Verifica-se nos seus contos a presença do heterodiscurso, sendo fundamental a voz de Arthur Schopenhauer, tendo como referência a sua obra Metafísica do Amor. Por outro lado, o narrador desenvolverá uma voz que se oporá ao maquinismo do amor, a essa determinação dos sentimentos pelo dever biológico. No universo de Signos, (...) levando-se em conta a grande verdade sobre a natureza, revelada pelo filósofo, os casais não mais se encontrarão, uma vez que a paixão se esgota no tédio por causa da violência do instinto. O artigo procura apresenta os argumentos centrais das principais correntes interpretativas da Filosofia Política de Hegel na Alemanha, França e no Brasil de forma a avaliar e demonstrar o potencial de diagnose de tal esforço teórico; ao mesmo tempo, objetiva-se demonstrar desde estes autores como uma análise da obra de Filosofia Política de Hegel revela-se atual mediante a articulação de seu sistema como um todo.

This article tests human inference rationality when dealing with default rules. To study human rationality, psychologists currently use classical models of logic or probability theory as normative models for evaluating human ability to reason rationally. Our position is that this approach is convincing, but only manages to capture a specific case of inferential ability with little regard to conditions of everyday reasoning. We propose that the most general case to be considered is inference with imperfect knowledge - in the present (...) case restricted to uncertain knowledge - and that a natural framework for testing the rationality of plausible reasoning is System P. This system provides rational postulates for nonmonotonic inference. The semantic of the nonmonotonic inference is given by a possibilistic constraint introduced by Dubois and Prade (1991). This constraint states that a rule p ( q is a plausible rule if "the degree to which p ( q is possible" is greater than "the degree to which p ( (q is possible". Given the choice of this constraint, we study two supplementary postulates of rationality. Eighty-eight subjects participated in an experiment whose results confirm - provided that reflexivity and left logical equivalence would be tested in a further experiment - the rationality of human nonmonotonic inference according to the rational postulates of System P. Preference queries from databases aim to retrieve the best answers w.r.t. user's requirements. The integration of preferences in database queries has known many advances in the last decade. Most of works however are based on comparative preference statements obeying more or less strong semantics. Representing and reasoning about comparative preference statements has also been widely investigated in Artificial Intelligence. In this paper, we bridge the two frameworks and develop a simple and unified framework to reason about preferences in database queries. (...) This paper first provides a brief survey of a possibilistic handling of default rules. A set of default rules of the form, "generally, from α deduce β", is viewed as the family of possibility distributions satisfying constraints expressing that the situation where α and β is true has a greater plausibility than the one where α and ⇁β is true. When considering only the subset of linear possibility distributions, the well-known System P of postulates proposed by Kraus, Lehmann and Magidor, (...) has been obtained. We also present two rational extensions: one based on the minimum specificity principle and the other is based on the lexicographic ordering. The second part of the paper presents an empirical study of three desirable properties for a consequence relation that capture default reasoning: Rationality, Property Inheritance and Ambiguity Preservation. An experiment is conducted to investigate 13 patterns of inference for the test of these properties. Our experimental apparatus confirms previous results on the relevance of System P, and enforces the psychological relevance of the studied properties. (shrink)

One persistent question in jurisprudence relates to the role of morality in the concept of law. For instance, consider the question of whether unjust statutes are laws. Legal positivists say that they’re laws in every relevant sense, while natural lawyers say that they’re not. This article considers a different answer inspired by recent findings in experimental philosophy: there is one relevant sense in which unjust statutes are laws, but also a different relevant sense in which they aren’t. After considering the (...) ways in which this alternative differs from some of the mainstream theories in general jurisprudence, the article argues that it provides more elegant solutions to two problems that have puzzled legal philosophers in the past: the paradox of customary international law and the shifts in legal discourse over history. There has been considerable debate in legal philosophy about how to attribute purposes to rules. Separately, within cognitive science, there has been a growing body of research concerned with questions about how people ordinarily attribute purposes. Here, we argue that these two separate fields might be connected by experimental jurisprudence. Across four studies, we find evidence for the claim that people use the same criteria to attribute purposes to physical objects and to rules. In both cases, purpose attributions appear to (...) be governed not so much by original intention or by moral value as by current practice. We argue that these findings in the cognitive science of purpose attribution have implications for jurisprudential questions involving purposivist legal interpretation. (shrink)

