La Unión Europea es una Comunidad de Derecho. El Estado de Derecho es un valor europeo consagrado en el artículo 2 del Tratado de la Unión Europea. Su efectividad requiere de la existencia de un Poder Judicial independiente en la propia Unión y en todos y cada uno de los Estados miembros. Hoy en día está amenazado por un enemigo interior: el populismo iliberal que impugna las instituciones contramayoritarias del control de poder. En la primera parte de este trabajo pondré (...) de manifiesto la incompatibilidad del populismo iliberal con la cultura política democrática que da sentido a las instituciones contramayoritarias. Incompatibilidad que le conduce directamente a impugnar un principio básico inherente a aquella como es el respeto a la independencia judicial. En la segunda, analizaré la respuesta que ha dado la Unión Europea, y concretamente, el Tribunal de Justicia a los ataques a la independencia judicial por parte del Estado polaco. (shrink)

Recent research in philosophy of science has shown that scientists rely on a plurality of strategies to develop successful explanations of different types of phenomena. In the case of biology, most of these strategies go far beyond the traditional and reductionistic models of scientific explanation that have proven so successful in the fundamental sciences. Concretely, in the last two decades, philosophers of science have discovered the existence of at least two different types of scientific explanation at work in the biological (...) sciences, namely: mechanistic and structural explanations. Despite the growing evidence about the radically different nature of these two types of explanation, no inquiry has been conducted to date to determine the ontological reasons that might underlie these differences, nor the way in which these types of explanations can be systematically related with each other. Here, we aim to cover this gap by connecting this plurality of research strategies with the existence of emergent levels of reality. We argue that the existence of these different—and apparently incompatible—explanatory strategies to account for biological phenomena derives from the existence of “ontological jumps” in nature, which generate different regimes of causation that in turn demand the development of different explanatory frameworks. We identify two of these strategies—mechanistic modelling and network modelling—and connect them to the existence of two ontological regimes of causation. Finally, we relate them with each other in a systematic way. In this vein, our paper provides an ontological justification for the plurality of explanatory strategies that we see in the life sciences. (shrink)

Carl Schmitt is the most important anti-liberal political theorist of the European interwar period (1918-1939). His theories on the state of exception, dictatorship, and his criticism of parliamentary democracy are very well known. However, what remains unknown to this day is how his ideas had a remarkable influence on the ideologues of the Francoist state between 1939 and 1942. During these years, a debate developed among Francoist jurists about whether Francisco Franco was a “sovereign dictator,” that is, a dictator legitimized (...) by popular consent, or rather a new kind of “monarch” that emerged in the context of the Spanish Civil War (1936-1939). This paper aims to explain how two ideological factions formed in Francoist Spain. The “Decisionist Francoism” of Juan Beneyto Pérez, Francisco Elías de Tejada, and Luis Legaz Lacambra held that Franco emerged as a reaction to the process of “legalization” triggered by liberalism in Spain. The “Weberian Francoism” of Francisco Javier Conde held that Franco was a charismatic and traditional leader whose position emerged in response to the Civil War. I explain how three concepts of Schmitt's anti-iberalism inspired Francoist theorists: political theology, dictatorship, and the rejection of parliamentary democracy. (shrink)

In the last decade, the organization of pharmaceutical research on neglected tropical diseases has undergone transformative change. In a context of perceived “market failure,” the development of new medicines is increasingly handled by public-private partnerships. This shift toward hybrid organizational models depends on a particular form of exchange: the sharing of proprietary assets in general and of intellectual property rights in particular. This article explores the paradoxical role of private property in this new configuration of global health research and development. (...) Rather than a tool to block potential competitors, proprietary assets function as a lever to attract others into risky collaborative ventures; instead of demarcating public and private domains, the sharing of property rights is used to increase the porosity of that boundary. This reimagination of the value of property is connected to the peculiar timescape of global health drug development, a promissory orientation to the future that takes its clearest form in the centrality of “virtual” business models and the proliferation of strategies of deferral. Drawing on the anthropological literature on inalienable possessions, we reconsider property’s traditional exclusionary role and discuss the possibility that the new pharmaceutical “commons” proclaimed by contemporary global health partnerships might be the precursor of future enclosures. It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

