Seit dem Zusammenbruch der bipolaren Ordnung wissen wir, dass weder die internationale "Staatengemeinschaft", noch das Imperium Amerika oder gar das globale Empire als raumliche Bezugsgrossen die weltpolitische Realitat angemesssen abbilden konnen. Vor allem China, aber auch Russland und Indien entziehen sich dieser Kategorisierung. Am deutlichsten wird das bei der Europaischen Union, die nicht nur kein Imperium sein will, sondern sich geradezu als Gegenmodell versteht. Hier kommt die Grossraumtheorie ins Spiel, die Carl Schmitt zu Beginn des Zweiten Weltkrieges entwickelt hat. All geopolitical change represents the creation of a new order and this entails the alteration of the spatial conditions and, therefore, the modification of the way of understanding borders. Carl Schmitt, especially in his last stage, aimed at delineating a new international configuration made up of large spaces (Grossräume), once the time of sovereignties typical of the Ius publicum europaeum was over. The goal of this study is to analizy to which extent and how Schmitt 's analytical tools around borders (...) can be useful to understand the current state of globalization. Todo cambio geopolítico representa la creación de un nuevo orden y ello conlleva la alteración de las condiciones espaciales y, por tanto, la modificación de la manera de entender las fronteras. Carl Schmitt, especialmente en su última etapa, apuntó al delineamiento de una nueva configuración internacional conformada por grandes espacios (Grossräume), una vez que el tiempo de las soberanías propias del Ius publicum europaeum había terminado. El objetivo de este estudio es analizar hasta qué punto y de qué manera las herramientas analíticas de Schmitt en torno a las fronteras pueden ser útiles para comprender el estado actual de la globalización. The paper is devoted to the analysis of the evolution of the basic political figures of Carl Schmitt’s philosophical discourse from the 1920s to the early 1940s. It emphasized the importance of the transition from a statist perspective of an ordered, territorially closed state understood as the basic area of political implementation to a dynamic formation based on the category of Volk – the Great Space, which is devoid of defining characteristics in the form of territorial borders and stable legal (...) rules. The analysis of this process is based on the analogy between the Schmittian concept of the Grossraum formation and Klaus Theweleit’s concept of fascist subject – fundamentally indefinite, broken and boundless. It is the transition from the category of the closed state to the category of Volk as a concrete and dynamic essence of the political that not only inscribes Schmitt’s thought in the broadly understood fascist discourse, but also makes Schmitt’s concept of the international political entity structurally and essentially similar to the borderless and fluid fascist subject described by Theweleit. In the proposed interpretation, the concept of the Great Space, contrary to what Schmitt claims, is not an objective description of the processes taking place in the international relations of that time, but the postulate of a new, expansive, fascist nomos of the Earth. Dans cette étude du grand livre que Schmitt a consacré à l’histoire du droit international, Le Nomos de la terre, on tente de reconstituer la logique d’une pensée qui, partie de l’idée d’un lien essentiel entre le droit et la « limite », aboutit à une critique de la résurgence moderne de la « guerre juste » comme « guerre pour l’humanité ». Si l’actualité et la sagacité de certaines analyses restent frappantes, on rappelle aussi ici ce que fut « (...) l’envers de la critique », soit l’accompagnement théorique que Schmitt a fourni à la politique du « grand espace » nazi et son rejet ultérieur de la notion de « crime contre l’humanité », où peuvent se lire les effets d’un « antihumanisme » radical.This paper is a study of Schmitt’s book The Nomos of the Earth. We try to investigate the historical background and the political consequences of Schmitt’s genealogy and criticism of the humanitarian « just war ».Schmitts Verständnis des « Nomos » begründet seine Polemik gegen die destabilisierenden Folgen des Universalismus und gegen den « Krieg für Menschheit ». Heute findet diese Kritik eine neue Aktualität. Aber sowohl mit seiner Rechtfertigung der « Grossraum »-Politik als auch mit seiner Verwerfung des Begriffs des « Verbrechens gegen die Menschlichkeit », hat Schmitt die gefährlichsten Konsequenzen aus seinem juristischen « Antihumanismus » gezogen.
