We modify the payment rule of the standard divide the dollar (DD) game by introducing a second stage and thereby resolve the multiplicity problem and implement equal division of the dollar in equilibrium. In the standard DD game, if the sum of players’ demands is less than or equal to a dollar, each player receives what he demanded; if the sum of demands is greater than a dollar, all players receive zero. We modify this second part, which involves a harsh (...) punishment. In the modified game $(D\!D^{\prime })$ , if the demands are incompatible, then players have one more chance. In particular, they play an ultimatum game to avoid the excess. In the two-player version of this game, there is a unique subgame perfect Nash equilibrium in which players demand (and receive) an equal share of the dollar. We also provide an $n$ -player extension of our mechanism. Finally, the mechanism we propose eliminates not only all pure strategy equilibria involving unequal divisions of the dollar, but also all equilibria where players mix over different demands in the first stage. In the vast expanse of classical Arabic literature, the works of Abū Dhu’ayb al-Hudhalī stand out, particularly his elegies, which provide a pro-found glimpse into the sociocultural dynamics of his era. The research presented in this article delves deep into the life and artistry of Abū Dhu’ayb, meticulously examining how his personal experiences and surroundings shaped his poetic expressions. Elegies, often characterized by their mournful tone and reflective nature, become especially significant in Abū Dhu’ayb’s repertoire as they offer poetic lamentations (...) and provide insight into the world in which he lived. The subject of this research focuses on Abū Dhu’ayb’s elegies, providing an in-depth literary analysis, and aiming to discern the intricate interplay between his life’s events and his poetic manifestations. By situating Abū Dhu’ayb’s elegies within the broader canvas of classical Arabic poetry, this research seeks to shed light on their distinct characteristics, thematic concerns, and stylistic nuances. Within the scope of this article, special attention is given to his deeply moving elegy dedicated to his sons. Drawing from a wide spectrum of his poems, we ensure a comprehensive understanding of Abū Dhu’ayb’s unique approach to the art of elegy. The rationale for this inquiry becomes particularly salient when we position Abū Dhu’ayb within the milieu of his literary peers. Although numerous poets of his era ventured into the domain of elegy, Abū Dhu’ayb’s compositions stand apart, characterized by their intimate resonance and the intricate threads of narrative woven seamlessly into his poetic tapestry. Engaging with overarching themes of fate, destiny, honor, and the human condition, his works do more than just lament the loss of loved ones or ponder the transient nature of life. Through this research, we aim to elevate the understanding of Abū Dhu’ayb’s contribution to Arabic literature and underscore the importance of his elegies as both literary mas-terpieces and historical documents. The primary purpose of this study is twofold. Firstly, it seeks to explore the artistic depth and breadth of Abū Dhu’ayb’s elegies, understanding their thematic richness and linguistic excellence. Secondly, the study aims to draw connections between the poet’s life—a life replete with its share of joys, sorrows, triumphs, and tribulations—and the elegies he crafted. By doing so, the research offers a holistic view of the poet, not just as a literary figure but also as a person deeply affected by the world around him. The methodological framework employed in this research is rooted in both literary analysis and historical contextualization. By closely reading Abū Dhu’ayb’s elegies, the research deciphers their symbolic and metaphorical elements, laying bare the poet’s craft. Concurrently, by positioning these elegies within their historical context, the study provides a