Are properties universal or particular? According to Universalism, properties are universals because there is a certain fundamental tie that makes properties capable of being shareable by more than one thing. On the opposing side, Particularism is the view that properties are particulars due to the existence of a fundamental tie that makes properties incapable of being shared. My aim in this paper is to critically examine the connections between the notions of the fundamental tie and universality and particularity. I argue, (...) first, that universality and particularity can characterize a property if and only if there is a universalist or a particularist fundamental tie, and, second, that it is unclear that these should be the fundamental ties that connect ordinary and scientific properties to their respective bearers. Then I develop an alternative approach to properties and the fundamental tie, which is neutralist because it dispenses with universality and particularity as features of properties, and naturalist because it naturalizes the possession of properties by replacing metaphysical fundamental ties with a scientific one, in particular, a physical process. I show how this approach improves our understanding of properties and instantiation. (shrink)

Este trabajo arroja luz sobre dicho vitral, su diseñador y el arte sobre cristal. Analizamos su composición pilarista en el contexto de la historia civil, religiosa y legendaria de Zaragoza. This work sheds light on this stained-glass window, your designer and art on glass. Next, we will analyze its ‘pilarista’ composition, a synthesis of the civil, religious and legendary history of Zaragoza. We will conclude with the deep symbolic meaning of this stained-glass window, which consecrates the Virgen del Pilar as the honor of the people of Zaragoza, Aragon and Spain. Eventually, this article constitutes an invitation to consider this work as an element of the spirit of Spanish-French reconciliation of 1908. Developments in biosemiotics and democratic theory enable renewed appreciation of the possibilities for ecological democracy. Semiotics is the study of sign processes in meaning-making and communication. Signs and meanings exist in all living systems, and all living systems are therefore semiotic systems. Ecological communication can involve abiotic and biotic communication, including human language, facilitating an integration of politics and ecology in the form of ecological democracy encompassing communicative networks in nature and human society.

1. Categories and the Scientific Turn of Metaphysics: The Notion of World-Fundamentality What are the fundamental inhabitants of the world? This question, as old as it is new, is about the fundamental structure of our world. Is our world a world of Aristotle's ordinary substances, Locke's physical substances, Husserl's wholes, Wittgenstein's facts, Sellars's processes, or Quine's sets? In order to distinguish the sort of metaphysical fundamentality at stake in this discussion from other possible types of fundamentality, I shall call it (...) from now on "world-fundamentality." In this article I want to make a proposal in the context of this metaphysical dispute. The proposal is the addition of a new criterion of world-fundamentality to the existing catalog of independence and simplicity, among some other prominent classical examples. I call this criterion "the materialist criterion of world-fundamentality" because it states that metaphysicians should not decide the question of whether our world is a world of facts rather than a world of sets or other categories without considering the explanatory power of such categories to account for the relation between "the manifest image" and "the scientific image," to use the words of Wilfrid Sellars. Is structure a fundamental and indispensable part of the world? Is the question of ontology a question about structure? Structure is a central notion in contemporary metaphysics [Sider 2011. Writing the Book of the World. Oxford: Clarendon Press]. Realism about structure claims that the question of ontology is about the fundamental and indispensable structure of the world. In this paper, I present a criticism of the metaphysics of realism about structure based on a version of Russell’s famous regress argument against (...) nominalism [Russell 1911. “On the Relation of Universals and Particular.” In Logic & Knowledge. Reprint, London: George Allen & Unwin]. First, I argue that the three general tests for the fundamentality of structure proposed by realism about structure rely on a particular empirical test for structure, namely, the so-called ‘similarity test for structure.’ Second, I argue that the similarity test is not well-founded because it leads to a vicious regress. Third, I argue that the regress affects the whole metaphysics of realism about structure, and that no structural notion can be said to be fundamental in connection with any of the other tests. Lastly, I argue that the question of ontology as a question about structure is not substantive. (shrink)

