Most of the standard arguments against the retributive theory of punishment are hardly new. That the retributive view of punishment is but a rationalization of a primitive urge for revenge; that the retributivists, instead of providing an answer to the question about the source of our moral right to add a new evil to an already perpetrated one , simply assert dogmatically that punishment is an intrinsic good, i.e. something that needs no further moral justification; that it is impossible to (...) apply the lex talionis in practice; that the retributivist thesis that the criminal has a right to punishment is absurd, because the criminal himself would be the first to deny that he has any such right; that the retributive theory is incompatible with the claims of forgiveness and mercy; that the practical consequences of the theory are conservative, the theory itself being in fact an apology for the existing laws and the existing social order; that the Hegelian idea of punishment as a ‘negation’ or ‘annulment’ of crime is either unintelligible or essentially utilitarian in character–most of this had been said already in the last century, or even earlier. All these arguments are still in use. 1 But in recent literature–in a number of papers published in the last twenty years or so–we find a new argument against the retributive theory. It is only natural that this particular argument should not have been used earlier: methodologically it is typical of a philosophical orientation which emerged only in our century–analytical philosophy. When encountering a set of alternatives displayed in the form of a list, the decision maker usually determines a particular alternative, after which she stops checking the remaining ones, and chooses an alternative from those observed so far. We present a framework in which both decision problems are explicitly modeled, and axiomatically characterize a ‘divide-and-choose’ rule which unifies successive choice and satisficing choice.

We present a unified look at myopic stability concepts for hedonic games, and discuss the status of the existence problems of stable coalition structures. In particular, we show that contractual strictly core stable coalition structures always exist, and present a sufficient condition for the existence of contractually Nash stable coalition structures on the class of separable games.

BackgroundDecisions about limitations of life sustaining treatments are made for end-of-life patients in intensive care units. The aim of this research was to explore the professional and ethical attitudes and experiences of medical professionals on treatment of end-of-life patients in ICUs in the Republic of Croatia.MethodsA cross-sectional study was conducted among physicians and nurses working in surgical, medical, neurological, and multidisciplinary ICUs in the total of 9 hospitals throughout Croatia using a questionnaire with closed and open type questions. Exploratory factor (...) analysis was conducted to reduce data to a smaller set of summary variables. Mann–Whitney U test was used to analyse the differences between two groups and Kruskal–Wallis tests were used to analyse the differences between more than two groups.ResultsLess than third of participants stated they were included in the decision-making process, and physicians are much more included than nurses. Sixty two percent of participants stated that the decision-making process took place between physicians. Eighteen percent of participants stated that ‘do-not-attempt cardiopulmonary resuscitations’ orders were frequently made in their ICUs. A decision to withdraw inotropes and antibiotics was frequently made as stated by 22.4% and 19.9% of participants, respectively. Withholding/withdrawing of LST were ethically acceptable to 64.2% of participants. Thirty seven percent of participants thought there was a significant difference between withholding and withdrawing LST from an ethical standpoint. Seventy-nine percent of participants stated that a verbal or written decision made by a capable patient should be respected. Physicians were more inclined to respect patient’s wishes then nurses with high school education. Nurses were more included in the decision-making process in neurological than in surgical, medical, or multidisciplinary ICUs. Male participants in comparison to female, and physicians in comparison to nurses with high school and college education displayed more liberal attitudes about LST limitation.ConclusionsDNACPR orders are not commonly made in Croatian ICUs, even though limitations of LST were found ethically acceptable by most of the participants. Attitudes of paternalistic and conservative nature were expected considering Croatia’s geographical location in Southern Europe. (shrink)

Optimal shelflisting invites profit maximization to become sensitive to the ways in which purchasing decisions are order-dependent. We study the computational complexity of the corresponding product arrangement problem when consumers are either rational maximizers, use a satisficing procedure, or apply successive choice. The complexity results we report are shown to crucially depend on the size of the top cycle in consumers’ preferences over products and on the direction in which alternatives on the shelf are encountered.

