The human history has evidenced a great number of systems of hierarchy and power, various manifestations of power and hierarchy relations in different spheres of social life from politics to information networks, from culture to sexual life. A careful study of each particular case of such relations is very im-portant, especially within the context of contemporary multipolar and multicultural world. In the meantime it is very important to see both the general features, typical for all or most of the hierarchy (...) and power forms, and their variation. This set of issues has been treated by a series of international conferences titled ‘Hierarchy and Power in the History of Civilizations’ held in 2000–2006. Most articles of this volume were originally presented at the 4th conference of this series (Moscow, 2006). Needless to mention that all those presentations have been substantially re-worked for the publication in this volume. Notwithstanding the fact that the relations of hierarchy and power are rele-vant for all the spheres as they penetrate the whole of social life, establishing a sort of framework for the human agency, they are naturally most visible in the political sphere. They existed long before the formation of the earliest states – ethologists maintain that complex systems of hierarchy and power can be found among many highly organized animals. Yet, this was with the formation of the state and civilization when the power and hierarchy relations acquired their mature forms. Although ancient and medieval systems of government and domination always attract special attention, contemporary systems are much closer for every scholar. At the same time relations of power and hierarchy in the modern political world system demonstrate a great number of variants, levels and dimensions. In the present edited volume we only focus on three aspects of this important subject. These are revolutionary transformations (in the broad sense of this notion), violence, and globalization. Given that civility is essential to all aspects of public life, it is important to address how (...) civility may be taught. This paper links the claims of neuroscientist Antonio Damasio to the civilization of the Ancient Greeks. Although Damasio’s book, Looking for Spinoza: Joy, Sorrow and the Feeling Brain, makes the argument for the connection between Spinoza and neuroscience, he says that he prefers Aristotle’s model of human flourishing, but he does not describe Aristotle’s model. I explain Aristotle’s model and connect neuroscience to Aristotle and to the educational system underlying Greek mythology, Hesiod, Homer, tragedy and other aspects of Greek (...) culture, including the role of the arts, religious rituals and the institutions of Greek democracy. It will show that Gramsci shares with the ancients specific theoretical, linguistic, and intellectual topoi. Hegemony has hitherto been located within the context, both theoretical and historical, of debates and controversies arising out of the Marxist and later Leninist revolutionary tradition. It is rightly seen as a notion developed by Gramsci to explain revolutionary failure in Italy and in the West generally, and consequently its antecedents are traced to the problems attendant upon the collapse of the Second International and the rise of Bolshevism in Russia. 2 While such an approach has been useful in revealing the immediate (both political and tactical) constraints acting upon Gramsci's thinking, it has overlooked passages in his writings which reveal an interest in, and [End Page 305] familiarity with, philosophical and theoretical themes originally formulated and elaborated by classical political thought.I. In a note entitled "Passage from Knowing to Understanding and to Feeling and vice versa from Feeling to Understanding and to Knowing" Gramsci establishes a distinction between intellectuals who "know" and the "people-nation" that "feels." The former may know but do not always understand or feel, while the latter may feel but does not always know. The intellectual, in order to know something politically and socially, not merely abstractly or philosophically, must understand it with feeling and passion. As Gramsci writes: The intellectual's error consists in believing that one can know without understanding and even more without feeling and being impassioned (not only for knowledge in itself but also for the object of knowledge); in other words that the intellectual can be an intellectual (and not a pure pedant) if distinct and separate from the people-nation, that is, without feeling the elementary passions of the people, understanding them and therefore explaining and justifying them in the particular historical situation and connecting them dialectically to the laws of history and to a superior conception of the world, scientifically and coherently elaborated--i.e. knowledge. One cannot make politics-history without this passion, without this sentimental connection between intellectuals and people-nation. 3The merely abstract knowledge of the intellectual becomes life and politics when linked to the experiential and passionate feelings of the people. At the same time, the feeling-passion of the people acquires the character of knowledge. Of course such a formulation is reminiscent of Marx's comments in the Theses on Feuerbach. 