This paper focuses on a crucial and insufficiently examined issue of the conflict between legality and legitimacy, seen as a key element in securing continuity and providing the intellectual justification of the Francoist regime. Without analyzing the tension between legality and legitimacy, it is impossible to comprehend and successfully dismantle the thesis of the regime's intellectuals, recently revitalized by revisionist historians, according to which Francoism succeeded in re-establishing historical continuity and political normalcy in Spanish society. In the context of the (...) Cold War, it was crucial for Spanish legal scholars to portray Francoism not as a bastion of anti-liberalism, but as a regime whose survival entailed an original interpretation of notions such as freedom, rule of law, sovereignty and authority. They argued that the significance of Francoism consisted not only in defeating liberalism in Spain but in offering an alternative interpretation of its main tenets. By aspiring to justify and overcome its own historical exceptionality, the Francoist regime sought to avoid the inevitability of its demise. By virtue of its failure to do so, Francoism remained outside the European political norm, to which only democratic Spain would be re-admitted. (shrink)

Películas como El proyecto de la bruja de Blair, Actividad paranormal y REC han desarrollado este recurso para emerger una impresión de realismo en la trama de estos largometrajes al momento de ser proyectados. Así como esta técnica, la investigadora propondrá otras categorías vigentes, tales como las de las monstruas (...) o los filmes estribados en un horror noire. De esa manera, queda constancia de que esta conversación permitirá a los lectores tener un conocimiento más profundo sobre este tema del terror, que a muchos no deja de cautivar. (shrink)

El metaverso, como nuevo espacio prometido de interacción social, no configura en sí mismo la posibilidad del encuentro, porque no es el espacio lo que propicia el “entre” sino la disposición de las personas. Por ello en este artículo se dirige la mirada al interior del ser humano y se centra en la reflexión ética del ser en el estar; precisamente, porque toda herramienta configura un nuevo ethos con el sujeto. En primer lugar, tras problematizar la pregunta por el metaverso, (...) se desarrolla el concepto de relación social, para pasar, en segundo lugar, al espacio como configurador de la utopía y a la pregunta de cómo el ser humano se construye en lo que él mismo crea. De esta manera, se llega al último punto, en el que se plantea que la promesa del metaverso no guarda en sí misma la posibilidad de ser mejores personas, sino que, en cuanto herramienta, depende exclusivamente del uso que se le dé. Este trabajo parte de la entrevista realizada a Rafael Courtoisie, tesorero de la Academia Nacional de Letras de Uruguay. El propósito de este manuscrito consistió en que el intelectual brindara un panorama de la producción literaria de su país a lo largo de la historia. Asimismo, su trayectoria que tiene como investigador y crítico de la Literatura permitió que pudiera ahondar en valoraciones que atañen a temas un tanto controversiales, como los pueden ser las entregas del Premio Nobel de Literatura, (...) la consolidación y la permanencia de un canon representativo en cada país o la realización de propuestas novedosas en torno a autores clásicos, como Dante Alighieri. En este artículo examino las posiciones de McDowell y Davidson acerca del dualismo de esquema y contenido. Defiendo que este dualismo no puede recuperarse de las críticas de Davidson incluso en la sugestiva forma defendida por McDowell. Defiendo que McDowell falla al evaluar el verdadero alcance y significado de los argumentos davidsonianos y que su empirismo mínimo no puede evitar algunos de los problemas que otras posiciones empiristas muestran.

