Ao longo da descrição da paideía pela mousik é e gymnastik é proposta por Sócrates na República , mais de uma vez foi considerado que ela concorre para a persuasão dos homens sobre certas crenças que eles deveriam ter. Porém, mais do que as referências explícitas às relações entre poesia e persuasão, o que se deve de ter em vista é que a poesia dirigida aos que são educados na cidade é moldada pelo conhecimento que Sócrates demonstra ter dos elementos (...) da alma humana e de suas relações. A sofisticada "psicologia" apresentada na República é o ponto de partida para uma intervenção na alma dos homens, através da paideía , que visa à ordenação dos elementos constituintes de suas almas de modo a torná-los mais propensos a aceitar as leis e as prescrições que dirigem o modo de vida da cidade. Nesse sentido, pode-se dizer que a poesia, que faz parte dessa paideía , visa à persuasão. (shrink)

Uma noção que perpassa tanto o Estatuto da Advocacia e da OAB quanto o Código de Ética e Disciplina da OAB é a noção da dignidade da profissão de advogado. Essa alta dignidade também se encontra refletida na solenidade que costuma acompanhar os atos jurídicos, cujos sinais visíveis vão desde a indumentária jurídica até o tratamento especial que se dispensa a todos os agentes envolvidos na produção da justiça. Que tudo isso atinja até mesmo os cidadãos que servem temporariamente à (...) justiça como jurados mostra que o verdadeiro valor encontra-se mais no servir à justiça do que nas pessoas que se encontram investidas dessa função. O diálogo Críton, de Platão, representa um desses momentos em que um valor se encarna com a máxima evidência, nesse caso, o valor da justiça e das leis. Ao retratar de forma magistral e exaustiva os fundamentos do profundo compromisso de Sócrates para com as leis que sustentavam a pólis, o autor lega para a posteridade um texto capaz de levar os homens de todos os tempos à compreensão do que seja a cidadania e do valor do que veio a ser chamado de estado de direito.Palavras-chave: Sócrates, Críton, valores, “estado de direito”. No Protágoras, de Platão, ao defender a sua concepção segundo a qual a virtude se ensina, o personagem que dá nome ao diálogo faz uma breve exposição do que seria a educação tradicional em seu tempo e atribui a ela, aos costumes e às leis o poder de promover nos cidadãos a conquista das virtudes cívicas fundamentais, ainda que destaque a necessidade do concurso da coerção. Uma comparação com a proposta de educação visando às mesmas virtudes na República mostrará uma (...) notável semelhança entre as duas concepções. Porém certas diferenças fundamentais também se fazem notar. O sofista do primeiro diálogo mencionado parece muito mais otimista do que o Sócrates do segundo quanto à possibilidade de promover a virtude. O que parece patente é que, segundo esse Sócrates, é necessária uma intervenção muito profunda na educação e nos costumes antes que se possa esperar que os homens adquiram e mantenham as virtudes cívicas fundamentais. Essa intervenção parece fundada num profundo conhecimento da alma humana e das forças em jogo nela. Parece também fundada em uma compreensão de como intervir na alma para promover o ordenamento que tornará possível a virtude. (shrink)

