The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. The enormous increasing of connections between people and the noteworthy enlargement of domains and methods in sciences have augmented extraordinarily the cardinality of the set of meaningful human symbols. We know that complexity is always on the way to become complication, i.e. a non-tractable topic. For this reason scholars engage themselves more and more in attempting to tame plurality and chaos. In this book distinguished scientists, philosophers and historians of science reflect on the topic from a multidisciplinary point of view. (...) Is it possible to dominate complexity through reductionism? Are there other conceptual instruments useful to take account of complexity? Marcel Proust’s In Search of Lost Time, raises an interesting philosophical issue, namely, how can one be in touch with past things if they no longer exist? It provides us with a way to address this issue by outlining an ontological view according to which past things still exist within a four-dimensional world. Although one cannot be in touch with past things by means of ordinary perception, one can do so by combining perception and memory. In this sense, In Search (...) of Lost Time helps us to reconcile a four-dimensionalist ontology according to which things have both spatial and temporal parts with a realist phenomenology according to which experience gives us access to things as they are. In so doing, Proust’s masterpiece allows us to shed some light on what it means for a subject of experience to exist in a four-dimensional world. (shrink)

This work presents a model-theoretic approach to the study of first-order theories of classes of BL-chains. Among other facts, we present several classes of BL-algebras, generating the whole variety of BL-algebras, whose first-order theory has quantifier elimination. Model-completeness and decision problems are also investigated. Then we investigate classes of BL-algebras having (or not having) the amalgamation property or the joint embedding property and we relate the above properties to the existence of ultrahomogeneous models.

This paper investigates the question of how we manage to single out the natural number structure as the intended interpretation of our arithmetical language. Horsten submits that the reference of our arithmetical vocabulary is determined by our knowledge of some principles of arithmetic on the one hand, and by our computational abilities on the other. We argue against such a view and we submit an alternative answer. We single out the structure of natural numbers through our intuition of the absolute (...) notion of finiteness. (shrink)

In this article, we describe an ontology aimed at the representation of the relevant entities and relations in the philosophical world. We will guide the reader through our modeling choices, so to highlight the ontology’s practical purpose: to enable an annotation of philosophical resources which is capable of supporting pedagogical navigation mechanisms. The ontology covers all the aspects of philosophy, thus including characterizations of entities such as people, events, documents, and ideas. In particular, here we will present a detailed exposition (...) of the entities belonging to the idea branch of the ontology, for they have a crucial role in the world of philosophy. Moreover, as an example of the type of applications made possible by the ontology we will introduce PhiloSurfical, a prototype tool we created to navigate contextually a classic work in twentieth century philosophy, Wittgenstein’s Tractatus Logico-Philosophicus. We discuss the potential usage of such navigation mechanisms in educational and scholarly contexts, which aim to enhance the learning process through the serendipitous discovery of relevant resources. Enrico Müller legt hier die erste philosophische Gesamtdarstellung zur Bedeutung der Griechen für Nietzsches Denken vor. Er zeigt, wie sich in Auseinandersetzung mit dem Griechentum Nietzsches eigene Philosophie entwickelte, und problematisiert deren Abgrenzungen von der Logosphilosophie der griechischen Klassik. Müller kommt dabei zu dem Schluss, dass auch Nietzsches Philosophie letztlich auf die Vorgaben der sokratisch-platonischen Dialektik angewiesen bleibt.

In this paper I argue that Rawlsians have largely misunderstood the idea of an overlapping consensus of reasonable comprehensive doctrines, thereby failing to delineate in an appropriate way the place of comprehensive doctrines in political liberalism. My argument rests on two core claims. The first claim is that (i) political liberalism is committed to three theses about the overlapping consensus. The first thesis concerns the subject of the overlapping consensus; the second thesis concerns the function of the overlapping consensus; the (...) third thesis explains how the overlapping consensus can serve its function in accordance with political liberalism’s commitment to epistemic neutrality. The second claim on which my argument relies is empirical: (ii) Rawlsians typically deny at least one of the three theses to which political liberalism is committed. Based on (i) and (ii), I conclude that Rawlsians have hitherto provided unconvincing accounts of the place of comprehensive doctrines in political liberalism. (shrink)

