Abortion is the most common and controversial issue in many parts of the world. Approximately 46 million abortions are performed worldwide every year. The world ratio is 26 induced abortions per 100 known pregnancies. Pakistan has an estimated abortion rate of 29 abortions per 1,000 women of reproductive age, despite the procedure being illegal except to save a woman’s life. 890,000 abortions are performed annually in Pakistan. Many government and non-government organizations are working on the issue of abortion. Islamic finance has experienced considerable growth worldwide interms of deposits and assets of Islamic banks over the last 40 years, but showslittle signs of achieving maturity. Almost all Islamic finance products currentlyis use are mere replicas of their conventional counterparts. This study followsthe archival research strategy of Bryman, and analyses the literatureon Islamic finance theory and products and practices in order to ascertainthe reforms needed for the maturity goal. The paper proposes adoption ofa new law regarding money, different policy approaches, (...) new structures offinance for shifting to risk-based financing, new models, procedures and somefresh thought in order to relate banking and finance to the real economy. Itrecommends a leading role for Islamic economists for effective reforms in themonetary and credit system in order to ensure that all financing is based ongoods, services, stocks or securities representing real assets in line withthe Shariʽah principles. The Sharī‘ah ‘Committee is a board which is independent in directing, reviewing and supervising an Islamic Financial Institution. It consists of those who are specialised in Fiqh Mu‛āmalāt or those who know it with expertise in other fields. In conjunction with IFIs emergence, the Accounting and Auditing Organization for Islamic Financial Institutions was established and has issued numerous standards on accounting, auditing and also governance for IFIs. The researchers intend to review the duties and decision-making guidelines of the Sharī‘ah Committee (...) prescribed by the AAOIFI in 2010. The review undergoes a thorough search and critical analysis of any related content about the topic throughout the whole standard. Some important results are: AAOIFI mentions directly the duties of the Sharī‘ah Committee along with the definition of this Sharī‘ah Committee. These duties are directing, reviewing and supervising. : Hisbah is the most important institution in a society and nation.Enforcement parties are those who are directly involved in executing this. Incarrying out their duties, they bear heavy responsibility because it involvesthe rights of Allah and the rights of human. Hisbah implies theimplementation of al-amr bi-l-maʿrūf when it is clear thatit is abandoned, and wa-n-nahy ʿani-l-munkar when itis clear that it is done. This study is based on the concept of Hisbah in SharīʿahLaw which is of a general and (...) widespread aspect of enjoining good andpreventing evil. Literature reviews and library searches have been conductedintensively to clarify the principles of hisbah. Additionally, descriptiveand content analysis of textual content was done on the provisions of lawsand regulations as well as guidelines on the prevention of sharīʿah crimeparameters in Malaysia. In general, our country has implemented the conceptof hisbah in its own form without the branding of an institution specifically as“the institution of hisbah”. This article examines the stance held by a Meccan-Indonesian exegete in the 13 AH or 19 AD century, Muḥammad Nawawī al-Bantānī (d. 1230–1314 H/1813–1897 AD), in dealing with Ṣifāt verses in his exegetical work, Marāḥ Labīd li Kashf Ma’nā al-Qur’ān al-Majīd. As an established term, Ṣifāt verses refer to Quranic expressions that ostensibly ascribe anthropomorphic dimensions to God. Interpretation of such ambiguous verses has been bitterly contended since the 2/8th century and remains one of the most debated topics in the (...) pre- and postmodern era. This study applies literature and document analysis focused on many of al-Bantānī’s works. The results show that al-Bantānī actively applied ta’wīl [figurative interpretation] in dealing with Ṣifāt verses without totally discarding amodality position [tafwīḍ].Contribution: Although al-Bantānī never mentioned Wahhabism in any of his works, his interpretation of Ṣifat verses alludes to his indirect response to the Wahhabi’s literalism and anti-ta’wīl approach. In addition, by accepting both of ta’wīl and tafwīḍ solutions, al-Bantānī underpinned the wasaṭī [moderate] stand, which later became the most distinctive tradition in Malay–Islamic discourse. Rapid developments in science and technology have resulted in novel discoveries, leading to new questions particularly related to human values and ethics. Every discovery and technology has positive and negative implications and affects human lives either directly or indirectly, involving all walks of life. Bioethical discourse in Malaysia must consider the multiracial and multireligious background of Malaysia and especially the Islamic view as the majority of Malaysians are Muslims and Islam is the religion of the federation. This article discusses several (...) selected