Trata-se de uma introdução interpretativa ao primeiro livro filosófico publicado por Simone de Beauvoir, Pirro e Cinéias (1944), que inaugura, segundo ela, após a eclosão da Segunda Guerra Mundial, o período moral de sua carreira literária e seu interesse particular em atribuir um conteúdo material à moral existencialista – junto de um livro publicado posteriormente, Por uma moral da ambiguidade (1947). Destaca-se, portanto, que Beauvoir é a autora que vai superar as oposições que separavam a natureza da cultura, o corpo (...) do espírito, a liberdade da facticidade, a subjetividade da objetividade, o individual do coletivo, o particular do universal, de tal forma que sua alternativa será, no ensaio aqui estudado, pensar como as liberdades separadas entre si se reconhecem mutuamente para que o movimento ontológico de uma em direção à outra possibilite uma investigação do vínculo fundamental e indissociável entre os extremos mencionados. Com efeito, nossa conclusão é que Pirro e Cinéias anuncia duas das ideias centrais que esclarecem o período moral da literatura beauvoiriana, que é a individualidade de cada situação vivida, tal como as situações de suas personagens literárias, e o movimento das liberdades situadas em sua própria dimensão: a dimensão humana. More organizations use AI in the hiring process than ever before, yet the perceived ethicality of such processes seems to be mixed. With such variation in our views of AI in hiring, we need to understand how these perceptions impact the organizations that use it. In two studies, we investigate how ethical perceptions of using AI in hiring are related to perceptions of organizational attractiveness and innovativeness. Our findings indicate that ethical perceptions of using AI in hiring are positively related (...) to perceptions of organizational attractiveness, both directly and indirectly via perceptions of organizational innovativeness, with variations depending on the type of hiring method used. For instance, we find that individuals who consider it ethical for organizations to use AI in ways often considered to be intrusive to privacy, such as analyzing social media content for traits and characteristics, view such organizations as both more innovative and attractive. Our findings trigger a timely discussion about the critical role of ethical perceptions of AI in hiring on organizational attractiveness and innovativeness. (shrink)

This paper presents an ontological perspective that enables evaluating the effectiveness of business models from an integrative worldview. Different groups’ fragmented and reductionist views on this topic create a dichotomy that makes it difficult to compare and analyze them in practice. Such groups use different values for some components, which may result in neglecting others and their interrelationship. This study discusses a functional characteristic of business models that academia still needs to address. It explores new frontiers in the field, such (...) as business models for networks, sustainability, and their practical evaluation. To achieve an integrative ontology and avoid focusing on specific constructs or systems at the expense of others, we draw upon the theory of worldviews from Wilhelm Dilthey, reformational philosophy, and Herman Dooyeweerd’s theory of modal aspects. Society should move beyond dualistic thinking and embrace practical and applicable solutions. To help companies develop effective models, we introduce a new business model framework based on an integrative worldview that enables comparisons and evaluations of companies in practice. Creating competitive advantages and value appropriations synergizes with essential aspects of reformational philosophy. Analyzing and interrelating such elements are fundamental to understanding the real applied value of business models. (shrink)

The use of artificial intelligence (AI) in hiring entails vast ethical challenges. As such, using an ethical lens to study this phenomenon is to better understand whether and how AI matters in hiring. In this paper, we examine whether ethical perceptions of using AI in the hiring process influence individuals’ trust in the organizations that use it. Building on the organizational trust model and the unified theory of acceptance and use of technology, we explore whether ethical perceptions are shaped by (...) individual differences in performance expectancy and social influence and how they, in turn, impact organizational trust. We collected primary data from over 300 individuals who were either active job seekers or who had recent hiring experience to capture perceptions across the full range of hiring methods. Our findings indicate that performance expectancy, but not social influence, impacts the ethical perceptions of AI in hiring, which in turn influence organizational trust. Additional analyses indicate that these findings vary depending on the type of hiring methods AI is used for, as well as on whether participants are job seekers or individuals with hiring experience. Our study offers theoretical and practical implications for ethics in HRM and informs policy implementation about when and how to use AI in hiring methods, especially as it pertains to acting ethically and trustworthily. Crowdfunding platforms have revolutionized entrepreneurial finance, with 200 billion dollars expected to be dispersed annually to entrepreneurs and small business owners by 2020. Despite the importance of this growing phenomenon, our knowledge of the dynamics of successful lending-based prosocial crowdfunding and its implications for the business ethics literature remain limited. We use a social responsibility lens to examine whether crowdfunders on a lending-based prosocial platform lend their money based on altruistic or strategic motives. Our results indicate that the dynamics of (...) prosocial lending-based crowdfunding are somewhat consistent with traditional forms of financing. Specifically, despite a prosocial setting in nature, crowdfunders tend to act strategically, positively responding to signals of quality and low risk. Notably, we also find that projects that are high on both financial and social appeal receive the highest average amount of funding. Furthermore, language on the lender’s profile indicating ability to pay is positively related to both funding success and funding amount. Our study contributes to filling the gap in the business ethics literature about the dynamics of lending-based prosocial crowdfunding, and the strategic and altruistic ethical motives that drive lenders in such endeavors. As COVID-19 emerged as a phenomenon of the total environment, and despite the intertwined and complex relationships that make humanity an organic part of the Bio- and Geospheres, the majority of our responses to it have been corrective in character, with few or no consideration for unintended consequences which bring about further vulnerability to unanticipated global events. Tackling COVID-19 entails a systemic and precautionary approach to human-nature relations, which we frame as regaining diversity in the Geo-, Bio-, and Anthropospheres. Its (...) implementation requires nothing short of an overhaul in the way we interact with and build knowledge from natural and social environments. Hence, we discuss the urgency of shifting from current to precautionary approaches to COVID-19 and look, through the lens of diversity, at the anticipated benefits in four systems crucially affecting and affected by the pandemic: health, land, knowledge and innovation. Our reflections offer a glimpse of the sort of changes needed, from pursuing planetary health and creating more harmonious forms of land use to providing a multi-level platform for other ways of knowing/understanding and turning innovation into a source of global public goods. These exemplary initiatives introduce and solidify systemic thinking in policymaking and move priorities from reaction-based strategies to precautionary frameworks. (shrink)