In section 1 we argue that the adoption of a tenseless notion of truth entails a realistic view of propositions and provability. This view, in turn, opens the way to the intelligibility of theclassical meaning of the logical constants, and consequently is incompatible with the antirealism of orthodox intuitionism. In section 2 we show how what we call the potential intuitionistic meaning of the logical constants can be defined, on the one hand, by means of the notion of atemporal provability (...) and, on the other, by means of the operator K of epistemic logic. Intuitionistic logic, as reconstructed within this perspective, turns out to be a part of epistemic logic, so that it loses its traditional foundational role, antithetic to that of classical logic. In section 3 we uphold the view that certain consequences of the adoption of atemporal notion of truth, despite their apparent oddity, are quite acceptable from an antirealist point of view. Numenius is an author who straddles the line between Middle Platonism and Neoplatonism. In this contribution, I focus on the differences between the second and the third God, which emerge from analyses of the relevant fragments. Numenius emphasizes, on several occasions, how the second God (i.e., the demiurge) has a dual nature. In this paper, I investigate the role of the demiurge in Numenius and examine in what sense the second and third God are “one.” On the one hand, Numenius (...) seems to be stressing the unity of the second and third levels of reality, but on the other hand, he also appears to be differentiating them. The present analyses concentrate on fragments 19F, 24F, 29T and 30T (respectively 11, 16, 21, and 22 in des Places’ edition). My purpose is to demonstrate that, according to Numenius, the second and the third God are one because they both can be regarded as demiurgic. Thus, Numenius conceives a kind of “double demiurgy,” which preserves the distinction between the second and the third God, who are distinguished from an ontological point of view, but who, at the same time, share a demiurgic function. The second God is then the paradigm, whereas the third God is immanent in matter as a ruling principle of the cosmos, which is similar to the World Soul, as he operates on matter in order to make it rationally ordered. El vínculo entre músicos/as de rock y agencias estatales ha sido en nuestro país históricamente dinámico, intermitente, cambiante. Un clima de época iniciado en los años 2000, tanto en Argentina como en Latinoamérica, caracterizado por demandas de políticas culturales democrático-participativas, se tradujo en una modificación en el vínculo entre hacedores culturales y agentes estatales. Buscando contribuir al debate en torno al diseño e implementación de estas políticas, este artículo tiene como objetivo analizar las lógicas, las legitimidades y las disputas existentes (...) en el vínculo entre músicos/as de rock de la ciudad de La Plata y agencias estatales locales. Para ello, partiremos de un conjunto de políticas culturales que tuvo lugar durante 2016 y 2017 que permitió ver procesos de articulación entre ambos actores, así como instancias de tensión, consenso y reposicionamiento. La investigación se desarrolló en base a una estrategia metodológica de tipo cualitativa, aplicando distintas técnicas de recolección y producción de datos, como entrevistas en profundidad, observación participante, cartografía, sombreo (Jirón, 2012) y relevamiento y análisis de fuentes primarias y secundarias. What is the theoretical and applied responsibility of practical legal policies against environmental degradation? Which political-philosophical attitude is implicit in the International and European environmental legislation for reducing and preventing the environmental degradation? The concepts and means, developed to compare us with the environmental issue, are adequate to capture the reality of these emergencies? The basic thesis, I intend to discuss and defend, argues that there is a “question incompatibility” between political liberalism and environmental protection.