Esta entrevista se realizó en dos sesiones vía Zoom, cuyas fechas están ubicadas en agosto de 2021. La primera conversación que se tuvo consistió en que el filósofo Modesto Gómez Alonso brindara unas ideas panorámicas y reflexivas, las cuales se han colocado al inicio de cada resolución. Entretanto, en la segunda conversación, se partió de lo planteado anteriormente y de algunos apuntes que permitieron esbozar de una forma más contundente las respuestas. Todo este procedimiento sirvió para que se pudiera tratar (...) sobre la noción de la epistemología desde sus múltiples manifestaciones. Es por eso por lo que el filósofo Modesto Gómez recurrió a concepciones afines, como aquellas que proporcionan el conocimiento, al igual que buscó explicar con mayor detalle al citar a autores como Descartes, Sosa, entre otros. En ese sentido, esta entrevista tuvo el propósito de buscar las conexiones que existen de la Filosofía con la vida cotidiana en cuanto a que se indaga de las posibilidades de contribuir al conocimiento y contar con las herramientas adecuadas. The combination of student Self-Regulation (SR) and the context of Regulatory Teaching (RT), each in varying degree, has recently been demonstrated to have effects on achievement emotions, factors and symptoms of stress, and coping strategies. The aim of the present research study is to verify its possible further effects, on academic behavioral confidence and procrastination. A total of 1193 university students completed validated online questionnaires with regard to specific subjects in their degree program. Using an ex post facto design, multivariate (...) analyses and structural equation modeling (SEM) were carried out in order to test the relationships predicted by the model. SR and RT had a significant joint effect in determining the degree of academic behavioral confidence and of procrastination. Academic behavioral confidence also significantly predicted reasons for procrastinating, and these in turn predicted activities of procrastination. Conclusions are discussed, insisting on the combined weight of the two variables in determining academic behavioral confidence, reasons for procrastinating and activities subject to procrastination, in university students. Implications for guidance and educational support of university students and teachers are analyzed. (shrink)

El autor Luis Rodríguez Manzanera propone el concepto de macrocriminalidad al referirse a una etapa histórica que involucra el desarrollo de manifestaciones delictivas, que se mantienen por una justificación sociopolítica y que implica a toda una sociedad. Esta definición fue propicia incorporarla para el análisis de Noticia de un secuestro (1996), debido a que, en esta novela periodística, se narran sucesos vinculados con acciones subversivas que respaldan el tráfico ilícito de drogas, junto con atentados que provocó Pablo Escobar, organizador del (...) Cartel de Medellín (Colombia), a las entidades gubernamentales. Algunos indicadores que se apropian a esta conceptualización son la violencia, la locura y el narcoterrorismo. (shrink)

Esta investigación forma parte de un Proyecto de Innovación Docente de la Universidad de Málaga (PIE19-179) que se inició en 2019 y que continuó en 2022 con el grupo de investigación PROCING de la Universidad de Huila-CORHUILA. El objetivo era tratar de desarrollar en el alumnado universitario el pensamiento crítico a través de la lectura crítica y la metodología Scrum como estrategias. La recopilación de datos se llevó a cabo con un cuestionario dividido en cuatro dimensiones y compuesto por 68 (...) ítems. Si bien los resultados del post-test en ambas universidades no son significativos, hubo un aumento en las respuestas a «siempre» en un 4% para los participantes de la Universidad de Málaga (España) y de un 6% en los estudiantes de la Universidad de Huila-CORHUILA (Colombia). Religion and spirituality (R/S) serve as coping mechanisms for circumstances that threaten people’s psychological well-being. However, using R/S inappropriately to deal with difficulties and problems in daily life may include the practice of Spiritual Bypass (SB). SB refers to avoiding addressing emotional problems and trauma, rather than healing and learning from them. On the other hand, coping strategies may be determined by the cultural context. This study aims to describe the presence of SB in individuals who may have experienced stressful (...) situations and to understand the influence of culture on SB by comparing SB in two culturally different groups. The sample consists of a total of 435 people, 262 of Honduran nationality and 173 of Spanish nationality. Both groups are approximately equivalent in age and gender. The degree of SB, stressful events, perception of social support and spiritual well-being are examined, respectively, through the Spiritual Bypass Scale, and specific items and subscales from the Social Readjustment Rating Scale, Multidimensional Scale of Perceived Social Support, and the Functional Assessment of Chronic Illness Therapy - Spiritual Wellbeing. The results showed a higher spiritual well-being and use of SB in the Honduran sample as compared to the Spanish sample, but similar social support and stressful events. Furthermore, some of the factors predicting SB were different between the two samples. While age and a greater number of R/S practices were important in both samples, for the Honduran sample the variables that best explained SB were being a Christian, having greater social support, fewer stressful events, and greater attendance at church or temple. For the Spanish sample, however, the variable that best explained SB was studying R/S texts. Therefore, SB must be understood within the culture in which it develops, since in different cultural contexts it appears to relate to differing factors. Thus, SB becomes a possible functional or dysfunctional coping strategy depending on the social context. (shrink)

