The single most influential and widely accepted objection against any form of dualism, the belief that human beings are both body and soul, is the objection that dualism violates conservation laws in physics. The conservation laws objection against dualism posits that body and soul interaction is at best mysterious, and at worst impossible. While this objection has been both influential from the time of its initial formulation until present, this paper occupies itself with arguing that this objection is a fleeting (...) one, and has successful answers from both scientific and philosophical perspectives. It is to this end that I provide three groups of responses to the conservation laws objection. First, I outline responses which take the ‘laws of nature’ as the proper entry point into the discussion. Secondly, I provide an analysis of those who argue that contemporary quantum physical data requires that the objection itself involves scientifically unjustified premises. Finally, I layout a philosophically oriented answer which argues that the objection is linguistically problematic since its demands on the dualist are categorically fallacious. From these groups of answers, I conclude that while the conservation laws objection has been arguably the most widely accepted objection against dualism, the objection is without philosophical justification. Addresses the relationship between the nation-state and non-state law, considering how they can coexist and transform each other.

There are various supernatural phenomena which hardly can be explained by the existing electromagnetic science, for instance non-locality interactions (may be associated with ESP etc), and also precognitive interdictions. And there are other problems such as how to include the Spirit in our consciousness. For example, it has been known for long time that intuition plays significant role in many professions and human life, including in entrepreneurship, government, and also in detective or law enforcement activities. Despite these examples, such a (...) precognitive interdiction is hardly accepted in established science. In this paper, we discuss non-locality interactions and also advanced solutions of Maxwell equations, and argue in favor of precognitive interdiction from classical perspective. We also discuss shortly on how “spirit” may be included in medicine, although we also make cautious remarks on the danger of “spiritism.” However, we admit that what we discuss here is quite rough, and more researches are needed to verify what we describe here. Since the nineteenth century, the problem of the arrow of time has been traditionally analyzed in terms of entropy by relating the direction past-to-future to the gradient of the entropy function of the universe. In this paper, we reject this traditional perspective and argue for a global and non-entropic approach to the problem, according to which the arrow of time can be defined in terms of the geometrical properties of spacetime. In particular, we show how the global non-entropic arrow can (...) be transferred to the local level, where it takes the form of a non-spacelike local energy flow that provides the criterion for breaking the symmetry resulting from time-reversal invariant local laws. This book is a stimulating and engaging discussion of philosophical issues in the foundations of classical electromagnetism. In the rst half, Frisch argues against the standard conception of the theory as consistent and local. The second half is devoted to the puzzle of the arrow of radiation: the fact that waves behave asymmetrically in time, though the laws governing their evolution are temporally symmetric. The book is worthwhile for anyone interested in understanding the physical theory of electromagnetism, as well (...) for the views it presents on philosophical issues such as causation, counterfactuals, laws, scienti c theories, models, and explanation. While philosophers of physics tend to focus on quantum mechanics and relativity, Frisch’s book shows that there are deep foundational issues in classical physics, equally worthy of attention. That said, let me lodge disagreement on some key points. Frisch argues from an alleged inconsistency in classical electromagnetism— that Maxwell’s equations, the Lorentz force law, and the conservation of energy cannot be jointly true—to the conclusion that the standard view of scienti c theories as a formalism plus an interpretation is incorrect. Consistency is a necessary condition of any view on which scienti c theories give us an account of “ways the world could be” (Frisch, , ). Since classical electromagnetism is successfully used by practicing physicists, consistency must be just one criterion of theory choice weighed equally among others. This is an intriguing idea, but I am not sure that consistency can be given up so easily. That road leads dangerously close to accepting orthodox ‘Copenhagen’ quantum mechanics. In this paper, the ethical, legal, and social implications of Thailand’s surrogacy regulations from both domestic and global perspectives are explored. Surrogacy tourism in Thailand has expanded since India strengthened its visa regulations in 2012. In 2015, in the wake of a major scandal surrounding the abandonment of a surrogate child by its foreign intended parents, a law prohibiting