El presente trabajo de investigación tiene como objeto el estudio de la legislación penal en la República de Colombia desde 1890 hasta la actualidad con la ley 599 de 2000, este último conocido como el vigente Código Penal. Lo anterior, conforme a la siguiente pregunta problémica ¿se ha dado un desarrollo oportuno de la legislación penal colombiana que otorgue soluciones fehacientes a las necesidades de una política criminal sólida desde sus inicios hasta la actualidad? Con ello, se pretende analizar las (...) diversas escuelas que han influido en los legisladores a la promulgación y tipificación de los delitos y sus penas en el marco jurídico penal colombiano. Se destaca ante todo, el análisis que a lo largo del desarrollo del ordenamiento jurídico colombiano abarca el contexto constitucional, doctrinal y jurisprudencial, los cuales, han logrado evidenciar el carácter de un óptimo “derecho penal” a lo largo del contexto histórico del país en mención. Se destaca así, la gran influencia de las Escuelas Clásica, Positivista y Finalista, que a hoy han venido a establecerse con fuerza en Colombia a lo largo de su codificación, desde 1980 hasta la actual ley 599 del año 2000. Este artículo aborda dos temáticas de la novela La muerte es una vieja historia de Hernán Rivera Letelier: la construcción de la identidad de la mujer pentecostal y el uso de la música tanto en el templo como en la vida de un fiel pentecostal. En el primer apartado abordamos tres aspectos del primer tema relacionados con la mujer pentecostal: la inteligencia social y cognitiva, la corporalidad y sensualidad, y la violencia sexual. En el segundo apartado hacemos referencia a la (...) importancia que tiene la música en los templos y la vida cotidiana de los pentecostales, que en la novela se refleja en las anécdotas y experiencias que se cuentan de la protagonista, la hermana Tegualda. People generally accept that there is causation by omission—that the omission of some events cause some related events. But this acceptance elicits the selection problem, or the difficulty of explaining the selection of a particular omissive cause or class of causes from the causal conditions. Some theorists contend that dependence theories of causation cannot resolve this problem. In this paper, we argue that the appeal to norms adequately resolves the selection problem for dependence theories, and we provide novel experimental evidence (...) for it. (shrink)

Cognitive theories claim, whereas non-cognitive theories deny, that cognitive access is constitutive of phenomenology. Evidence in favor of non-cognitive theories has recently been collected by Block and is based on the high capacity of participants in partial-report experiments compared to the capacity of the working memory. In reply, defenders of cognitive theories have searched for alternative interpretations of such results that make visual awareness compatible with the capacity of the working memory; and so the conclusions of such experiments remain controversial. Instead of entering the debate between alternative interpretations of partial-report experiments, this paper offers an alternative line of research that could settle the discussion between cognitive and non-cognitive theories of consciousness. Here I relate the neural correlates of cognitive access to empirical research into the neurophysiology of dreams; cognitive access seems to depend on the activity of the dorsolateral prefrontal cortex. However, that area is strongly deactivated during sleep; a period when we entertain conscious experiences: dreams. This approach also avoids the classic objection that consciousness should be inextricably tied to reportability or it would fall outside the realm of science. (shrink)

We develop a general framework for forcing with coherent adequate sets on [Formula: see text] as side conditions, where [Formula: see text] is a cardinal of uncountable cofinality. We describe a class of forcing posets which we call coherent adequate type forcings. The main theorem of the paper is that any coherent adequate type forcing preserves CH. In developing a theory of consciousness, one of the main problems has to do with determining what distinguishes conscious states from non-conscious ones—the delimitation problem. This paper explores the possibility of solving this problem in terms of self-awareness. That self-awareness is essential to understanding the nature of our conscious experience is perhaps the most widely discussed hypothesis in the study of consciousness throughout the history of philosophy. Its plausibility hinges on how the notion of self-awareness is unpacked. The idea that (...) consciousness involves self-awareness has been understood in two different ways: either as awareness of oneself—the subject of experience—or as awareness of the conscious episode itself. In this paper I argue (i) that every experience concerns the subject in a very specific way, involving what I will call ‘perspectival de se representation’, and (ii) that there is no need to appeal to the experience itself in order to characterize the awareness within that experience. The view I articulate explains the subjective nature of experience without over-intellectualizing it, accommodates the phenomenology of experience, and dispels any doubt about the need to find the self in introspection. Experimental philosophers have gathered impressive evidence for the surprising conclusion that philosophers' intuitions are out of step with those of the folk. As a result, many argue that philosophers' intuitions are unreliable. Focusing on the Knobe Effect, a leading finding of experimental philosophy, we defend traditional philosophy against this conclusion. Our key premise relies on experiments we conducted which indicate that judgments of the folk elicited under higher quality cognitive or epistemic conditions are more likely to resemble those of the (...) philosopher. We end by showing how our experimental findings can help us better understand the Knobe Effect. (shrink)

