RésuméʾAbū Saʿīd al-Siǧzī, astronome et mathématicien du ive/xe siècle, fut l'un des premiers auteurs du genre ʿilm al-hayʾa ; mais on connaît peu la genèse de cette discipline et sa relation aux autres écrits et pratiques en astronomie. Dans cet article, je présente de nouvelles découvertes permettant de préciser la biographie d'al-Siǧzī. Je décris ensuite, pour la première fois, une composition d'astronomie théorique du ive/xe siècle, la « Structure des orbes » d'al-Siǧzī, et je montre sa place dans la formation (...) de la discipline ʿilm al-hayʾa en comparant ce livre à l'ouvrage antérieur d'al-Farġānī sur la taille de la Terre et le nombre des sphères célestes. Je conclus que la Tarkīb al-aflāk d'al-Siǧzī est le plus ancien exemple connu d'un livre traitant des sujets abordés plus tard en hayʾa, et qu'il contient peutêtre la première occurrence du neuvième orbe céleste, classique dans les écrits du genre. Hasta el momento, la obra más conocida e importante del prolífico autor andalusí Ibn Saʿīd al-Maġribī (m. 685/1286) era su antología al-Muġrib fī ḥulà l-Maġrib (Lo extraordinario acerca de las joyas del Occidente). Sin embargo, igual en importancia debió de ser su homóloga oriental, al-Mušriq fī ḥulà l-Mašriq (Lo extraordinario acerca de las joyas del Oriente), obra de la que, por el contrario, se conoce muy poco. El propósito de este artículo es dar a conocer esta obra de Ibn Saʿīd, (...) dedicada a Oriente, así como el estudio preliminar de dos manuscritos inéditos del Mušriq, preservados en El Cairo. En él se tratan aspectos relativos a la composición de la obra, su autoría, su estructura y fuentes, y se ofrece una breve descripción de las principales características de ambos manuscritos junto con la información más relevante que contienen. This paper examines the debate on gender equality which is considered by some groups to be in conflict with Q.S. An-Nisa [4]: ​​11. With a philosophical approach and referring to the concept of inheritance of Sa'id Ramadan al-Buthi in the _Kitab_ _al-Mar'ah Bayna Thughyan al-Nizam al-Gharbi wa Lata'if al-Tashri' al-Rabbani_, this paper tries to refute these allegations and offers a more gender-friendly interpretation. For al-Buthi, the verse has actually liberated women because the provisions are caused by the responsibilities imposed by (...) Islam on men as prospective husbands and not experienced by women. On the contrary, if women are empowered than men, that is a moral responsibility, not a _sharia_ responsibility. Thus, women have been given freedom by the _sharia_ in order to determine the choice to participate in bringing about stability in life, regardless of the existence of a condition of women more empowered than men that will not be the cause of changes in the provisions of _sharia_ concerning inheritance. Este artículo tiene como objetivo presentar un manuscrito conservado en la biblioteca de la Universidad de Bengasi (Libia) que contiene el Kitāb al-Ǧawhara fī nasab al-nabī ṣallā Allāh ʽalayhi wa-sallam wa-aṣḥābihi al-ʽašara por Abū ʽAbd Allāh Muḥammad b. Abī Bakr b. ʽAbd Allāh b. Mūsà al-Anṣārī al-Barrī al-Tilimsānī (596/1200-681/1282). Aunque ha sido mencionado en algunas publicaciones, no llamó la atención de los especialistas de la historia cultural de al-Andalus. Debido a la situación actual de la institución de conservación, no ha (...) sido posible ver ni ofrecer reproducciones. Aun así, como se cedió una fotografía para un catálogo, el último folio resultó muy útil. Se hace constar claramente el origen de la obra, que fue copiada en Menorca por su propio autor en el año 645/1248. Además, se puede observar que fue ofrecido como regalo a Saʽīd b. Ḥakam al-Qurašī, el gobernador de la isla, que fundó una biblioteca cuya riqueza fue celebrada por los autores medievales. En el estado actual del conocimiento, se trata precisamente del quinto manuscrito identificado, encontrándose hoy los otros cuatro en la Real Biblioteca del Monasterio de San Lorenzo de El Escorial. La historia del manuscrito permanece oscura, aunque se puede dar por establecido que reapareció en Libia a mediados del siglo XIX, siendo entonces propiedad de Muḥammad b. ʽAlī al-Sanūsī, fundador de la poderosa ṭarīqa al-Sanūsiyya. The biographical chapter presents Wright as an attractive character among devoted friends and also as a solitary, original scientist. Wright's primary achievement was to apply utilitarian principles to Darwinian natural selection theory. Since Darwin himself made no such attempt, nor did John Stuart Mill, and since Darwin showed an evident interest in Wright's attempt, this represents (...) a major contribution to evolutionary theory. On the negative side, too, Wright was incisive in his criticisms of Spencer, Mivart, Hamilton, Mansel, and Lewes. The pragmatic strains in Wright's philosophical