the practice of surrogacy for commercial purposes was enacted. Consequently, a complete ban on surrogacy tourism was imposed. However, some Thai physicians (...) and surrogate mothers cross into neighboring countries to provide foreign clients with the commercial surrogacy services that are forbidden in Thailand. Under this legislation, the needs of Thai couples who are unable to conceive are accommodated by legally accessible, non-commercial surrogacy services; however, there is currently no provision in place aimed at protecting the rights and interests of surrogate mothers and children. It is widely believed that the abolition of surrogacy tourism, an industry that give rise to several major scandals, and legal access to surrogacy by Thai couples were the Thai government’s primary goal in implementing this legislation. The aim of the article is to intervene in debates about the digital and, in particular, framings that imagine the digital in terms of epochal shifts or as redefining life. Instead, drawing on recent developments in digital methods, we explore the lively, productive and performative qualities of the digital by attending to the specificities of digital devices and how they interact, and sometimes compete, with older devices and their capacity to mobilize and materialize social and other relations. In doing so, (...) our aim is to explore the implications of digital devices and data for reassembling social science methods or what we call the social science apparatuses that assemble digital devices and data to ‘know’ the social and other relations. Building on recent work at CRESC on the social life of methods, we recommend a genealogical approach that is alive to the ways in which digital devices are simultaneously shaped by social worlds, and can in turn become agents that shape those worlds. This calls for attending to the specificities of digital devices themselves, how they are varied and composed of diverse socio-technical arrangements, and are enrolled in the creation of new knowledge spaces, institutions and actors. Rather than exploring what large-scale changes can be revealed and understood through the digital, we argue for explorations of how digital devices themselves are materially implicated in the production and performance of contemporary sociality. To that end we offer the following nine propositions about the implications of digital data and devices and argue that these demand rethinking the theoretical assumptions of social science methods: transactional actors; heterogeneity; visualization; continuous time; whole populations; granularity; expertise; mobile and mobilizing; and non-coherence. Hudson has formulated two local deterministic theses and argued that both are incompatible with freedom. We argue that Hudson has half the story right. Moreover, reflection on Hudson’s theses brings out an important point for debates about freedom generally: that instead of focusing on the notion of entailment, debates about freedom should focus on the notions of explanation and sourcehood. This paper asks whether geographically localised, or ‘hyperlocal’, uses of Twitter succeed in creating peer-to-peer neighbourhood networks or simply act as broadcast media at a reduced scale. Literature drawn from the smart cities discourse and from a UK research project into hyperlocal media, respectively, take on these two opposing interpretations. Evidence gathered in the case study presented here is consistent with the latter, and on this basis we criticise the notion that hyperlocal social media can be seen as a community (...) in itself. We demonstrate this by creating a network map of Twitter followers of a popular hyperlocal blog in Brockley, southeast London. We describe various attributes of this network including its average degree and clustering coefficient to suggest that a small and highly connected cluster of visible local entities such as businesses form a clique at the centre of this network, with individual residents following these but not one another. We then plot the locations of these entities and demonstrate that sub-communities in the network are formed due to close geographical proximity between smaller sets of businesses. These observations are illustrated with qualitative evidence from interviews with users who suggest instead that rather than being connected to one another they benefit from what has been described as ‘neighbourhood storytelling’. Despite the limitations of working with Twitter data, we propose that this multi-modal approach offers a valuable way to investigate the experience of using social media as a communication tool in urban neighbourhoods. The vast majority of Biblical historians believe there is evidence sufficient to place Jesus’ existence beyond reasonable doubt. Many believe the New Testamentdocuments alone suffice firmly to establish Jesus as an actual, historical figure. I question these views. In particular, I argue (i) that the three most popular criteria by which various non-miraculous New Testament claims made about Jesus are supposedly corroborated are not sufficient, either singly or jointly, to place his existence beyond reasonable doubt, and (ii) that a prima (...) facie plausible principle concerning how evidence should be assessed—a principle I call the contamination principle—entails