Članak tematizira ulogu kompleksnog mišljenja u razvoju znanstvene spoznaje i mišljenja općenito. Po Vigotskom, kompleksno mišljenje je početna faza u ontogenezi, pa i filogenezi, ljudskog mišljenja i ono je u tom slijedu predpojmovno. Prema istom autoru, ono ima svoju unutarnju genezu koja započinje asocijativnim kompleksima, a završava pseudopojmovima. Kompleksno mišljenje je po svojoj bitifluidno, neograničeno i omogućuje prenošenje značenja. Smatramo da kompleksno mišljenje dolazi do izraza prije svega u uporabi metafora i analogija. Metafore i analogije imaju važnu eksplanatornu i ponekad (...) čak heurističku ulogu u znanstvenom mišljenju. Kompleksno mišljenje dolazi do izražaja na svim razinama i etapama razvoja znanstvenog mišljenja. Metafore mogu biti dijelom kompleksnog mišljenja kao dominantnog načina mišljenja ili u pojmovnoj strukturi kao pomoćni elementi objašnjenja. The paper is a critical examination of the main attempts at a reconciliation of the two theories of legal punishment: the utilitarian and the retributive. four middle-of-the-road theories of punishment are discussed with hart's theory offering a genuine synthesis of two approaches (negative retribution and positive retribution). In the first part of the paper I demarcate patriotism from nationalism and layout a typology of patriotism, distinguishing its types or facets in terms of the object of patriotic loyalty, reasons for it, its motive, strength, dominant vicarious feeling, and moral import. Under the last heading, I distinguish between mundane patriotism, which seeks to promote the worldly interests of the patria -- its political stability and power, economic strength, cultural vibrancy, etc. -- and a distinctively ethical type of patriotism, (...) which is concerned with the country’s moral identity and integrity. While mundane patriotism is devoid of positive moral significance, the distinctively ethical type of patriotism is, under certain fairly common circumstances, a stance we ought to adopt. In the second part, I offer several arguments for this claim, and assess their weight and scope. (shrink)

The paper is on the role of complex thought in the development of thought and scientific knowledge. According to Vigotsky, the complex thought is the first phase in the ontogenesis and phylogenesis of human thought. It is in this sense pre-conceptual. Also, according to Vigotsky, the complex thought has its internal genesis which begins with associative complexes and ends in pseudo-concepts. Complex also an explanatory role in scientific thought. Complex thought ppears on all levels and stages of the development of (...) scientific knowledge. Metaphors may appear in the complex thought as a dominant mode of thought or in the conceptual structure as the auxiliary in the explanation. Analogies present a certain structuration of the complex thought, which contributes to the creation of conceptual structure. The place of analogy is thus between a complex thought and conceptual thought. (shrink)

Raspravljamo o ulozi predpojmovnog kompleksnog mišljenja u znanstvenoj spoznaji i razvoju znanosti. Kompleksno mišljenje sa svom heterogenošću i imaginacijom omogućuje održavanje pojmovne strukture i reorganizaciju cjelokupnih teorijskih mreža, ali to “naplaćuje” latentnim prisustvom protuslovlja i nekonzistentnosti.Članak se nastavlja na našu analizu odnosa između kompleksnog i pojmovnog mišljenja u Aristotelovoj Fizici. Ako je kod Aristotela središnji kompleks pojam “mjesta”, kod Galileija je osnovni kompleks zbirka gibanja-stanja. Galilei još nema izrađenu potpunu pojmovnu strukturu mehanike pa možemo reći da je njegova teorijska osnova (...) uronjena u kompleksnu razinu, ali se oslanja na matematičku strukturu i eksperiment i time uspijeva formirati jednu stabilnu teorijsku organizaciju. Time dobiva osnovu za novu teorijsku sistematizaciju i za formiranje pojmovne strukture kakva je Newtonova. Možemo u izvjesnom smislu reći da je time kompleksno mišljenje u znanosti bilo podignuto na višu razinu i dovedeno u pred-paradigmično razdoblje.We discuss the role of the pre-conceptual complex thought in scientificknowledge and in the development of science. The heterogeneity and imagination of complex thought enables the preservation of the conceptual structure and helps reshape entire theoretical nets, however, its downside is reflected in its latent contradiction and inconsistency. This paper is a continuation of our analysis of the relationship between complex and conceptual thought in Aristotle’s Physics. If Aristotle’s central complex is the notion of “place”, then Galileo’s basic complex is the notion of “ movement”. Since Galileo didn’t have an elaborated conceptual structure of mechanics, we can say that his theoretical basis is “steeped” in the level of complex thought, yet it relies on the mathematical structure and experiment, thereby creating a stable theoretical organization which serves as a basis for the new theoretical systematization and for the shaping of a conceptual structure as Newton’s. Thus, we may claim that, in a certain way, this change raised complex thought in science to a higher level, and brought it to a pre-paradigmatic period. (shrink)

Healthcare professionals working in intensive care units are often involved in end-of-life decision-making. No research has been done so far about these processes taking place in Croatian ICUs. The aim of this study was to investigate the perceptions, experiences, and challenges healthcare professionals face when dealing with end-of-life decisions in ICUs in Croatia. A qualitative study was performed using professionally homogenous focus groups of ICU nurses and physicians of diverse professional and clinical backgrounds at three research sites. In total, six (...) institutions at the tertiary level of healthcare were included. The constant comparative analysis method was used in the analysis of the data. Differences were found between the perceptions and experiences of nurses and physicians in relation to end-of-life decisions. Nurses’ perceptions were more focused on the context and features of immediate care, while physicians’ perceptions also included the wider sociocultural context. However, the critical issues these specific professional groups face when dealing with end-of-life decisions seem to overlap. A high variability of practices, both between individual practitioners and between different organizational units, was omnipresent. The lack of adequate legal, professional, and clinical guidelines was commonly expressed as one of the most critical source of difficulties. (shrink)