The aim of this paper is to defend a naturalistic approach to instantiation and the Principle of Instantiation. I argue that the instantiation of an ordinary property F consists of two coordinated relationships at the levels of the manifest and scientific images, namely, constituency and entailment. Also, I offer an account of the Principle of Instantiation related to this conception of instantiation based on the notion of scientific prediction.

The aim of this paper is to offer two novel solutions to two perennial problems of categorial ontology, namely, the problem of the categorial structure: how are the categories related to one another? And the problem of categorial completeness: how is the completeness of a proposed list of categories justified? First, I argue that a system of categories should have a structure such that there is a most basic category that is a bearer of all other categories and that has (...) what I shall call “combinatorial conditions”. To do so, I compare this approach to categorial structure with the approaches given by substantialist, mereological, factualist, and geo ontologies. Second, I argue that the problem of categorial completeness is only a problem for certain ontologies. In this connection, I explore views on categorial completeness proposed by substantialists and geo-ontologists. Lastly, I conclude that factualism does a better job of accounting for categorial structure and categorial completeness than other categorial ontologies. (shrink)

Since Sigmund Freud developed and popularized psychoanalysis, this psychological theory has significantly influenced contemporary thinking, particularly in philosophical disciplines focused on understanding human behavior and addressing social problems. Take the examples of political philosophy, race theory, and feminist thought, among many others. However, although sport philosophy qualifies as one such discipline, scholars in this field have given little to no attention to psychoanalysis and psychoanalytical theorists. Remarkably, psychoanalytical notions, especially those of Eric Berne and Norman O. Brown, significantly shaped Bernard (...) Suits’ pioneering thoughts on games. Nevertheless, sport philosophers have largely overlooked the importance of psychoanalysis in Suits’ examinations of games and, more broadly speaking, rarely attempted to apply psychoanalytical concepts to their analyses of sport. In this paper, I explain the psychoanalytical roots of Suits’ theory of games and explore how much of his theory of games is indebted to psychoanalysis. Specifically, I first compare Suits’ analysis of unconscious gameplay to psychoanalytic concepts of repression and neurosis. Subsequently, I explore the alignment between Suits’ views on gameplay and psychoanalytic accounts of play and pleasure. To conclude, I examine the therapeutic and emancipatory character of Suits’ proposal, drawing parallels between his philosophical corpus and critical theorists whose critical analyses of modern society are heavily indebted to Freud. The Sellarsian task of ontology is to reconcile two seemingly divergent images of ordinary objects such as persons, tomatoes and tables, namely, the manifest image of common sense and the scientific image provided by fundamental physics (Sellars, Science, Perception, and Reality, 1963). Can the genuine categories of the ontologies of Substantialism (Heil, The World as We Find It, 2012), Structural Realism (Ladyman and Ross,Every Thing Must Go: Metaphysics Naturalized, 2007; French, The Structure of the World: Metaphysics and Representation, 2014), and (...) Factualism (Cumpa, ‘A Materialist Criterion of Fundamentality’, American Philosophical Quarterly, 2014), such as ‘substance’, ‘structure’, and ‘fact’, help us to solve the problem of the reconciliation of the two images of ordinary objects? In this paper I defend the thesis that the ontology of Factualism does a better job of reconciling the manifest and the scientific images of ordinary objects than other ontologies. (shrink)

Consider two similarity facts: a is similar to b with respect to G, and c is similar to d with respect to G. According to the Platonist approach to similarity, the analysis of such facts forces us to admit that similarity facts are to be analyzed into facts about universal similarities of the form: a is similar to b with respect to G, and c is similar to d with respect to G, where similarity is a universal. In this paper, (...) I defend Neutralism, a view according to which there are properties and similarities, but these are not universals, particulars, or of other categories. After presenting the Platonist analysis of similarity proposed by Russell and Grossmann, I examine the question of whether or not the Platonist analysis of similarity leads us inevitably to a conception of similarity as a universal. Then I offer a novel, alternative analysis of similarity free of commitment to universals. (shrink)