We aimed to characterize the age of onset of training, age at menarche, menstrual periodicity, and performance perception during the menstrual cycle and examined the impact of these reproductive variables on body composition, morphology, and body weight satisfaction in Brazilian elite futsal players. The study consisted of 115 female Brazilian elite futsal players from the top national teams. Data were collected during the twentieth Women’s Brazil Futsal Cup. Players were interviewed and self-reported their age of onset of training, age at (...) menarche, menstrual periodicity, and the menstrual period, where they performed best. We also asked for what they considered to be their ideal body weight as well as information related to their training. Subsequently, anthropometric measurements were performed to estimate the body composition and determine morphological characteristics. Fifty-nine players were postmenarche-trained and 52 were premenarche-trained. Eighteen, 65, and 28 were classified as early, normal, and late menarche, respectively. Only 11 and 1 had irregular menstrual cycles and were amenorrheic, respectively. Seventy-three, 23, and 9 reported that their game performance was the best at the follicular phase, menses, and luteal phase of the menstrual cycle, respectively. No associations between the four reproductive-related variables were found. Postmenarche-trained players had significant lower age at menarche and higher percentage body fat. The somatotype profile registered lower ectomorphy rate for the postmenarche-trained participants after controlling for covariates. Early menarche group presented higher sum of six skinfold thickness and endomorphy rate compared to normal and late menarche groups. No differences were found when menstrual periodicity groups and best performance groups were compared, except for higher femur width in the regular menstrual cycle group compared to the irregular one. The association between body weight satisfaction and the four reproductive-related variables were not observed. Premenarche-trained Brazilian elite futsal players had the menarche later than the postmenarche-trained athletes. Most of the participants had menarche age classified as “normal,” presented “regular” menstrual cycles and perceived to perform better during the follicular phase of the menstrual cycle. (shrink)

Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

Recent literature in experimental philosophy has postulated the existence of the abstract/concrete paradox : the tendency to activate inconsistent intuitions depending on whether a problem to be analyzed is framed in abstract terms or is described as a concrete case. One recent study supports the thesis that this effect influences judicial decision-making, including decision-making by professional judges, in areas such as interpretation of constitutional principles and application of clear-cut rules. Here, following the existing literature in legal theory, we argue that (...) the susceptibility to such an effect might depend on whether decision-makers operate in a legal system characterized by the formalist or particularist approach to legal interpretation, with formalist systems being less susceptible to the effect. To test this hypothesis, we compare the results of experimental studies on ACP run on samples from two countries differing in legal culture: Poland and Brazil. The lack of significant differences between those results suggests that ACP is a robust effect in the legal context. (shrink)

This article analyzes the issue of organizational transparency through the lens of Thomas Aquinas’ ethics. It provides moral justification for current claims about corporate transparency and sheds light on the ethical values and virtues affecting information disclosure decisions. Transparency is conceptualized as an informational mechanism necessary for performing the virtues of truthfulness, justice, and prudence. This article extends the organizational transparency and corporate social responsibility literatures by providing an alternative moral justification grounded in virtue-based theory, which extends our understanding of (...) the information disclosure decisions made by management. Cultural diversity is an inescapable reality and a concern in many businesses where it can often raise ethical questions and dilemmas. This paper aims to offer suggestions to certain problems facing managers in dealing with cultural diversity through the inspiration of Thomas Aquinas. Although he may be perceived as a voice from the distant past, we can still find in his writings helpful and original ideas and criteria. He welcomes cultural differences as a part of the perfection of the universe. (...) His systemic approach leads one to place the problem in its proper context, and to reflect on it from the perspective of virtue ethics, with a central role for practical wisdom and giving primacy to neighborly love and natural moral law. Rather than a set of rigid standards with no consideration of diversity Aquinas focuses on the common human ground, which allows for the indispensable dialogue between different positions. When dealing with practical questions, the problem is one of finding the right balance between general principle and cultural specifics, tolerance, and dialogue, always guided by practical wisdom. In this way, Aquinas’ approach is neither rigid ethical universalism with no consideration for diversity nor moral relativism with no place for any transcultural and absolute morals. (shrink)