4 The dyadic relation between intellectual and people-nation, and between knowledge and feeling-passion, both parallels and informs the relation between common sense and good sense. Is shame dead? With personal information made so widely available, an eroding public/private distinction, and a therapeutic turn in public discourse, many seem to think so. People across the political spectrum have criticized these developments and sought to resurrect shame in order to protect privacy and invigorate democratic politics. Democracy and the Death of Shame reads the fear that 'shame is dead' as an expression of anxiety about the social disturbance endemic to democratic politics. Far from an essential supplement (...) to democracy, the recurring call to 'bring back shame' and other civilizing mores is a disciplinary reaction to the work of democratic citizens who extend the meaning of political equality into social realms. Rereadings from the ancient Cynics to the mid-twentieth century challenge the view that shame is dead and show how shame, as a politically charged idea, is disavowed, invoked, and negotiated in moments of democratic struggle. This unique publication offers a complete history of Roman law, from its early beginnings through to its resurgence in Europe where it was widely applied until the eighteenth century. Besides a detailed overview of the sources of Roman law, the book also includes sections on private and criminal law and procedure, with special attention given to those aspects of Roman law that have particular importance to today's lawyer. In this part, special attention is given to the factors that warranted the revival and subsequent reception of Roman law as the 'common law' of Continental Europe. The civil law tradition is the oldest legal tradition in the world today, embracing many legal systems currently in force in Continental Europe, Latin America and other parts of the world. Despite the considerable differences in the substantive laws of civil law countries, a fundamental unity exists between them. The most obvious element of unity is the fact that the civil law systems are all derived from the same sources and their legal institutions are classified in accordance with a commonly accepted scheme existing prior to their own development, which they adopted and adapted at some stage in their history. The article discusses the rights of minorities in the system of the International Covenant on Civil and Political Rights. It establishes a conceptual distinction between universal rights, specific rights of minorities in general and specific rights of particular minorities. Universal rights correspond to all individuals (e,g,, “no one shall be subjected to torture”) or all groups of a certain class (e.g., “all families are entitled to protection”). Minority groups and their members are entitled to these rights in the same (...) way as any other individual or group. Specific rights of minorities in general are granted to minority groups (e.g., “minority groups have the right to speak their own language”) or their members (e.g., “persons belonging to a minority group have the right to speak the language of the group”). Finally, specific rights of particular minorities are granted to specific groups identified by their characteristics (e.g., “the linguistic minority X has the right to speak the X language”) or their members (e.g., “any member of the linguistic minority X has the right to speak the X language”). Treaties and international declarations often refer to universal rights and specific rights of minorities in general. However, these rights are usually recognised in broad terms, and their implementation may lead to the recognition of specific rights in favour of particular minorities or their members. Protection of minorities (in the broad sense of the expression) is based on two pillars: on the one hand, the protection against discrimination; on the other hand, the protection of minorities in the strict sense. The first pillar is an aspect of the general principle of nondiscrimination and requires respect for both formal and substantive equalities. The protection of minorities in the strict sense involves the preservation of their particular identity. The purpose of the equality in a formal sense is achieved through universal rights, to the extent that these are granted to minority groups and their members. On the contrary, to achieve equality in a substantive sense, it could be necessary to implement positive measures. The implementation of these measures will usually lead to the recognition of specific rights of minority groups or their members. Finally, the protection of the distinctive characteristics of the minorities will also be done through specific rights. Thus, on the one hand, there are rights, which are intended to protect the minority forms of life (i.e. to protect differences), and, on the other hand, those that are intended to allow minorities equal access to different uniform social goods (i.e. to protect equality). Whereas the former ones seek to protect and promote the particularities of the minority culture (e.g., the right to receive education in their own language), the latter ones are recognised to overcome the disadvantages that minority groups and their members face and are not intended to promote peculiarities, but rather to permit equal access to resources and social opportunities. Article 27 of the International Covenant on Civil and Political Rights enshrines specific rights of minorities intended to protect and promote their own forms of life. Although economic rights are not mentioned (the article refers to the rights “to enjoy their own culture, to profess and practise their own religion, [and] to use their own language”), they may stem from the explicitly recognised rights. The rights recognised by the Covenant are not collective, but individual rights (“in those States in which ethnic, religious or linguistic minorities exist, persons belonging to such minorities shall not be denied the right [...]”). The rights recognised in the Declaration of the United Nations General Assembly on the Rights of Persons Belonging to National or Ethnic, Religious and Linguistic Minorities are of the same nature. The principle of equality and non-discrimination is contained in Articles 2.1 and 26 of the Covenant. This principle forbids direct and