Adrian Piper argues that the Humean conception can be made to work only if it is placed in the context of a wider and genuinely universal conception of the self, whose origins are to be found in Kant’s Critique of Pure Reason. This conception comprises the basic canons of classical logic, which provide both a model of motivation and a model of rationality. These supply necessary conditions both for the coherence and integrity of the self and also for unified agency. (...) The Kantian conception solves certain intractable problems in decision theory by integrating it into classical predicate logic, and provides answers to longstanding controversies in metaethics concerning moral motivation, rational final ends, and moral justification that the Humean conception engenders. In addition, it sheds light on certain kinds of moral behavior – for example, the whistleblower – that the Humean conception is at a loss to explain. (shrink)

The Humean conception of the self consists in the belief-desire model of motivation and the utility-maximizing model of rationality. This conception has dominated Western thought in philosophy and the social sciences ever since Hobbes’ initial formulation in Leviathan and Hume’s elaboration in the Treatise of Human Nature. Bentham, Freud, Ramsey, Skinner, Allais, von Neumann and Morgenstern and others have added further refinements that have brought it to a high degree of formal sophistication. Late twentieth century moral philosophers such as Rawls, (...) Brandt, Frankfurt, Nagel and Williams have taken it for granted, and have made use of it to supply metaethical foundations for a wide variety of normative moral theories. But the Humean conception of the self also leads to seemingly insoluble problems about moral motivation, rational final ends, and moral justification. Can it be made to work? (shrink)

The constitutionalist debate - over where decision-making power in society should lie, and how it should be exercised - is one which is of fundamental importance not only in academia and constitutional theory, but in society generally. The main aim of this thesis is to critically examine the current debate from a particular, sceptical philosophical perspective - one which questions the possibility of convincingly defending moral premises. This controversial perspective, which goes to the heart of debates over moral realism, objectivity, (...) and epistemology is set out and defended in detail, drawing on the work of the sceptical and strongly anti-foundationalist legal theorist, Arthur Leff, and the pragmatic philosophy of Richard Rorty. Some implications of this perspective for the constitutionalist debate and key approaches within it are then considered in the rest of the thesis . This examination includes instrumentalist arguments and "democratic" arguments often relied on by various sides in the debate. It is argued that, when taken to their underlying premises and assumptions, each approach is misguided from the perspective defended here and, therefore, that the current constitutionalist debate is unsatisfactory. Some suggestions of the way forward following this argument are then made. (shrink)

Can John Stuart Mill’s radicalism achieve liberal egalitarian ends? Joseph Persky’s The Political Economy of Progress is a provocative and compelling discussion of Mill’s economic thought. It is also a defense of radical political economy. Providing valuable historical context, Persky traces Mill’s intellectual journey as an outspoken proponent of laissez-faire to a cautious supporter of co-operative socialism. I propose two problems with Persky’s optimistic take on radical social reform. First, demands for substantive equality have led past radicals to endorse exclusionary (...) nationalist and eugenics policies. It pushes some contemporary radicals towards illiberal interventions into intimate social life. Second, the radical critique of capitalism relies on an account of profit that neglects the epistemic function of private-property markets. Once this is acknowledged, capitalism retains some progressive credentials against radical alternatives. (shrink)

En el presente trabajo sostengo que los argumentos específicos desarrollados por John Rawls para justificar la adopción de un estándar de bienes sociales primarios no logran su cometido. En primer lugar, presento y critico los argumentos rawlsianos relacionados con intuiciones antidiscriminatorias y con el hecho del pluralismo razonable. Asimismo, caracterizo y critico las ideas rawlsianas concernientes al alcance del concepto de equidad, así como el argumento de los gustos caros y de la responsabilidad por los fines. Estimo que ellos no (...) logran justificar el distribuendum recursivista de bienes sociales primarios. En cambio, entiendo que tales consideraciones brindan apoyo a un estándar bienestarista. Ello se debe a que un estándar welfarista enfrenta exitosamente las dificultades que Rawls menciona para favorecer el estándar recursivista de bienes sociales primarios. In the present paper I argue that the specific arguments developed by John Rawls to justify the standard of social primary goods do not succeed. In the first place I develop and criticize the Rawlsian arguments grounded in antidiscriminatory intuitions and the fact of reasonable pluralism. I also characterize and criticize Rawls's ideas concerning the scope of the concept of fairness as well as his argument concerning extensive tastes and responsibility for ends. I believe that they do not justify a resourcist distribuendum. On the contrary, I argue that such considerations support a welfarist standard. The reason is that a welfarist standard successfully deals with the difficulties Rawls mentions in favoring the resourcist standard of social primary goods. (shrink)