Higher-Order Thought (HOT) theories of consciousness maintain that the kind of awareness necessary for phenomenal consciousness depends on the cognitive accessibility that underlies reporting. -/- There is empirical evidence strongly suggesting that the cognitive accessibility that underlies the ability to report visual experiences depends on the activity of the dorsolateral prefrontal cortex (dlPFC). This area, however, is highly deactivated during the conscious experiences we have during sleep: dreams. HOT theories are jeopardized, as I will argue. I will briefly present HOT (...) theories in the first section. Section 2 offers empirical evidence to the effect that the cognitive accessibility that underlies the ability to report depends on the dorsolateral prefrontal cortex: dlPFC is the neural correlate of HOTs. Section 3 shows the evidence we have of the deactivation of this brain area during dreams and, in section 4, I present my argument. Finally, I consider and rejoin two possible replies that my opponent can offer: the possibility of an alternative neural correlate of HOTs during dreams and the denial that we have phenomenally conscious experiences during sleep. In this article, we review the conceptions of Collective Effervescence (CE) –a state of intense shared emotional activation and sense of unison that emerges during instances of collective behavior, like demonstrations, rituals, ceremonies, celebrations, and others– and empirical approaches oriented at measuring it. The first section starts examining Émile Durkheim's classical conception on CE, and then, the integrative one proposed by the sociologist Randall Collins, leading to a multi-faceted experience of synchronization. Then, we analyze the construct as a process emerging (...) in collective encounters when individuals contact with social ideal and values, referring to the classical work of Serge Moscovici as well as those more recent empirical approaches. Third, we consider CE as a set of intense positive emotions linked to processes of group identification, as proposed by authors of the Social Identity Theory tradition. Finally, we describe CE from the perspective of self-transcendence (e.g., emotions, experiences), and propose a unified description of this construct. The second section shows the results of a meta-analytical integration (k= 50,N= 182,738) aimed at analyzing CE's proximal effects or construct validity (i.e., Individual Emotions and Communal Sharing) as well as its association with more distal variables, such as Collective Emotions, Social Integration, Social Values and Beliefs and Empowerment. Results indicate that CE strongly associates with Individual Emotions –in particular, Self-Transcendent Emotions– and Communal Sharing constructs (e.g., Group Identity, Fusion of Identity), providing construct validity. Among the distal effects of CE, it is associated with Collective Positive Emotions, long-term Social Integration (e.g., Ingroup Commitment), Social Values and Beliefs and Empowerment-related variables (e.g., Wellbeing, Collective Efficacy, Collective Self-Esteem). Among the moderation analyses carried out (e.g., study design, CE scale, type of collective gathering), the effects of CE in demonstrations are noticeable, where this variable is a factor that favors other variables that make collective action possible, such as Group Identity (rpooled= 0.52), Collective Efficacy (rpooled= 0.37), Negative and Self-Transcendent Emotions (rpooled= 0.14 and 0.58), and Morality-related beliefs (rpooled= 0.43). The traditional approach in cognitive sciences holds that cognition is a matter of manipulating abstract symbols followingcertain rules. According to this view, the body is merely an input/output device, which allows the computationalsystem—the brain—to acquire new input data by means of the senses and to act in the environment following its com-mands. In opposition to this classical view, defenders of embodied cognition (EC) stress the relevance of the body inwhich the cognitive agent is embedded in their explanation of cognitive processes. (...) From a representationalist frameworkregarding our conscious experience, in this article, I will offer a novel argument in favor of EC and show that cognitionconstitutively—and no merely causally—depends upon body activity beyond that in the brain. In particular, I will arguethat in order to solve the problem derived from the empirical evidence in favor of the possibility of shifted spectrum,representationalist should endorse the view that experiences concern its subject: the content of experience isde se.Ishow that this claim perfectly matches the phenomenological observation and helps explaining the subjective characterof the experience. Furthermore, I argue that entertaining this kind of representation constitutively depends on bodilyactivity. Consequently, insofar as cognition depends on consciousness, it is embodied. (shrink)