bioethical issues in Malaysia by studying the application of maṣlaḥah (the public good) and mafsadah (evil and harms) in Malaysian Islamic rulings (fatwas). This article uses the critical interpretation approach, as this is an ethical, interpretive, textual, and contextual analysis. In a situation when there is a conflict between maṣlaḥah and avoidance of mafsadah, it is preferred to attempt to address both needs. However, if maṣlaḥah and avoidance of mafsadah are mutually exclusive, the decision to choose must be made by weighing (tarjīḥ) and choosing the one which is superior. The maṣlaḥah and mafsadah concepts play vital and significant roles in bioethical discourse to realize human essential interests, namely faith, life, lineage, intellect, and property, thus achieving maqāṣid al-sharīʿah (the ultimate goal of sharia). This concept helps in guiding bioethical discussions, especially in determining the priority between achieving benefits and avoiding harms. The application of this concept will also assist Malaysian authorities in formulating appropriate rulings, especially bioethical issues related to Malaysian Muslims’ lives. (shrink)

This paper examines the debate on gender equality which is considered by some groups to be in conflict with Q.S. An-Nisa [4]: ​​11. With a philosophical approach and referring to the concept of inheritance of Sa'id Ramadan al-Buthi in the _Kitab_ _al-Mar'ah Bayna Thughyan al-Nizam al-Gharbi wa Lata'if al-Tashri' al-Rabbani_, this paper tries to refute these allegations and offers a more gender-friendly interpretation. For al-Buthi, the verse has actually liberated women because the provisions are caused by the responsibilities imposed by (...) Islam on men as prospective husbands and not experienced by women. On the contrary, if women are empowered than men, that is a moral responsibility, not a _sharia_ responsibility. Thus, women have been given freedom by the _sharia_ in order to determine the choice to participate in bringing about stability in life, regardless of the existence of a condition of women more empowered than men that will not be the cause of changes in the provisions of _sharia_ concerning inheritance. Muʽtazilah is one of the kalām schools in which intellectual freedom is seen the most and therefore divergences within the sect are the most common. Although al-usûl al-ḥamsa/five principles constitute the main framework on which Muʽtazilah has agreed, opposing ideas have emerged within the sect on the principles of ʽadl (divine justice) and al-manzilah bayna al-manzilatayn and on the issues of nature and imamah. As a matter of fact, Muʽtâzilī scholars wrote many refutations to each other on the disputed issues. (...) One of those who have opposing views within the Muʽtazilah is Muḥammad b. Shabīb al-Baṣrī (d. mid 3rd/9th century), who lived between the end of 2nd and the middle of the 3rd century of hijra. Ibn Shabīb is one of the students of Ibrāhīm Ibn Sayyār al-Naẓẓām (d. 231/845), who was one of the leading scholars of Muʽtazilah. He initially opposed the principle of al-manzilah bayna al-manzilatayn, while he was Muʽtezilî, and accepted the Murji’ah approach on this issue. However, after he accepted the idea of irjā’, he continued his loyalty to Muʽtazilah with regard to the principles of tawhīd (divine unity) and ʽadl. Ibn Shabīb, who had a theological assembly of his own and is respected by the people in Baṣra, was an important scholar who stands out with his comprehensive knowledge of religious and philosophical schools of his time. In the doxographical tradition, his adoption of Murjī’ ideas is generally emphasized, except that he has not been referred to much. However, when the sources of kalām are examined meticulously, it is understood that he influenced many Muslim theologians with his works and views and that he was a source for them regarding many topics. The most important reason for this is that he was one of the first scholars to defend the Islamic belief against various philosophical and religious movements. Naturally, this situation provided him with a wide knowledge of religious and philosophical trends. Considering the quotations made from him, it is understood that he recorded this accumulation in a doxographical work. Another remarkable feature of Ibn Shabīb is that he was one of the first scholars to write in the genre of Kitāb al-Tawhīd. It is possible to see both contextual and methodological effects of this work in the quotations and narratives of Al-Māturīdī's book with the same name. What makes him different is that he adopts Muʽtazilī and Murjī’ ideas at the same time and develops a unique discourse on the subjects of grave sins and waʽīd (divine warning). Although he was raised in a strong tradition of thought such as Muʽtazilah, his ability to oppose his sect and his teacher Al-Naẓẓām and also to develop a different definition of faith despite accepting the doctrine of irjā’, makes him stand out as an original and intellectual personality. His different definition of faith is important in that it represents a more moderate approach to the issue of takfīr. For, he drew an encompassing framework based on the Quran and the Sunnah regarding the definition of faith and the conditions of takfīr, thus, he tried to preserve the unity of Muslims. He did not consider the denial of controversial issues that are not explicitly included in the Quran and Sunnah as a reason for takfīr. With this attitude, Ibn Shabīb took an important approach in ensuring social peace and free thought. In this article, all the information contained in Muʽtazilī sources, and doxographical works related to the life, scientific personality and theological views of Ibn Shabīb are gathered and analyzed, and then his theological thought is reconstructed based on these data. From this point of view, identifications and evaluations have been made regarding the issues that make him different and unique in the history of Muslim thought. (shrink)

