John Searle attempts to show through a consideration of promising that at least some ‘ought’ statements can be derived from ‘is’ statements. He thinks that you can determine on purely factual grounds that a person has made a promise, and that it follows logically from the statement that a person has made a promise that he has at least a prima facie obligation to do the thing he promised to do. I agree with but not with.

I shall argue here that the reason supererogatory acts are not obligatory is that they require too much personal sacrifice, and that in order for an act to be supererogatory, it must have a kind of result that you would have an obligation to bring about if you could do so with no personal sacrifice. I further argue that traditional utilitarianism should be modified so as not to treat supererogatory acts as obligatory.

Act Utilitarianism has traditionally been regarded as the view that you should always perform the action that will bring about the greatest possible excess of happiness over unhappiness or, if there is no such alternative, the least possible excess of unhappiness over happiness.1 Following Rawls, I shall call this the classical principle. An alternative which Rawls calls the average principle is the view that you should always do the thing that will bring about the highest possible average happiness level. Rawls, (...) Rescher and Broad2 regard the average principle as superior to the classical principle, and there are considerable grounds for supposing that Mill accepted the average principle.3 Smart favours the classical position but confesses that if someone doesn't feel the same way, he doesn't know how to argue with him.4. There has been a revival of interest in Hegel of late among English-speaking philosophers. Although he is still regarded as maddeningly obscure, a number of important philosophers have been attracted by a doctrine prominently associated with Hegel, the coherence theory of truth. In order to hold the coherence theory of truth, it is obvious that you must hold what might be called the coherence theory of truth-testing as well: for if this theory is wrong and we can test some statements (...) by, for example, introspection as well as in terms of coherence, truth must involve something more than just coherence. My arguments against the coherence theory of truth-testing, since it is implied by the coherence theory proper, are indirectly against the coherence theory as well. I also argue that unless some version of the Private Language Argument is successful, it is virtually impossible to defend the coherence theory of truth-testing without denying the existence of experiences, thereby committing oneself to materialism. I try to show that there is much sap (synthetic a priori) knowledge although one may not find many, or even any, sap true statements in most natural languages. Reasons are given for the difficulty of expressing sap truths in natural languages, but it is argued that these are not necessary features of language as such. There are, then, sap true statements in some possible languages.Admission of the sap gives one a way of distinguishing logical from metaphysical possiblity. Something is (...) metaphysically impossible just in case it is a sap truth that it is impossible. I argue that the realm of logically possible entities is vastly larger than the realm of metaphysically possible entities.My.defence of the sap begins with a partial defence of the analytic/synthetic distinction. In particular, I attack the intentionality circle argument,Quine's indeterminacy thesis and some applications of the Kripke/Putnam theory of meaning for natural kind terms. Without being a conclusive defence of the analytic/synthetic distinction, this section makes the defence of the sap more secure. Arguments are then mounted in direct defence of the sap by showing that the purported reduction of sap truths to analytic truths is mistaken. Examples are adduced to show that, even where expressions of natural language fail, one can stipulate usage in ways that allow expression of sap truths. I then consider and reply to various objections, giving an example of the sort of meaning theory which illegitimately legislates the analyticity of any purported sap true statement. (shrink)

In “Incorrigibility as the Mark of the Mental,” Richard Rorty argues that although there is no characteristic that marks off everything that is mental, the contents of the stream of consciousness may be considered as that which is paradigmatically mental, and they are distinguished by the fact that sincere first-person reports about them are currently treated as incorrigible. He adds that “beliefs, desires, moods, emotions, intentions, etc.“ are also taken to be mental because reports about them are almost incorrigible.

Professor Sikora rightly says that the claim that there might turn out to be no mental events turns on finding some mark of the mental “such that certain events could be mental at one time and then cease to be mental at another time.” This sounds paradoxical, but perhaps the paradox can be mitigated as follows. On the view that I want to recommend, “being mental” resembles “being a capital crime.” One might want to say that there never were (...) any such crimes—for there never were any acts which deserved death. Or one might want to say that there used to be such crimes, but that now, thanks to new legislation, there no longer are. (shrink)