While the overall impact of antimicrobial use in animals on antimicrobial resistance in humans and the environment is unclear, it undeniably has a role. Yet, some degree of antimicrobial use in animals is necessary for animal health and welfare purposes. Balancing the benefits and risks of antimicrobial use in animals is challenging because of the complexity of the problem and limitations in available data. However, a range (...) of measures can be implemented to reduce, refine and optimize antimicrobial use in animals, with a goal of minimizing the impact on human and environmental health while maintaining necessary therapeutic use in animals. A pandemic instrument can provide the necessary foundation for the whole-of-society and whole-of government One Health approach that is required to strengthen surveillance, communication, collaboration, and action. Este artigo apresenta um esforço teórico para sintetizar o conceito de compreensão presente nas contribuições de Bakhtin e do Círculo, baseado em uma revisão das obras Marxismo e filosofia da linguagem. Problemas fundamentais do método sociológico na ciência da linguagem e O freudismo, bem como dos ensaios Os gêneros do discurso, presente na coletânea Estética da criação verbal, e O discurso (...) no romance, da coletânea Questões de literatura e de estética: a teoria do romance, de M. Bakhtin. De acordo com o Círculo, a compreensão é composta por elementos concretos, ideológicos e axiológicos, além de ser um processo que permite a representação e o prolongamento da atividade comunicativa. ABSTRACT Understanding is a process that grounds educational activity and enables the development of teaching and learning. This article presents a theoretical effort to synthesize the concept of understanding in the works of Bakhtin and the Circle. This paper was based on a review of the works Marxism and the Philosophy of Language and Freudianism: a Marxist critique; and on a review of the essay The Problem of Speech Genres, in the collection BAKHTIN, M., Speech Genres and Other Late Essays, and the essay Discourse in the Novel, in BAKHTIN, M., The Dialogical Imagination: Four Essays. O tema da corrupção pode ser pensado nas mais diversas chaves de leitura: no âmbito político, de degeneração dos governos, no território dos humores, no vocabulário de Maquiavel, e também no campo da vontade e das paixões, na terminologia rousseauísta. Nos interessa, nesta comunicação, discutir isto que está situado nas duas últimas áreas.