We examined the direct and indirect (via relational social capital) relationship between ethical leadership and knowledge hiding. We also tested the moderating role of instrumental thinking in the relationship between ethical leadership and knowledge hiding and the relationship between ethical leadership and relational social capital. Data were collected from 245 employees in different firms spanning different manufacturing and service sectors. The results showed that ethical leadership was negatively related to knowledge hiding, both directly and via relational social capital. The results (...) revealed that instrumental thinking moderated the positive relationship between ethical leadership and relational social capital, such that the relationship was weak when instrumental thinking was high. The results also showed that instrumental thinking moderated both direct and indirect relationships between ethical leadership and knowledge hiding, such that the relationships were weak when instrumental thinking was high. The study carries important practical implications for managers concerned about the destructive consequences of knowledge hiding. (shrink)

This paper is a historically based approach to the topic of contemporary political and religious status of Nigeria. Recently, the secular administration by Islamists has generated violence between Muslims and Christians. The latter view Islamism as a gradual Islamisation of the country. Modern Islamists plead for a re-introduction of shari’a and OIC membership. They reject the secular status of Nigeria, the Islamic banking and educational system, etc. The meaning and purpose of these are not different from hijrah, and mahdism of (...) early 20th century. The is- sue is about restoring the ousted Caliphal system, and about rejecting the Western system and secularism, which were introduced by imperialists. The spirit of Islamism is increasing, especially among the grass-roots, elite, and politicians. In these circumstances, the phe- nomenon has to be assessed in an interdisciplinary way. (shrink)

The purpose of the current research was to present a proposed outline for an introductory textbook for Theology faculties students. This outline is based on the Common European Framework of Reference for Language Learning, Teaching, and Assessment. The research problem was determined in the need of more academic contributions that can enrich the process of designing educational textbooks and programs which sometimes are not based on sound linguistic and educational foundations, in addition to, the lack of procedural steps for designing (...) an introductory textbook for Arabic language learners in Theology faculty in order to enrich them with the desired linguistic inventory. This can be confirmed by research that indicated a deficiency in the attention given to designing learning textbooks for Arabic language learners in general and for preparatory year students in particular. To address this problem, the research determined the standards of the linguistic performance for the introductory textbooks, the appropriate performance indicators for each standard, the appropriate assessment methods for both linguistic performance and linguistic aspects, then presented the final proposed outline for the introductory textbook in light of the European reference framework." The research utilized the descriptive analytical approach. The theoretical framework of the research consists of two chapters. The first chapter presented the status quo of teaching Arabic language in the preparatory year of theology faculty in Turkey. The second chapter presented the teaching of the Arabic language at the preparatory level in light of the Common European Framework of Reference for Language learning, teaching and assessment. It also presented the specification table of the introductory level mentioned in the Common European Framework of Reference. The research provided a proposed outline and presented linguistic performance indicators and linguistic aspects. Then, it highlighted the importance of cultural content and the assessment methods that can be utilized in the introductory textbook. The research then presented suggestions on the production of the textbook. The conclusion of the research emphasized the importance of having an outline for designing an introductory Arabic language textbook for Turkish theology students in light of the Common European Framework of Reference especially that the available textbooks in the preparatory year is still