broader understanding of the socio-political and cultural milieu of Abū Dhu’ayb’s era. This dual approach ensures a well-rounded exploration, enabling readers to appreciate the elegies both as individual pieces of art and as part of a larger poetic tradition. Since the time Plato wanted to banish poetry from his ideal state by accusing Homer of “imitation”, the tension between poetry and philosophy has made itself evident. Our study aims to rethink this highly controversial relationship and to question the relationship between logic, which is the basis of the intellectual sciences, directly connected to logos, and poetry, which is seen as closer to sensation and to “mythos”. This questioning about the possibility of logical thinking through poetics will be realized through (...) language, logic and poetics. In this context, our discussion ground will be the reception of Aristotle’s Poetics, which is accepted as the first work of philosophy of art, in Islamic philosophy, specifically in Avicenna. While commenting on Aristotle, muslim logicians and Avicenna included poetry in logic by placing Poetics in the Organon. This very inclusion invites us to think about the logical status of poetry for Avicenna. In this context, the question we will pursue with Avicenna will be essentially: What is the logical status of poetry and what is the possibility of poetic syllogism? According to Avicenna, poetry is related to the “possibles”, and in this respect, it allows to consider being and non-being together. While poetry addresses imagination, the fact that the imagination is between the sensation and the intellect, makes poetry’s position of “mediator” valuable. In order to show what this position means, we will try to discuss the relationship between poetry and logic through a number of basic themes of the Avicennian philosophy, such as powers of the soul, the relationship between sensation-imagination-intellect, the distinction of essence-existence, the importance of imitation, and types of syllogism. Finally, we will discuss, through particular examples, the place given to the poetry, and examine the possibilities of poetry and the relationship between the poetic and the logical, in terms of the aforementioned theory of poetry. Bu çalışmanın amacı, kent kültürü ve kentlilik bilincinin gelişmesi noktasında kentin merkezi ve yerel yönetimlerine ait kurum ve kuruluşlarının, Erzincan Binali Yıldırım Üniversitesi akademik personelini ne derecede dikkate aldıklarını belirlemek, akademik personelin kent kültürü ve kentlilik bilincinin gelişimi konusundaki algı düzeylerini ortaya çıkarmak ve araştırma bulgularına dayalı olarak önerilerde bulunmaktır. Araştırmanın çalışma evrenini, Erzincan Binali Yıldırım Üniversitesi’nde görev yapan 1.086 akademik personel oluşturmaktadır. Çalışmaya Erzincan ilçelerinde bulunan yüksekokul ve meslek yüksekokulları zaman darlığı ve ulaşım zorluklarından dolayı dahil edilmemiştir. Gerek yerleşkede (...) gerekse yerleşke dışında bulunan tüm fakülte, yükse okul ve meslek yüksek okullarına anket formları elden ulaştırılmıştır. Tıp fakültesi ve Sağlık Hizmetleri yüksekokulu yöneticilerinin çalışmaya katkı vermek istememelerinden dolayı bu iki birim kapsamdışı tutulmuştur. Anket formları 268 kişi tarafından doldurulmuştur. Veri toplama aracı olarak nicel araştırma tekniği olan tarama deseni (anket deseni) kullanılmıştır. Anket soruları Belli ve Aydın’ın (2017) “Kent Kültürü ve Kentlilik Bilincinin Oluşumunda Üniversitelerin Rolü: Mustafa Kemal Üniversitesi Örneği” adlı çalışmasından alınmıştır. Araştırmada elde edilen verilerin çözümlenmesinde, sosyal bilimlerde istatistiksel analiz için oldukça yaygın olarak tercih edilen SPSS programı kullanılmıştır. Araştırma sonucuna göre; Erzincan Binali Yıldırım Üniversitesi akademik personeline, kent kültürü ve kentlilik bilincinin geliştirilmesi konusunda kentte yer alan diğer paydaşlar tarafından (merkezi ve yerel yönetimlere ait kurum ve kuruluşlar) hak ettikleri değerin verilmediği