method were incidental to his primary interest in showing that sciences are metaphysically "neutral." But his influence on Peirce and James was direct and strong, both on their cosmological and methodological doctrines. He deserves to be mentioned as the prime mover in this trinity of early pragmatism and naturalism, but since his own writings were relatively few and scattered, his historical importance rests largely on the use which Peirce and James made of his ideas and the development which they gave to his philosophy. The passionate and staunch defence of logic of the controversial thinker Ibn Ḥazm, Abū Muḥammad ʿAlī b. Aḥmad b. Saʿīd of Córdoba (384-456/994-1064), had lasting consequences in the Islamic world. Indeed, his book Facilitating the Understanding of the Rules of Logic and Introduction Thereto, with Common Expressions and Juristic Examples (Kitāb al-Taqrīb li-ḥadd al-manṭiq wa-l-mudkhal ilayhi bi-l-alfāẓ al-ʿāmmiyya wa-l-amthila al-fiqhiyya), composed in 1025-1029, was well known and discussed during and after his time; and it paved the way for the studies (...) of his compatriots Ibn Bājjah (d. 1138), Ibn Ṭufayl (1185), and Ibn Rushd (1198), who each gave demonstrative reasoning a privileged place within the methods of attaining knowledge. Unfortunately, as too often in the history of science, Ibn Ḥazm’s innovative perspectives and contributions in logic have been overlooked or considered with an attitude of contempt. On the one hand, his work has been seen, at best, as promulgating the benefits of studying Aristotle’s logic, so that his contribution is assessed as more didactical than conceptual. And on the other hand, those who do examine his innovations often consider them to be mistaken. As indicated by Chejne (1984, p. 2) contempt towards the logical work of Ibn Ḥazm was also present in its reception by the Eastern philosophers who accused him of deviating from Aristotelian logic and of dabbling in things beyond his capability. However, a reassessment of his work on logic has since begun, by delving into the ways the thinker of Córdoba studied the links between deontic and modal qualification of propositions. In this context Lameer’s (2013) paper on the logical sources of Ibn Ḥazm is worth mentioning; the author (p. 417, footnote 1) observes that, although, strictly speaking, it was al-Fārābī who first drew the parallelism between deontic and modal concepts, it was Ibn Ḥazm who developed it and worked it out in a more precise manner. A primary aim of this paper is to help fill some of these gaps by stressing the role of the work of Ibn Ḥazm in developing a notion of deontic necessity deeply rooted in legal normativity, and in explicitly discussing the transference between deontic and modal concepts. According to our view; the basic units of Islamic deontic logic are what we might call, indulging in terminological anachronism, heteronomous imperatives. As it turns out, the heteronomy of imperatives within Islamic legal systems contrasts with those of the purely moral realm, which seem to be closer to an autonomous conception of moral law. There it concurs again with Leibniz’s proposal to define obligatory as “what is necessary for a good person to do”. In the present paper, we will focus on the heteronomous imperatives of legal systems rather than on the imperatives of the purely moral realm. In this context, the work of Ibn Ḥazm extends the parallelism between the necessity of events and that of human actions stressed by his predecessors. According to our understanding, Ibn Ḥazm’s parallelism can be rendered explicit formally by means of a conditional (or hypothetical) structure shared by both deontic and modal propositions. Moreover, this structure makes apparent that this parallelism displays an underlying system of “degrees”. Indeed, while in the domain of events, given some conditions, it makes sense to distinguish between an event that is more likely to happen than another. Ibn Ḥazm speaks of near and distant possibility (such as the higher degree of likelihood of rain, given the condensation of clouds in December, and its lower degree, when the condensation occurs in summer); and, in the domain of actions, the Islamic notion of weighting actions determines degrees of virtue (or of legal and moral value). So whereas the degree of virtue of performing a forbidden act as determined by the distribution of sanction and reward is 0, we obtain the same value by pondering the likelihood of an impossible event to take place. Furthermore, as discussed in section II.3.2, the system of values at work in the parallelism can be seen as opening the way to a more direct correspondence. Thus, while in the realm of nature, likelihood of occurrence of an event is dependent upon the conditions specific to the occurrence of that