This book provides a clear, concise description of medical law; but it does more than that. It also provides an introduction to the ethical principles that can be used to challenge or support the law. It also provides a range of perspectives from which to analyse the law: feminist, religious and sociological perspectives are all used.

In 1912, Julian Huxley published his first book The Individual in the Animal Kingdom which he dedicated to the then world-famous French philosopher Henri Bergson. Historians have generally adopted one of two attitudes towards Huxley’s early encounter with Bergson. They either dismiss it entirely as unimportant or minimise it, deeming it a youthful indiscretion preceding Huxley’s full conversion to Fisherian Darwinism. Close biographical study and new archive materials demonstrate, however, that neither position is tenable. The Bergsonian elements in play in (...) Julian Huxley’s early works fed into his first ideas about progress in evolution and even his celebrated theories of bird courtship. Furthermore, the view that Huxley rejected Bergson in his later years needs to be revised. Although Huxley ended up claiming that Bergson’s theory of evolution had no explanatory power, he never repudiated the descriptive power of Bergson’s controversial notion of the élan vital. Even into the Modern Synthesis period, Huxley represented his own synthesis as drawing decisively on Bergson’s philosophy. (shrink)

This is the first book to unpack the legal and ethical issues surrounding unauthorised intimate examinations during labour. The book uses feminist, socio-legal and philosophical tools to explore the issues of power, vulnerability and autonomy. The collection challenges the perception that the law adequately addresses different manifestations of unauthorised medical touch through the lens of women's experiences of unauthorised vaginal examinations during labour. The book raises questions about women's experiences during childbirth in hospital settings. It explores the status of women's bodies during labour and childbirth where too easily they become objectified, and it raises important issues around consent. The book highlights links to the law on sexual offences and women's loss of power under the medical gaze. The book includes contributions from leading feminist philosophers, medical professionals, and academics in medicine and law, and offers pioneering analysis relevant to lawyers and healthcare professionals with an interest in medical law and ethics; feminist theory; criminal law; tort law; and human rights law. Recently, a physician requested permission to include in the information packet about himself that he would not accept patients who smoke and would not continue the care of current patients who smoke. His poignant statement follows.

Common property has been theoretically linked to environmental degradation through the metaphor of “the tragedy of the commons,” which discounts local solutions to commons dilemmas and typically posits the need for strong states or privatization. Though neither solution is theoretically or empirically adequate—because of the nature of states and nature in the real world—local arrangements for averting the tragedy suffer certain lacunaeas well, including stringent boundary conditions and overlapping/overarching commons situations that necessitate larger scale cooperation than is possible in the (...) face-to-face communities that are conducive to cooperation. Second-order or meta-commons issues expand the scope of inquiry necessarily beyond conservationto preservation.The Sundarbans illustrates the contradictory implications of the Leviathan solution to comons dilemmas, as well as the centrality of alternative perceptual framings of natural systems. “Eve Sedgwick’s ‘Other Materials’” refers to a graduate seminar that Sedgwick offered at the CUNY Graduate Center entitled “How to Do Things with Words and Other Materials.” As its title suggests, her seminar advanced Sedgwick’s enduring “FASCINATION” with “MAKING UNSPEAKING OBJECTS” of all sorts, which elsewhere included the body’s organic and inorganic waste. Taking a cue from her teaching, I suggest that, while critics have extensively detailed Sedgwick’s contributions to literary interpretation, sexuality, gender, affect, and performativity, we should also appreciate (...) her writings as theorizing queer material relations. This observation is pertinent given her rethinking of psychodynamic object relations theory alongside her creative writings on “THE WASTE PRODUCTS,” or the matter we ceaselessly produce. My argument thus anchors its claims in a close non-Kleinian reading of her poem “Bathroom Song,” which also offers an unforeseen take on paranoid and reparative idioms of psycho-material being. How waste matter facilitates this unanticipated insight is one of my essay’s – and Sedgwick’s – subsidiary concerns. (shrink)

This article explores the current parenting culture, particularly the promotion of competitive and excessive parenting, as an important background issue against which the debates around pre-natal testing take place. It offers an alternative vision of parenting, relying on care ethics, which sees parenting as a relationship, rather than a job. A relationship that should change a parent’s understanding of what is valuable in life. Parenting should not be about moulding the ‘perfect child’ but being open to being profoundly changed. The (...) parent–child with a disability relationship offers particular opportunities to find new meanings and values in life. This analysis is offered as another dimension to the debates over pre-natal testing. It is not intended as an argument against such testing, but rather raises concerns about some of the broader attitudes around it. (shrink)

The tension between the popular embrace of same-sex marriage and the queer critique of homonormativity prompts the contributors to Long Term to explore queer commitments as they are more broadly conceived. The essays contained here de-familiarize the idea of commitment and extend the category of significant others to include animals, possessions, institutions and disciplines. Revitalizing the concerns of queer theory beyond the commitment to anti-normativity, these essays contribute to interdisciplinary scholarship in queer temporality studies, disability studies, autotheory, and the emergent (...) sub-field of age studies.