sonucu ortaya çıkmıştır. Causal knowledge unquestionably provides useful means to describe, explain and predict both natural and daily phenomena. This article addresses whether causality as such may not be ontologically primary and looks for an alternative fundamental mechanism encapsulating the information load of the causal framework. A probabilistic process view of reality asserting the struggle of natural forces is considered along with lines quoted from Nietzsche’s posthumously published notebooks and published work. Examples from scientific discoveries, in particular neurosciences, echoing his ontology are provided. (...) Furthermore, I propose a basic number game algorithm to illustrate and model the struggle of forces leading to causal inferences for an external observer. Nietzschean dynamic ontology involving the ceaseless struggle of will-to-power units accords with the emergentist approach to causation, which has been principally employed by the scientists working under the fields of thermodynamics, quantum mechanics and complex dynamical systems. Bu makalede, Abbâsî dönemi şairlerinden İbnu’r-Rûmî’nin Abbâsî hanedanlığının bir üyesi olan Abdülmelik b. Sâlih için nazmettiği methiyesinin tematik bir incelemesinin yapılması planlanmaktadır. Bu analiz, İbnu’r-Rûmî’nin methiyesinin karmaşık katmanlarına derinlemesine bir bakış sağlamaktadır. Methiye, bilhassa Abbâsî döneminin Arap edebî geleneğinde önemli bir yeri bulunan şiirsel bir ifade biçimidir. Yapılan çalışmanın konusu, methiyedeki tematik unsurların araştırılmasına ve İbnu’r-Rûmî’nin hem övgüsel hem de eleştirel anlayışa sahip bir anlatı oluşturmak için dili ve imgeleri nasıl kullandığının ortaya çıkartılmasına dayanmaktadır. Araştırmanın kapsamı, bahis mevzu methiyenin tarihî (...) ve kültürel arka planı bağlamında anlaşılmasının sağlanmasına kadar uzanmaktadır ve Abbâsî döneminin toplumsal normlarının, değerlerinin ve beklentilerinin anlaşılmasına da ehemmiyet vermektedir. Bu yaklaşım, metnin öneminin daha derinlemesine anlaşılmasını sağlamaktadır ve salt övgünün ötesine geçerek dönemin sosyopolitik dinamikleri hakkında bir yorum sunmaktadır. Öte yandan mevcut tarihî kayıtların İbnu’r-Rûmî ile Abdülmelik b. Ṣāliḥ arasındaki ilişki hakkında çok az ayrıntı sunduğunu ve mevcut belgelerde bu konuda kapsamlı bilgi bulunmadığını vurgulamak gerekir. Bu çalışmanın önemi, klasik Arap edebiyatı alanına yaptığı katkısından, özellikle de methiyelerin bu literatür geleneğindeki rolünün ve gelişiminin anlaşılması hususundaki önceliğinden kaynaklanmaktadır. İbnu’r-Rûmî’nin eserinin analizi vasıtasıyla bu araştırma, methiye nazmının karmaşık doğasına dikkat çekmesinin yanı sıra; şair, şiirde övülen kişi ve şaire verilen maddi ödül arasındaki ilişkinin ayrıntılı şekilde anlaşılmasını da sağlamaktadır. This cross-sectional study was carried out to investigate the frequency of consanguineous marriage in a group of army conscripts in Ankara and the factors affecting this. Of 4153 soldiers, 387 were married. The rate of marriage between first cousins was found to be 19·1%, and the overall rate of consanguineous marriage was 24·1%. Consanguineous marriage was found to be significantly prevalent among soldiers who were born in and still living in the Eastern region; among those who lived in villages; among (...) those whose parents as well as themselves had low educational levels; and among those whose marriages were arranged by their families. Neither the payment of bride-price nor the presence of consanguinity between parents was a significant factor for consanguineous marriage. In addition, the age of the soldier and the age at marriage were significantly lower among soldiers married to first cousins than among soldiers whose marriages were not consanguineous. (shrink)