My aim is to discuss the impact of higher-order evidence on aesthetic appreciation. I suggest that this impact is different with respect to aesthetic beliefs and to aesthetic affective attitudes (such as enjoyment). More specifically, I defend the view that higher-order evidence questioning the reliability of one’s aesthetic beliefs can make it reasonable for one to revise those beliefs. Conversely, in line with a plausible account of emotions, aesthetic affective attitudes are not directly sensitive to this type of higher-order evidence; (...) they are sensitive only to those features of objects that make such attitudes (un)fitting. Thus, I argue, there are cases of non-defective recalcitrant aesthetic attitudes where the subject has both a non-defective, fitting aesthetic affective attitude and a reasonable belief questioning the fittingness of this attitude. I further discuss whether, in this type of case, the subject has decisive reasons to try to change her recalcitrant attitudes—say by trying to modify her aesthetic affective dispositions. My answer is negative. Even granting that subjects always have aesthetic reasons to try to avoid aesthetically unfitting attitudes, these can be outweighed by further reasons not to do so—perhaps including aesthetic reasons related to the construction of valuable aesthetic identities or to the value of aesthetic engagement. En el ámbito del derecho procesal penal, particularmente en el contexto del tránsito, existe una carencia de disposiciones legales que regulen el aspecto probatorio para demostrar infracciones por parte de las autoridades competentes. Específicamente, la falta de regulación sobre el uso de fotografías o videos como evidencia dificulta el proceso de aplicación de la ley, ya que ni el COIP ni la LOTTTSV ni sus reglamentos abordan adecuadamente cómo deben obtenerse pruebas mediante medios digitales. Esta laguna normativa plantea interrogantes sobre (...) qué aspectos pueden capturarse en contenido digital, cómo llevar a cabo dicho proceso y qué requisitos deben cumplir los dispositivos utilizados. Ante esta situación, se justifica la necesidad de realizar una investigación exhaustiva para determinar qué aspectos deben incorporarse en la normativa de tránsito con el fin de garantizar un debido proceso. El objetivo principal de esta investigación fue identificar las deficiencias en la regulación del aspecto probatorio en casos de infracciones de tránsito, así como proponer recomendaciones para mejorar el marco normativo existente. Se buscó determinar qué aspectos deben ser incorporados en la normativa de tránsito para garantizar un debido proceso y una aplicación justa de la ley. Para abordar esta problemática, se llevó a cabo una investigación cualitativa con un enfoque descriptivo. Se empleó el método dogmático-jurídico analítico-sintético para analizar en detalle la legislación existente y las lagunas normativas relacionadas con la obtención de pruebas digitales en casos de infracciones de tránsito. Además, se realizaron entrevistas a expertos en derecho procesal penal y se recopiló información de jurisprudencia relevante. Este enfoque metodológico permitió una comprensión profunda de los desafíos y las posibles soluciones en este ámbito. Los resultados de la investigación revelaron importantes lagunas en la regulación del aspecto probatorio en casos de infracciones de tránsito. Se identificaron problemas relacionados con la falta de claridad en los procedimientos de obtención de pruebas digitales y la ausencia de criterios específicos para la admisibilidad de dichas pruebas en los procesos legales. Además, se destacó la necesidad de establecer estándares claros y procedimientos adecuados para garantizar la integridad y fiabilidad de la evidencia digital en el contexto del tránsito. Esta investigación resalta la importancia de abordar las deficiencias en la regulación del aspecto probatorio en casos de infracciones de tránsito. Se recomienda la implementación de medidas específicas para mejorar la recopilación y admisibilidad de pruebas digitales, así como la revisión y actualización de la normativa existente. Esto contribuirá a garantizar un proceso legal justo y transparente en el ámbito del tránsito, fortaleciendo así el Estado de derecho y la confianza en el sistema judicial. (shrink)

