When the policies and activities of one country or generation harm both other nations and later generations, they constitute serious injustices. Recognizing the broad threat posed by anthropogenic climate change, advocates for an international climate policy development process have expressly aimed to mitigate this pressing contemporary environmental threat in a manner that promotes justice. Yet, while making justice a primary objective of global climate policy has been the movement's noblest aspiration, it remains an onerous challenge for policymakers. -/- Atmospheric Justice (...) is the first single-authored work of political theory that addresses this pressing challenge via the conceptual frameworks of justice, equality, and responsibility. Throughout this incisive study, Steve Vanderheiden points toward ways to achieve environmental justice by exploring how climate change raises issues of both international and intergenerational justice. In addition, he considers how the design of a global climate regime might take these aims into account. Engaging with the principles of renowned political philosopher John Rawls, he expands on them by factoring in the needs of future generations. Vanderheiden also demonstrates how political theory can contribute to reaching a better understanding of the proper human response to climate change. By showing how climate policy offers insights into resolving contemporary controversies within political theory, he illustrates the ways in which applying normative theory to policy allows us to better understand both. -/- Thoroughly researched and persuasively argued, Atmospheric Justice makes an important step toward providing us with a set of carefully elaborated first principles for achieving environmental justice. Contemporary persons are daily confronted with enormous quantities of information, some of which reveal causal connections between their actions and harm that is visited upon distant others. Given their limited cognitive and information processing capacities, persons cannot reasonably be expected to respond to every cry for help or call to action, but neither can they defensibly refuse to hear and reflect upon any of them. Persons have a limited obligation to know, I argue, which requires that they inform themselves and (...) others about their role in harmful social practices, with a view toward challenging the norms that sustain such practices. In this paper, I explore this obligation to know, and the related idea of excusable ignorance, offering accounts of the epistemic burden that it entails for persons in their capacities as citizens and in the context of global climate change and of reproach as a potentially effective tool for rectifying rather than excusing ignorance. In distributing the costs associated with climate change, most scholars have focused exclusively upon mitigation burdens. Few consider the distribution of adaptation costs, which concern projects that seek to minimize harm from human-induced climate change.
The practice of conservation assumes that current persons have some obligations to future generations, but these obligations are complicated by a number of philosophical problems, chief among which is what Derek Parfit calls the Non-Identity Problem. Because our actions now will affect the identities of persons to be born in the distant future, we cannot say that those actions either benefit or harm those persons. Thus, a causal link between our acts and their consequences for particular persons is severed, and (...) the justification for conservation duties toward future generations undermined. I argue for an alternative justification for conservation in the capacity of foresight, which requires us to act not only upon duties that we have now, but also upon those that we will predictably have in the future. In this way, the future generations problem, at least as applied to conservation issues, is overcome. (shrink)
The phenomenon of anthropogenic climate change—in which weather patterns and attendant ecological disruption result from increasing concentrations of greenhouse gases released into the atmosphere through human activities—challenges several conventional assumptions regarding moral responsibility. Multifarious individual acts and choices contribute (often imperceptibly) to the causal chain that is expected to produce profound and lasting harm unless significant mitigation efforts begin soon. Attributing responsibility for such harmful consequences is complicated by what Derek Parfit terms “mistakes in moral mathematics,” or failures to correctly (...) assess the various individual contributions to collectively produced harm. Combined with the difficulties in attributingresponsibility to agents for spatially and temporally distant harmful effects and that of holding agents culpable for effects (resulting from socially-acceptable acts) about which they may be ignorant, this paper attempts to sort out several ethical problems surrounding the identification of responsible parties contributing to climate change. Does the receipt of benefits from some common resource create an obligation to contribute toward its maintenance? If so, what is the basis of this obligation? I consider whether individual contributions to climate change can be impugned as wrongful free riding upon the stability of the planet's climate system, when persons enjoy its benefits but refuse to bear their share of its maintenance costs. Two main arguments will be advanced: the first urges further modification of H.L.A. Hart’s “principle of fairness” (...) as the basis for demanding that would-be free riders pay their fair share in the context of climate change, while the second claims that remedial action on climate change is better captured through collective action analysis than through harm principles that seek to connect individual actions to bad environmental outcomes. Radical environmental groups engaged in ecotage—or economic sabotage of inanimate objects thought to be complicit in environmental destruction—have been identified as the leading domestic terrorist threat in the post-9/11 “war on terror.” This article examines the case for extending the conventional definition of terrorism to include attacks not only against noncombatants, but also against inanimate objects, and surveys proposed moral limits suggested by proponents of ecotage. Rejecting the mistaken association between genuine acts of terrorism and ecotage, it considers the proper (...) moral constraints upon ecotage through an examination of just war theory and nonviolent civil disobedience. At the United Nations climate change conference in 2011, parties decided to launch the “Durban Platform” to work towards a new long-term climate agreement. The decision was notable for the absence of any reference to “equity”, a prominent principle in all previous major climate agreements. Wealthy countries resisted the inclusion