El pensamiento de Gianni Vattimo como entrecruzamiento de política, filosofía y religión.

If we classify ethical theories into ‘immanentist’ (those that detect what is ethically acceptable in some type of world events, such as the utilitarian growth of general benefits) and ‘transcendentalist’ (those that locate in some space beyond this world the reason why we should behave ethically – for example, due to some kind of otherworldly reward –), then the moral philosophy of the so-called ‘first’ Wittgenstein would occupy a special place between both extremes of such a dichotomy. To a certain (...) extent, it could be said that the ethical proposal of Wittgenstein during his years composing the Tractatus Logico-philosophicus maintains a delicate balance that avoids both its exclusive submission to transcendental instances (fundamentals), and its total assimilation by immanent motivations (benefits) when justifying the fact of acting in a correct way. In this article we will look at such a Wittgensteinian pirouette between both members of the transcendent-immanent dualism, and we will suggest that the peculiar place where he leaves ethics, between the heavenly and the earthly, may not be completely alien to some thesis of the Christian religion. Ozone is one of the pollutants with most negative effects on human health and in general on the biosphere. Many data-acquisition networks collect data about ozone values in both urban and background areas. Usually, these data are incomplete or corrupt and the imputation of the missing values is a priority in order to obtain complete datasets, solving the uncertainty and vagueness of existing problems to manage complexity. In the present paper, multiple-regression techniques and Artificial Neural Network models are applied to (...) approximate the absent ozone values from five explanatory variables containing air-quality information. To compare the different imputation methods, real-life data from six data-acquisition stations from the region of Castilla y León are gathered in different ways and then analyzed. The results obtained in the estimation of the missing values by applying these techniques and models are compared, analyzing the possible causes of the given response. (shrink)

This study presents the application of self-organizing maps to air-quality data in order to analyze episodes of high pollution in Madrid. The goal of this work is to explore the dataset and then compare several scenarios with similar atmospheric conditions : some of them when no actions were taken and some when traffic restrictions were imposed. The levels of main pollutants, recorded at these stations for eleven days at four different times from 2015 to 2018, are analyzed in order to (...) determine the effectiveness of the anti-pollution measures. The visualization of trajectories on the self-organizing map let us clearly see the evolution of pollution levels and consequently evaluate the effectiveness of the taken measures, after and during the protocol activation time. Some philosophers, like David Chalmers, have either shown their sympathy for, or explicitly endorsed, the following two principles: Panpsychism—roughly the thesis that the mind is ubiquitous throughout the universe—and Organizational Invariantism—the principle that holds that two systems with the same fine-grained functional organization will have qualitatively identical experiences. The purpose of this paper is to show the tension between the arguments that back up both principles. Most people think indexical thought has special content (_de se_ content). However, it has been acknowledged that classical examples, such as those offered by Perry and Lewis, are insufficient to establish this conclusion. Ongoing discussions typically focus on first-person beliefs and their relationship to the explanation of successful behavior and linguistic practices. Instead, I want to direct attention to the phenomenal content of our conscious experiences and the largely neglected contribution that its comprehension can make to the way in which (...) first-person representation is understood. This paper offers a novel argument for both the existence and a specific interpretation of the essential indexicality thesis based on widely accepted assumptions regarding the relation between phenomenology and representation. Specifically, I will argue that if (i) two different individuals can have token experiences with the same phenomenology and ii) two token experiences of ordinary subjects with the same phenomenology have the same phenomenal content, then phenomenal content is_ de se _content of a particular kind: _perspectival de se_ content. This paper aims to show that: 1) theory of evolution is ontologically neutral inside the debate about metaphysical naturalism and theism; and 2) that it is consistent to hold simultaneously methodological naturalism and theism. In order to achieve this, I shall first examine Plantinga’s argument that tries to show that there is consistency between theism and evolution, but, on the contrary, there is inconsistency between the theory of evolution and naturalism. I accept the first part of this argument, but I (...) reject the second part. I defend that Plantiga’s argument is valid if and only if it is supposed a theory of truth by correspondence. Finally, I shall argue that if such notion is replaced by James’s pragmatist conception of truth, it is possible to conclude 1 and 2. (shrink)

