La France a été le premier pays au monde à institutionnaliser la bioéthique en créant un comité consultatif national d’éthique. Les philosophes qui participent aux débats de cette instance normative doivent se livrer à une expérience de pensée inhabituelle, sur un mode collégial et interdisciplinaire. Compte tenu des décisions politiques qui seront prises en fonction des recommandations du Comité, leur implication doit aussi s’accompagner d’une réflexion critique et épistémologique sur le processus de production des avis.

Annoncer une mauvaise nouvelle, décider d'un arrêt de traitement, tenter une opération risquée, réanimer un patient suicidaire... les dilemmes moraux ne sont pas rares en médecine. Les problèmes éthiques ont néanmoins revêtu une acuité particulière de nos jours du fait des progrès techniques, du coût des thérapeutiques innovantes, de l'évolution des moeurs, du vieillissement de la population. Cette nouvelle conjoncture conduit peu à peu à changer les façons d'exercer la médecine. Une culture du partage s'instaure avec les soignants, le monde (...) associatif ou les sciences humaines et sociales. La philosophie morale se trouve également mise à contribution. Car pour être une démarche rigoureuse, l'éthique biomédicale ne doit pas se réduire à un échange d'opinions informelles et spontanées. Elle doit se nourrir de la connaissance des travaux des philosophes d'hier et d'aujourd'hui. A cette fin, le présent ouvrage propose aux professionnels de santé, ainsi qu'à tous ceux qui sont concernés par leurs décisions, de découvrir les grands principes et les principales théories de la philosophie morale. De l'éthique des vertus au contractualisme moral, en passant par le probabilisme, le déontologisme, l'utilitarisme, le libertarisme, l'éthique de la sollicitude ou l'éthique narrative, l'histoire de l'éthique est riche en ressources. The outcome of very preterm infants is marked by the development of complications that can have an impact on the quality of life of the children and their families. The concept of quality of life and its evaluation in the long term raise semantic and ethical problems for French physicians in perinatal care. Our reflection aims to gain a better understanding of the representations surrounding quality of life in neonatal medicine.

This paper reflects on the presumption that there are distinct ethical differences between the supposedly ‘Anglo-Saxon liberal’ and ‘Latin (Southern European) paternalist’ ethical traditions. The predominance of the bioethical paradigm (principalism) is measured by a comparative analysis of regional moral opinion reflected in nation-state health laws. By looking at the way the ethico-legal concept figures into various national ordinances, we attempt to ascertain the extent and nature of variation (if any) between localities by exploring the understanding and application of principalism’s (...) keystone: patient autonomy. Next SectionThe present investigation looks for a solution to the problem of the influence of feelings and emotions on our ethical decisions. This problem can be formulated in the following way. On the one hand, emotions (fear, pity and so on) can alter our sense of discrimination and lead us to make our wrong decisions. On the other hand, it is known that lack of sensitivity can alter our judgment and lead us to sacrifice basic ethical principles such as autonomy, (...) beneficence, non-maleficence and justice. Only emotions can turn a decision into an ethical one, but they can also turn it into an unreasonable one. To avoid this contradiction, suggest integrating emotions with the decisional factors of the process of “retrospective thinking”. During this thinking, doctors usually try to identify the nature and impact of feelings on the decision they have just made. In this retrospective moment of analysis of the decision, doctors also question themselves on the feelings they did not experience. They do this to estimate the consequences of this lack of feeling on the way they behaved with the patient. (shrink)