Conceiving of fictional characters as types allows us to reconcile intuitions of sameness and difference about characters such as Batman that appear in different fictional worlds. Sameness occurs at the type level while difference occurs at the token level. Yet, the claim that fictional characters are types raises three main issues. Firstly, types seem to be eternal forms whereas fictional characters seem to be the outcome of a process of creation. Secondly, the tokens of a type are concrete particulars in (...) the actual world whereas the alleged tokens of a fictional character are concrete particulars in a fictional world. Thirdly, many fictional characters, unlike Batman, only appear in one work of fiction, and therefore one can wonder whether it does make sense to treat them as types. The main aim of this paper is to address these issues in order to defend a creationist account of fictional characters as types. (shrink)

A rigorous ab initio derivation of the (square of) Dirac’s equation for a particle with spin is presented. The Lagrangian of the classical relativistic spherical top is modified so to render it invariant with respect conformal changes of the metric of the top configuration space. The conformal invariance is achieved by replacing the particle mass in the Lagrangian with the conformal Weyl scalar curvature. The Hamilton-Jacobi equation for the particle is found to be linearized, exactly and in closed form, by (...) an ansatz solution that can be straightforwardly interpreted as the “quantum wave function” of the 4-spinor solution of Dirac’s equation. All quantum features arise from the subtle interplay between the conformal curvature acting on the particle as a potential and the particle motion which affects the geometric “pre-potential” associated to the conformal curvature itself. The theory, carried out here by assuming a Minkowski metric, can be easily extended to arbitrary space-time Riemann metric, e.g. the one adopted in the context of General Relativity. This novel theoretical scenario appears to be of general application and is expected to open a promising perspective in the modern endeavor aimed at the unification of the natural forces with gravitation. The paper is devoted to an examination of the epistemic account of the notion of deductive inference recently provided by D. Prawitz, and based on the notion of ground. This is part of the general scenario constituted by the “Proof-theoretic semantics”, presented since the ’70s of the last century as an alternative to the standard model-theoretic explication of the notion of logical consequence.Our argument pivots on the so-called “Curry–Howard Correspondence”, which exploited the idea of considering proofs as proper mathematical objects (...) in a remarkable way. A sort of rational reconstruction of this idea is outlined, tracing it back to Hilbert and Husserl’s investigations. (shrink)

El artículo aborda una aplicación pedagógica del recurso retórico clásico del decorum en la pedagogía agustiniana. Se ofrece en primer lugar una introducción a la formación retórica agustiniana para posteriormente hacer un recorrido de la obra del Obispo de Hipona, deteniéndose en dos de los así llamados “Diálogos de Casiciaco”, concretamente en el De ordine, y el contra Académicos. El artículo analiza también desde la perspectiva del decorum la ep. 29, destacando cómo el Obispo de Hipona aplica dicho recurso retórico (...) a la solución de conflictos. Se aborda, asimismo, el De catechizandis rudibus, en donde el decorum, desde una perspectiva pedagógica agustiniana significa poner al alumno en la sintonía de la enseñanza, ya que según el Hiponate, es preciso “conectar para enseñar”. Finalmente aborda desde esta misma perspectiva el s. Dolbeau 5, 11 (= s. 114B ). (shrink)

In the first part of this paper, published in issue 1 of Augustinianum 63 (2023), 9-45, we examined the question of whether Irenaeus of Lyons depended on the Exposition of Logia about the Lord of Papias of Hierapolis. In this second and final part we focus on the way Irenaeus used information which, since the first decades of the second century, had been attributed to presbyters of Asia and then in particular on the way he identifies the succession of presbyters (...) with that of bishops (primarily in Rome). He links the latter with Christian origins but also profoundly alters the function traditionally attributed to the presbyters themselves, within a system he devised in order to respond to urgent problems, in a context quite different from the era in which the traditions to which he appeals were born. His sizable work has shaped a great part of Italian studies on Aristotle and other ancient philosophers. The present paper deals with natural intuitionistic semantics for intuitionistic logic within an intuitionistic metamathematics. We show how strong completeness of full first order logic fails. We then consider a negationless semantics à la Henkin for second order intuitionistic logic. By using the theory of lawless sequences we prove that, for such semantics, strong completeness is restorable. We argue that lawless negationless semantics is a suitable framework for a constructive structuralist interpretation of any second order formalizable theory (classical or intuitionistic, (...) contradictory or not).