of equity on the grounds that the term had become too closely yoked to developing countries’ favored conception of equity. This conception, according to wealthy countries, exempts developing countries from making (...) commitments that are stringent enough for the collective effort needed to avoid dangerous climate change. In circumstances where even mentioning the term equity has become problematic, a critical question is whether scope for a fair agreement is being squeezed out of negotiations. To address this question we set out a conceptual framework for normative theorizing about fairness in international negotiations, accompanied by a set of minimal standards of fairness and plausible feasibility constraints for sharing the global climate change mitigation effort. We argue that a fair and feasible agreement may be reached by (i) reforming the current binary approach to differentiating developed and developing country groups, in tandem with (ii) introducing a more principled approach to differentiating the mitigation commitments of individual countries. These two priorities may provide the basis for a principled bargain between developed and developing countries that safeguards the opportunity to avoid dangerous climate change without sacrificing widely acceptable conceptions of equity. Scholars concerned with abuses of the “resource privilege” by the governments of developing states sometimes call for national sovereignty over the natural resources that lie within its borders. While such claims may resist a key driver of the “resource curse” when applied to mineral resources in the ground, and are often recognized as among a people’s territorial rights, their implications differ in the context of climate change, where they are invoked on behalf of a right to extract and combust fossil (...) fuels that is set in opposition to global climate change mitigation imperatives. Moreover, granting full national sovereignty over territorial carbon sinks may conflict with commitments to equity in the sharing of national mitigation burdens, since much of the planet’s carbon sink capacity lies within territorial borders to which peoples have widely disparate access. In this paper, I shall explore this tension between a global justice principle that is often applied to mineral resources and its tension with contrary principles that are often applied to carbon sink access, developing an analysis that seeks to reconcile what would otherwise appear to be fundamentally incompatible aims. Ecotourism has been lauded as a potentially effective means for raising revenue for nature conservation, and certification schemes likewise promise to help to “sustain the well-being of local people” in ecotourist destinations. In this paper, we consider the social and environmental justice dimensions of ecotourism through the certification schemes that define the industry, treating the desire to engage in ethically responsible travel as a necessary but insufficient condition for bringing about these desired ends, and one that requires accurate and trustworthy (...) information in order to effectively realize ecotourism’s potential to engage normative concerns through leisure activities. William Cronon has recently argued that the current debate concerning justifications for protecting wilderness relies upon conceptions of natural value premised upon a nature/society dualism that originated in older nature writing but which still animates contemporary thinking. This dualism, he argues, prevents adequate realization of the human and social places in nature, and is ultimately counterproductiveto the task of articulating the proper relationship between humans and the natural world. While the origin of one of these conceptions of natural value (the (...) frontier) can be traced back to Rousseau, I argue that Rousseau’s writings reveal a far more complex and nuanced treatment of the value of nature in and for society (and the persons that compose it) than has thus far been acknowledged. Moreover, by unpacking several arguments made by Rousseau on behalf of the stewardship and accessibility of natural areas, one can not only gain a more accurate view of Rousseau’s environmental thought than is ordinarily recognized by authors who focus on his primitivism and anti-modern critique, but also some insights that may help bridge the nature/society dualism plaguing contemporary environmental ethics and noted by Cronon. Proponents and critics alike have invoked ideas of fairness in justification of their positions. The two distinct conceptions of fairness that are involved in this debate—one of fair shares, and another of fair burdens—helpfully illuminate the proper role of fairness in designing an equitable and effective global climate regime. In this paper, I critically examine the idea (...) of fairness as manifest in two contending visions of the proper international response to mounting evidence that human activity is causing climate change, and that harm from this change is likely to exacerbate existing inequalities. The field of environmental economics, while offering powerful tools for the diagnosis of environmental problems and the design of policy solutions to them, is unable to effectively incorporate normative concepts like justice or rights into its method of analysis, and so needs to be supplemented by a consideration of such concepts. I examine the two main schools of thought in environmental economics ? the New Resource Economics and Free Market Environmentalism ? in order to illustrate the shortcomings of their methods (...) of analysis, taken on their own, and to demonstrate how a consideration of concepts like rights or justice might usefully supplement them. The politics of food illustrates an enduring tension within environmental ethics and green political theory: the oft-assumed division between those thinkers for whom humanitarian goals remain prominent but who situate them within a normative framework stressing environmental sustainability and those thinkers who reject any distinctively humanitarian interests as untenably anthropocentric. In posing the problem as a moral dilemma between feeding people and saving nature, light and dark green value theories are made to appear in stark contrast, with the former prescribing (...) the delivery of food aid to relieve hunger-related suffering, and the latter rejecting that call. This supposed dilemma between feeding people and saving nature is a false one. The real problem is a moral elitism on the part of developed countries where an insidious form of selfishness overemphasizes the role of population and obscures the roles of highly variable rates of consumption upon current environmental ills. An examination of theexemplary case of food politics shows that the exaggerated differences in policy implications of these two value theories can be diminished and that there is potential for common cause.
