In the article the review of modern methodological approaches is carried out to forming of the reputation rating of legal companies and their features are considered. Except practice of western rating legal directories that successfully work at the market of legal services, methodology of the Russian and home rating directories is considered. Semantic interpretation is conducted and the matrix of criteria of the reputation rating of legal firms of basic rating directories is formed: Chambers, Legal 500, FLR Who's, Вest Lawyers, (...) Who Legal, Pravo.Ru, GVardia of legal companies. The row of conclusions that touch possibilities and expediency of application of rating technologies in the estimation of regional market of legal services is formed. Development of the regional rating of legal firms will allow really to estimate the contribution of large operators to regional market of legal services development, will provide possibility to the small regional companies to go out on the new level of business activity. Also it will be the catalyst of introduction of the new service technologies of service oriented to the client, will assist to development of competition on regional to the market. (shrink)

The article explores the way gamification transforms the informal learning space of the higher education institutions inspired by information technologies and the all-consuming digitalization of human society. An overview is presented of the existing ideas about gamification in the context of the digital transformation of higher education. It is established that the effective use of gamification as a learning technique in the context of digital transformation of higher education contributes to the implementation of its core principles. We have attempted to (...) analyze the factors that gave rise to gamification as well as to examine the ways to introduce gamification to the informal learning experience. The components of this technology are singled out along with the principles of its functioning. In the process, we reveal the role of gamification and opportunities that open up for the organization of educational activities in the informal space of higher education. The given work identifies peculiarities and advantages of this digital form of education as well as risks associated with its introduction in the informal learning space of higher education. The authors elaborate on the specifics of the development of informal learning space in the context of global gamification, as well as the technological and semantic modernization of higher education. Визначення онтологічного статусу «емпатії» – це сьогодні важлива частина проблематики, що стосується відповідей на питання про природу ментальної реальності як такої. У межах класичного поділу світу на «тіло та розум» («психофізичний дуалізм») такі об’єкти, як емпатія, мали цілком визначене пояснення. Вони тлумачилися як частина «нетілесної», «душевної» реальності. Однак зміна наукових і світоглядних парадигм заклала умови для формування нового розуміння онтологічного та епістемологічного статусу подібних об’єктів. Ключові питання, що ставиться у статті: чи належать акти емпатії до ментальної реальності? і чи є (...) ментальні акти частиною «ментального світу»? Однак після середини минулого століття світ «ментального» зазнав трансформації. Дана стаття – це спроба підважити твердження, що акти емпатії є різновидом ментальних актів (у традиційному розумінні). Джерельну базу дослідження становлять переважно праці Вілфреда Селарса та Гілберта Райла. Визначено, які зміни відбулися у розумінні свідомості після зауваг Райла та яким чином це впливає на приписування онтологічного статусу феноменам, які у минулому беззаперечно належали до ментальних об’єктів. The paper analyzes the content of Soviet propaganda and agitation used in working with the Red Army personnel in the European theater of military operations at the final stage of World War II. The author identifies the interdependence between the ideological work among the Soviet troops and political relations of the USSR with the European countries which the Red Army planned to enter and with guideline documents on organization and carrying out of outreach activities. It is demonstrated that the communications (...) work ensured an appropriate moral and psychological state of Red Army soldiers and officers, contributed to establishment of adequate interrelations with local communities of foreign countries, allies in arms of other nationalities and military units of European countries. For the sake of objectivity in treating this issue, however, it should be pointed out that there were some cases of pillage, moral and physical humiliation of inhabitants of the 'liberated' countries. Their repercussions adversely affected the postwar image of the Soviet Union and dwell within the hearts of contemporaries. It is concluded that during the work of Soviet propagandists on the eve of the Red Army entering the territory of European countries the genetic patriotism inherent in any person in circumstances which threaten his or her life, existence of his or her family and Motherland was developing into the patriotism with notes of political understanding of the goals of the Soviet Union in the European theater of military operations. The article deals with the problems of inconsistency of Ukrainian translation education with the trends of the postmodern state of society and the advisability of introducing the achievements of the American system of training translators is substantiated. The article describes the organization of training masters in technical translation in the United States on the basis of a systematic analysis, in particular, the structure and content, forms and methods of teaching and learning masters in technical translation. Postmodern tendencies and peculiarities of (...) master's education in the USA are revealed and substantiated. The principles of permanent improvement of translation competence, profile and general cultural orientation are described; ensuring the full formation of the readiness of graduates of master's programs in technical translation for