event; while, in the realm of jurisprudence, likelihood of performing an action is dependent upon the distribution of reward and sanction specific to that action (being that, given the choice to perform or not perform a given action, those that will be rewarded are more likely to be performed than those that are not). According to this perspective, the point of the parallelism is that both deontic and modal qualifications measure the degree of an action or event to become actual; that is – indulging once more in anachronism (but this time from the Leibnizian background) – the degree measures how feasible (facile) an action or event may be. This suggests that Ibn Ḥazm’s perspectives already herald the links to probability and possibility explored by Leibniz six centuries later – see for example Leibniz’s (1671, A VI, I, p. 424-26) use of probability in the context of conditional right. Nevertheless, it also shows a crucial difference to the approach developed in the Elementa Jura Naturalis: whereas Leibniz’s studies seek to define what is to be just or virtuous, the logical system of deontic imperatives within Islamic jurisprudence presupposes that what is to be virtuous has already been settled. Determining what is to be virtuous is not achieved by logical reasoning within the system of legal jurisprudence, but by delving into the higher objectives of the Sharīʿa. While developing our point, we will delve into the logical structure of the heteronomous imperatives. This distinguishes our contribution from the existing literature, such as the papers of Chejne (1984), Lameer (2014), and Guerrero (1997, 2010, 2014), which do not provide a logical analysis of the deontic concepts put into work by Ibn Ḥazm. The true antecedent to the present paper is the work of Farid Zidani (2007, 2015), who, so far as we know, was the first to undertake such a task. Some of our own developments and general epistemological thoughts go beyond Ibn Ḥazm’s framework and motivations; mainly those contained in sections II.3.2 and IV. However, according to our view, these reflections suggest that Ibn Ḥazm’s approach has the substance for a broader and deeper exploration of the logic of norms. The paper is structured as follows:I.Ibn Ḥazm’s Logic of Heteronomous Imperatives. After presenting some extracts of the relevant text, we proceed by providing a formal reconstruction of the five forms of deontic modalities. II. A Landmark in the History of the Logical Analysis of Norms. Duties and Modalities. In this section, we study the transferences from deontic to modal necessity and possibility. We briefly compare the deontic system of Islamic Jurisprudence with that of Leibniz.III. Leibniz and Hypothetical Imperatives in Law.IV. Beyond Ibn Ḥazm: Conclusions and the Work Ahead. We will conclude the paper by discussing briefly some conceptual points that distinguish the logic of heteronomous imperatives from contemporary deontic logic. The issue of wiping over socks is part of the more general issue of wiping over leather socks (khuffayn) for ablution (wuḍū’). Washing feet or wiping over them is a debate whose sides bases their claims on the verses of the Qur’an and supports these claims with narrations. When performing ablution, if shoes or socks are on the feet, whether one can wipe over them without taking these off and the qualities that these clothes should have is a debate based (...) on hadith narrations. Most Muslims except for the Ja’farite are of the opinion that either washing the feet or wiping over a khuff or similar clothing that was put on while a person already had ablution can be done during ablution, while the Ja’farite think that wiping over bare feet is enough but wiping over khuff is not. There is a consensus that shoes, boots, buskins and other leather footwear qualify as khuff. However, there is disagreement over whether clothing from materials like cotton, linen, wool, and felt -usually referred to as socks- qualify as khuff. For this reason, some Muslims of the world wipe over socks while others do not. There are contemporary fatwas (legal opinion) that are supportive of either of the positions. However, there are those who treat this issue beyond choosing a side in an ijtihad (process of juristic legal reasoning) and some who wipe on socks are censured strongly. In this research based on an examination of the fiqh heritage, the goal is to contribute to making this issue better understood and its fiqh ruling clearer.Summary: The sixth verse of Surah Ma’idah in the Qur’an clearly states that wuḍū’ requires washing the face, arms up until elbows, and wiping over the head. However, when it comes to the fourth element of wuḍū’, the feet, there has been disagreement about whether it should be wiped or washed. Arabic grammar rules and narrations have been interpreted