LANGUAGE NOTE | Document text in Chinese; abstract also in English. 當代生命倫理學近年逐漸脱離宗教和醫護傳統，趨向哲學和法律的方向。學者視脱離宗教和醫護傳統，趨向哲學和法律方向的生命倫理學為世俗進路的生命倫理學。世俗進路的生命倫理學關注世俗議題的討論，如人權、程式公義 、個人定立的人生方向和共同利益，並強調對不公平和不公義的反抗。然而，許多學者論證世俗進路的生命倫理學的不足。恩格爾哈特提出，世俗進路的生命倫理學忽略美德和德性的論述，故此未能論及人類在實踐時遇到的困難 (Engelhardt 1996, 419)。切里同樣批評世俗進路的生命倫理學忽略人類生存境況的探討，缺乏明確的道德基礎，因此無法對人類的苦難做出明確的回應（Cherry 2014, 337）。除了世俗進路的生命倫理學忽略檢視人類苦難和死亡的問題，以及缺乏追求真正的美善，譚認為，神學傳統長久以來思考上述問題。假如生命倫理學阻隔了神學宗教在這些議題的智慧，則是一個重大失誤(Tham 2008, 452; 2011, 49)。更重要的是，由信仰主導的宗教進路生命倫理學和由理性主導的世俗進路生命倫理學n」'以在良性角力中互相理解自身限制，並借鑑對方的優勢補充自身不足之處(Tham 2013,18)。譚在最新的文章〈生命倫理學：跨文化的探索〉不僅重申其理論觀點，並闡釋如何身體力行實踐世俗和宗教兩種進路的生命倫理學以及跨文化的互補。(撮要取自內文首段) The aim of this article is to examine Joseph Tham's “Bioethics: Cross-Cultural Exploration.” Tham argues that the secular approach to bioethics advocates ethical responsibilities through the concept of universal human rights. However, the concept of universal human rights is only a supposition with no foundational theory, which renders this concept incompatible with the spirit of many cultures. This article uses (...) Confucian culture as an example to support Tham's argument that the ethical responsibilities in Confucianism are based on the ideas of loving with distinctions and family-oriented values, ideas which stand in opposition to the concepts of egalitarianism and libertarianism. As such, the religious approach to bioethics can be corrective and supplementary to the secular approach to bioethics. This article concludes by pointing out that Tham's explorations of cross-cultural dialogue in the bioethical debate contribute to the intercultural understanding and complementarity between the East and the West. Personalized Medicine is an evolving and often missinterpreted concept and no agreement of personalization exist. We examined the PM discourse towards foucauldian archeological and genealogical analysis to understand the meaning of “personalization” in medicine. In the archaeological analysis, the historical evolution is characterized by the coexistence of two epistemologies: the holistic vision and the omic sciences. The genealogical analysis shows how these epistemologies may affect the meaning of “person” and, consequently, the ontology of patients. Additionally, substitutions/confusions of the term PM (...) are related to continuously evolving medical knowledge and new technologies; different etymological roots of “personalization” and “person”; and cultural differences. In conclusion, if the definition of “personalization” in medicine is not clear, patients might get wrong expectations about what is achievable for their health. Therefore, epistemological trends should not be separated as they drive same goals: providing accurate diagnosis and treatments based on large data to predict disease progression. (shrink)

This paper is an attempt to make sense of the notion and ideal of nonviolence in these ultra-violent days. The paper is a dialogue with three “specialists” of violence, who nevertheless aspire to a different, brighter horizon: Ramchandra Gandhi, Saadat Hasan Manto and Mahasweta Devi. R. Gandhi is one of the most intriguing voices of twentieth-century Indian philosophy. Manto and Mahasweta are writers, the former known for his short partition stories in Urdu; the latter for her gut-wrenching literature (...) in Bengali. All three dare to look violence in the eye, implying that nonviolence can only emerge from deep reflection on violence as an inherent human tendency. Violence is part of me as much as of anyone else. R. Gandhi argues that partition, the cradle of violence, is in the eye, and suggests that we can train the human gaze, our gaze, to prioritize the common denominator between you and I, which hides under the obvious differences between us. For Manto, the remedy is to be found in language. He implies that an ethical dimension is concealed within language, waiting to be excavated. Mahasweta gives voice to those unheard. Acknowledging the unacknowledged, she and Manto show us, is an act of nonviolence. (shrink)

