The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. A key question has been underexplored in the literature on conscientious objection: if a physician is required to perform ‘medical activities,’ what is a medical activity? This paper explores the question by employing a teleological evaluation of medicine and examining the analogy of military conscripts, commonly cited in the conscientious objection debate. It argues that physicians (and other healthcare professionals) can only be expected to perform and support medical acts – acts directed towards their patients’ health. That is, physicians cannot (...) be forced to provide or support services that are not medical in nature, even if such activities support other socially desirable pursuits. This does not necessarily mean that medical professionals cannot or should not provide non-medical services, but only that they are under no obligation to provide them. (shrink)

Both the multidimensional phenomenon and the polysemous notion of consciousness continue to prove resistant to consistent measurement and unambiguous definition. This is hardly surprising, given that there is no agreement even as regards the most fundamental issues they involve. One of the basic disagreements present in the continuing debate about consciousness pertains to its gradational nature. The general aim of this article is to show how consciousness might be graded and multidimensional at the same time. We therefore focus on the (...) question of what it is, exactly, that is or could be graded in cases of consciousness, and how we can measure it. Ultimately, four different gradable aspects of consciousness will be described: quality, abstractness, complexity and usefulness, which belong to four different dimensions, these being understood, respectively, as phenomenal, semantic, physiological, and functional. Consequently, consciousness may be said to vary with respect to phenomenal quality, semantic abstraction, physiological complexity, and functional usefulness. It is hoped that such a four-dimensional approach will help to clarify and justify claims about the hierarchical nature of consciousness. The approach also proves explanatorily advantageous, as it enables us not only to draw attention to certain new and important differences in respect of subjective measures of awareness and to justify how a given creature may be ranked higher in one dimension of consciousness and lower in terms of another, but also allows for innovative explanations of a variety of well-known phenomena (amongst these, the interpretations of blindsight and locked-in syndrome will be briefly outlined here). Moreover, a 4D framework makes possible many predictions and hypotheses that may be experimentally tested (We point out a few such possibilities pertaining to interdimensional dependencies). At Protagoras 353de, Socrates gives three possible reasons for calling some pleasures `wrong'. Scholarly attention has focused on the second of these, according to which pleasures are `wrong' when they have negative consequences. This paper argues that the first reason (the pleasures are fleeting) corresponds to beliefs held by Democritus, among others; and that the third reason (the pleasant things “give pleasure in whatever way and for whatever reason“) is the view adopted by Socrates in the dialogue.

Our present knowledge in the field of dynamical systems, information theory, probability theory and other similar domains indicates that the human brain is a complex dynamical system working in a strong chaotic regime in which random processes play important roles. In this environment our mental life develops. To choose a logically ordered sequence from a random or almost random stream of thoughts is a difficult and energy consuming task. The only domain in which we are able to do this with (...) a full success is mathematics. Leibniz’s life ambition was to extend this success, with the help of what he called _characteristica universalis_, to other areas of human activity. The belief that this is possible lies at the basis of Leibniz’s rationalist system. Reasoning within his system, Leibniz claimed that also fundamental laws of physics can be deduced from the “first principles”. Just as linguistic or conceptual units are at the basis of the _charactersistica universalis_, his monads are responsible for physical activity of material bodies. When this rationalistic strategy is applied to the philosophy of space and time, it leads to their radically relational conception. Leibniz’s rationalistic approach to philosophy and science arouses out sympathy but it was Newton’s mathematical-empirical method that turned out to be effective in human endeavour to understand the functioning of the physical world. Successes of the Newtonian method compel us to revise our concept of rationality. (shrink)

The article discusses the political meaning of refusal. Against the dominating philosophical perspective, praising participation and sense of community, it argues that the acts of refusal may play an important role in resistance against power. Some elements of a possible theory of refusal are to be found in the philosophy of Gilles Deleuze, especially in his famous essay on Herman Melville’s Bartleby, the Scrivener, but also in Dialogues and Mille Plateaux, where he coins the crucial concept of becoming-imperceptible.