Mimesis can refer to imitation, emulation, representation, or reenactment - and it is a concept that links together many aspects of ancient Greek Culture. The Western Greek bell-krater on the cover, for example, is painted with a scene from a phlyax play with performers imitating mythical characters drawn from poetry, which also represent collective cultural beliefs and practices. One figure is shown playing a flute, the music from which might imitate nature, or represent deeper truths of the cosmos based upon (...) Pythagorean views (which were widespread in Western Greece at the time). The idea that mimesis should be restricted to ideals was made famous by Plato (whose connections to Pythagoreanism and Siracusa are well-known), and famously challenged by his student Aristotle (not to mention by the mimetic character of Plato’s own poetry). This volume gathers essays not only on the philosophical debate about mimesis, but also on its use in architecture, drama, poetry, history, music, ritual, and visual art. O magistrado justo equidistante manifesta-se no âmbito interno do processo livre dos interesses conflituosos sobretudo no freio estatal do jus puniendi. Logo, a função jurisdicional do juiz caracteriza-se pela imparcialidade nos processos, referenciando-se, por exemplo, no conceito de justiça corretiva e de equidade de Aristóteles. Neste diapasão jurídico, o artigo discorre sobre a sistemática filosófica da justiça em Aristóteles, recepcionando o conceito do juiz das garantias inserido na lei 13.964/2019, e sua aplicabilidade.

First I will explore the importance granted by Wittgenstein, in the middle period, to memory, in the primary/phenomenological world. According to him, memory is the source of time , past , knowledge and identity . The main objective of this article is to present Wittgenstein's reasons for the rejection of the phenomenological project, using as backdrop his analysis about time (and the abandonment of the semantical and epistemological roles granted to memory). For this purpose it will be crucial to understand (...) a false analogy, that according to him was the cause for the quest for an ideal language. This false analogy can be interpreted as the attribution of a mistaken status to memory (in the phenomenological sense), that leads to the illusion of a criteria of exactitude for the phenomenological description. At the end of this article, I will point out briefly the importance of those ideas to the understanding of the so called "private language argument". (shrink)