Hicrî birinci yüzyılın sonu ile ikinci yüzyılın ortalarında yaşamış bulunan Ca‘fer-i Sâdık ve Ebû Hanîfe, akran iki âlimdir. Kûfe’de yetişen ve Ehl-i sünnet mezheplerinden birinin imamı olan Ebû Hanîfe’nin, Medine’de yetişen ve İsnâaşeriyye’nin altıncı imamı kabul edilen Ca‘fer ile bir araya geldiği ve onun talebesi olduğu hem sünnî hem Şiî kaynaklarda rivayet edilmektedir. Mukaddem kaynaklarda Ebû Hanîfe’nin Ca‘fer-i Sâdık’ın öğrencisi olduğu yönündeki ifadelerin, muahhar kaynaklarda abartılı bir şekilde yorumlandığı görülmüştür. Bu çalışmada Ebû Hanîfe ile Ca‘fer-i Sâdık arasındaki hoca-talebe ilişkisi (...) netleştirilmeye çalışılmıştır. Bu sebeple öncelikle kısaca her iki imamın hayatı ele alınarak onların ilmî birikimi tespit edilmiştir. Akabinde Ebû Hanîfe ile Ca‘fer’in ne zaman ve ne kadar süre birlikte oldukları, Ebû Hanîfe’nin Ehl-i beyt’e yönelik tutumunun Ca‘fer’den ilim almasında ne gibi bir etkisinin bulunduğu ve çeşitli ilim dallarında Ebû Hanîfe- Ca‘fer ilişkisi tespit edilmeye çalışılmıştır. Background and aim Difficult moral situations assume more critical importance in pediatric wards since children are more vulnerable than adults. Given that professional ethics is a substantial part of children treatment, the present study was conducted to determine the ethical performance of nurses from the perspective of mothers and nurses in the pediatric wards of Be'esat Hospital in Hamadan. Materials and methods The present descriptive-analytical study was conducted on 58 nurses and 263 mothers of children referred to the pediatric (...) wards of Be'esat Hospital in Hamadan in 2019. The study samples were randomly selected. Data collection tools included the demographic form and Ethical Performance Assessment Questionnaire developed by Beykmirza et al. The obtained data were analyzed in SPSS software version 23using descriptive and inferential statistics. Results As evidenced by the obtained results, the mean ethical performance of nurses from the perspective of nurses and mothers were reported as 86.72 ± 6.397 and 69.92 ± 18.09. From the mothers' viewpoint, 27%, 39.2%, and 33.8% of nurses had weak, moderate and good levels of performance, respectively. On the other hand, from the nurses' perspective, 24.6% and 75.4% of nurses had moderate and good levels of performance, respectively. The obtained results were indicative of a statistically significant difference between the performance score as reported by mothers and nurses. Conclusion Considering that the majority of mothers rated the ethical performance of nurses as weak and moderate, it is suggested that professional ethical principles be implemented in the form of Retraining programs in an attempt to improve the ethical performance of nurses. This study seeks to investigate the perceptions of elementary school 4th grade students related to the lesson and teachers of religious culture and moral knowledge via metaphors. In this study, the phenomenological design, one of the qualitative research designs, was used. Data was analysed through content analysis, and the study group was comprised of 234 elementary school 4th grade students. The sampling of the study was determined through criterion sampling, which is one of the purposeful samplings. The data of the (...) study were collected via a semi-structured form composed of two questions asked as “Religious culture and moral knowledge lesson is like … because …” and “Religious culture and moral knowledge teacher is like … because …”. The analysis of metaphors was conducted considering the stages including data encoding and extraction, the compilation of sample metaphor image, the development of themes/categories, the configuration of data based on codes and themes, the reliability and validity analyses of data, carrying out quantitative data entries and analyses and interpreting findings of the study. Considering the results of the study as a whole, it was determined that the metaphors developed by elementary school 4th grade students were largely positive related to the lesson and teachers of religious culture and moral knowledge. Summary: Metaphors are tools that try to clarify how people see life, the environment in which