in ways that support both views; in general Sunni sects, Zaydis, and Kharijites argue the feet should be washed while Shia Ja’farites are in favor of wiping over bare feet. There have also been efforts among faqihs (jurists) to reconcile washing and wiping; washing slightly; choosing the better one between the two; washing when not covered, wiping when covered; washing if there is dirt, wiping if it is clean; viewing at least wiping as fard (obligatory), washing as a Sunna (recommended) that includes the fard as a way to unify the two approaches have also been proposed.According to widely accepted narrations, the prophet and his companions washed their feet when performing wuḍū’ and once they put on their shoes having had wuḍū’, the next time they only wiped over the shoes without taking them off. In less commonly accepted narrations, which some hadith authorities regard as authentic, the Prophet is said to have wiped over his socks. In narration sources, it has been narrated that about fifteen faqih companions, among them ʿUmar b. al-Khaṭṭāb, ʿAlī b. Abī Ṭālib, ʿAbdallāh Ibn Masʿūd, ʿAbdallāh b. ʿAbbās, ʿAbdallāh b. ʿUmar, saw wiping over socks as appropriate. However, there are no narrations about the companions disapproving of wiping over socks. Among those who approved of wiping over socks are tābiʿūn (successors) faqihs like Saʿīd b. D̲j̲ubayr, Saʿīd b. al-Musayyab, Ibrāhīm al-Nakhaʿī, ʿAṭāʾ b. Abī Rabāḥ, al-Ḥasan al-Baṣrī ve al-Aʿmash, and Mujtahid Imams like Zufar, Sufyan al-Thawri, al-Ḥasan b. Ṣāliḥ, Ibn al-Mubārak, Abū Yūsuf, Muḥammad al-Shaybānī, Aḥmad b. Ḥanbal, Isḥāq b. Rāhawayh. Considering their most prominent positions, we can say that Ḥanafis and Shafis allow wiping over socks that are thick and opaque, Hanbalis allow it over socks that cover the foot even if thin, while Mālikīs do not allow wiping over socks at all.As far as it is understood from narrations from the Prophet’s time, due to both climate conditions and weaving possibilities, socks were used only rarely. Also, footwear like shoes or slippers made of leather were very hard to find and narrations suggest that prayers were performed at houses and the masjids over soil base on either bare foot or with shoes. For these reasons, the issue of wiping over socks did not arise at the time and at later periods different opinions on the issue led to disagreements. When carpets were placed on the ground at later periods, performing the prayer with shoes was abandoned and a second layer of shoes (khuff) was placed inside the shoes as khuff. Since removing the shoes would invalidate wuḍū’ performed over that shoe, those who wanted to avoid the difficulty of having to wash their feet each time they needed wuḍū’ have instead wiped over this second layer once they put them on after performing wuḍū’.Ḥanafīs and Shāfiʿīs, who tend to approach the issue of wiping over socks with hesitation and make this conditional on some strict rules, emphasize that the socks to be wiped over should be similar to shoes in terms of thickness, based on the idea that it is certain that the Prophet has wiped over shoes made of leather but his wiping over socks is weaker and that the qualities of those socks are not clear. Among the thickness criteria expressed for the socks are being waterproof, the ability to walk for at least a league with it, and its ability to hold on to feet without being tied at the wrists. Due to these criteria, which have been developed to protect the wuḍū’ and whose boundaries are not well specified, especially among Ḥanafis the idea that wiping over socks is not allowed has gained popularity. As opposed to this, in circles dominated by Ḥanbalīs opinions allowing wiping over any type of socks have been expressed.At times when the Prophet had his shoes on and did not want to take off his shoes, he used to wipe over the shoes. The equivalent of this act today is to wipe over socks since prayer with shoes on is not common any more. While nowadays wiping over socks is an ease for everybody when performing wuḍū’, it is something that is especially needed under certain circumstances. Cold weather and the lack of drying possibilities for the feet leading catching cold and illness, socks that are put on when feet are wet leading to bad smell and fungus on feet, the hardship of elevating the feet high enough to the sink and of changing socks on one foot when there are no special wuḍū’ places, the fact that at societies distant from Islamic culture it is seen against the etiquette to wash feet in the sink are among the reasons why this need arises. Because most of the time we are not in a position to determine the circumstances of our work and travels at modern times, it can be said that today this need is more than it was in the past.Some scholars of today use a precautionary