highly qualified, productive and creative professional activities; learning in a multicultural environment; application of the latest means of automated translation during training; certification of technical translators. For the reform of translation education in Ukraine, these trends are identified as key. The results of the study were obtained by applying a comparative typological and systems analysis, the method of extrapolating educational trends in the United States and Ukraine in relation to the postmodern context of society and its practical requirements for translation education. The practical significance of the article lies in borrowing the American experience of postmodern aspects of translation education, which can be useful to the countries of the former socialist camp and post-Soviet society. The symbolic world of Corpus Areopagiticum is considered here from the prospect of the dichotomy in similar and dissimilar similarity (the images). The dissimilar images are divided into decent, average andthe distant ones. The similarand dissimilar images of Areopagite describe the world system by cataphatic and apophatic approach. The apophatic one seems to be noticeably more important for the author, as in denial (what God is not) or as in applying of unworthy predicates concerning him, his fundamental transcendence and unknowability (...) become more expressive. Similarand dissimilar images are both the divine names from the NewTestament and the Old Testament respectively. They allow the agent of cognition get closer to the understanding of the universe structure. The divine names correspond to the so-called universal concepts which are considered in the works of contemporary linguistic conceptualistics. Anthropomorphic and zoomorphic characters of the Scripture belong to the dissimilar images, such as parts of the human body, wild animals etc. The most distant dissimilar images should be analyzed as the manifestations of the human passions applied to the naming or description of God. This is the most controversial aspect of the dissimilar similarities because of their provocative character for a profane reader. Thomas Aquinas, one of the ardent admirers of the Corpus, has denied it while considering the theory of images ("The Mystical Theology"). The works of Areopagite have become an example of combining the Eastern and Western traditions ofargumentation which still remains within the framework of the Christian experience. (shrink)

This overview presents the most authoritative publications, theories and reflections of contemporary philosophers, culturologists and sociologists working on the study of cultural exclusion zones. There is a short introduction module, in which we have endeavoured to collate and highlight on the principal themes, terms, concepts and technical vocabulary developed to describe the specific phenomena of cultural exclusion zones. It is not intended as an exhaustive review of all aspects of the large agglomeration of themes related to Cultural Exclusion studies, but (...) focuses in particular on materials from the international “Mechanisms of Formation Zones of Cultural Exclusion and Frontier Areas” conferences (St. Petersburg, 2014, 2015, 2016 and 2017), some of which have also been selected for this edition of Rivista di Estetica. In this introduction we will present a selection of trends and individuals relating to the Russian and international interdisciplinary research project directed by the Centre for Cultural Exclusion and Frontier Zones of the Russian Academy of Sciences and the St. Petersburg State University as institutions, and by Sergey Troitskiy as theorist and visionary.In the following review we put forth the reflections of contemporary scientists on the phenomena of exclusion and re-actualization in conjunction with historical processes, along with an analysis of the origins and current state of the problem, and suggest ways to overcome cultural exclusion between various socio-demographic, national and socio-professional groups, as well as the social experience of separation from existing cultural values and norms through the development of a community’s cultural identity. The problem of person’s social formation becomes especialy actual in all its aspects during the periods of social historical transformations. The guiding lines of individual’s development accepted by society (socialization norms) are either lacking or being overthrown. Such situation demands from the researchers to switch their attention from the mechanisms of sociality reproduction to the mechanisms responsible for the sociality formation. The last ones become the main subject of the self-organization theory (synergetics). According to it, socialization can be represented as (...) the self-organizing system-process. The features of forms and means of Soviet propaganda on Romanian military and civilian audience from the time of the Red army entry to the territory of Romania to the time of Bucharest liberation and during subsequent battle actions on the territory of Romania have been analyzed. The questions of proper support of moral and psychological condition of the Red army soldiers in the capitalist country, whose troops were included to the Hitler coalition, have been reviewed. The role of Romanian (...) resistance movement at the time of propagandist providing of positive perception of the "liberation mission" of the Red army by the population of Romania on the territory of their state has been determined. The article is devoted to topical issues of the culture of professional speech of representatives of the field of law, the level of which is an indicator of professionalism and general culture of the specialist in today's conditions. The purpose of the article is a comprehensive review of speech culture in the professional activities of lawyers at the present stage of development of Ukraine. In the research process, a descriptive method was used, as well as linguistic observation. The content of (...) the concepts of “culture of speech”, “culture of speech”, “culture of professional speech”, “culture of professional speech of a jurist” is