they live, phenomena, events and objects with different metaphors. Metaphor can also be described as meaning or experiencing something according to something else. It can be said that metaphors are mental images that help individuals to perceive their environment and to illuminate complex structures. Metaphors are tools that describe abstract events, facts, principles and rules using concrete expressions, examples and similes. Some of the basic functions of metaphors can be counted in the fact that a large number of data, revealing, interpreting, transferring information, discerning new knowledge and eliminating uncertainties. Metaphors have the characteristics of being simulation tools that make complex structures understandable, diversify perceptions about education, describe the roles of teachers and reveal the views of teachers and students about education.The aim of the current study is to examine the perception and reactions of 4th grade Elementary School students about the lesson and teachers of Religious Culture and Moral Knowledge through metaphors based on their experiences. The metaphors produced for the teacher and the lesson have the potential to give important ideas about the students' perceptions about educational activities. From this point of view, the aim of this study is to analyse the students’ perspectives about education and teaching practices by questioning the meaning that the students develop in their emotions and thoughts about the lesson and the teacher of Religious Culture and Moral Knowledge.There is no scientific study relating students’ perceptions of Religious Culture and Moral Knowledge lessons and teachers. This makes the current study unique. Considering that the perceptions of the students are formed especially during the elementary and secondary school periods, it can be said that the perceptions of the students about the lessons and teachers at early ages are necessary and important. It is thought that this study will contribute to the literature in terms of students' perceptions about a lesson and the teacher of the lesson by means of metaphors. It is thought that the fact that metaphors produced by the students in the scope of this research are answers to the questions of “what kind of teacher” and “what kind of lesson.”The current study used the phenomenological pattern among qualitative research designs. The study group consists of 234 elementary school 4th grade students. The study group was determined by criterion sampling method. Data was collected through a structured form consisting of two questions (“Religious culture and moral knowledge lesson is like … because …” and “Religious culture and moral knowledge teacher is like … because …”.) and the data obtained in the research was analysed by content analysis. Analysis of participants’ metaphors was done by taking into account the steps of coding and sorting the data, compiling the sample metaphor image, developing the themes/categories, arranging the data according to the codes and themes, conducting validity and reliability analysis of the data, quantitative data entry and analysis, and interpreting the findings.In the research, it was found out that the students produced 46 metaphors related to the lesson of Religious Culture and Moral Knowledge and the most frequently repeated metaphor related to the lesson was “the love of Allah” metaphor. It was determined that the metaphors produced in the category of the lesson of Religious Culture and Moral Knowledge were gathered in 6 categories and the category with the highest frequency was the category of “Peaceful lesson”. Regarding the teachers of Religious Culture and Moral Knowledge, it was found out that the participants produced 52 metaphors and the most frequently repeated metaphor related to the teacher was the metaphor of “Hoca” (teacher). The metaphors produced for the teacher of Religious Culture and Moral Knowledge were gathered in 7 categories and the category with the highest