The article deals with the interpretation of the Council of Europe Convention on Human Rights and Biornedicine, article 17. The author develops the idea of dignity in regard to therapeutic and non-therapeutic research. He points out the tension and unity between the aim of healing and the aspect of wellbeing of the patient in research. The article discusses especially the criteria for non-therapeutic research and stresses the fact that this research aims to attain benefits for »other persons in the same (...) age category or afflicted with the same disease or disorder or having the same condition« as the patient. In this important new book, Jürgen Habermas takes up certainfundamental questions of philosophy. This article contains reflections on the further structural transformation of the public sphere, building on the author’s widely-discussed social-historical study, The Structural Transformation of the Public Sphere, which originally appeared in German in 1962 (English translation 1989). The first three sections contain preliminary theoretical reflections on the relationship between normative and empirical theory, the deliberative understanding of democracy, and the demanding preconditions of the stability of democratic societies under conditions of capitalism. The fourth section turns to the implications of digitalisation (...) for the account of the role of the media in the public sphere developed in the original work, specifically to how it is leading to the expansion and fragmentation of the public sphere and is turning all participants into potential authors. The following section presents empirical data from German studies which shows that the rapid expansion of digital media is leading to a marked diminution of the role of the classical print media. The article concludes with observations on the threats that these developments pose for the traditional role of the public sphere in discursive opinion and will formation in democracies. (shrink)

In the midst of the current crisis that is threatening to derail the historical project of European unification, Jürgen Habermas has been one of the most perceptive critics of the ineffectual and evasive responses to the global financial crisis, especially by the German political class. This extended essay on the constitution for Europe represents Habermas’s constructive engagement with the European project at a time when the crisis of the eurozone is threatening the very existence of the (...) European Union. There is a growing realization that the European treaty needs to be revised in order to deal with the structural defects of monetary union, but a clear perspective for the future is missing. Drawing on his analysis of European unification as a process in which international treaties have progressively taken on features of a democratic constitution, Habermas explains why the current proposals to transform the system of European governance into one of executive federalism is a mistake. His central argument is that the European project must realize its democratic potential by evolving from an international into a cosmopolitan community. The opening essay on the role played by the concept of human dignity in the genealogy of human rights in the modern era throws further important light on the philosophical foundations of Habermas’s theory of how democratic political institutions can be extended beyond the level of nation-states. Now that the question of Europe and its future is once again at the centre of public debate, this important intervention by one of the greatest thinkers of our time will be of interest to a wide readership. This anthology brings together for the first time, in revised or new translation, ten essays that present the main concerns of Jürgen Habermas's program in formal pragmatics. Jürgen Habermas's program in formal pragmatics fulfills two main functions. First, it serves as the theoretical underpinning for his theory of communicative action, a crucial element in his theory of society. Second, it contributes to ongoing philosophical discussion of problems concerning meaning, truth, rationality, and action. By the "pragmatic" dimensions of language, Habermas means (...) those pertaining specifically to the employment of sentences in utterances. He makes clear that "formal" is to be understood in a tolerant sense to refer to the rational reconstruction of general intuitions or competences. Formal pragmatics, then, aims at a systematic reconstruction of the intuitive linguistic knowledge of competent subjects as it is used in everyday communicative practices. His program may thus be distinguished from empirical pragmatics--for example, sociolinguistics--which looks primarily at particular situations of use. Religious toleration first became legally enshrined in Europe in the 16th and 17th centuries. Religious toleration led to the practice of more general inter-subjective recognition of members of democratic states which took precedence over differences of conviction and practice. After considering the extent to which a democracy may defend itself against the enemies of democracy and to which it should be prepared to tolerate civil disobedience, the article analyses the contemporary dialectic between the notion of civil inclusion and multiculturalism. Religious (...) toleration is seen as the pacemaker for modern multiculturalism, in which the claims of minorities to civic inclusion are recognized so long as members of all groups understand themselves to be citizens of one and the same political community. Some authors claim that minimal models have limited epistemic value (Fumagalli, 2016; Grüne-Yanoff, 2009a). Others defend the epistemic benefits of modelling by invoking the role of robustness analysis for hypothesis confirmation (see, e.g., Levins, 1966; Kuorikoski et al., 2010) but such arguments find much resistance (see, e.g., Odenbaugh & Alexandrova, 2011). In this paper, we offer a Bayesian rationalization and defence of the view that robustness analysis can play a confirmatory role, and thereby shed light on the potential of minimal (...) models for hypothesis confirmation. We illustrate our argument by reference to a case study from macroeconomics. At the same time, we also show that there are cases in which robustness analysis is detrimental to confirmation. We characterize these cases and link them to recent investigations on evidential variety (Landes, 2020b, 2021; Osimani and Landes, forthcoming). We conclude that robustness analysis over minimal models can confirm, but its confirmatory value depends on concrete circumstances. (shrink)

