Ethnophilosophy is so called because its focus is on the thought that underlies the life patterns and belief system of a people. It is folk philosophy insofar as it is an exposition of the philosophical thought undergirding the way of life of a people as a collectivity. African and Japanese philosophy belong to this tradition. Western philosophy, however, is based on reason and logic; in contrast with ethnophilosophy, it developed ab initio as a critique of folk thought and worldviews. This is a first attempt at the philosophical articulation and projection of the Igbo concept of law and the role of law in the traditional environment. In the Igbo traditional setting, the rules of law are uncodified. The author, who teaches philosophy of law and logic at the University of Nigeria, defines the law of a given community as the body of rules recognised as binding by its members. On this concept of law, he has based his attempt to elucidate (...) the philosophical underpinning of those rules recognised in Igbo traditional legal system as law. Unless the philosphical foundation is understood, the traditional law, machinery for enforcement, and legislative and judicial processes may appear incomprehensible. The first part gives a descriptive insight into the moral, religious, socio-political and legal background of the Igbo. The second part is devoted to the fundamental questions concerning the concept of law, the various types of laws, the reciprocal influence between law and Igbo religion and the end of laws. Vjekoslav Bajsić , koji je poput Karla Balića u mnogim bitnim postavkama svojega mišljenja i svoje »integralne skolastike« anticipirao temeljna nastojanja enciklike Fides et ratio, razvio je u svojim istraživanjima vrlo osebujno razumijevanje prirodne znanosti. U ovome se radu nastoji pokazati kako je Bajsić najsuvremenije prirodoznanstvene spoznaje pokušao učiniti ne samo religijski relevantnim, već jednako tako i samu religiju pokazati kao temeljni osmišljavajući moment prirodoznanstvenih istraživanja, bez kojega same prirodne znanosti uvijek iznova dospijevaju u »krizu smisla« vlastitoga postupanja. U tom (...) se smislu razmatra i Bajsićev pojam »hominizacije« znanosti, ali i same religije, tj. njegovo nastojanje da religija i znanost ponovno zadobiju svoje životno svjetovno utemeljenje i svoju značajnost za konkretan ljudski život, bez čega one postaju bezsvjetovnim i nadvremenskim datostima koje više nemaju mogućnost da konkretnoga čovjeka oslove u njegovom faktičnom životu.Vjekoslav Bajsić der wie sein Vorgänger Karlo Balić in vielen Ansätzen seines Denkens und in seiner sogenannten »integralen Scholastik« die Grundbemühungen der Enzyklika Fides et ratio antizipiert hat, entwickelte in seinen Forschungen ein eigentümliches Verständnis der Naturwissenschaft. In diesem Beitrag versucht man zu zeigen, wie Bajsić nicht nur die modernsten naturwissenschaftlichen Erkenntnisse religiös relevant gemacht hat, sondern zugleich die Religion selbst als das sinngebende Grundmoment der naturwissenschaftlichen Forschungen betrachtet, ohne das die Naturwissenschaften selbst in „Sinnkrise” des eigenen Verfahrens immer wieder gelangen. In diesem Sinne wird auch Bajsićs Begriff der „Hominisation” der Wissenschaft erörtert, zugleich aber der Religion selbst, d.h. seine Bemühung, die Religion und Wissenschaft ihre lebensweltliche Begründung und ihre Bedeutsamkeit für das konkrete menschliche Leben wieder zu erreichen, ohne die sie die weltlose und überzeitliche Gegebenheiten werden, die keine Möglichkeit mehr haben, den konkreten Menschen in seinem faktischen Leben in Anspruch zu nehmen. How does a country repair its harm to a vulnerable minority targeted during times of national fear because of race? How did the United States redress its then popular yet unconstitutional WWII incarceration of 120,000 innocent Japanese Americans in desolate barbed wire prisons without charges, hearings, or bona fide evidence of military necessity? In response to a Congressional inquiry, political lobbying, and lawsuits, the Civil Liberties Act of 1988 directed the President to apologize and authorized over one billion dollars in (...) reparations. Congress also created a fund to educate the public about the government’s false assertion of “national security” to restrict civil liberties. Some considered redress a tremendous victory — rewriting history and personal healing. Others questioned reparations for one U.S. group but not others. Japanese American Redress served as a catalyst for reparations movements worldwide. This paper examines its genesis, legal implementation, and apparent effects. It also explores wide-ranging political mobilization and social meanings of redress and “unfinished business”. Reparations cannot be measured by laws alone. Diverse communities must engage contested questions of history, justice, and belonging. Reparations claims face often unforeseen benefits and limitations. Beauchamp* In response to society's concerns about the