In a larger context of an egalitarian project which aims to reformulate capitalism a job guarantee program in the form of a State as an Employer of Last Resort is considered superior to Unconditional Basic Income by many, namely Alan Thomas. This article claims that most of the arguments used to assert the superiority of SELR fail their objective, for the following reasons: first, SELR falls short in its reformulation of capitalism because neither SELR nor UBI alone can euthanize the (...) rentier class. Second, most accounts are based on a flawed assumption that UBI leads to rampage inflation. Third, if macroeconomic considerations are not enough to justify implementing SELR over UBI, then insisting on the superiority of SELR can only stem from two types of moral reasons: on one hand from a perfectionist view of empowering the worst-off through labor and on the other from demands and obligations of reciprocity. We argue that these two moral-based reasons fall short of providing a justification for the superiority of SELR over UBI. We conclude our paper defending the possibility of conciliating the two policies. (shrink)

The paper highlights the need to discuss the norm of reciprocity in the context of basic income experiments. Considering how the norm of reciprocity is an important objection to basic income, both at a normative level, but also in empirical discussions, a case is made for considering it in basic income experiments. The paper proposes several hypotheses on basic income and reciprocity and concludes with two distinct points: the first is focused on what in fact experiments could be telling us (...) about behaviours that seem relevant to reciprocity, and how this could enhance our understanding of both basic income and the norm of reciprocity. The second point is a reflection on how our theoretical debate is shaped on ideal settings, whereas experiments take place in real-world conditions, hence non-ideal ones. This reflection might contribute to the need to reframe our theoretical account of the norm of reciprocity. (shrink)

O presente trabalho trata, em linhas gerais, da filosofia do direito de Immanuel Kant (1724- 1804), discutindo seu enquadramento no jusnaturalismo ou no juspositivismo. Para tanto, analisa o contraste entre a fundamentação do direito em Kant, fortemente marcada pela ideia de liberdade como legitimadora do Estado e da ordem jurídica, e sua estrutura, caracterizada pelo formalismo, pelo rigor lógico, pela importância exagerada da coação e pela manutenção da validade da ordenamento mesmo diante de um rompimento com a ideia de justiça (...) que o sustenta (negação do direito de resistência). Este artigo tem como objetivo apresentar um diálogo entre a literatura que perpassa a temática entre os filósofos Jürgen Habermas e Immanuel Kant, e suas contribuições para pensarmos o campo da Educação. Caracteriza-se por um estudo bibliográfico, fundamentado na análise e interpretação da temática proposta. Aponta-se algumas aproximações relevantes da perspectiva habermasiana e o pensamento kantiano, sobretudo no que diz respeito a conceitos básicos como emancipação e conhecimento, apropriando-se dos sentidos e interpretações discutidas nas obras bibliográficas elencadas. A partir do (...) diálogo exposto, compreende-se as contribuições dos pressupostos comunicativos no campo educacional, na área de formação continuada de profissionais da educação, conduzindo assim a uma justiça social expressa por processos de ensino-aprendizagem, garantindo o preparo de profissionais da educação fundamentada na concepção de um professor reflexivo, pesquisador e que aprende com o coletivo, visando o atendimento às necessidades de seus estudantes. Partindo de algumas passagens dos Ensaios de Montaigne, e, especialmente, do capítulo "Sobre versos de Virgílio", consideramos o retrato da mulher elaborado pelo autor. Contrariamente à maioria dos autores de sua época - dentre os quais Bodin e Charron que, seguindo Aristóteles, consideram que a mulher possui uma natureza inferior à do homem, feita para obedecer, enquanto este último o foi para governar -, Montaigne nos apresenta outro quadro. Influenciado, acreditamos, pelo texto de Agrippa sobre as mulheres, ele propõe uma (...) igualdade dos gêneros desequilibrada, perturbada e aniquilada tanto pela tradição quanto pelos costumes. Taking as a starting point some passages of Montaigne's Essays and the chapter "On some verses of Virgil", we consider the woman's portrait composed by the author. In contradicion with the majority of his contemporary authors - such as Bodin and Charron who, in accordance with Aristotle, consider women's nature as inferior to that of men, since women are meant to obey while men are meant to rule -, Montaigne presents us another picture. Influenced by, we believe, Agrippa's text on women, he proposes an equality between the genders unballanced, perturbed and annihilated by both tradition and customs. (shrink)