that, given the large proportion of uncorroborated miracle claims made about Jesus in the New Testament documents, we should, in the absence of good independent evidence for an historical Jesus, remain sceptical about his existence. Fire safety expertise was in great demand following the Grenfell Tower fire in London in June 2017. The government established a review of building regulations and an expert panel to inform its responses to Grenfell, and many other relevant organisations also formed their own expert panels. However, expert knowledge in fire safety is a highly contested domain, with knowledge claims based on differing sources. Fire fighters can claim expertise based on their experience of fighting fires, scientists and science-based engineers can (...) claim expertise from experimentation, and those who create and enact regulations can claim expertise in what can termed ’codespeak’—the language of regulation. Although distanced from fundamental empirical experience of fire, codespeak is powerful because of its relative clarity and certainty, and legal status. Building users also bring their own form of ‘local’ expertise—they have first-hand experience of the practicalities of the solutions wrought by the other experts. Policy-makers thus face many competing forms of expert advice on fire safety, and their ability to judge what is most relevant in any particular case rests on the existence of a sufficient range and depth of in-house government expertise. Despite the long history of beliefs about the therapeutic properties of work for people with mental ill health, rarely has therapeutic work itself been a focus for historical analysis. In this article, the development of a therapeutic work ethic (1813—1979) is presented, drawing particular attention to the changing character and quality of beliefs about therapeutic work throughout time. From hospital factories to radical ‘antipsychiatric’ communities, the article reveals the myriad forms of activities that have variously been considered fit work for (...) people with mental health problems. While popular stereotypes of basket-weaving paint a hapless portrait of institutional work, a more nuanced reading of therapeutic work and its political and philosophical commitments is advanced. The article concludes by arguing that the non-linear and inherently contested development of therapeutic work is less the effect of paradigmatic shifts within the therapeutic professions, but rather evidence of a broader human struggle with work. The laws of nature have come a long way since the time of Newton: quantum mechanics and relativity have given us good reasons to take seriously the possibility of laws which may be non-local, atemporal, ‘all-at-once,’ retrocausal, or in some other way not well-suited to the standard dynamical time evolution paradigm. Laws of this kind can be accommodated within a Humean approach to lawhood, but many extant non-Humean approaches face significant challenges when we try to apply them to laws (...) outside the time evolution picture. Thus for proponents of non-Humean approaches to lawhood there is a clear need for a novel non-Humean account which is capable of accommodating these sorts of laws. In this paper we propose such an account, characterizing lawhood in terms of constraints, which are understood as a form of modal structure. We demonstrate that our proposed realist account can indeed accommodate a large variety of laws outside the time evolution paradigm, and describe some possible applications to important philosophical problems. To be effective, NGOs must recognize the critical role law plays in protecting the health of the public and in the public health system’s emergency preparedness. They must be ready to work with federal, state, and local leaders to advance the goals that public health laws were enacted to achieve. NGOs also have technical expertise, which they can utilize to help translate highly complex (...) scientific concepts into public health action steps that regulators, legislators, and members of the public can readily understand.Those who are most often affected by pollution tend to be low income people, the working class, Native Americans, and people of color. For Humean atomists, cosmic contents supervene on a spatiotemporal mosaic of modally insulated, freely recombinable local qualities. One piecemeal subspecies of Humean atomism promises more than global supervenience—somehow or other—on a separable base; it constrains how exactly elemental inputs yield everything else. Roughly, the distribution of basic local qualities across elements in one part of our cosmos metaphysically suffices for the complete local physical state of that part: anything sharing this part’s basic elemental decoration should share its (...) more complete contents, regardless of what may be happening elsewhere. On a non-piecemeal alternative, derivative contents can be recognizably local to, or manifest within, one part of our cosmos while reflecting some more global elemental base. To develop this alternative, non-piecemeal Humeans can borrow inspiration from some critics of Humean supervenience, who already distinguish a broader notion of locality from strict Humean intrinsicality. This paper argues that the demands of respect for autonomy in the context of biobanking are