This paper explores the role of envy in the third part of A Theory of Justice and challenges a wide-spread game-theoretic view of stability. The proponents of this view see Rawls’s account of stability as an attempt to solve a collective action problem. I claim that Rawls treats the development of envious feelings as a distinct source of instability which is not part of a collective action problem and has to be addressed separately. My thesis entails that we shouldn’t read (...) the congruence between the right and the good as the culmination of Rawls’s overall argument for stability. This reading is supported by the revised account of stability in Justice as Fairness: A Restatement and leads to a better understanding of Rawls’s political turn. (shrink)

El artículo "Repensar el liberalismo igualitario de John Rawls" pretende analizar el paradigma tanto cognoscitivo como organizativo de Teoría de la justicia y la trascendencia del pensamiento de Rawls a cuarenta años de su publicación. Por consiguiente, está dividido en cinco apartados. El primero --Introducción-- exhibe el contexto de su obra y su gran resonancia. El segundo --El nuevo paradigma liberal "rights based"-- expone la propuesta, a través del estudio de su inspiración kantiana; la crítica del utilitarismo; la discusión de (...) la "justicia como imparcialidad", la cual incluye aspectos como sociedad bien ordenada, concepción de la persona, posición original, así como velo de ignorancia, principios de justicia, bienes primarios y prioridad de la libertad; y, por último, el debate sobre la configuración del paradigma liberal "fundado en los derechos", a partir de las observaciones no sólo de Barry y Wolff sino también de Nozick y Dworkin. El tercero --Crítica al liberalismo igualitario de Rawls-- introduce algunas objeciones formuladas, desde la perspectiva del comunitarismo, por autores tales como MacIntyre, Sandel, Taylor, Unger y Walzer. El cuarto --Réplica a sus críticos-- manifiesta las concesiones y las respuestas de Rawls. Under the circumstances of pluralism people often claim that the state ought to be neutral towards its citizens’ conceptions of the good life. However, what it means for the state to be neutral is often unclear. This is partly because there are different conceptions of neutrality and partly because what neutrality entails depends largely on the context in which neutrality is demanded. This paper discusses three different conceptions of neutrality – neutrality of impact, neutrality as equality of opportunity and justificatory (...) neutrality – and analyses the strengths and weaknesses of the different conceptions in different contexts. It suggests that there are two common elements of neutrality in all its exemplifications: a) an element of “hands-off” and b) an element of equal treatment. It therefore argues that while justificatory neutrality is necessary for the state to be neutral it is not sufficient and claims that while conceptions of the good must not enter the justification of state regulations, they must be taken into consideration when delib- erating the implementation of these regulations. Normal 0 false false false MicrosoftInternetExplorer4 In this article, we will look at the political philosophical theories of Brian Barry ( Culture and Equality , 2001) and Chandran Kukathas ( The Liberal Archipelago , 2003) and see which consequences both theories have for the Belgian model of church and state. For both authors, the liberal state should be neutral toward religion but they interpret this neutrality in a different way. According to Kukathas, neutrality implies a hands-off policy and therefore, recognizing (...) and financing religions is out of the question. For Barry on the other hand, the state is neutral if equal people have equal opportunities. Consequently, state support for religions and even the recognition of religions is possible, if religions are treated in the same way. However, a hands-off policy is also in line with Barry’s theory. Both from a pragmatic and from a normative point of view, Barry’s egalitarian liberalism seems the most interesting theory as an inspiring source for the evolvement and modification of the Belgian system, towards more fairness and equality.