principle and argue that the Qur’an commands to wash the feet, and the only narration powerful enough to make an exception to this rule is about masts made of leather, and extending this to include socks would go against the precaution principle and some other principles of uṣūl al-fiqh (Islamic legal theory). However, some other scholars who use the ease in religion principle argue that the permission to wipe over masts also include wiping over socks and that they are of the same nature, that there are authentic narrations that show wiping over socks are allowed and that one can even talk of an ijmāʿ (consensus) among the companions on this issue, and that seeking additional qualities socks on which one is to wipe over, such as thickness, ability to walk with it, its ability to hold on to the feet, being waterproof, have no merit in the sharīʿa. Jamaleddīn Qāsimī, who wrote a special research book on the topic, and scholars like Abū l-Aʿlā Mawdūdī, Yūsuf al-Qaradāwī, ʿAbd al-ʿAzīz b. Bāz, Ibn al Uthaymeen think that one can wipe over daily socks that do not show the skin beneath it, while scholars predominantly of the Ḥanafi opinion hold that one cannot wipe over the thin daily socks. There are some radical practices of asceticism, such as wearing ṣūf (wool clothes), traveling without provisions, choosing to be single, and avoiding earning a living by working, which were generally seen in the 2nd century A.H. and were subject to criticism with the formation of classical Ṣūfism. Criticisms of these practices have started to appear in the literature since the 3rd century A.H. Early Ṣūfī writers such as Al-Ḥakīm al-Tirmidhī, Muḥāsibī, Abū Saʿīd al-Kharrāz, al-Sarrāj focused on this issue and criticized (...) these practices. How are these practices of ascetics viewed in the sects that were formed and spread in the 6th and 7th centuries? Our research seeks the answer to this question, but limits it to the example of Abū l-Ḥasan al-Shādhilī, the founder of Shādhiliyya. This question is important in two respects: First of all, it is investigated whether the determination of some researchers that al-Shādhilī taught comfort in the face of worldly blessings is also correct. Because, among contemporary researchers, there are those who believe that al-Shādhilī wears ostentatious clothes, rides horses, encourages economic competitiveness, and is therefore open to benefiting from worldly blessings to the fullest. Secondly, it includes an investigation of the validity of the belief that these practices belong to an early period in the history of Sûfism and have been completely abandoned over time. Although al-Shādhilī seems to have completed his spiritual education in Morocco with his sheikh, he later went to Tunisia with the latent command of his master. We see that in his first years in Tunisia, he went into seclusion in a cave and was completely isolated from the society and engaged in worship in a way that reminds us of the practices of the early ascetics. But in the second phase of his life in Tunisia, he went to the city on a spiritual sign, socialized, started to give sermons to people, and started to behave more flexible about eating and drinking. al-Shādhilī specifically states that he did not prefer socialization at this stage, but with a spiritual sign. Later, he went to Egypt again with a spiritual sign and got married there, started to deal with agriculture, and continued to socialize by establishing relations with the rulers. Therefore, it can be said that this new social period is a break both from the radical practices of the early ascetics and from the early period in Tunisia itself. It is also seen that in this new period of al-Shādhilī, he did not wear the clothes of ascetics like sūf (wool clothes) and did not want his followers to wear them. He also encouraged to have a profession and was generally against traveling without provisions. But there are two points to be noted here: First, these milder and more comfortable practices should not lead to a search for comfort and luxury. He continued to keep his distance from worldly blessings and to advise asceticism. Secondly, he had some of his distinguished disciples make some practices of the ascetics. The reason for the existence of these seemingly contradictory practices is that while he recommends moderate and sustainable practices to the general public and his followers, he can make the specialized sūfis more strict and difficult practices. While he was encouraging work and earning in general, not ignoring experience, including avoiding work; not ignoring seclusion while leading to sociality in general; while generally suggesting to resort to occasions, he also follows a path of implementing and enforcing radical practices such as traveling without food. Thus, al-Shādhilī is able to encompass all the seemingly incompatible practices of the previous sūfi accumulation with a point of view of spiritual rank and hierarchy. (shrink)