use of human subjects in research, the Department of Health and Human Services commissioned the Institute of Medicine to perform a comprehensive assessment of current systems of research participant protection in the U.S., including recommendations for reform (...) (Committee 2002). Although the committee declared its frustration over the lack of data, it found ample evidence to indicate that there are pivotal weaknesses in the current system. First, it discovered dissatisfaction with the current system from virtually every quarter and at virtually every level. Second, it found evidence that IRBs are under severe strain and performing inadequately. Third, it found that the existing regulatory framework—the IRB system and the Common Rule—has not and probably now cannot react adequately to the constantly evolving research environment. Some of these problems might be handled through federal agencies, but the committee holds that the problems are more extensive and will require additional institutional support and professional attention.The committee found that federal protection requirements should be extended to every research project—private, public, or otherwise. Subjects should be, in this respect, equally protected in privately sponsored research.The committee found that the IRB system is in important respects a failure, especially when it alone is relied upon for ethics reviews in institutions. One set of problems concerns the proper education of IRB members. The committee recommends that all members henceforth be given a specialized knowledge of human research ethics. It finds that IRB deliberations commonly have been dominated by scientists, who often marginalize the perspectives of nonscientist members. It therefore recommends that unaffiliated members, nonscientists, local community representatives, and those representing the participant-perspective comprise at least 25 percent of the membership. It also recommends that no protocol be approved without three-quarters of the voting members concurring. [End Page 389]The committee recommends that institutions distinguish review aimed at (1) scientific merit, (2) conflict of interest, and (3) general Ethics Review. The distinction should more evenly distribute the work of institutional ethics review. The IRB should not conduct the initial scientific review nor should it be spending the bulk of its time purely in examining either scientific merit—as many IRBs now do—or conflict of interest. Instead, the conclusions of the scientific review should be submitted to the IRB for ethics-focused deliberations. Problems of both financial and nonfinancial conflicts of interest should be handled similarly, preferably by a committee properly distanced from the institution's interests.The committee underscores that consent must be understood on the model of an interactive dialogue between research staff and participants and not merely as a signed form or single-disclosure event. Conversations between the participant and the research staff should begin even prior to the point of enrollment and should be reinforced during each stage of the research. The committee finds that informed consent conversations and documents too often are being conceived as risk management tasks gauged to protect the institution from liability.The committee also believes that the system of protections established by a research program should be open to the public in order to foster and maintain the community's trust. Open communication should occur among all relevant stakeholders. The aim of this chapter is to reconstruct a hypothetical genealogy of the U.S. national motto “in God we Trust” by comparing the juridical and theological concept of “depositum”. According to Philo of Alexandria, the deposit was the most sacred institutional act of ancient social life, because it had both a religious and a sociological function. According to the Epistulae to Timothy the term ‘deposit’ defined the legacy of the Christian faith of which the disciple of St. Paul was entrusted. (...) His task was to manage this legacy and to spread it among the others. Hence the deposit defined at the same time a contract based upon good faith and a symbolic space of “security”, namely a container that protected an unchangeable content: the oral knowledge transmitted by Christ to the Apostoles and, indirectly, to St. Paul. The depositum was also the procedure through which the word of Christ would acquire all its potential. On the other hand, the contract defined as “depositum” by Roman law was characterized by a centrality of the so-called bona fides and by the distinction between regular and irregular deposit. This means that the principle of good faith should lead the conducts of the manager whose task is exactly to look after an object called Christian faith. How can we interpret the word ‘trust’ according to the juridico-political remarks? The purpose of this chapter is to explain all these related issues. (shrink)