This article aims to rethink the trauma of the 1947 Partition of British India through the figure of the border. It is at the border that we can see how the present is as much constituted by the concentration of new realities that call for shifting frameworks of understanding as it is by past events that continue to haunt memory. It undertakes this task through a close reading of the trope of borders in Saadat Hasan Manto’s 1953 short story, (...) ‘Toba Tek Singh’. Partition fiction serves as a fruitful ground for developing new approaches to that history because, in part, literature is uniquely situated between representation and theory, between what a text represents and how it represents. In Manto’s story, the border is embodied in its central protagonist, Bishan Singh, who experiences an ontological struggle between being and belonging that exceeds the particular historical, geographical, and national context of the Partition. I suggest that the division of British India signaled a unique rupture within the subcontinent in which the creation of borders became the defining traumatic event of that history. This article thus moves away from the familiar nationalist rhetoric that has otherwise dominated conversations about the 1947 Partition of British India. It focuses instead on the geographical border as a conceptual figure that is at once spatially and corporeally oriented to a collective identity that exceeds nationalist frameworks of reference. Bajo un manto de humanismo, las energías ideológicas del sistema persiguen que los marginados acepten que el capitalismo y su economía de mercado son la única alternativa y declinen la lucha por un mundo mejor mientras creen que están preservando sus valores culturales. Aunque actualmente occidente promueve la complementación y la solidaridad como valores rectores de los procesos económicos, no pasa de ser una retórica discursiva que no va a cambiar nada mientras no se muten los fundamentos filosóficos que (...) sostienen al sistema capitalista, que basa las relaciones sociales y mercantiles en el antagonismo y la competencia. El llamado social a hacer «otro mundo posible» requiere la reconfiguración paradigmática de las ciencias económicas, entre otras, para hacer posible la constitución de una sociedad pluricultural y plurieconómica, en la que puedan autodeterminarse distintas modalidades de producir y consumir según las diversas cosmovisiones que la pueblan. Nuestro aporte a este propósito es el planteamiento de una economía inter e intracultural. (shrink)

Las definiciones ocupan un lugar muy importante en la _Ética_ de Spinoza, sin embargo, su naturaleza y su función permanecen aún en gran medida bajo un manto de oscuridad. Tal es así que numerosos comentadores han abordado el tema aunque nunca se ha llegado a un acuerdo definitivo. En el presente trabajo revisitaremos esta vieja cuestión comenzando por una reconstrucción de la doctrina spinoziana de la definición expuesta en diferentes partes del _corpus_. Para ello tomaremos como punto de referencia (...) la oposición entre definición real y definición nominal tal como aparece delineada en la doctrina de la _Lógica_ de Port Royal. Luego ofreceremos un examen de la naturaleza y función de las definiciones de la _Ética_. El recorrido realizado aquí nos permitirá, por un lado, determinar cuál de las interpretaciones en juego tiene mejores fundamentos y, por el otro, arrojar luz sobre la función de las definiciones en la metodología spinoziana. Há um discurso teórico que denuncia a igualdade formal presente no ideal de Estado de Direito como um manto ideológico a serviço do conservadorismo. Por debaixo desse manto, as profundas desigualdades sociais e relações de opressão seriam legitimadas como se fossem simplesmente fruto da aplicação imparcial das regras jurídicas a que todos estariam igualmente submetidos. Embora essa crítica sirva quando direcionada ao modelo de Estado de Direito defendido por Hayek, que apresenta falsamente as regras oriundas dos costumes e (...) dos precedentes como isentas de posições políticas, ela não atinge da mesma maneira o modelo de Estado de Direito centrado na supremacia da legislação. Apesar de todas as limitações que podem ser reconhecidas no ideal de igualdade formal, a sua recusa parece antes permitir novas e mais graves formas de opressão do que as suprimir. (shrink)

A presença do componente curricular Ensino Religioso – ER na escola, de modo especial na escola pública, é marcada pela controvérsia. O Brasil viveu sob o manto da confessionalidade, mesmo depois do decreto n. 119A, e a separação legislativo-jurídica entre Igreja e Estado não pôs fim ao problema. A partir dessa perspectiva, o objetivo deste artigo é refletir sobre a configuração atual do Ensino Religioso na escola pública, a partir de breve referência inicial aos antecedentes históricos e aos aspectos (...) filosóficos deste processo, que permitiram essa situação, desde a implantação do regime republicano no país. Quer considerar o problema de o Ensino Religioso estar sempre marcado por um discurso conflitivo entre os pressupostos da laicidade e da confessionalidade. O itinerário foi norteado pela seguinte questão: como analisar as mudanças e alterações que fizeram com