indirect discrimination, be it de iure or de facto. As this is a universal right, minorities can also benefit from it. According to the Human Rights Committee, Article 27 imposes on States the adoption of positive measures that exceed an attitude of mere abstention. In the same way, positive measures may be necessary to make the principle of equality and non-discrimination effective. Although neither Article 27 nor Articles 2.1 and 26 refer to individuals belonging to a specific minority, the concrete implementation of these articles through positive measures may produce specific rights for persons belonging to particular minority groups. We can no longer speak of a state of war in any traditional sense, yet there is currently no viable theory to account for the manifold internal conflicts, or civil wars, that increasingly afflict the world's populations. Meant as a first step toward such a theory, Giorgio Agamben's latest book looks at how civil war was conceived of at two crucial moments in the history of Western thought: in ancient Athens (from which the political concept of stasis emerges) (...) and later, in the work of Thomas Hobbes. It identifies civil war as the fundamental threshold of politicization in the West, an apparatus that over the course of history has alternately allowed for the de-politicization of citizenship and the mobilization of the unpolitical. The Limits of Doubt: The Moral and Political Implications of Skepticism. Albany: The State University of New York Press, 2001. Pp. xiv + 138. Cloth, $49.50. Paper, $16.95. Since the appearance in 1960 of Richard Popkin's The History of (...) Skepticism from Erasmus to Descartes (later extended to Spinoza and, in a forthcoming edition, to Bayle) skepticism has been acknowledged as a powerful intellectual force in modern philosophy. Lom's The Limits of Doubt corroborates this view by showing the relevance of this ancient tradition in the political and moral thought of a number of major modern philosophers.The major thesis of the book is that skepticism in itself, that is, conceived as the epistemological position of raising doubts about any knowledge claim, has no moral or political implications. According to Lom, the moral and political positions that have been associated with skepticism (either tyranny and other forms of political oppression or toleration and liberalism in general) derive not from skepticism itself but from what he calls "the limits of doubt": beliefs left untouched by skeptical doubt. To establish this thesis Lom examines the moral and political aspects of skepticism in Nietzsche (chapter 1), Sextus Empiricus (chapter 2), Hobbes (chapter 3), Diderot (chapter 4), and Montaigne (chapter 5), showing in each case the (value) beliefs responsible for the different moral and political positions held.Lom's analysis of these thinkers' relation to skepticism is comprehensive, detailed, and engaged with an extended secondary literature. I can here just briefly indicate some results of Lom's investigation. He shows Nietzsche's esteem for the ancient skeptics in whom alone Nietzsche saw a plain exhibition of intellectual integrity or honesty. This integrity implies, according to Lom, a demand for justice often unnoticed by superficial readings of Nietzsche. The illiberal aspects of Nietzsche's political philosophy, related to his doctrine of the will to power, derive, according to Lom, not from Nietzsche's skepticism but from the limits of his doubt, namely, his dogmatic nihilism (belief that there is no value, a position that Lom carefully distinguishes from skepticism). Lom also finds limits in Sextus Empiricus's skepticism. He follows Martha Nussbaum ("Skeptic Purgatives...," Journal of the History of Philosophy 29 [1991], 1-33) in claiming that Sextus's skepticism does not extend to the principle of non-contradiction and to the end of tranquility (ataraxia). The [End Page 551] latter is mainly responsible for what Lom considers the ancient Pyrrhonians' political indifference. This indifference, coupled with the Pyrrhonians' attempt to destroy reason (a polemical interpretation of ancient Pyrrhonism) "may also allow political nightmares to breed in the night" (45). In Hobbes, Lom identifies a kind of methodical doubt whose aim is not that of Descartes's of finding certain truth but to combat the pride of men. This pride leads to different and conflicting views of the summum bonum that disturb the civil order. Its destruction through skepticism facilitates the acceptance of the sovereign's decisions and thus the attainment of peace. Lom notes the similarity of Hobbes's position on doubt with Sextus's (the subordination of the skepsis to the goal of tranquility) and points out a number of interesting and still little explored parallels between Hobbes and Montaigne, whose skeptical and moral views are examined in chapter 5. According to Lom, Montaigne, like Sextus, is little interested in politics and his attack on cruelty and defense of toleration do not issue from his skepticism but from moral values that remain outside the scope of doubt, notably Montaigne's desire for peace. Lom's analysis of Diderot is interesting and original. This is an excellent compilation of essays honoring the seventieth birthday of Joseph Needham. Sivin’s preface plausibly argues for the thesis that, "since the theoretical and practical approaches seem in traditional societies everywhere to have formed a unity with the social, political, and spiritual aspects of life, the reader can enrich his understanding of the latter to the extent that he is aware of the former". The essays belong to two complementary parts. The first four essays by Derek J. (...) de Solla Price, S. Nakayama, A. C. Graham, and Mitukuni Yosida furnish valuable critical aids and perspectives on Needham’s monumental work, Science and Civilization in China.