With a philosopher like Martin Seel, reflecting this closely on the literary form in which to present his ideas, it is not surprising that philosophy of language makes for a focus of interest. Since my own interest also points in this direction, I will start with Seel’s groundbreaking essay on literal and figurative speech (I). I will then deal with the concept of ›letting oneself be determined‹ as the pivotal point of Martin Seel’s philosophy (II). The resulting pragmatist understanding of (...) sociocultural forms of life has important consequences for the way in which Seel detranscendentalizes Kant’s epistemology (III). Finally, I will critically examine the conception of a practical philosophy developing aesthetics and morality out of the fundamental question of ethics (IV). In this conception, a self-image of philosophy oriented towards the unity of the true, the good and the beautiful. In my opinion, however, Martin Seel neglects history as a dimension in which reason leaves its traces (V). (shrink)

Feature logics are the logical basis for so-called unification grammars studied in computational linguistics. We investigate the expressivity of feature terms with negation and the functional uncertainty construct needed for the description of long-distance dependencies and obtain the following results: satisfiability of feature terms is undecidable, sort equations can be internalized, consistency of sort equations is decidable if there is at least one atom, and consistency of sort equations is undecidable if there is no atom.

One of the achievements of Hans Blumenberg’s historical anthropology is to have reflected on the way individuals can preserve themselves when they come up against points of significance (Bedeutsamkeiten). Goethe’s encounter with Napoleon, in which the poet succeeded in standing up to the emperor at eye level, was of such self-preserving significance. For Blumenberg himself, his sole encounter with Thomas Mann was of comparable significance, since the Nobel prize-winner asserted himself in the face of the ascendant Nazis as the representative (...) of Goethe and the defender of a humane world. Blumenberg likewise sought contact with Carl Schmitt in order to claim his own interpretative sovereignty over Goethe and thereby — following the model of Goethe and Thomas Mann — assert himself against a representative of the Third Reich. This article discusses the complex space of the city as an urban milieu of vitality. On the skin of the city, a permanent change of its physical and physiognomic appearance takes place. The alternation of urban “faces” is constituted situationally in the structures and wrinkles of the skin. However, characteristic features of urban quarters do not only appear visually; they become bodily felt and are perceptible as holistic impressions, emanating from atmospheric “vital qualities”. Therefore, lively urban districts are discussed as (...) “body islands” in urban space. Seen from this vitalistic perspective, the city is not only a world of rational actors—as it is common ground in the social sciences—but also an unpredictable space of performativity. (shrink)

Quasi-equational logic concerns with a completeness theorem, i. e. a list of general syntactical rules such that, being given a set of graded quasi-equations Q, the closure Cl Q = Qeq Fun Q can be derived from by the given rules. Those rules do exist, because our consideration could be embedded into the logic of first order language. But, we look for special (quasi-equational) rules. Suitable rules were already established for the (non-functorial) case of partial algebras in Definition 3.1.2 of (...) [27], p. 108, and [28], p. 102. (For the case of total algebras, see [35].) So, one has to translate these rules to the (functorial) language of partial theories .Surprisingly enough, partial theories can be replaced up to isomorphisms by partial Dale monoids (cf. A Hobbesian Model. If ever possible the modelling of the abstract pattern of the item of a philosophical theory belongs, alas!, to its interpretation. In the case of the Hobbesian theory of the natural right and the natural laws (Lev c. XIV, XV) the mathematics of the covenant-model and of its interpretation by an model of preferences and utilities is a neglect task till now. Its performance shows certain shortcomings of the Hobbesian theory.

In the Metaphysics of Morals Kant repeats Hamann's remark that “only the descent into the hell of self-cognition can pave the way to godliness”. This article pursues the question what Kant and Hamann meant by a “descent into the hell of self-cognition” and a “way to godliness”. It will be shown that they share an affinity in their assessment that evil is rooted in humanity and that moral improvement is necessary, but that their views nevertheless differ significantly. For this reason (...) Kant later distances himself from Hamann. Whereas Hamann's view is that the recognition of one's own depravity leads to an experience of one's dependence on God, with the consequence that the concept of godliness is understood as salvation through grace, Kant emphasizes the inscrutability of evil within us and calls for moral improvement through our own effort. In this way the divergent moral conceptions of the age of Enlightenment with their theological and philosophical aspects are reflected in the respective views of these two authors. (shrink)