frequency in these categories was “the Peaceful Teacher” category.Metaphors produced in relation to the lesson of Religious Culture and Moral Knowledge can be considered as snapshots of the aims, content, learning-teaching processes and measurement-evaluation activities of the lesson. The metaphors produced about the lesson can determine the direction of the attention of preparers and decision makers in these subjects by pointing to the importance of the lesson, the importance that the student attach to the lesson, their emotions towards the lesson, the students' interests and expectations of the lesson. Metaphors produced by students in this study can be evaluated as answers given to the question of “what kind of lesson?” Metaphors produced about the teacher of Religious Culture and Moral Knowledge are important tools that reveal who the teachers are, where they stand, how they teach and how they are defined. The metaphors produced by the students can be considered as definitions from another point of view, which will enable the teacher to recognize himself/herself in many ways and to recognize him/herself more impartially. In this study, metaphors produced by the students can be evaluated as answers to the question “what kind of teacher?” When the results of the research are evaluated as a whole, it is seen that the 4th grade students' metaphors about the lesson and teacher of Religion Culture and Moral Knowledge are generally positive. In this context, it can be said that the students have positive perceptions and thoughts about the lesson and the teacher. The less negative metaphors and explanations show that the students also have negative feelings and thoughts about the lesson and the teacher. Considering the fact that students' positive feelings and thoughts about the lesson and the teacher have a significant effect on the success of the students, precautions should be taken to eliminate negative perceptions of the students by evaluating the negative metaphors about the lesson and the teacher of Religious Culture and Moral Knowledge in detail. İbn Hacer’in Nuhbetü’l-Fiker ’i ve onun şerhi olan Nüzhetü’n-Nazar ’ının, kendisinden sonra yazılan hadis usûlü eserlerine kaynaklık etmesi ve onları etkilemesi açısından usûl tarihinde önemli bir yeri vardır. Nitekim mezkûr eserler üzerine yapılan şerh ve hâşiye çalışmalarının çokluğu bu önemi ortaya koymaktadır. Fıkıh ve hadis başta olmak üzere çeşitli ilim dallarında 100’ün üzerinde eser kaleme alan ve aynı zamanda İbn Hacer’in de talebelerinden olan Kasım b. Kutluboğa da bahsedilen eser üzerine çalışma yapan âlimlerden biridir. İbn Kutluboğa, hocası İbn Hacer’i birçok (...) yönden eleştirmiş ve çeşitli katkılarda bulunmuştur. Bu makalede İbn Kutluboğa’nın Nüzhetü’n-Nazar üzerine yazdığı Hâşiyetü İbn Kutluboğa adlı eserindeki itirazlar bağlamında kısaca red/itiraz kültüründen bahsedilerek örnekler ortaya konulacak ve mezkûr itirazlar esere hâşiye yazan ilgili bazı âlimlerin görüşleri çerçevesinde değerlendirilecektir. Ele alınan itirazlardan da anlaşılacağı üzere İbn Kutluboğa’nın polemik türü ve muhatabını ilzam edici itirazlarının neredeyse olmadığı ve yönelttiği kimi eleştirilerinde hadis usûlünde bilinen kurallardan farklı görüşler ortaya koyduğu tespit edilmiştir. Ayrıca İbn Kutluboğa’nın öne sürdüğü her itirazında isabetli yorumlar ortaya koymadığını da söylemek mümkündür. (shrink)

This article considers the role of Raphelengius’s translation within the framework of the manuscript circulation and print production of Nasreddin Hoca tales in Europe from the first dated manuscript to twentieth-century printed editions Raphelengius’s editorial choices for his intended publication, the style of his Latin translation, and his excision of bawdy (...) or sacrilegious passages from the original text come under scrutiny. Makalenin konusu Ebû Hanîfe örneğinden hareketle İslam düşüncesinde yargı-siyaset ilişkisi-dir. Ebû Hanîfe’nin yaşadığı döneme kadar karizmanın dini ve siyasi kültürde