highlighted and delimited, and it is also determined that they are in a logical mutual dependence and interdependence. It is revealed that the main standards in the speech activity of a lawyer are correctness, accuracy, logic, clarity, purity, conciseness and expediency, where normativity plays a key role. The studied material demonstrates typical mistakes of irregularity of language norms in professional speech. The causes of these mistakes are identified and ways to eliminate them are named. After analyzing the importance of language literacy and noting the importance of increasing its level for perfect mastery of the Ukrainian language standards and application in practice, it is emphasized that the culture of professional literacy today is the key to the success of a professional personality of a lawyer. Lists of species underpin many fields of human endeavour, but there are currently no universally accepted principles for deciding which biological species should be accepted when there are alternative taxonomic treatments (and, by extension, which scientific names should be applied to those species). As improvements in information technology make it easier to communicate, access, and aggregate biodiversity information, there is a need for a framework that helps taxonomists and the users of taxonomy decide which taxa and names should be used (...) by society whilst continuing to encourage taxonomic research that leads to new species discoveries, new knowledge of species relationships, and the refinement of existing species concepts. Here, we present 10 principles that can underpin such a governance framework, namely (i) the species list must be based on science and free from nontaxonomic considerations and interference, (ii) governance of the species list must aim for community support and use, (iii) all decisions about list composition must be transparent, (iv) the governance of validated lists of species is separate from the governance of the names of taxa, (v) governance of lists of accepted species must not constrain academic freedom, (vi) the set of criteria considered sufficient to recognise species boundaries may appropriately vary between different taxonomic groups but should be consistent when possible, (vii) a global list must balance conflicting needs for currency and stability by having archived versions, (viii) contributors need appropriate recognition, (ix) list content should be traceable, and (x) a global listing process needs both to encompass global diversity and to accommodate local knowledge of that diversity. We conclude by outlining issues that must be resolved if such a system of taxonomic list governance and a unified list of accepted scientific names generated are to be universally adopted. (shrink)

Socio-cultural reality of the present time is marked by quite significant events. First, the active penetration into society of the latest information and communication technologies, which arose as a result of the rapid development of electronics. And secondly, the formation and spread of a special type of worldview under the general name of "postmodernism". It is the need for a philosophical understanding of these two events and determined the main idea of this article. The article also shows the role of (...) information technology in the transformation of the cultural reality of postmodernism. Also the main directions of application of information systems and innovative technologies in the field of education and science in general, and at studying of disciplines of a natural cycle in particular are covered. Peculiarities of studying natural sciences by students are revealed, didactic potential of ICT and its realization in the process of studying natural disciplines is considered, methodical analysis of the problem of application of information technologies in natural education is carried out. The principle of integration, multimedia clarity, interactive interaction of participants of educational process at application of new information technologies at studying of natural disciplines is allocated. It is determined that ICT in the teaching of natural sciences can intensify the educational process, accelerate the transfer of knowledge and experience, as well as improve the quality of teaching and education. Primary headaches are highly prevalent and represent a major cause of disability in young adults. Neurofeedback is increasingly used in the treatment of chronic pain; however, there are few studies investigating its efficacy in patients with headaches. We report the results of a cross-over sham-controlled study on the efficacy of neurofeedback in the prophylactic treatment of tension-type headache. Participants received ten sessions of infra-low frequency electroencephalographic neurofeedback and ten sessions of sham-neurofeedback, with the order of treatments being randomized. The study (...) also included a basic psychotherapeutic intervention — a psychoeducational session performed before the main study phases and emotional support provided throughout the study period. The headache probability was modeled as a function of the neurofeedback and sham-neurofeedback sessions performed to date. As a result, we revealed a strong beneficial effect of neurofeedback and no influence of the sham sessions. The study supports the prophylactic use of infra-low frequency neurofeedback in patients with TTH. From a methodological point of view, we advocate for the explicit inclusion of psychotherapeutic components in neurofeedback study protocols. (shrink)