que este componente curricular passasse da área eclesiástica para a esfera pública? Será que o Ensino Religioso é um problema para a laicidade? A metodologia utilizada é a pesquisa bibliográfica, qualitativa e documental, através da análise de documentos constitucionais, leis de diretrizes e bases da educação, pareceres e resoluções que envolveram esse componente curricular, bem como discursos de juristas em diversas épocas. Ao se investigar este tema, percebe-se que a discussão sobre o Ensino Religioso, bem como a compreensão de sua presença na escola pública, envolve uma complexa discussão, que não pode desconhecer os aspectos históricos, filosóficos e jurídicos. En el texto se hace hincapié en los tenebrosos elementos sacrificiales que le ha acarreado al movimiento estudiantil perteneciente a la combativa Escuela Normal Rural de Ayotzinapa, situada en el Estado mexicano de Guerrero, dominado por el narcotráfico y un gobierno municipal que actúa en complicidad con este último. Se trata de un establecimiento que, además de formar maestros populares, se halla enrolado en las luchas sociales y políticas. A fines de 2014 fueron reprimidos brutalmente y objeto de desaparición forzosa (...) unos 43 alumnos de esa Escuela, lo cual dio lugar a una ininterrumpida protesta civil con muy diversos ribetes internos y mundiales cuyas múltiples expresiones procuran explicitarse en el trabajo. Por otra parte, se incursiona en el trasfondo ideológico que viene acompañando el devenir institucional mexicano bajo el manto del neoliberalismo -al cual el autor ha optado por reconceptuar como neuroliberalismo en distintos ensayos suyos y en colaboración. Conjuntamente, se enfoca la problemática en cuestión desde un ángulo doctrinario y existencial específico: el del necropoder y el pensamiento crítico. Entre los referentes bibliográficos principales pueden citarse desde Foucault y Mbembe a Holloway y González Casanova. The paper deals with the engagement of mexican student movement in Ayotzinapa Rural College and the repressive way that the local goverment and the narco-maffia fought against those students, with the disappearance and destruction of their bodies and cadavers, around september 2014. The case has an enormous influence in world and local public opinion, with different movilizations and artistic expressions that have a very critical reading of Mexican treatment in the field of Human Rights. Mexican and international neoliberalism, as well as bio and necropolitics, has been specially analyzed with the auxiliary tool of critical thinking. Between the theoretical authors that are close involved in these approaches, we can find Michel Foucault, Achille Mbembe, John Holloway and Pablo González Casanova. (shrink)

This article presents a systematic examination of matrilineal succession in Greek myth. It uses MANTO, a digital database of Greek myth, to identify kings who succeed their fathers-in-law, maternal grandfathers, step-fathers, or wives’ previous husbands. Analysis of the fifty-four instances identified shows that the prominence of the ‘succession via widow’ motif in archaic epic is not typical of the broader tradition. Rather, civic mythmaking more commonly relies on succession by sons-in-law and maternal grandsons to craft connections between cities and (...) lineages, and to claim panhellenic prestige. We show that matrilineal successors are not treated as necessarily illegitimate or inferior within the overwhelmingly patrilineal conventions of Greek myth. In fact, matrilineal calculations afford certain advantages, like the ability to integrate heroes from elsewhere, or to champion local kings with divine fathers. Matrilineal succession reveals the gendered dynamics inherent to Greek myth; we argue that, although in these instances regnal power is transferred through female relatives, the heroines involved are typically treated simply as nodes for this power and their roles in these stories do not necessarily correlate to a greater visibility or autonomy. También ha coordinado las obras Administración Pública y Estado de Bienestar (2004) y Teorías sociológicas de la acción (2005). En las últimas décadas se ha desarrollado un intenso (...) debate que contrapone a los defensores de un modelo liberal de sociedad y a los que apuestan por un modelo comunitario. Bajo el manto liberal se engloban todas aquellas teorías políticas cuyo objetivo es buscar procedimientos, universalmente compartidos, de agregación de los intereses individuales. Por su parte, en el bando comunitarista, nos encontramos aquellos planteamientos -cuyo denominador común es una crítica a toda visión puramente