Le dernier Foucault a donné à Platon et au platonisme un rôle très important dans le surgissement de la culture ancienne de soi et dans ce qu’il a appelé « l’esthétique de l’existence ». Mais sa position en rapport à Platon et au platonisme est très complexe et ambigüe. Foucault se déplace d’un anti-platonisme d’allure nietzschéenne dont le thème général serait « la vérité du pouvoir », à une position que l’on pourrait nommer « platonicienne », où le thème « (...) le pouvoir de la vérité » apparaît. Il s’agirait d’un déplacement d’une position anti-philosophique à une autre position philosophique où Foucault chercherait un concept de philosophie à la valeur transhistorique en référence à Platon et dans son extrême radicalisation dans le cynisme. Cette clé platonicienne du dernier Foucault pourrait jeter un peu plus de lumière sur le projet général d’une « ontologie de l’actualité ». (shrink)

The objective of this research is to develop accurate forecasting models for chlorophyll-α concentrations at various depths in El Mar Menor, Spain. Chlorophyll-α plays a crucial role in assessing eutrophication in this vulnerable ecosystem. To achieve this objective, various deep learning forecasting techniques, including long short-term memory, bidirectional long short-term memory and gated recurrent uni networks, were utilized. The models were designed to forecast the chlorophyll-α levels with a 2-week prediction horizon. To enhance the models’ accuracy, a sliding window method (...) combined with a blocked cross-validation procedure for time series was also applied to these techniques. Two input strategies were also tested in this approach: using only chlorophyll-α time series and incorporating exogenous variables. The proposed approach significantly improved the accuracy of the predictive models, no matter the forecasting technique employed. Results were remarkable, with |$\overline{\sigma}$| values reaching approximately 0.90 for the 0.5-m depth level and 0.80 for deeper levels. The proposed forecasting models and methodologies have great potential for predicting eutrophication episodes and acting as decision-making tools for environmental agencies. Accurate prediction of eutrophication episodes through these models could allow for proactive measures to be implemented, resulting in improved environmental management and the preservation of the ecosystem. Argumentation is the gear of a cognitive process of reconstruction when it manifests itself in the discursive proximal space. The cognitive-semiotic perspective of multimodal argumentation suggests that, depending on the knowledge, the codes and signs employed (modes) and the context, certain multimodal structures can lead some audiences towards an accurate mental representation of argumentation, without the need forany formal standardized and verbal structure. We are able to argue with other(s) effectively without the need for a verbal translation of the contents (...) in a space that includes the semiotic interpretation of the message. (shrink)

Reinhardt Grossmann is one of the most sophisticated, knowledgeable and original contemporary metaphysicians. Although he was a student of Bergmann, he influenced the development of Bergmann's metaphysics considerably. No philosopher other than Grossmann defends perception to that degree against the persistent skeptical arguments. He characterizes his epistemological positions as radical empiricism and radical realism. By realism Grossmann mainly means the view that the material things we perceive exist. It is thus also an ontological position and closely related to his empiricism. (...) Grossmann's empiricism is radical insofar as he claims that entities of all categories are perceptible, even numbers and universals. Grossmann's universal realism advocates a theory of abstract categories against the current naturalism. He distinguishes between the world and the physical universe. Los museos han perdido visitantes como consecuencia de la COVID-19 y la ciudadanía sigue creyendo que la ciencia es aburrida. En este contexto de crisis, examinamos, mediante técnicas de análisis de contenido, la presencia de la arqueología en programas de radio y estudiamos los recursos lingüísticos que hacen a la comunicación capaz de emocionar, aumentado las posibilidades de éxito de la divulgación científica. Concluimos que la escasez de equipo humano cualificado en comunicación de la ciencia y experto en recursos para (...) hacerla más atractiva, puede poner en peligro la recuperación de los museos como centros de ocio, cultura y conocimiento. En este trabajo adoptamos una postura crítica, en primer lugar, ante un planteamiento que desde la investigación empírica pretende explicar los fines propios de la educación. Frente a éste proponemos la metodología hermenéutico-crítica para desentrañar cuáles son los fines últimos de la educación. Descubrimos que desde la metodología hermenéutico-crítica es posible enfocar adecuadamente el fin de la educación así como aportar una justificación ética solvente. Profundizando en la dimensión crítica de la hermenéutica, pero sin desvincularla de su quicio experiencial, reparamos (...) en que no basta con interpretar los valores establecidos por la sociedad, sino que es necesario ahondar en el radical ético que justifica la educación como auténtico desarrollo humano de las capacidades morales. Esta experiencia primordial de la educación que hunde sus raíces en el radical humano es una experiencia genuinamente ética. A este respecto, destacamos once claves del enfoque éticohermenéutico y sus ventajas para la determinación del enclave de la educación. (shrink)