few and the field is still in need for more attention to accomplish the desired targets; among them, is addressing the individual differences issue among learners and helping teachers to present the subject matter to the learners who are diverse in their cognitive levels as they have linguistic systems that have its phonic, grammatical, morphological, semantic and structural features. The research demonstrated the importance of the paper textbook due to its unique role in the learning and teaching process regardless of its type, pattern, or content. The research emphasized that the adoption of a common framework-based introductory textbook by theology faculty will accomplish numerous benefits. These include reaching a consensus on the level of competence that students are expected to achieve by the end of the preparatory year. In light of the research problem and its revealed findings, the research recommended the importance of designing textbooks and educational series in line with global reference frameworks and reconsidering the content of some preparatory level textbooks. Additionally, the research highlighted the importance of organizing workshops to train Arabic language teachers to use reference frameworks to develop students’ linguistic skills. The research recommended that it is necessary to prepare proposed outlines for other levels, such as the novice, intermediate, and advanced, in light of the European reference framework. (shrink)

I propose a framework for comparative Islamic—Western ethics in which the Islamic categories "Islam, Iman," and "Ihsan" are juxtaposed with the concepts of obligation, value, and virtue, respectively. I argue that "shari'a" refers to both the obligation component and the entire structure of the Islamic ethic; suggesting a suspension of the understanding of "shari'a" as simply Islamic "law," and an alternative understanding of "usul al-fiqh" as a moral epistemology of obligation. I will test this approach by addressing the question of (...) reason in Islamic moral epistemology via an examination of an argument advanced by a founding usul scholar Muhammad bin Idrīs al-Shāfi'ī (150 A.H./767 C.E.). The study aimed to identify the strategic sensitivity and its impact on enhancing the creative behavior of Palestinian NGOs in Gaza Strip, and the study used the descriptive analytical approach and the questionnaire as a main tool for collecting data from employees of associations working in Gaza Strip governorates, and the cluster sample method was used and the sample size reached (343) individuals (298) questionnaires were retrieved, and the following results were reached: The relative weight of strategic sensitivity was 79.22 (...) (%), and the relative weight of creative behavior was 78.99 (%), a statistically significant relationship between all strategic sensitivity and creative behavior, and the presence of a sensitivity effect The strategy’s strategy on creative behavior, there are statistically significant differences in the scale dimensions attributable to the gender variable and the differences were in favor of females, there are no statistically significant differences between the averages of strategic sensitivity due to the age variable, and the educational qualification, and there were no statistically significant differences in creative behavior according to The gender variable, age, educational qualification, specialization, and the study presented a set of recommendations, the most important of which are: the need for civil organizations in Gaza Strip to seek funding from external countries in order to provide self-income for associations to face crises and give them independence Mechanism in order to keep them to carry out their role in society, the need to follow up the strategic plan of civil organizations using e-mails as they pave the way to reach excellence and creativity in the field of work. Cancer, a terminal illness, has long been a focus of attention due to its fatal nature. Its diagnosis results in distress not only to the patients and physicians, but also the families and caregivers involved. This distress is of a multifaceted nature, including psychological, financial and physical distress. The present paper aims to explore mental health issues that specifically influence cancer patients’ caregivers. However, in a country like Pakistan literature is not very rich regarding the mentioned issue. Therefore, giving rise (...) to the immense need to create awareness concerning this pressing issue. In this paper, an effort has been made to identify the types of mental health problems and variables which could potentially affect the mental health of a cancer patient caregiver. An analysis on the type of issues and associated determining variables reveals various patients’ variable, situational variable or the caregiver’s own personality which makes them susceptible to poor mental health. Furthermore, the paper tries to answer the different question regarding the prevalence rate, current status of, and awareness on the above mentioned aspect. In the end some possible recommendations have also been made in the context of the mental health issues regarding the caregivers of cancer patients discussed in the paper. (shrink)