The concept of continuing professional development (CPD) for teachers combines issues of training, recognition, and professional effectiveness. In this article, we examine the conditions and effects of the implementation of CPD policies at the international and national levels, before looking comparatively at concrete CPD training provision in two “academies” in France. We seek to identify certain conditions for the renewal of in-service teacher training engineering devices and, more broadly, to document major contemporary issues for the teaching profession: attractiveness, recognition, renewal, (...) mobility, and professional development. Physicians frequently face ethical dilemmas when caring for patients. To help them to cope with these, biomedical ethics aims to implement moral norms for particular problems and contexts. As a means of studying the cognitive and neurobiological features underlying the respect for these norms, moral cognitive neuroscience could help us to understand and improve ethical questioning. The article reviews recent developments in the field and presents neurobiological arguments to highlight why some moral rules are universally shared and why some ethical (...) responses are very dependent on context. Alvin Goldman contends that, in addition to the familiar sense or use of the term “knowledge” according to which knowledge is at least true justified belief, there is a weaker yet strict sense or use of the term “knowledge” according to which knowledge amounts to nothing more than information-possession or mere true belief. In this paper, I argue that Goldman has failed to show that there is such a weaker sense, and that, even if he had shown this, he has (...) not shown that this putative weaker sense is a strict one by his own criterion for strictness. According to a historical claim oft-repeated by contemporary epistemologists, the ‘traditional’ conception of knowledge prevailed in Western philosophy prior to the publication in 1963 of Edmund’s Gettier’s famous three-page article ‘Is Justified True Belief Knowledge?’. On this conception, knowledge consists of justified true belief. In this article, I critically consider evidence for and against this historical claim, and conclude with a puzzle concerning its widespread acceptance.

Rik Peels has once again forcefully argued that ignorance is not equivalent to the lack or absence of knowledge. In doing so, he endeavors to refute the Standard View of Ignorance according to which they are equivalent, and to advance what he calls the “New View” according to which ignorance is equivalent (merely) to the lack or absence of true belief. I defend the Standard View against his new attempted refutation.

Suppose that knowledge and ignorance are complements in the sense of being mutually exclusive: for person S and fact p, either S knows that p or is ignorant that p. Understood in this way, ignorance amounts to a lack or absence of knowledge: S is ignorant that p if and only if it is not the case that S knows that p. Let us call the thesis that knowledge and ignorance are opposites the “Complement Thesis”. In this article, I discuss (...) its deployment in an ingenious new argument advanced by Alvin Goldman and Erik Olsson (2009) which, if sound, establishes that there is a kind of knowledge that amounts to nothing more than true belief. I rebut their argument and in doing so delineate some important epistemological lessons brought to light by the contrast between ignorance and knowledge. (shrink)

Exploring intentionality from an externalist perspective, I distinguish three kinds of intentionality in the case of seeing, which I call transparent, translucent, and opaque respectively. I then extend the distinction from seeing to knowing, and then to believing. Having explicated the three-fold distinction, I then critically explore some important consequences that follow from granting that (i) there are transparent and translucent intentional states and (ii) these intentional states are mental states. These consequences include: first, that existential opacity is neither the (...) mark of intentionality nor of the mental; second, that Sellars has not shown that all intentionality is non-relational; third, that a key Quinean argument for semantic indeterminacy rests on a false premise; fourth, that perceptual experience is intentional on Alston’s Theory of Appearing; fifth, that either some mental causation is more than internal physiological causation or some mental states are epiphenomenal. In this paper, I offer a proof that a disastrous conclusion (namely, that any observation report confirms any hypothesis) may be derived directly from two principles of qualitative confirmation which Carl Hempel called the "Converse Consequence Condition" and the "Entailment Condition." I then discuss three strategies which a defender of the Converse Consequence Condition may deploy to save this principle.

Crispin Sartwell ingeniously defends the provocative thesis that mere true belief suffices for knowledge. In doing so, he challenges one of the most deeply entrenched epistemological tenets, namely that knowledge must be more than mere true belief. Particularly interesting is the way he defends his thesis by appealing to considerations adduced by such prominent epistemologists as William Alston, Laurence BonJour, Alvin Goldman and Paul Moser, each of whom denies that knowledge is merely true belief. In this paper, I argue that (...) the case Sartwell presents for his thesis fails. However, by examining why it fails, we may derive at least four important epistemological lessons: being justified does not entail being able to give a justification; we should distinguish between epistemic justification conceived of as intrinsically conducive to truth and conceived of as extrinsically conducive to truth; we should distinguish between epistemic justification conceived of as an essential criterion of knowledge and conceived of as an accidental criterion of knowledge ; and epistemologists need to specify how the telos of inquiry involves more than the acquisition of true beliefs.Socrates: Then tell me: what definition can we give with the least risk of contradicting ourselves? One of the most venerable and enduring intuitions in epistemology concerns the relationship between true belief and knowledge. Famously articulated by Socrates, it holds that true belief does not suffice for knowledge. I discuss a matching intuition about ignorance according to which true belief does not suffice for the absence of ignorance. I argue that the latter intuition undercuts the New View of Ignorance and supports the Standard View of Ignorance.

