While the enormous influence of Martin Heidegger's thought in Japan and China is well documented, the influence on him from East-Asian sources is much lesser known. This remarkable study shows that Heidegger drew some of the major themes of his philosophy--on occasion almost word for word--from German translations of Chinese Daoist and Zen Buddhist classics.

Non-therapeutic circumcision violates boys’ right to bodily integrity as well as to self-determination. There is neither any verifiable medical advantage connected with the intervention nor is it painless nor without significant risks. Possible negative consequences for the psychosexual development of circumcised boys (due to substantial loss of highly erogenous tissue) have not yet been sufficiently explored, but appear to ensue in a significant number of cases. According to standard legal criteria, these considerations would normally entail that the operation be deemed (...) an ‘impermissible risk’—neither justifiable on grounds of parental rights nor of religious liberty: as with any other freedom right, these end where another person's body begins. Nevertheless, after a resounding decision by a Cologne district court that non-therapeutic circumcision constitutes bodily assault, the German legislature responded by enacting a new statute expressly designed to permit male circumcision even outside of medical settings. We first criticise the normative foundations upon which such a legal concession seems to rest, and then analyse two major flaws in the new German law which we consider emblematic of the difficulty that any legal attempt to protect medically irrelevant genital cutting is bound to face. There is as yet no widely agreed-upon solution to the standard textbook problem whether actively shutting off a life-sustaining medical device, e.g. a respirator, and thus bringing about a patient9s death amounts to active killing or just to an omission of further treatment. Apart from a range of astutely contrived case examples and respective particular solutions proposed in the literature, there seems to be no consensus on the normative principles such solutions should be grounded in, not even on the need (...) for such principles beyond sheer intuition. The present paper attempts to develop a normative approach based on fundamental principles of law. From this perspective, what is decisive for the question of ‘killing or letting die’ in such cases is not that death ensues from a behaviour that is active and relevantly causative, but rather, whether or not the agent in performing the deadly act transgresses the boundaries of the domain of his or her sole normative authority, and thereby intervenes in the protected sphere of another. Unless he or she does so, their behaviour cannot be classified as active commission regardless of the amount of causal activity it may display and regardless of its potentially harmful consequences. This conception is spelled out in detail and tested in a range of case examples, as are several of its corollaries that deviate from standard type solutions. (shrink)

After National Socialism had destroyed any tradition in the history of thought, humanities in post-war Germany answered by criticizing this tradition, initiating a number of projects in the field of the history of concept. Erich Rothacker and Carl Schmitt, both compromised by National Socialism, can be seen here as predecessors of Joachim Ritter and also of Hans-Georg Gadamer. The letters, of which there are only a few, display consensus as well as dissent between the writers.

Hermann Lübbe’s distinctive contribution to conceptual history needs to be seen in the discipline’s wider political context in post-war Germany. This contribution outlines the cultural conditions, intellectual backgrounds and institutional prerequisites of Lübbe’s pertinent work. An additional focus is twofold: On the one hand, the article describes Lübbe’s inimitable rhetoric of presence as a means of keeping philosophy in touch with contemporary real-world problems; on the other, it explores the question of how this philosopher’s style and conceptual productivity translate into (...) the peculiarities of a late work that awaits posterity’s interest and judgement in ever more changing and uncontrollable times. ARthur Liebert (1878-1946) war bis 1933 in Berlin der zentrale Organisator der Kant-Gesellschaft und Kant-Studien; Emil Utitz (1883-1956) profilierte als Ordinarius in Halle die philosophische Asthetik und Charakterologie; Liebert emigrierte 1933 nach Belgrad, 1939 nach England und kehrte 1946 nach Berlin zuruck; Utitz wechselte nach Prag, uberlebte das KZ Theresienstadt und blieb dann nach 1945 in Prag. BEide begrundeten nach 1933 philosophische Gesellschaften, die eng miteinander kooperierten und in der (...) Sicherung des Nachlasses von Edmund Husserl sowie der Herausgabe der Emigrationsfachzeitschrift Philosophia bis 1939 wichtige Aufgaben fanden. Das Buch rekonstruiert ihr Emigrationsschicksal, dokumentiert es durch die erhaltene Korrespondenz zwischen Utitz und Liebert sowie weitere sehr gewichtige Korrespondenzen und macht das Spatwerk der Autoren mit weithin unbekannten Texten zuganglich. Using unknown letters, it also outlines Schmitt's relationship with Jewish intellectuals before 1933, describes the dramatic development of the political-theological controversy, and honors Feuchtwanger as a postassimilationist Jewish intellectual and legal historian.