The self- vs. external-regulation behavior theory, SR-ER Theory model has postulated the Self-Regulation /Non or De-Regulation/Dys-regulation continuum in the person and in their context. The model also generates a behavioral heuristic that allows us to predict and explain the variability of other dependent behavioral variables in a range of scenarios. Consequently, the objective of this study was to validate the different scales prepared on the basis of the theory presented. A total of 469 students voluntarily completed at different times the (...) five questionnaires presented, to give a total of 1,385 completed questionnaires. Using an ex post facto design, descriptive, correlational, confirmatory factorial analysis, reliability, and concurrent validity analyses were carried out. The scales were analyzed individually and as a whole. The results showed the acceptable structure of scale and consistent levels of reliability. The five levels generated by the SR-NR-DR combinatory heuristic that arises from the theoretical model determined significant differences in the levels of the variables analyzed for each psychological context. We discuss the theoretical implications and the implications for the assessment and improvement of the behaviors analyzed in function of the personal and contextual regulation levels evaluated. Pretendemos con este texto explorar la presencia y función, a veces problemática y contradictoria, del pensamiento orteguiano y de algunos de los conceptos fundamentales de su circunstancialismo, en su trasvase directo –vía sus reflexiones argentinas– o su trasplante críticamente mediado –vía México–, a tierras americanas. La relevancia en la promoción y justificación del pensamiento filosófico latinoamericano moderno y actual de las ideas orteguianas adquieren especial interés cuando son indagadas en los años cruciales del inicio del destierro español en México.

A necessary condition for a group being taken as a rational agent is that its choices and judgements are ‘logically contestable’, but this can lead to problems of aggregation, as Arrow impossibility theorem or the discursive dilemma. This paper proposes a contractarian or constitutional approach: the relevant thing is what aggregation mechanisms would be preferred by the members of the group. Two distinctions need to be made: first, judgement aggregation is not aggregation of decisions, and judgement aggregation needs be distinguished (...) from the aggregation of information: we assume that every member of the group has already taken into account the opinions of the other members, by means of a process of public deliberation, but they may end having different opinions; we also assume that the members are rational, so that they have no reasons to accept further changes in their individual opinions. So, from the epistemic point of view, the collective judgment is not a 'better' opinion than those of the individual members. The collective judgement is better seen as a kind of compromise, the outcome of a ‘bargain’, so to say. Basically, we assume that individuals will have an interest in choosing a specific aggregation function by taking into account how are they affected by the collective actions carried out by the group, and grounded on the chosen collective judgement. El presente artículo demuestra como el uso de los cuadernillos de trabajo se convierten en una herramienta importante de las estrategias docentes para la enseñanza y aprendizaje del inglés en el CECyTEC. El aumento en los índices de aprobación en este campo disciplinar muestran que esta estrategia tiene un impacto positivo al implementarse en los diferentes planteles y que esta metodología en un futuro pudiera ser implementada en otros estados. Se llega a esta conclusión a través de varios ensayos; se (...) inicia con este proyecto en septiembre de 2020, no propiamente como cuadernillo sino como una compilación de actividades y ejercicios, mismos que no tuvieron un gran impacto en los estudiantes, ya que las oraciones, textos y ejemplos eran ajenos a su cotidianidad o realidad inmediata, se carecía de gráficos o imágenes que ayudaran a focalizar la atención del joven, así como también la ausencia de enlaces o links para que el estudiante siguiera practicando el contenido en cuestión. A partir del semestre febrero-junio 2021 se realizan todos estos “ajustes/modificaciones” resultando más atractivos en contenido y diseño. (shrink)