We start from an understanding of the human person as a communicative and symbolic reality. We emphasise the more subjective aspect of education, as showing the best of the person (educere) by creatively appropriating the treasures of history (educare). With these premises, we approach narratives that are surprising for the heterodoxy (resistance) they manifest, with respect to the social reality in which they were written, in the 1st century, in which they were written. In this approach it becomes evident that (...) the interruption of the silence of women, which appears in these narratives, shows the radical value of the human personal reality, opening an egalitarian educational space. Biometric identity systems are now a prominent feature of contemporary law enforcement, including in Europe. Often advanced on the premise of efficiency and accuracy, they have also been the subject of significant controversy. Much attention has focussed on longer-standing biometric data collection, such as finger-printing and facial recognition, foregrounding concerns with the impact such technologies can have on the nature of policing and fundamental human rights. Less researched is the growing use of voice recognition in law enforcement. This paper examines (...) the case of the recent Speaker Identification Integrated Project, a European wide initiative to create the first international and interoperable database of voice biometrics, now the third largest biometric database at Interpol. Drawing on Freedom of Information requests, interviews and public documentation, we outline the emergence and features of SiiP and explore how voice is recognised and attributed meaning. We understand Speaker Identification Integrated Project as constituting a particular ‘regime of recognition’ premised on the use of soft biometrics to disembed voice in order to optimise for difference. This, in turn, has implications for the nature and scope of law enforcement, people's position in society, and justice concerns more broadly. (shrink)

Desde el Renacimiento, la utopía ha cumplido una función crítica con respecto al orden social establecido. La representación imaginativa de una sociedad perfecta se construye sobre la constatación de la injusticia de la realidad presente. Por oposición, la ideología, como representación que da identidad a una sociedad, desempeña la función de justificación del orden establecido. Ambas -utopía e ideología-, en su deformación, se oponen y se excluyen mutuamente, en tanto que evasión de la realidad o encubrimiento de la injusticia. El problema que se plantea es si es posible, en nuestro tiempo, recuperar el impulso transformador que llevó al pensamiento utópico en la Modernidad a aspirar a una sociedad mundial más justa. This paper analyzes the narrative strategies of Radical Basque Nationalism, taking advantage of Thomas Lacoste's documentary, Pays Basque et liberté. It is made up of four parts. The first, as an introduction, focuses on general considerations about language to frame the narrative practices of the RBN. The second and third address the two central elements of the nationalist communication strategy: the use of international figures as an amplification mechanism, on the one hand, and the appropriation of a noble language that (...) functions as a legitimating and prestigious element, while it incorporates elements that can be decoded by the members of the collective as part of its canonical interpretation, on the other. The fourth summarizes the main argumentative axes conveyed by the participants in the documentary. The text is closed with a brief conclusion. The main methodological tool is the analysis of contents. (shrink)