fewer and more limited than is often supposed. It discusses the difficulties of agreeing a concept of autonomy from which duties can easily be derived, and suggests an alternative way to determine what respect for autonomy in a biobanking context requires. These requirements, it argues, are limited to provision of adequate information and non-coercion. While neither of these is in itself negligible, this is a (...) smaller set of demands than is often suggested. In particular, it is argued here that securing ‘one time consent’ is consistent with respect for autonomy. Finally, the paper notes that while the demands of respect for autonomy may be less than some suppose, respecting autonomy is not the only way in which biobanks and their users may have moral duties to donors. This paper argues that international development research should be submitted to the oversight of research ethics committees from the countries where data will be collected. This includes research conducted by individuals who may fall outside the jurisdictions of most ethics guidelines or policies, such as individuals contracted by non-governmental organizations. The argument is grounded in an understanding of social justice that recognizes that not seeking local ethics approval can be an affront to the decolonization movement, and may lead to (...) significant direct harms to participants. Local ethics oversight can help ensure projects appropriately take into consideration local laws, regulations, priorities and context. For example, a local research ethics committee may be in a better position than a foreign one to assess whether any given proposed project carries context-specific risks. In addition, submitting to a local research ethics committee is to acknowledge the legitimacy of local authorities, thereby taking a stance against the history of colonizing disempowerment. Local oversight is a mechanism to increase the accountability of researchers working abroad: if respect for local authority and tailoring to local context are to be upheld, there must be mechanisms to ensure that research that does not meet these requirements does not proceed. Objections based on the limited oversight capacity in some countries and on concerns related to the politicization of the review process are discussed. Finally, the roles and responsibilities of the various stakeholders in the implementation of greater local ethics oversight are laid out. (shrink)

We emphasize that the pressure related work appearing in a general relativistic first law of thermodynamics should involve proper volume element rather than coordinate volume element. This point is highlighted by considering both local energy momentum conservation equation as well as particle number conservation equation. It is also emphasized that we are considering here a non-singular fluid governed by purely classical general relativity. Therefore, we are not considering here any semi-classical or quantum gravity which apparently suggests thermodynamical properties even (...) for a (singular) black hole. Having made such a clarification, we formulate a global first law of thermodynamics for an adiabatically evolving spherical perfect fluid. It may be verified that such a global first law of thermodynamics, for a non-singular fluid, has not been formulated earlier. (shrink)

We present a model of similarity‐based retrieval that attempts to capture three seemingly contradictory psychological phenomena: (a) structural commonalities are weighed more heavily than surface commonalities in similarity judgments for items in working memory; (b) in retrieval, superficial similarity is more important than structural similarity; and yet (c) purely structural (analogical) remindings e sometimes experienced. Our model, MAC/FAC, explains these phenomena in terms of a two‐stage process. The first stage uses a computationally cheap, non‐structural matcher to filter candidate long‐term memory (...) items. It uses content vectors, a redundant encoding of structured representations whose dot product estimates how well the corresponding structural representations will match. The second stage uses SME (structure‐mapping engine) to compute structural matches on the handful of items found by the first stage. We show the utility of the MAC/FAC model through a series of computational experiments: (a) We demonstrate that MAC/FAC can model patterns of access found in psychological data; (b) we argue via sensitivity analyses that these simulation results rely on the theory; and (c) we compare the performance of MAC/FAC with ARCS, an alternate model of similarity‐based retrieval, and demonstrate that MAC/FAC explains the data better than ARCS. Finally, we discuss limitations and possible extensions of the model, relationships with other recent retrieval models, and place MAC/FAC in the context of other recent work on the nature of similarity. The paper compares dispositionalism about laws of nature with primitivism. It argues that while the distinction between these two positions can be drawn in a clear-cut manner in classical mechanics, it is less clear in quantum mechanics, due to quantum non-locality. Nonetheless, the paper points out advantages for dispositionalism in comparison to primitivism also in the area of quantum mechanics, and of contemporary physics in general.