En la vida cotidiana del ejercicio del derecho, ya sea en el campo de la judicatura, ora en el del litigio, bien sea en el de la academia, o en actividades administrativas, es bastante común que se hable de la prueba sumaria; pero desafortunadamente no es común que se tenga plena conciencia de su entidad, alcances y usos conforme a su propia naturaleza. Es preocupante observar la peligrosa y antijurídica ligereza, con la cual se acude a la prueba sumaria; pero (...) no para darle su natural uso, sino para superar omisiones de los sujetos procesales con interés de parte en el cumplimiento de las cargas probatorias. La prueba sumaria es utilizada en forma deliberada para conseguir ciertas ventajas probatorias en el proceso, con evidente desmedro del derecho de prueba de la contraparte, afectación de la garantía de la igualdad real de las partes en el proceso, y conculcación del derecho de defensa en toda su extensión. En realidad, el mal uso de la prueba sumaria implica violar los principios probatorios de necesidad, publicidad, contradicción, legalidad y formalidad de la prueba. En otros términos, la utilización indiscriminada de la prueba sumaria, sin el cuidado y la estrictez exigidos expresamente por el mismo legislador para poder usarla, constituye una manifiesta violación al derecho constitucional fundamental al debido proceso. Growing evidence in recent years has led to an agreement on the importance and benefits that inclusive education has for students with special educational needs (SEN). However, the extension and universalization of an inclusive approach will also be enhanced with more evidence on the benefits that inclusion has for all students, including those without SEN. Based on the existing knowledge that learning interactions among diverse students are a key component of educational inclusion, the aim of this study is to identify (...) the impact on students without SEN of being educated with students with SEN in shared, inclusive, interactive learning environments. Data were collected in three schools using a qualitative approach with a communicative orientation. Semistructured interviews were held with teachers as well as community volunteers participating in the schools. Further, focus groups were conducted with students and teachers. The results show that students without SEN benefit from participating in interactive learning activities with peers with SEN in different ways: (1) they learn to respect others, accept differences, and acknowledge different abilities, thereby creating opportunities for new friendships to develop; (2) they learn about abilities related to helping others participate and learn, to be patient and to gain the satisfaction in helping others learn and behave better; and (3) they benefit from the cognitive effort required to explain themselves and from the contributions of peers with SEN from which they can learn. El artículo 270.2 del Código penal español hace responsables a los prestadores de servicios intermediarios cuando existe una facilitación activa y no neutral de un comportamiento infractor en las obras protegidas por copyright. Ello se ha traducido en un mecanismo incierto que fomenta la colaboración acrítica con los titulares del copyright sin ponderar de forma adecuada la creatividad social a través del uso transformativo de la obra. Este artículo propone un análisis de la autoría como signo distintivo con la finalidad (...) de corregir esta incertidumbre normativa mediante una interpretación restrictiva del derecho de uso exclusivo eliminando los usos derivados como fuente generadora de una obligación de actuar, y a la vez, reconociendo la necesidad de un mecanismo de contra-notificación que permita al supuesto infractor una defensa efectiva de sus intereses sin que ello implique la pérdida de la condición de actor neutral. Verisimilitude theorists (and many scientific realists) assume that science attempts to provide hypotheses with an increasing degree of closeness to the full truth; on the other hand, radical sociologists of science assert that flesh and bone scientists struggle to attain much more mundane goals (such as income, power, fame, and so on). This paper argues that both points of view can be made compatible, for (1) rational individuals only would be interested in engaging in a strong competition (such as that (...) described by radical sociologists) if they knew in advance the rules under which their outcomes are to be assessed, and (2), if these rules have to be chosen "under a veil of ignorance" (i.e., before knowing what specific theory each scientist is going to devise), then rules favoring highly verisimilar theories can be prefered by researchers to other methodological rules. Paradoxes arises in self-referential language if a new perception cannot be adequately described. A solution is only possible by revising the categorical system as well as the language. This work focuses on the second aspect. The non-standard, modal proposals for the above-mentioned semantic paradoxes fall to completely satisfy both aspects since, as we still demonstrate, the language becomes self-restricting, which then bears serious consequences.
