Law search is fundamental to legal reasoning and its articulation is an important challenge and open problem in the ongoing efforts to investigate legal reasoning as a formal process. This Article formulates a mathematical model that frames the behavioral and cognitive framework of law search as a sequential decision process. The model has two components: first, a model of the legal corpus as a search space and second, a model of the search process that is compatible with that environment. The (...) search space has the structure of a “multi-network”—an interleaved structure of distinct networks—developed in earlier work. In this Article, we develop and formally describe three related models of the search process. We then implement these models on a subset of the corpus of U.S. Supreme Court opinions and assess their performance against two benchmark prediction tasks. The first is to predict the citations in a document from its semantic content. The second is to predict the search results generated by human users. For both benchmarks, all search models outperform a null model with the learning-based model outperforming the other approaches. Our results indicate that through additional work and refinement, there may be the potential for machine law search to achieve human or near-human levels of performance. (shrink)

In this article, I propose to see the emotion of anger in the ‘Antapodosis’ by Liudprand of Cremona as an important means of assessing characters. By depicting the anger of the Ottonian kings as just and predictable, Liudprand shows how the ideal ruler should behave. He uses various examples from the Old Testament and especially the Deuterocanonical books of the Maccabees to present the anger of the Ottonian kings in the same fashion. In his vision, the negative counterpart to the (...) Ottonians is played by the Italic kings, who show their unworthiness precisely through the inept and tyrannical use of anger. In addition to this, Liudprand writes about aristocratic anger-management as well as the anger of women. Although a man of the church, Liudprand shows himself to understand and to use the code of honour which applied to noblemen in conflicts. Women do not, on the contrary, show unmediated anger. IntroductionSpatial navigation is a complex cognitive function that declines in older age. Finding one’s way around in familiar and new environments is crucial to live and function independently. However, the current literature illustrates the efficacy of spatial navigation interventions in rehabilitative contexts such as pathological aging and traumatic injury, but an overview of existing training studies for healthy older adults is missing. This scoping review aims to identify current evidence on existing spatial navigation interventions in healthy older adults and analyze (...) their efficacy.MethodsTo identify spatial navigation interventions and assessments and investigate their effectiveness, four electronic databases were searched. Two independent reviewers conducted a screening of title, abstract and full-texts and performed a quality assessment. Studies were eligible if published in English, the full text was accessible, at least one group of healthy older adults was included with mean age of 65 years or older, three or more spatial navigation-related training sessions were conducted and at least one spatial ability outcome was reported.ResultsTen studies were included, only healthy older adults were assessed further. Studies differed in sample size, type of training, total intervention duration, and intervention period.ConclusionThe spatial navigation abilities addressed and the measures applied to elicit intervention effects varied in quantity and methodology. Significant improvements were found for at least one spatial ability-related outcome in six of 10 interventions. Two interventions achieved a non-significant positive trend, another revealed no measurable post-training improvement, and one study did not report pre-post-differences. The results indicate that different types of spatial navigation interventions improve components of spatial abilities in healthy older adults. The existing body of research does not allow conclusions on transferability of the trained components on everyday life spatial navigation performance. Future research should focus on reproducing and extending the promising approaches of available evidence. Virtual reality (VR) is the computer simulation of a three‐dimensional environment that a person can interact with using special electronic equipment, such as a headset with an integrated display. Often coupled with VR, exergames are video games that involve physical exercise. Little is known regarding the chronic effects of exergaming through VR chon cognitive functions. Eleven young participants were enrolled in this crossover exploratory study. They had to follow two trainings of 5 consecutive days, 15 min per day, interspaced by (...) a 1‐month washout period. Trainings were performed in a random order: (1) a video training using shadow boxing fitness videos (SBV) and (2) a VR training using a three‐dimensional game where the aim is to cut moving cubes with a sword in each hand. Before and after each training period, a battery of cognitive tests was performed to assess executive functions, such as attention (change blindness), reaction time, response inhibition (go/no‐go, Stroop task), or flexibility (trail making test). Fine motor skills were also evaluated through a Fitt's task. No effect of the SBV training was observed on any of the cognitive functions tested. On the contrary, a significant increased performance in selective attention and observation tests was found after VR training, as well as in inhibitory processes (Stroop and go/no‐go). Other performances were unaffected by either VR or SBV training. The present study argues that VR exergaming is a promising tool to promote cognitive enhancement but targets specific functions according to the type of interface/game that is used. (shrink)

In this article, we address the problem of the potential crisis in people’s life’s meaning due to massive automation-driven technological unemployment. Assuming that the problem of (re)distribution of economic resources to the whole of society in such a scenario will be solved (e.g. through provision of a Universal Basic Income), the question arises concerning the meaning of people’s lives in a world in which almost everyone does not have to (or even could not) work in order to live. Here, we (...) side with many current proposals that paid work is not the only possible source of meaning and hence, that a meaningful life could indeed be led in a post-work society. We especially focus on one of the most developed accounts, Danaher’s Virtual Utopia (Danaher, 2016, 2019, 2022). According to him, living immersed in playful virtual worlds where new, expanded and personalized possibilities of personal and collective experiences and actions, could not only be perfectly meaningful lives, but furthermore, “be the utopia we are looking for” (Danaher, 2019, p. 270). However, our analysis will suggest that although it is a very well thought and carefully articulated position, it suffers from various important problems. Our criticism will be based on an alternative framework to think about life’s meaning and the conditions for leading a good life in general. This alternative is based on the philosophy of buen vivir (“good living”). This notion has its roots in common aspects of various Latin American indigenous cultures regarding a community-centered way of life where humans, society and nature are taken to be deeply interconnected and interdependent, and where the notions of respect, harmony and balance are at the core of this interrelationship (Gudynas, 2011; Acosta, 2008; Beling et al., 2021). Buen vivir has many facets, but we will focus on three: the importance of healthy human communities, the human-nature relationship, and the intrinsic value of nature. Based on these, we argue that the Virtual Utopia is not a good candidate for human’s post-work utopia because i) it unnecessarily augments the environmental damage that is already involved in massive labor automation; ii) it entails an unnecessary and detrimental dependence on technology for human relationships; and iii) increases the severance of the link between humanity and nature. We conclude that the buen vivir approach is a promising candidate for an alternative utopian project, but one that needs further construction. (shrink)