This study examines the socioeconomic and familial background of Irish Catholic priests born between 1867 and 1911. Previous research has hypothesized that lack of marriage opportunities may influence adoption of celibacy as part of a religious institution. The present study traced data from Irish seminary registries for 46 Catholic priests born in County Limerick, Ireland, using 1901 Irish Census returns and Land Valuation records. Priests were more likely to originate from landholding backgrounds, and with landholdings greater in size and wealth (...) than the local average. Priests were found to originate from families with more sons than the national average, but with similar numbers of daughters. These findings are discussed in relation to competition for resources and lineage survival strategies. (shrink)

A framework for the mind-matter problem in a holistic universe which has no parts is outlined. The conceptual structure of modern quantum theory suggests to use complementary Boolean descriptions as elements for a more comprehensive non-Boolean description of a world without an a priori mind-matter distinction. Such a description in terms of a locally Boolean but globally non-Boolean structure makes allowance for the fact that Boolean descriptions play a privileged role in science. If we accept the insight that there are (...) no ultimate building blocks, the existence of holistic correlations between contextually chosen parts is a natural consequence. The main problem of a genuinely non-Boolean description is to find an appropriate partition of the universe of discourse. If we adopt the idea that all fundamental laws of physics are invariant under time translations, then we can consider a partition of the world into a tenseless and a tensed domain.In the sense of a regulative principle, the material domain is defined as the tenseless domain with its homogeneous time. The tensed domain contains the mental domain with a tensed time characterized by a privileged position, the Now. Since this partition refers to two complementary descriptions which are not given a priori we have to expect correlations between these two domains. In physics it corresponds to Newton 's separation of universal laws of nature and contingent initial conditions Both descriptions have a non-Boolean structure and can be encompassed into a single non-Boolean description. Tensed and tenseless time can be synchronized by holistic correlations. (shrink)

In this chapter, Card suggests that the non-ideal part of Rawls’ Law of Peoples can be a resource for thinking about responding to evils when the subject is not state-centered. It is plausible that defense against great evils other than those of aggressive states should be governed by analogues of scruples that Rawlsian well-ordered societies observe in defending themselves against outlaw states. This essay explores those hypotheses (...) in relation to women’s self-defense and mutual defense against evils of misogyny, the term feminists apply to the most deeply hostile environments of and attitudes toward women and girls and to the cruelest wrongs to them/us, regardless whether perpetrators harbor feelings of hatred. It extrapolates and adapts to this case values, concepts, and methods from Rawls’s life’s work, especially his writing on war. (shrink)

The paper shows how the Bohmian approach to quantum physics can be applied to develop a clear and coherent ontology of non-perturbative quantum gravity. We suggest retaining discrete objects as the primitive ontology also when it comes to a quantum theory of space-time and therefore focus on loop quantum gravity. We conceive atoms of space, represented in terms of nodes linked by edges in a graph, as the primitive ontology of the theory and show how a non-local law in (...) which a universal and stationary wave-function figures can provide an order of configurations of such atoms of space such that the classical space-time of general relativity is approximated. Although there is as yet no fully worked out physical theory of quantum gravity, we regard the Bohmian approach as setting up a standard that proposals for a serious ontology in this field should meet and as opening up a route for fruitful physical and mathematical investigations. The theory of natural selection is a rich systematization of biological knowledge without a first principle. When formulations of a proposed principle of natural selection are examined carefully, each is seen to be exhaustively analyzable into a proposition about sources of fitness and a proposition about consequences of fitness. But whenever the fitness of an organic variety is well defined in a given biological situation, its sources are local contingencies together with the background of laws from disciplines other than (...) the theory of natural selection; and the consequences of fitness for the long range fate of organic varieties are essentially applications of probability theory. Hence there is no role and no need for a principle of the theory of natural selection, and any generalities that may hold in that theory are derivative rather than fundamental. (shrink)