En los debates actuales sobre ética y filosofía política, a menudo se acusa a autores de tradiciones tan distintas como Gianni Vattimo, Paul K. Feyerabend y Richard Rorty de pecar de un mismo vicio: el relativismo en su idea de lo que es la racionalidad (tanto epistémica como moral). Nuestra tesis en este escrito es doble: en primer lugar, defendemos que ninguno de ellos es (ni se considera) relativista; sino que, bien al contrario, su pensamiento podría considerarse como un ejercicio (...) de "antirrelativismo". En segundo lugar, puntualizaremos que este antirrelativismo no les lleva a identificarse con el universalismo (epistémico o moral); sino que, de algún modo, logran recuperar una vía intermedia entre estos dos extremos para apostar a favor de una idea de racionalidad práctica que cifra en el diálogo sin apriorismos sus esperanzas. Desde un punto de vista postmetafísico y a partir de los argumentos que nos proporciona un autor como Ludwig Wittgenstein, trataremos de defender la tesis de que las normas en general cobran su carácter normativo de la responsabilidad que se atribuye a cada agente cuando, al actuar en sociedad, se liga a los compromisos que sostienen la posibilidad de que esa acción sea común. Esos compromisos, ya que no pueden responder ante una instancia ajena a los agentes sociales , habrán (...) de tener el cariz práctico de todo lo que atañe en exclusiva a los afanes de los humanos entre sí. Una regla no nos pide que respondamos de su cumplimiento o no, pero nosotros sí que podemos pedirnos cuentas unos a otros de ese cumplimiento o vulneración a partir de la responsabilidad compartida en la vida social en que pululan tales reglas; de hecho, a aquellos que las incumplen gravemente, siempre podemos apartarlos definitivamente de nuestra vida en sociedad adjudicándoles «maldad» o «locura» persistente. Al caer así en la cuenta de que las reglas tienen sólo este género de responsabilidad mutua, una nueva regla se nos puede hacer plausible junto a las demás: la de tolerar la posibilidad de otros compromisos con diferentes reglas en otros contextos que hayan generado otras responsabilidades diferentes a las nuestras. Existe una aparente incongruencia entre, por una parte, la gran distancia que Ludwig Wittgenstein detectaba entre sus objetivos filosóficos y los de los pragmatistas y, por otra, el acercamiento que posteriormente se ha producido en la historia de la recepción de la filosofía wittgensteiniana entre esta y el (neo)pragmatismo. Con afán de tratar de arrojar algo de luz sobre tal discordancia, nos ocuparemos aquí de modo privilegiado en las reflexiones de Wittgenstein en torno al cumplimiento de reglas (es decir, sobre (...) el fenómeno de la normatividad), y la solución que a este respecto dan diversos autores pragmatistas, para comprobar si efectivamente es similitud o más bien radical disparidad (o tal vez, si se nos permite la manida referencia, simplemente un «parecido de familia») la que se da entre el proyecto filosófico wittgensteiniano y el pragmatista. Pero el objetivo fundamental de este escrito no es, con todo, una simple determinación exegética de cuáles son las verdaderas intenciones de unos y otros (esfuerzo intencionalista que combinaría bastante mal, por lo demás, con las nociones tanto wittgensteinianas como pragmatistas acerca de la normatividad); sino que de lo que se tratará será principalmente de ver qué tesis resultan, a la postre, más plausibles si queremos hacernos con una idea filosóficamente coherente del fenómeno de lo normativo: si las de un pragmatismo estereotipado (que Wittgenstein repudia ferviente), o bien las de un pensamiento que se quiere no filosófico (como el del propio vienés), o bien las mucho más matizadas consideraciones procedentes del neopragmatismo.