According to the Ignorance Factivity Thesis, for every proposition p, one is ignorant of p only if p is a truth. By contrast, according to the Ignorance Non-Factivity Thesis, it is false that, for every proposition p, one is ignorant of p only if p is a truth. I argue that, on balance, the case for the latter thesis is stronger than the case for the former.

An ingenious argument – we may call it the Argument from Excuse – purports to show that the Standard View of Ignorance is false and the New View of Ignorance is true. On the former, ignorance is lack of knowledge; on the latter, ignorance is lack of true belief. I defend the Standard View by arguing that the Argument from Excuse is unsound. I also argue that an implication of my case is that Factual Ignorance Thesis (FIT) is false. According (...) to FIT, whenever an agent A acts from factual ignorance, A is morally blameworthy (culpable) for the act only if A is morally blameworthy (culpable) for the ignorance from which A acts. This paper explores and articulates an alternative to the two main approaches that have come to predominate in contemporary philosophical discussionsof skepticism. These we may call the ‘Foil Approach’ and the ‘Bypass Approach’ respectively. On the Foil Approach, skepticism is treated as a problem to be solved, or challenge to be met, or threat to be parried; skepticism’s value, insofar as it is deemed to have one, accrues from its role as a foil contrastively illuminating what is required for knowledge (...) and justified belief. On the Bypass Approach, skepticism is bypassed as a central concern of epistemology. In this paper, I articulate an alternative to both these approaches, one that explores when skepticism is healthy and when it is not. I call it the ‘Health Approach’ to skepticism. (shrink)

I articulate and defend a conception of skepticism inspired by Aristotle’s doctrine of the mean. On it, skepticism is vicious when deficient and when excessive. Virtuous skepticism lies as a mean between these two extremes.

Deploying distinctions between ignorance of \ and ignorance that \ , and between knowledge of \ and knowledge that \ , I address a question that has hitherto received little attention, namely: what is it to have knowledge of propositions? I then provide a taxonomy of ontological conceptions of the nature of propositions, and explore several of their interesting epistemological implications.

After reviewing the literature on current knowledge about consciousness in humans, we present a state-of-the art discussion on consciousness and related key concepts in animals. Obviously much fewer publications are available on non-human species than on humans, most of them relating to laboratory or wild animal species, and only few to livestock species. Human consciousness is by definition subjective and private. Animal consciousness is usually assessed through behavioural performance. Behaviour involves a wide array of cognitive processes that have to be (...) assessed separately using specific experimental protocols. Accordingly, several processes indicative of the presence of consciousness are discussed: perception and cognition, awareness of the bodily-self, self-related knowledge of the environment (including social environment). When available, specific examples are given in livestock species. Next, we review the existing evidence regarding neuronal correlates of consciousness, and emphasize the difficulty of linking aspects of consciousness to specific neural structures across the phyla because high-level cognitive abilities may have evolved independently along evolution. Several mammalian brain structures (cortex and midbrain) are involved in the manifestations of consciousness, while the equivalent functional structures for birds and fishes would likely be the pallium/tectum and midbrain. Caution is required before excluding consciousness in species not having the same brain structures as the mammalian ones as different neural architectures may mediate comparable processes. Finally, specific neurophysiological mechanisms appear to be strongly linked to the emergence of consciousness, namely neural synchrony and neural feedback. Considering the limited amount of data available and the few animal species studied so far, we conclude that different manifestations of consciousness can be observed in animals but that further refinement is still needed to characterize their level and content in each species. Further research is required to clarify these issues, especially in livestock species. (shrink)