Individuals are often the subject of generalizations of various special sciences. The traditional argument is that there can't be laws about such individuals, since the law statements would have to contain local predicates. Marc Lange argues that, despite local predication, there can be laws about individuals. This paper argues, on the contrary, that there can be no such laws – not because of local predication, but because the laws would discriminate among material systems on non-qualitative grounds. I (...) rely on the principle that qualitatively identical systems under one set of laws must evolve in the same manner. If there could be laws about individuals, nothing would guarantee that the principle is satisfied. This article argues that to advance the struggle for access to essential medicines, it is necessary to identify the global and local regimes that shape the rules that give impetus to particular policy options, while undermining others. In exploring the role of law and politics in this process, the author first outlines the globalization of a standardized, corporate-inspired, intellectual property regime. Second, the author uses the example of the HIV/aids pandemic to demonstrate how the stability of this new regime (...) came under pressure, both locally and globally. Finally, it is argued that while the global HIV/aids pandemic and the social movements that emerged in response to government inaction have effectively challenged the TRIPS regime, this complex contestation has reached an unsustainable stalemate in which development aid, corporate, and non-governmental philanthropy is simultaneously providing increased availability to drugs while precluding a more lasting solution to the crisis of access to essential medicines in developing countries. This volume explores the relationship between law and geography, especially with respect to taken-for-granted distinctions between the social and the material, the human and non-human, and what constitutes persons and things. As a genuinely reflective `Law and Geography' project, this collection offers interdisciplinary inquiry, particularly in response to globalisation - of law, commerce, environmental change and society - which renders relations between the local and the global more significant. Because of the sheer expansiveness and complexity of both law and (...) geography we use conceptual frames to structure this volume - boundaries, land, property, nature, identity, culture and time, and knowledge. These frames cut across the various subdivisions of law and geography described above and provide a route into the various practical and theoretical deliberations on the interrelationship and interstices of law and geography which follow. Pediatric participation in non-therapeutic research that poses greater than minimal risk has been the subject of considerable thought-provoking debate in the research ethics literature. While the need for more pediatric research has been called morally imperative, and concerted efforts have been made to increase pediatric medical research, the importance of protecting children from undue research risks remains paramount.United States research regulations are derived largely from the deliberations and report of the National Commission for the Protection of Human Subjects of Biomedical (...) and Behavioral Research. The authors of this report specifically designated children as a vulnerable population and suggested additional protections, most of which became U.S. law. One of the more contested sets of regulations surrounds non-therapeutic research, e.g., research that does not offer the potential for direct benefit to participants. Federal regulations allow local Institutional Review Boards to approve non-therapeutic research posing a minor increase above minimal risk when it involves children who have the disease or medical condition that the research addresses. This book concentrates on research done during the last twenty years on the philosophy of quantum mechanics. In particular, the author focuses on three major issues: whether quantum mechanics is an incomplete theory, whether it is non-local, and whether it can be interpreted realistically. Much of the book is concerned with distinguishing various senses in which these questions can be taken, and assessing the bewildering variety of answers philosophers and physicists have given up to now. The book is self-contained (...) in that it presents the necessary parts of the mathematical formalism of quantum mechanics and also covers other interpretative topics, such as the problem of measurement and the uncertainty relations. A considerable portion of the book is based on original arguments presented by the author in lectures and research papers over the past ten years. However, this material is integrated with a broad coverage of most of the recent research in the field, so as to provide a balanced introduction to the whole subject. (shrink)

In this short survey article, I discuss Bell’s theorem and some strategies that attempt to avoid the conclusion of non-locality. I focus on two that intersect with the philosophy of probability: (1) quantum probabilities and (2) superdeterminism. The issues they raised not only apply to a wide class of no-go theorems about quantum mechanics but are also of general philosophical interest.