procedimentalista de la filosofía pública-, que consideran que sólo se posee una comunidad política cuando se recurre a un patrimonio común de contenidos, valores y tradiciones, en el que todos los miembros de la comunidad se sienten radicados. En esta obra se presenta un análisis detallado de los protagonistas y de las etapas de este debate, proponiendo como conclusión un modelo de sociedad que pretende dar respuesta tanto a las instancias radicadas en el modelo procedimental como a las presentes en el modelo comunitario. La memoria de la literatura es rebelión contra el manto de olvido con que los medios de comunicación y las esferas del poder quieren cubrir las catástrofes, crueldades y mentiras vividas por una sociedad, y de ésta contribuye a mantener la utopía: el deseo de que la sociedad puede ser organizada más justamente. En el (...) centro de la reflexión de Adorno sobre la literatura está la relación entre obra literaria y sociedad, y las relaciones de la primera, mediante la forma, con la segunda. ¿En qué consiste la verdad de una obra de arte? ¿Cómo pensar la relación entre obra de arte y sociedad sin caer en el sociologismo? ¿Cumple la obra de arle una función cognoscitiva? Através de algumas considerações de caráter teológico, pretendemos mostrar que a festa da Virgem Maria de Guadalupe tem profundo enraizamento no coração do povo de Deus, por duas razões fundamentais: Primeiro: a devoção à "Guadalupana" nos remete à Palavra de Deus, que instrui nossa fé; e segundo, tal devoção se funda em uma verdadeira epifania profética. A reflexão teológica se sustenta em algumas idéias centrais: Guadalupe permite a reestruturação da consciência indígena. Analogicamente, Guadalupe permite nomear a Deus em três modos: (...) cristológico, trinitário e antropológico. Guadalupe, gravada na Tilma (manto) de Juan Diego, desvela um mundo como mundo de Maria que não é possível habitar. Na narrativa do Nican Mopohua discernimos uma Simbólica da Bondade originária , que manifesta o amor misericordioso do Pai no Filho, com a figura do Servo Sofredor como pano de fundo. Finalmente, Guadalupe remete ao texto bíblico, por ser interpretação do mesmo e sinal de sua recepção. A Virgem de Guadalupe assume dessa forma as características de um verdadeiro profeta. Resumen Es nuestro propósito mostrar, a través de algunas consideraciones de caracter teológico, que la Fiesta en torno de la Virgen María de Guadalupe tiene un arraigo profundo en el corazón del pueblo de Dios por dos razones fundamentales: Primero, la devoción a la Guadalupana nos remite a la Palabra de Dios, que instruye nuestra Fe; y segundo, la devoción se funda en una verdadera epifanía profética. La reflexión teológica se basa en algunas ideas fuerza: Guadalupe permite la reestructuración de la conciencia indígena. Guadalupe analógicamente permite nombrar a Dios en tres modos, cristológico, trinitario y antropológico. Guadalupe, grabada en la Tilma de Juan Diego, despliega un mundo como mundo de María que nos es posible habitar. En la narrativa del Nican Mopohua discernimos una Simbólica de la Bondad originaria , que manifiesta el amor misericordioso del Padre en el Hijo, con la figura del Siervo Sufriente como telón de fondo. Guadalupe es, finalmente, referencia al texto bíblico, por ser interpretación del mismo y señal de su recepción. La Virgen de Guadalupe asume las características fundamentales de un verdadero profeta. Palabras clave: Fiesta; sagrado; sociedad; religión.Through some theological observations, we intend to show that the feast of the Virgin Mary of Guadalupe has deep rooting in the heart of the people of God, for two basic reasons: Firstly: the devotion to the "Guadalupana" sends us to the Word of God, that instructs our faith; secondly: such devotion is founded on an authentic prophetic Epiphany. The theological reflection is supported in some central ideas: Guadalupe allows the reorganization of the aboriginal conscience. Analogicalally, Guadalupe allows us to nominate God in three ways: christological, trinitarian and anthropological. Guadalupe, recorded in Juan Diego's Tilma (mantle), reveals a world as a world of Mary which is not possible to inhabit. In the narrative of Nican Mopohua we discern a Symbolic approach of the originary Goodness, that manifests the merciful love of the Father in the Son, with the figure of the Sufferer Servant as background.. Finally, Guadalupe sends us to the Biblical text, for being an interpretation of such text and a sign of its reception. The Virgin of Guadalupe finally assumes the characteristics of an authentic prophet. Keywords: feast; sacred; society; religion. (shrink)