A hitherto unexamined problem for the ‘‘Kantian ideal’’ that one should always treat patients as ends in themselves, and never only as a means to other ends, is explored in this paper. The problem consists of a prima facie conflict between this Kantian ideal and the reality of medical practice. This conflict arises because, at least presently, medical practitioners can only acquire certain skills and abilities by practising on live, human patients, and given the inevitability and ubiquity of learning curves, (...) this learning requires some patients to be treated only as a means to this end. A number of ways of attempting to establish the compatibility of the Kantian Ideal with the reality of medical practice are considered. Each attempt is found to be unsuccessful. Accordingly, until a way is found to reconcile them, we conclude that the Kantian ideal is inconsistent with the reality of medical practice. (shrink)

It is widely held, to the point of being the received interpretation, that Frank Ramsey was the first to defend the so-called Redundancy Theory of Truth in his landmark article ‘Facts and Propositions’ (hereafter ‘FP’) of 1927.1 For instance, A.J. Ayer2 cited this article in the context of arguing that saying that p is true is simply a way of asserting p and that truth is not a real quality or relation. Other holders of the received interpretation, such as George (...) Pitcher,3 J.L. Mackie, 4 Susan Haack,5 A.C. Grayling,6 Nils-Eric Sahlin,7 Richard Kirkham,8 Donald Davidson9 and Michael Lynch10 credit Ramsey with having originated what they call ‘the Redundancy Theory.’ Even an authoritative source such as The Encyclopedia of Philosophy11 attributes this theory to him. What is more, Grover et al.,12 in defending their Prosentential Theory of Truth, claim that their theory is an improvement and development of the Redundancy Theory, which they too attribute to Ramsey.13.. This paper discusses two important emphases of epistemology – of virtue and vice epistemology in particular – one concerning agency and patiency, and the other concerning self-regard and other-regard. The paper offers, for the first time in the literature, a framework in which four types of epistemological work can be categorized according to their respective dual emphases: Type 1 (agent/self-regarding), Type 2 (agent/other-regarding), Type 3 (patient/self-regarding), and Type 4 (patient/other-regarding). ABSTRACTIn this paper, I offer an account of propositional learning: namely, learning that p. I argue for what I call the “Three Transitions Thesis” or “TTT” according to which four states and three transitions between them characterize such learning. I later supplement the TTT to account for learning why p. In making my case, I discuss mathematical propositions such as Fermat's Last Theorem and the ABC Conjecture, and then generalize to other mathematical propositions and to non-mathematical propositions. The notion of ‘gentle barbarism’ was developed during our critical analysis of the discourses and mechanisms of ‘modernisation’ that emerged in the context of the movement for permanent reform (in education, the public services and business management), in which public bodies and businesses have been engaged since the 1980s. These discourses and mechanisms of modernisation seem to us to represent a blind spot where sociological analysis is concerned.

Deploying distinctions between ignorance of a proposition and ignorance that it is true, and between knowledge of a proposition and knowledge that it is true, I distinguish between propositional privacy and factive privacy. While the latter is limited to personal facts, the former encompasses personal falsehoods as well. I argue that propositional privacy is both broader and deeper than factive privacy, and accordingly that conceiving of the nature of privacy in terms of propositional privacy has important advantages over conceiving of (...) it solely in terms of factive privacy. I draw similar lessons with regard to secrecy. (shrink)

Antognazza (“The Benefit to Philosophy”, “The Distinction in Kind”), Dutant (“The Legend”), and I (“Knowledge Before Gettier”) have argued for the historical falsity of the claim that, prior to Gettier’s famous counterexamples of sixty years ago, the so-called ‘traditional’ conception of knowledge was the justified true belief (JTB) conception. This note addresses a related historical question that, rather surprisingly, has not yet been addressed in the philosophical literature; to wit: when did this claim first appear in this literature?