In this article it will be concluded that systematic menstrual tracking in women’s sport has the potential to cause harm to athletes. Since the ruling of Dobbs v. Jackson Women’s Health Organization (2022) in the United States, concerns regarding menstrual health tracking have arisen. Research suggests that the menstrual tracking of female athletes presents potential risks to “women’s autonomy, privacy, and safety in sport” (Casto 2022, 1725). At present, the repercussions of systematic menstrual tracking are particularly under-scrutinized, and this paper (...) seeks to combine novel research in the sport sciences with present ethical debates in the philosophy of sports. Utilizing Beauvoir’s feminist philosophy (2011), this paper argues that systematic menstrual tracking may contribute to the wider system of women’s oppression by exploiting female athletes, as well as enabling the internalization of submissive behaviour in cultures where athletes are expected to comply unquestioningly. Five policy recommendations are made concerning autonomy, informed consent, education, safeguarding and data access. The overall findings of this paper propose that a more in-depth understanding of the links between data, privacy, and the menstrual cycle are required by sports organizations and governing bodies if athletes are to be protected in a future where systematic menstrual tracking is inevitable. This article confronts the challenges and opportunities presented by medical-legal partnerships (MLPs) representing families impacted by the family regulation system. Based on the authors’ experience developing a collaboration between a medical-legal partnership, interdisciplinary law school clinic and nurse home visiting program focused on clients impacted by the family regulation system, the article challenges traditional conceptions of the MLP model and proposes an expanded vision for MLPs to address systemic injustice and improve outcomes for families.

Noninvasive prenatal testing (NIPT) has become widely available in recent years. While initially used to screen for trisomies 21, 18, and 13, the test has expanded to include a range of other conditions and will likely expand further. This paper addresses the ethical issues that arise from one particularly controversial potential use of NIPT: screening for adult‐onset conditions (AOCs). We report data from our quantitative survey of Australian NIPT users' views on the ethical issues raised by NIPT for AOCs. The (...) survey ascertained support for NIPT for several traits and conditions including AOCs. Participants were then asked about their level of concern around implications of screening for AOCs for the future child and parent(s). Descriptive and comparative data analyses were conducted. In total, 109 respondents were included in data analysis. The majority of respondents expressed support for NIPT screening for preventable (70.9%) and nonpreventable AOCs (80.8%). Most respondents indicated concern around potential harmful impacts associated with NIPT for AOCs, including the psychological impact on the future child and on the parent(s). Despite this, the majority of participants thought that continuation of a pregnancy known to be predisposed to an AOC is ethically acceptable. The implications of these data are critically discussed and used to inform the normative claim that prospective parents should be given access to NIPT for AOCs. The study contributes to a body of research debating the ethical acceptability and regulation of various applications of NIPT as screening panels expand. (shrink)

As self-conscious curators and critics of moral history, the early Confucians are relevant to the contemporary debate over the fate of memorials dedicated to morally flawed individuals. They provide us with a pragmatic justification that is distinct from those utilized in the current debate, and in many respects superior to the alternatives. In addition to supplying this curative philosophic resource, the early Confucian practices of ancestral memorialization suggest preventative measures we might adopt to minimize the chances of establishing divisive and (...) oppressive memorials in the future. This essay is based on a portion of the author’s Spinoza Lecture, which was presented in Amsterdam on 24 May 2022. Although Spinoza is not the main subject of the lecture, his anxieties and fears about his Sephardic Jewishness and its links to Africa and by extension racialized blackness offer an opportunity to outline Euromodern hegemonic geography of reason as a misrepresentation from which a shift in point of view can offer a set of important challenges to the portrait of (...) philosophy it promotes. These challenges are elaborated through the author’s summary of Africana and Black philosophy and the questions that philosophy, understood in intellectual, historical, and political terms, generates. Among these are the meanings of humanity, freedom, justification, redemption, reality, political transformation, and love. (shrink)

This essay explores the extent to which Aristotle’s zoological researches were influenced by his general psychological theory and specific psychological doctrines, and the match or mismatch between the results of his zoological investigations and his general position on questions such as definition, essence, form, and matter. It argues that psychology provides the major articulating framework for Aristotle’s zoology. Certain key points in his zoology and specific psychological doctrines influence his interpretation of the biological phenomena.

This chapter argues that neuroscientist Benjamin Libet’s data do not justify his assertion that “the brain ‘decides’ to initiate [certain actions] before there is any reportable subjective awareness that such a decision has taken place,” and do not justify associated worries about free will. The data are examined in light of some recent findings about reaction times, and some familiar distinctions in the philosophy of action, for example, the distinction between decisions and desires.

This introductory chapter provides an overview of the book, defines some key terms, makes salient a serious problem luck poses for libertarianism, and provides background on the following topics: the expression “free will,” the nature of decision, the timing of actions, and agents’ abilities.

This chapter critically examines recent work on free will and moral responsibility by Randolph Clarke, Robert Kane, and Timothy O’Connor, in an attempt to clarify issues about control and luck that are central to the debate between libertarians and their critics. It is argued that present luck, that is, luck at the time of action, poses an as yet unresolved problem for libertarianism.
