmission of knowledge and sensations of continuity and connection with the past, but it must be critically evaluated so that it does not perpetuate certain prejudices. According to Heidegger, tradition transmits, but it also conceals. Tradition induces self-evidence and prevents us from accessing the origin of concepts. It makes us believe that we (...) do not need to return to that origin. Making tradition transparent dissolves the concealments it has provoked. Here I will apply this idea to the mental and the physical by suggesting that the mind-body problem has inherited occultations that are born in Descartes himself. As a result, what could be a new philosophical framework for the research in consciousness emerges: That as an individual cognitive being I cannot avoid splitting reality into what I am and what I am not, extending then the individual duality to a collective error transmitted culturally. What is the so-called “question of ontology?” Is the question of ontology genuinely a question about “categories” (Lowe 2006), “structure” (Sider 2011), “existence” (Thomasson 2015), or rather “reality” (Fine 2009)? In this article, I defend the neo-Sellarsian approach to the question of ontology, a novel, naturalistic approach according to which the foundational question of ontology is about “understanding the manifest and the scientific images of the world, and their multiple relationships.” First, I argue for the thesis of Impure Eliminativism, a (...) form of constructive pluralism about the question of ontology by which the substantivity of questions of ontology which are not the neo-Sellarsian one is to be built upon certain relations with the neo-Sellarsian question of ontology. Second, I argue for the categorial plasticity of the two images and their relations in connection with the hypothesis of Weak Epistemic Factualism. Third, and lastly, I argue for a person-based ontology framed in terms of the crucial notions of “fact” and “understanding” in response to the eliminativist categorizations of the two images and their relationships proposed by substantialism and structuralism. The paper defends an interactive theory of the distinctiveness of criminal law. It argues that criminal law’s distinctive behavior can be connected to the interaction between five traits: it is an institutional practice administered by a large and special bureaucracy, playing a substantial role in authorizing the use of coercive police force, leading to a harsh sanctioning regime linked, at least in part, with core wrongs and notions of personal responsibility. Although none of these features is exclusive to criminal law, (...) their interaction leads to modes of behavior that set it apart from other institutions. The paper argues that putting attention on the effects of this interaction provides us with powerful tools to both understand and asses the value and problems of criminal law. (shrink)

Mental body-representations are highly plastic and can be modified after brief exposure to unexpected sensory feedback. While the role of vision, touch and proprioception in shaping body-representations has been highlighted by many studies, the auditory influences on mental body-representations remain poorly understood. Changes in body-representations by the manipulation of natural sounds produced when one's body impacts on surfaces have recently been evidenced. But will these changes also occur with non-naturalistic sounds, which provide no information about the impact produced by or (...) on the body? Drawing on the well-documented capacity of dynamic changes in pitch to elicit impressions of motion along the vertical plane and of changes in object size, we asked participants to pull on their right index fingertip with their left hand while they were presented with brief sounds of rising, falling or constant pitches, and in the absence of visual information of their hands. Results show an "auditory Pinocchio" effect, with participants feeling and estimating their finger to be longer after the rising pitch condition. These results provide the first evidence that sounds that are not indicative of veridical movement, such as non-naturalistic sounds, can induce a Pinocchio-like change in body-representation when arbitrarily paired with a bodily action. Are properties universal or particular? According to Universalism, properties are universals because there is a certain fundamental tie that makes properties capable of being shareable by more than one thing. On the opposing side, Particularism is the view that properties are particulars due to the existence of a fundamental tie that makes properties incapable of being shared. My aim in this paper is to critically examine the connections between the notions of the fundamental tie and universality and particularity. I argue, (...) first, that universality and particularity can characterize a property if and only if there is a universalist or a particularist fundamental tie, and, second, that it is unclear that these should be the fundamental ties that connect ordinary and scientific properties to their respective bearers. Then I develop an alternative approach to properties and the fundamental tie, which is neutralist because it dispenses with universality and particularity as features of properties, and naturalist because it naturalizes the possession of properties by replacing metaphysical fundamental ties with a scientific one, in particular, a physical process. I show how this approach improves our understanding of properties and instantiation. (shrink)

1. Categories and the Scientific Turn of Metaphysics: The Notion of World-Fundamentality What are the fundamental inhabitants of the world? This question, as old as it is new, is about the fundamental structure of our world. Is our world a world of Aristotle's ordinary substances, Locke's physical substances, Husserl's wholes, Wittgenstein's facts, Sellars's processes, or Quine's sets? In order to distinguish the sort of metaphysical fundamentality at stake in this discussion from other possible types of fundamentality, I shall call it (...) from now on "world-fundamentality." In this article I want to make a proposal in the context of this metaphysical dispute. The proposal is the addition of a new criterion of world-fundamentality to the existing catalog of independence and simplicity, among some other prominent classical examples. I call this criterion "the materialist criterion of world-fundamentality" because it states that metaphysicians should not decide the question of whether our world is a world of facts rather than a world of sets or other categories without considering the explanatory power of such categories to account for the relation between "the manifest image" and "the scientific image," to use the words of Wilfrid Sellars. Aristotle's Ethics develops a complex theory of the qualities which make for a good human being and for several decades there has been intense discussion about whether Aristotle's theory of voluntariness, outlined in the Ethics, actually delineates what modern thinkers would recognize as a theory of moral responsibility. Javier Echeñique presents a novel account of Aristotle's discussion of voluntariness in the Ethics, arguing - against the interpretation by Arthur Adkins and that inspired by Peter Strawson - that he developed (...) an original and compelling theory of moral responsibility and that this theory has contributed in important ways to our understanding of coercion, ignorance and violence.