The Law of Inertia plays a key role in the scheme of constructive axioms for the General Theory of Relativity. A new formulation of this law which avoids the circularity problems inherent in previous formulations is presented. The empirical status of this law and the manner in which it provides a non-conventional foundation for the Law of Motion and the definition of physical forces is established. First, quite general path structures are discussed which are not defined at the outset in (...) terms of geodesic paths and which require for their description only the local differential topological structure. Secondly, a number of theorems are presented which serve as purely local differential topological criteria for singling out from among the general path structures the geodesic ones that represent the inertial structure of spacetime. In this article I intend to show that the inference problem, one of the main objections raised against the anti-Humean theory of natural laws defended by Dretske, Tooley and Armstrong (?DTA theory? for short), can be successfully answered. First, I argue that a proper solution should meet two essential requirements that the proposals made by the DTA theorists do not satisfy. Then I state a solution to the inference problem that assumes a local immanentistic view of universals, a partial (...) definition of the nomic necessitation relation as a relation of existential dependence, and a principle constraining multiple occupancy. I also argue that my solution meets the two requirements. Finally, I deal with non-standard laws such as exclusion laws, causal laws and laws involving spatiotemporal parameters. (shrink)

This paper offers a novel conversational implicature account of the pragmatic sensitivity of knowledge attributions. Developing an account I first suggested elsewhere and independently proposed by Lutz, this paper explores the idea that the relevant implicatures are generated by a constitutive relationship between believing a proposition and a disposition to treat that proposition as true in practical deliberation. I argue that while this view has a certain advantage over standard implicature accounts of pragmatic sensitivity, it comes with a significant concession (...) to proponents of pragmatic encroachment. On the account offered here, knowledge attributions have locally-pragmatically-sensitive implicatures because they have non-locally-pragmatically-sensitive entailments. The view thus represents a unique and powerful hybrid of these two approaches to the pragmatic sensitivity of knowledge attributions. (shrink)

Tax law is a technical area of law which does not seem to be culturally specific. It is thus seen as easily transferable between different societies and cultures. However, tax law is also based on definitions and notions which are not universal. So, is tax law universal or particular? Is it indeed easily transferable between different societies? And in what ways does tax law reflect ethnic or cultural rather than economic differences? This Article seeks to answer these questions by analyzing (...) one specific example — the history of income tax legislation in Mandatory Palestine. This history reveals the dual nature of income taxation. On the one hand, the Income Tax Ordinance which was enacted by the British in Palestine in 1941 was based on a one-size-fits-all colonial model, and the lawyers involved in its enactment, in Palestine and in the Colonial Office in London, made relatively little effort to adapt it to local conditions. On the other hand, other actors — the officials, politicians and businessmen involved in the initial debate about the imposition of income taxation in Palestine in the 1930s, and the administrators involved in the application of the specific rules of the Ordinance after it was enacted in the 1940s — were aware of the need to adapt the law to the specific conditions of Palestine. Thus, while on a formal level the Ordinance seems to represent a process in which the tax law of Palestine converged with that of other British colonies, once we expand our framework and examine not just law in the books, but also law in action, and actors such as politicians and administrators, we discover that particular local conditions were an important factor in the enactment and application of the Palestine Income Tax Ordinance. The study of the process of transplantation, the Article concludes, should therefore focus not only on the formal norms being transplanted, but also on the role of the different non-legal actors involved in the process. The violation of Bell inequalities seems to establish an important fact about the world: that it is non-local. However, this result relies on the assumption of the statistical independence of the measurement settings with respect to potential past events that might have determined them. Superdeterminism refers to the view that a local, and determinist, account of Bell inequalities violations is possible, by rejecting this assumption of statistical independence. We examine and clarify various problems with superdeterminism, looking in particular (...) at its consequences on the nature of scientific laws and scientific reasoning. We argue that the view requires a neo-Humean account of at least some laws, and creates a significant problem for the use of statistical independence in other parts of physics and science more generally. This paper examines how the law elects non-Muslim leaders from the Qur’an perspective. The issue raised was based on the Regional Head Election of the DKI Jakarta on February 6, 2017 where one of the candidates is non-Muslim. Then, the simultaneous local elections on June 27, 2018, and the Legislative Election and the Presidential Election on April 17, 2019. It has become interesting because the issue of ethnic, racial, and religious sentiments in the context of candidate leaders often becomes (...) a serious consideration for voters, in addition to capability and track record of the candidate. This paper uses the thematic interpretation method seeks to get a comprehensive genealogy of the verse choosing non-Muslim leaders. The results studies that in the Qur'an there are four terms related to leadership: khalȋfah, uli al-amr, imâm, and awliyâ’. The last term gives rise to various interpretations because it is mentioned 33 times with various meanings: salvation, friend, and leader. From these verses it can be understood that partiality for non-Muslims is not permitted in Islam, especially in the affairs of the nashb al-Imâmah. As for the fulfillment of the rights of non-Muslims as citizens, it is still guaranteed and highly upheld in Islam. (shrink)