RESUMO Tendo por base a ligeiramente controversa idéia de que a caracterização de sophía como a “ciência das causas primeiras ou princípios” seja a formulação cardeal de ciência suprema na “Metafísica” de Aristóteles, neste artigo examinamos Metaph. A2, o capítulo que contém tal caracterização. Em primeiro lugar, seguimos a análise aristotélica dos pontos de vista ordinários acerca da sophía e do sophós, análise que culmina na referida descrição de sophía. Em seguida, examinamos como a concepção de sophía como ciência de (...) causas absolutamente primeiras leva o filósofo a considerá-la como uma ciência que pode ser descrita apropriadamente como divina, sendo também o tipo mais elevado de conhecimento ao qual a filosofia pode aspirar. ABSTRACT Based on the somewhat controversial idea that the characterization of sophía as the “science of first causes or principles” is the pivotal formulation of the supreme science in the Aristotle’s “Metaphysics”, in this paper we scrutinize Metaph. A2, the chapter which contains such a characterization. Firstly, we follow the Aristotelian analysis of the commonly held views on sophía and the sophós, an analysis which culminates in the aforementioned description of sophía. Then we examine how the conception of sophía as the science of absolutely first causes leads the philosopher to regard it as a science that can be properly described as divine, being also the highest kind of knowledge which philosophy can aspire to. Higher courts sometimes assess the constitutionality of law by working through a concrete case, other times by reasoning about the underlying question in a more abstract way. Prior research has found that the degree of concreteness or abstraction with which an issue is formulated can influence people's prescriptive views: For instance, people often endorse punishment for concrete misdeeds that they would oppose if the circumstances were described abstractly. We sought to understand whether the so-called ‘abstract/concrete paradox’ also jeopardizes the consistency (...) of judicial reasoning. In a series of experiments, both lay and professional judges sometimes reached opposite conclusions when reasoning about concrete cases versus the underlying issues formulated in abstract terms. This effect emerged whether participants reasoned with broad principles, such as human dignity, or narrow rules, and was largest among individuals high in trait empathy. Finally, to understand whether people reflectively endorse the discrepancy between abstract and concrete resolutions, we examined their reactions when evaluating both, either simultaneously or sequentially. These approaches revealed no single pattern across lay and expert populations, or exploratory and confirmatory studies. Taken together, our studies suggest that empathic concern plays a greater role in guiding the judicial resolution of concrete cases than in illuminating judges' professed standards—which may result in concrete decisions in violation of their own abstract principles. O trabalho que se segue tem como objetivo principal abordar o conceito de bem comum de John Finnis, apresentando-o como um requisito prático-razoável e uma garantia material para a realização do florescimento humano. A fim de alcançar tal propósito, é necessário percorrer o caminho epistemológico que o autor traçou, analisando alguns dos seus conceitos fundamentais, para então chegar na sua noção de bem comum como uma comunidade política perfeita. Desse modo, inicia-se a pesquisa estudando o processo de entendimento dos princípios (...) da razão prática pelo fenômeno do insight; os bens humanos básicos como razões para a ação; e a atenção necessária aos requisitos da razoabilidade prática. Em um segundo momento, será explorada a relação do direito com a moral, ou seja, abordar-se-á como a razoabilidade prática - virtude moral que ordena a ação - afeta o exercício do direito, já que os atos jurídicos são uma força fundamental para a concretização do bem comum. Sobre essa segunda parte, há um enfoque nos fundamentos da ação humana, apresentando o florescimento humano - a felicidade - como o seu fim último, e a sua relação com o direito. Construído o raciocínio ético da proposta finnisiana da lei natural, a última parte do artigo aborda como a natureza racional da ação, através do direito, conduz ao bem comum. Portanto, atendo à princípios de razoabilidade prática, buscou-se apresentar o bem comum como uma garantia concreta e substancialmente prático-razoável para que as pessoas possam por si mesmas perseguir os bens que as realizem humanamente. The aim of this work is to present the thesis “On the Ontogenetic Evolution of the Human Embryo in its Relations with Phylogenesis,” by Affonso Regulo de Oliveira Fausto, published in Brazil in 1890. To our knowledge, it was one of the first Brazilian academic works focused specifically on evolution. It was also the first doctoral thesis that addressed the topic of recapitulation in order to analyze what was then called the progressive evolution of the human species in tandem with (...) the embryological development of the individuals that would constitute the Brazilian “type.” In the present work, we analyze the author’s thesis in relation to its sources, concepts, as well as the country’s political context at the time of its publication. Fausto’s text, in which he explicitly recognized the influence of Ernst Haeckel’s recapitulation theory, represents a window to understand better a concept of nation based on science and on the idea of inexorable progress that was accepted in Brazil at the end of the nineteenth century. Este artigo tem como objetivo explorar as diversas formas de silenciamento, a partir da análise de Rae Langton sobre a subordinação e o silenciamento das mulheres na pornografia. Ao longo do artigo, separarei a noção de silenciamento da temática da pornografia, abordando-a em uma perspectiva mais geral. Langton, baseando-se em John Austin, distingue três formas de silenciamento: locucionário, ilocucionário e perlocucionário. O artigo propõe a separação entre o silenciamento do ato de proferimento e o silenciamento do ato locucionário. Isso permitirá (...) a análise de quatro tipos de silenciamento do ato de proferimento: silenciamento físico, intimidatório, psicológico e estrutural. O uso da taxonomia de John Searle dos atos de fala nos permitirá notar de forma detalhada como o silenciamento dos atos ilocucionários se conecta às condições de realização dos atos. Isso nos permitirá distinguir, dentro do que Langton chama de silenciamento ilocucionário, três formas de silenciamento: o silenciamento das condições preparatórias, das condições de sinceridade e da condições essenciais. As diversas formas de silenciamento têm sido utilizadas para fins antidemocráticos e aplicadas de maneira sistemática. The proliferation of legal documents in various formats and their dispersion across multiple courts present a significant challenge for users seeking precise matches to their information requirements. Despite notable advancements in legal information retrieval systems, research into legal recommender systems remains limited. A plausible factor contributing to this scarcity could be the absence of extensive publicly accessible datasets or benchmarks. While a few studies have emerged in this field, a comprehensive analysis of the distinct attributes of legal data that influence (...) the design of effective legal recommenders is notably absent in the current literature. This paper addresses this gap by initially amassing a comprehensive session-based dataset from Jusbrasil, one of Brazil’s largest online legal platforms. Subsequently, we scrutinize and discourse key facets of legal session-based recommendation data, including session duration, types of recommendable legal artifacts, coverage, and popularity. Furthermore, we introduce the first session-based recommendation benchmark tailored to the legal domain, shedding light on the performance and constraints of several renowned session-based recommendation approaches. These evaluations are based on real-world data sourced from Jusbrasil. (shrink)