Este dossiê representa a continuidade de um projecto centrado no património dos agentes ligados à produção, circulação e recepção do livro. A partir da história e dos espólios de empresas editoriais e de coleccionadores, bibliófilos e/ou divulgadores, a introdução problematizante e os depoimentos convocam a memória dos agentes e debatem as ameaças que pendem sobre essa herança cultural riquíssima e possíveis soluções. As boas práticas de vários países impõem uma reflexão inadiável para o contexto português: que vias de cooperação inter-institucional (...) concretas para garantir o depósito, tratamento e comunica­ção duma dimensão fulcral do património e da memória colectiva. A relevância desta ques­tão deve-se a estar inextricavelmente ligada a um reconhecimento sustentável do estatuto patrimonial e histórico dos acervos dos editores e doutros agentes ligados à edição e ao livro enquanto espaços vitais para a construção da cultura impressa e para a história do livro e da edição. The aim of this work is to present the thesis “On the Ontogenetic Evolution of the Human Embryo in its Relations with Phylogenesis,” by Affonso Regulo de Oliveira Fausto, published in Brazil in 1890. To our knowledge, it was one of the first Brazilian academic works focused specifically on evolution. It was also the first doctoral thesis that addressed the topic of recapitulation in order to analyze what was then called the progressive evolution of the human species in tandem with (...) the embryological development of the individuals that would constitute the Brazilian “type.” In the present work, we analyze the author’s thesis in relation to its sources, concepts, as well as the country’s political context at the time of its publication. Fausto’s text, in which he explicitly recognized the influence of Ernst Haeckel’s recapitulation theory, represents a window to understand better a concept of nation based on science and on the idea of inexorable progress that was accepted in Brazil at the end of the nineteenth century. Ortega y Gasset enriqueceu os seus estudos na Alemanha entre 1905 e 1908, nas cidades de Leipzig, Berlim e Marburgo, tendo sido aqui discípulo do neokantiano HermannCohen. Tomando essa circunstância como ponto de partida, propõe-se, neste artigo,levar a cabo uma indagação sobre as ideias estéticas de Ortega, contrastando com os fundamentos das fontes kantianas ou neokantianas da sua formação universitária alemã,traçar uma linha que permita demarcar claramente até onde Ortega segue Kant e onde,pelo contrário, o filósofo espanhol trilha o seu (...) solitário e original caminho. This article starts with a historical questioning of postmodernity religious phenomenon, revisiting the "Masters of Suspicion", trying to detect the "perversions" of religion. The article presents the spirituality as something different from religion. Spirituality as the expression of the ancient spiritual traditions and religion as their historical formulations. It is argued that a Holistic Spirituality would seek convergences between all spiritual traditions. From that point we examine some of the major contemporary challenges, namely neoliberalism, postmodernity, as well as matters relating (...) to Justice, Peace and Ecology. The holism is indicated as output to a new paradigm. Finally, we intend to combine the holistic paradigm to the paradigm of liberation theology. Thus, the article concludes with practical issues: the problem of mediations of God's Kingdom, for example: a) the Christian churches today would be mediating the Kingdom? What about the religious life); b) some urgent issues of justice, peace, ecological respect, option for the poor and oppressed, looking for a non-capitalist economic model and more direct democracy, the need for active non-violence, the presence of grace in the midst of strategic and tactics mediations, as well as practice Spirituality following the Master of Galilee. The purpose of this article is to offer a new view of the key relation between the content and the conscious character of visual experience. The author aims to support the following claims. First, the author rejects the qualia realist claim that conscious character is an intrinsic, nonrepresentational property of visual experience, for example, a pattern of activation of neurons. However, the author also rejects the rival widespread representationalist claim that the conscious character of visual experience is identical to, or (...) supervenes on, any specific property represented by visual experience. The positive proposal is the following. Conscious character is identical to those patterns of activation of neurons that are referentially or representationally alive. Conscious redness, for example, is a pattern of activations of neurons that is normally created only when brains of physical duplicates come in visual contact with some distal property. This pattern of activation is recruited by natural selection to represent that property. This is called meaning representationalism. (shrink)