Due to the potential ethical and psychological implications of screening, and especially inregard of screening on children without available and acceptable therapeutic measures, there is a common view that such procedures are not advisable. As part of an independent research- and bioethical case study, our aim was therefore to explore and describe bioethical issues among a representative sample of participant families (n = 17,055 children) in the ABIS (All Babies In South-east Sweden) research screening for Type 1 diabetes (IDDM).The primary (...) aim is the identification of risk factors important for the development of diabetes and other multifactorial immune-mediated diseases. Four hundred, randomly chosen, participant mothers were asked to complete a questionnaire exploring issues of information, informed consent, bio-material, confidentiality and autonomy, and of prevention/intervention. 293 completed the questionnaire, resulting in a response rate of 73.3%. The majority of questions had the form of 6-point Likert-type response scales (1–6).We found that the majority of respondents felt calm in regard of samples and written material, and also concerning the possibility of their child in the future being identified as having high risk of developing Type 1 diabetes. An important finding concerning access and control of mainly biological data was indicated, with the respondents expressing concern for potential future use. We believe our findings indicate that this kind of empirical studies can substantially contribute to our understanding of bioethical issues of medical research involving genetics. Issues, such as safeguards ensuring theethical criteria of autonomy and respect, were emphasised by our respondents. We believe theissues brought up may promote further discussion, and do suggest issues for consideration by, among others, researchers, bioethicists and Institutional Review Boards. (shrink)

Based on extensive clinical questionnaire data, this paper explores the relation between research subjects’ self-assessed understanding and actual knowledge of a large-scale predictive screening study, and its implications for the proper handling of information and consent routines in longitudinal studies. The intitial data show that low self-assessed understanding among participants was correlated with limited knowledge, concern over participation and collected samples, less satisfaction with information, and feeling passive or negative towards the study. Among those reporting high understanding, a non-negligible number (...) displayed a lack of knowledge regarding central aspects of the study. Regarding high assessed understanding, the multivariate analysis identified the main predictor variables to be knowledge, having a positive attitude towards participation and the study itself, being satisfied with information, having a stable psychosocial background and feeling calm regarding the handling of samples. These findings indicate that to evaluate participants' understanding through self-assessment may not be reliable method. Self-assessed understanding may rather be a good indicator of general attitudes than a tool for analysing content. The data also show that actual understanding varies considerably among participants, suggesting that more effort needs to be put into adjusting the information to the needs of different subgroups. It is argued that when doing this, researchers in longitudinal studies must be careful not to exhaust participants with excessive information that they do not want and that may cause them to drop out. The ethical relevance of obtaining repeated consents in longitudinal research is discussed. (shrink)

The set-theoretic and individual-theoretic analyses of collections make the same mistake: their ontologies are far removed from language. Our basic notion, the collector, has a clear linguistic counterpart: the definite article. Our theory furnishes a theory of definite descriptions as a special case. We use 3-valued valued logic in order to come to grips with the existential presuppositions of the collections.

The knowledge of an object under observation will have no concrete meaning unless we can work out a logical model the similarities of which are known in relation to the analysed structures. The logical model, when dealing with complex structures, is drawn out by similarity starting from an analogical model worked out in relating local dimensions in the object to physical dimensions of a different nature which restrict the number of variables and can be arranged and modified as required.Any operating (...) similarity and behaviour comparisons come actually down to an apparent functional analogy. The difference between the thin structure of the natural and artificial systems makes it illusive to hope that a strict isomorphism between these two fields may thus be sorted out. However, the fact of achieving analogical models widens our knowledge and shows new possibilities to the human creative mind. (shrink)