Neste trabalho, analisamos brevemente as posições dos mais relevantes intérpretes acerca do tema, dedicando especial atenção aos autores unitaristas. Resumo O argumento do Terceiro Homem presente no “Parmênides” constitui uma formidável objeção à teoria das Ideias, à qual Platão não apresentou resposta explícita. A despeito disso, cremos ser possível haurir da filosofia platônica uma solução para a referida objeção, solução esta que estaria verossimilmente à disposição do filósofo. Sendo assim, compreende-se que Platão não tenha sido forçado a renunciar à teoria das Ideias, ao menos no que se refere às dificuldades que o Terceiro Homem lhe opõe.The Third Man Argument (...) presented in the “Parmenides” is a formidable objection to the Theory of Forms, one which Plato did not provide an explicit answer to. In spite of that we believe it is possible to draw from Plato’s philosophy a solution to the referred objection, and one which likely would be available to the philosopher. Thus, it becomes clear that Plato was not forced to renounce his Theory of Forms, at least with regard to the difficulties that the Third Man Argument raises to it. (shrink)

O presente artigo analisa a compatibilidade das leis de iniciativa parlamentar que instituem isenções tributárias em face da Constituição da República de 1988 e da Lei de Responsabilidade Fiscal, no contexto de crise econômica. Em conclusão, observou-se o risco de consequências prejudiciais ao Estado se não for enfrentado o problema da legalidade das leis tributárias de iniciativa parlamentar. O método de abordagem utilizado na pesquisa foi o dialético jurídico, notadamente à confrontação dos modelos econômicos de John Maynard Keynes e Friedrich (...) Hayek em relação ao Estado brasileiro, paralelamente ao método de pesquisa bibliográfico. (shrink)

The main objective of this paper is to understand the logic role played by photographs in thoughts about entities known only through photographs. I will contrast two general interpretative lines: photography as knowledge by acquaintance and as knowledge by description. The analyses of those interpretations will take into account possible relations with discussions about metaphysics of time and episodic memory. Throughout the paper I will criticize the treatment of photography as acquaintance, based on John Zeimbekis' interpretation. In its treatment as (...) acquaintance, photography would play the logical role of a demonstrative that points to a particular entity in the past, through the causal route that links the photograph to its referent. The criticism of this concept has as its starting point the distinction between the causal referent of the photograph and its representational content. The thesis here developed is that the photographic content would not be sufficient to determine the numerical identity of the referent. Thus, it will be proposed a shift of the logic role played by photography from a referential role to a predicative. Photograph would exemplify phenomenal properties attributed to an entity known only by description. (shrink)

In order to analyse pictures shared in WhatsApp groups of Jair Bolsonaro supporters, I will explore the idea that the act of sending someone a picture through social media performs a speech act. Thus we can separate the utterance act, the locutionary act, the illocutionary act, and the perlocutionary act. The pictures analysed were collected from January to September 2019, using the WhatsApp Monitor. My main philosophical argument will be in section 3, in which I develop the idea of pictorial (...) speech acts and its conceptual bases. To understand the communicational role of pictures it is necessary to supplement picture theories with a communicative act theory based on speech act. The development of the general outline of visual pragmatics is the main philosophical contribution envisaged in this paper. My last step it to argue that there are at least three forms of naivety that render the receivers prone to the uptake of the illocutionary act performed: aesthetic naivety, communicational naivety, and epistemic naivety.