gelişimine paralel olarak yargı-siyaset ilişkileri bağlamında İslam düşüncesinde bazı formlar çoktan ortaya çık-mıştı. Burada amaç İslam’ın henüz ikinci asrında yargı-siyaset ilişkilerini Ebû Hanîfe üzerinden anlamaya çalışmak ve dolaylı olarak da meselenin bugüne yansıyan yönlerine ışık tutmaktır. Bu yüzden farklı sosyolojik düzlemlerde inşa edilmiş Şiî, Haricî, Sünnî öteki formlar çalışma dışında tutulmuştur. Araştırma Ebû Hanîfe’nin; doktrini oluşturan Kur’an, sünnet ve sahabe uygulamaları (...) ile kendi dönemindeki dini, siyasi, sosyal ve kültürel şartlar arasında nasıl bir okuma yaptığını sorunsallaştırmıştır. Çalışmada Ebû Hanîfe’nin yargı-siyaset ilişkisi bağlamın-da ortaya çıkardığı genel anlama biçiminin, işaret edilen dini ve tarihi şartlarla kendi dini top-lumsallaşma çevresindeki diyalektik bir ilişkide şekillendiği varsayılmıştır. Dolaylı gözlem yöntemi ile elde edilen veriler bir tekil olay incelemesi bağlamında fenomenolojik bir çözüm-lemeye tabi tutulmuştur. Konu bugüne kadar ilahiyat bağlamında olduğu gibi din bilimi alanın-da da dikkat çekici görülmemiştir. Makale İslam düşüncesinde yargı-siyaset ilişkisinin farklı desenleri arasında Ebû Hanîfe modelini tartışması bağlamında bir değere sahip görülebilir. Çalışmada; temel hak ve özgürlüklerin korunması noktasında sivil ve barışçıl bir muhalefetin yeterli olmadığı, iktidarın kişisel hakları tanımaktan daha çok kişisel ödevler ve mutlak itaat talebi ile siyaset yaptığı bir ortamda Ebû Hanîfe’nin soruna ahlaki bir saikle yaklaştığı ve bu bağlamda bir çözüm önerisi getirdiği görülmüştür. Ebû Hanîfe gerek otorite ve karizması ge-rekse ekonomik statüsü ve kültürel birikiminden aldığı güç ile yaşadığı dönemde üst düzey siyasal ve hukuki bir katılım gerçekleştirmiştir. Yasama erkinin özgür bir üyesi olarak Ebû Hanîfe temel haklar bağlamında hayatı boyunca hep iktidarlarla karşı karşıya gelmiş ve bu mücadele içinde iken de öldürülmüştür. Müslüman bir ailede doğmasına rağmen dönemin politik tavrı nedeniyle daha doğumuyla birlikte iktidar tarafından öteki olarak görülmüş ve ömrü boyunca bu statü ile yaşamak zorunda kalmıştır. Başlangıçta kendi ailesi içinde toplum-sallaşırken deneyimlediği mevalilik duygusu, Ebû Hanîfe’de özellikle hocasının ölümünden sonra iktidarlara karşı toplumsal bir hak arayışına dönüşmüştür. Esasen kendi özelinde bir hak arayışı olmaksızın iktidarların yasa ile sorunlu politik tavırları karşısında dini, hukuki ve top-lumsal bir tavır içinde yürüttüğü bu mücadelesi Ehl-i Beyt’i ve diğer bütün toplumsal grup ve kategorileri içine alan bir genişlikte ilerlemiştir. Ebû Hanife’nin yargı- siyaset ilişkisine dair bu yaklaşımı teorik ve pratik olarak tamamen sistematik bir çerçevede şekillenmiştir. İslam hu-kukunun dayandığı bilgi gövdeleri kapsamında o, çok kapsayıcı ve dinamik bir tarzda din ve şeriat kavramsallaştırması yapmıştır. Buna göre Ebû Hanîfe dine temel hakların dayandığı temel yasa anlamı yüklerken şeriata ise kendisinin bu dini alana veya başka bir ifadeyle yasaya göre düzenlendiği neshe açık, değişken bir alan anlamı vermiştir. Bu tevhit eksenli hiyerarşi içinde siyaset, yasaya karşı kesin sorumluluğu olan dünyevi bir alan görülmüştür. Ebû Hanîfe’nin İslam’ın ilk dönemini bir hukuk devleti nosyonu içinde değerlendirdiğinde kuşku yoktur. Buna mukabil, genel yargı-siyaset ilişkisine yaklaşımından anlaşıldığına göre yaşadığı dönemi, iktidarlar tarafından hukukun araçsallaştırıldığı bir dönem olarak görmüştür. Kurmuş olduğu akademi onun yargı-siyaset ilişkisine bakışının önemli bir pratiğidir. Bu akademiden yetişen ve daha sonra resmi ve gayri resmi olarak yasamanın bir üyesi olan öğrencilerine tav-siyeleri ve mektupları, onun bir yargı elemanı olarak siyaset kurumuna yaklaşımının sübjektif değil; bir düzen ihtiyacının ortaya çıkardığı objektif bir tavır olduğunu göstermiştir. Ebû Hanîfe teorik yaklaşımını pratik bir eylem alanı ile birleştirmek suretiyle yargı-siyaset ilişkisine bakışı konusunda oldukça net bir fotoğrafa sahiptir. (shrink)