The article highlights the problem of the effectiveness of the learning process in higher education institutions in the post-pandemic. Today there are changes in the labor market, and more and more professions need to be updated. This affects the quality of higher education both in Europe and elsewhere, so many higher educational institutions have appeared, which primarily care about the number of students, and not about quality. In an environment where the pandemic has significantly changed the learning process, it is (...) very important to find new ways to improve its effectiveness. Now there is a transition from an industrial society to a society of obtaining knowledge in conditions of post-pandemic development; This means that there is a transition to mass education, and then to general higher education and the need to train a large number of people with average abilities. In addition, in higher educational institutions, in particular in universities, there are still imperfect academic programs in the basics of science, compiled by teachers with different levels of training in the context of post-pandemic development. In the scientific literature, there are accents that emphasize certain changes in the functioning of philosophy, which took place in connection with the establishment of the postulates of postmodernism as a new period in the development of culture, as a style of post non-classical scientific thinking, in fact, the content and hierarchy of values positions itself with a sophisticated departure from the classical and non-classical philosophical reflection. Philosophical and educational understanding of the methodology of research of dialogue and tolerance testified (...) to the relevance of their research in the development of the potential of today’s multicultural education and its growth in the cultural and educational space. Dialogue, dialogics and tolerance are represented by the mechanisms of meaning-making, axiology and praxeology: dialogical cognition of the interpersonal, social-group, societal, planetary world provides a certain "breakthrough" in the worldview-value coordinate system, in external-internal control of growth efficiency and its spiritual dimension. The axiological, ontological, educational-epistemological aspects of “fitting” a person into a new world context are precisely in the plane of philosophy, enriching the cultural fields of today’s education through integration in goal-setting, content, organizational and managerial conditions for teaching and upbringing value ideals, principles, methods of holistic study of a person and those that are relevant today and provide Homo educandus with a meaning-making knowledge. The present study aims to reveal how evaluative meanings shape the depiction of Ukrainian emigration and women emigrants in Ukrainian literature of the early 2000s by employing Appraisal Theory developed within the framework of Systemic Functional Linguistics and subjecting excerpts from the following five novels to an in-depth linguistic analysis: Usi dorohy vedut’ do Rymu by Olesia Halych, Shliub iz kukhlem Pil’zens’koho pyva by Lesia Stepovychka, Ia znaiu, shcho ty znaiesh, shcho ia znaiu by Irena Rozdobud’ko, Hastarbaiterky by Natalka Doliak, (...) and Korotka istoriia traktoriv po-ukraiins’ky by Marina Lewycka. The authors employ various grammatical and lexical items to communicate their assessments of the emigrant women characters and the phenomenon of emigration from Ukraine. Appraisal Theory allows us to identify such linguistic realisations of evaluations and interpret authors’ attitudinal positions voiced or implied in text. This research is significant as the first study of its kind using Appraisal Theory to analyse literary texts written in Ukrainian thus expanding the theory’s reach and relevance. Additionally, employing linguistic techniques when assessing the depiction of women’s emigration and its agents enriches an analysis by providing a detailed and balanced perspective. The findings of this research contribute to the fields of literary studies, linguistics, and migration studies. (shrink)

In case-marking languages with nominative-accusative alignment the subject of a sentence is usually marked by nominative case. In some of these languages, however, the subject of a number of verbs is either consistently or alternately marked by another, non-nominative case. Such non-canonical case marking has often been approached in the linguistic literature as a phenomenon at the interface between syntax and semantics. Yet the predictions of this kind of approach seem more probabilistic than regular. This paper offers a new perspective (...) to analyse the phenomenon, which encompasses the role of information structure in case marking. Drawing on Silverstein’s theory of differential subject marking and Dalrymple & Nikolaeva’s approach to differential object marking, it is argued that non-canonically case-marked subjects can be better analysed as instances of either non-topical subjects or subjects lacking one or more semantic features typical of topicality. The approach outlined in the paper is tested on a number of constructions in Russian and Lithuanian. It is shown how, in both languages, the analysed instances of non-canonically case-marked subjects exhibit a complex interplay among grammatical, semantic and discourse-pragmatic factors. (shrink)

The problem of the article is based on a long tradition of studying the category ‘antinomy‘ in the history of philosophy from antiquity until the early twentieth century. Antinomical thinking has particular importance for the spiritual life in the 20th century. The author draws attention to the fact that, for example, in the poetry of Thomas Stern Eliot antinomies and paradoxes are of philosophical and religious nature especially in then dealing with questions of reaching the Truth by rational way exclusively. (...) The basic material for studies are the works of modern Russian poets Olesya Nikolaeva, Sergei Kruglov, Timur Kibirov, Olga Sedakova and Helen Schwartz. It is shown how moral and philosophical themes and descriptions of the spiritual lives of the characters associated with the interpretation of ideas of compositions in the form of antinomies. The idea of the influence of the antinomies of thinking on aesthetics and system of images of Russian poets verses is justified. Article reveals the originality of each of the poets whose poems are analyzed in the work. The author concludes that modern poetry gives traditional antinomies personal psychological nature, but at the same time, problems and poetics of paradox are in tune with thinking of twentieth century as a whole - with its disastrous spirit, full of doubt and contradiction.