One of the ṣaḥābīs of Prophet Muḥammad is ʿUrwa b. Masʿūd from the Ṭāʾif tribe of Thaqīf. He belongs to the Ahlâf part of the Thaqīf tribe and he is the ruler of this part. ʿUrwa’s ancestry is known without any controversy until Kasî (Thaqīf). According to a narrative his epithet was Abū Yaʿfur and another of his epithet was Abū Masʿūd. Father of ʿUrwa an important person too. He is one of the leaders of his tribe and he commanded (...) his part (Aḥlāf) in wars of Fijār. Mother of ʿUrwa is Subay’a bt. ʿAbd Shams from Banū Umayya. In this way ʿUrwa has kinship both with Banū Umayya and Prophet Muḥammad. So ʿUrwa has a very important position because of his lineage, his mother and father. Thefore, his connections with Mecca and Quraysh strengthens his position. In our sources there is no information about his dates of birth and death. It is likely to be over middle age when he became a muslim, considering that he was the leader of his tribe and his son become a muslim after he died. There is too little information about weddings of ʿUrwa. According to narratives, he had ten wives before becoming Muslim. After becoming a Muslim Prophet Muḥammad warned from him to prefer four out of ten wives. One of his four wives is the daughter of Abū Sufyān. Howev-er, there is no information about the names of his wives. Names of his sons: ʿĀṣim, Abū Murra, Abū Mulayḥ, Dāwūd, Hammām and Hishām and names of his daughters: Umm Saʿīd (married with Ḥaẓrat ʿAlī) and Ḥalīma. We could see he served as embassy before the treaty of Hudaybiyah. His embassy duty shows us the superiority of his position. Also, this embassy duty was very effective at peace negotiations. He mentioned kinship relations which connects about Mecca. He said that it could be beneficial to talk to Prophet Muḥammad himself. The Meccans mentioned about their trust in ʿUrwa. During the time of his embassy, he expressed that both sides should be away from war. In this context, he told the Meccans: The people around Prophet Muḥammad are very loyal to him and he told to Prophet Muḥammad: People around him could disintegrate easily. This mission shows us he is intelligent, respectable and had high persuasion skills. ʿUrwa, observed loyalty of ṣaḥābīs to Prophet Muḥammad. He confessed this loyalty can not be for any ruler. This observa-tion probably affected ʿUrwa’s conversion to Islam. Because of the conquest of Meccah and the events that followed, the people of Ṭāʾif were very worried. Because of this reason people of Ṭāʾif took part in the side of Hawāzin’s and they bat-tled with Muslims. In this time they sent ʿUrwa b. Masʿūd and Ghaylān b. Salama to the city of D̲j̲aras̲h̲ of Yemen, to learn about some war machines and techniques. Therefore they did not join wars of Hunayn and Ṭāʾif. Prophet Muḥammad ended the siege of Ṭāʾif and went to Medina. Meanwhile, ʿUrwa and his friend returned from Yemen. According to narratives when the Prophet Muḥammad returned Medina or he was way in Medina ʿUrwa visited him and became Muslim. Some people tell about the date of ʿUrwa’s being Muslim at before or after Abū Bakr’s emirate of Hadj. However, when the narrations are examined, it can be said he became Muslim after four or five months from Prophet’s siege of Ṭāʾif and before three or four months from Tabūk expedition of Rabīʿ al-awwal or “Rabīʿ al-ākhir” (July or August) in the year 9/630. As for the conversion of ʿUrwa, basic sources report that “Allah, inspired Islam to the heart of ʿUrwa and he changed his situation. He went to the Messenger of Allah and he became Muslim.” They do not give a specific reason. But after this period the narratives tell the reason for ʿUrwa’s becoming a Muslim as due to an experience he had while travelling to Najrān for trade. In this travel, two mysterious young girls and the priest in Najrān said the last prophet came and ʿUrwa must be subject to him and ʿUrwa became Muslim after he returned. But this narrative is prob-lematic with regard to evidence and text. After being Muslim, ʿUrwa wanted permission from the Prophet to invite his tribe to accept Islam. The prophet did not want to accept this at first. Because the people of Ṭāʾif had an arro-gant stance against Islam, and he said that the people of Thaqīf could kill ʿUrwa. Eventually ʿUrwa went to his hometown with permission of Prophet and invited people to Islam and they did not accept this invitation and cursed ʿUrwa. The next morning ʿUrwa read adhan of fajr and people of Ṭāʾif killed him. ʿUrwa b. Masʿūd was likened to Prophet Jesus by the Prophet Muḥammad. It is generally accept-ed that ʿUrwa b. Masʿūd el-Thaqafī is “one of the biggest from two cities” expressed in sūra Zukhruf. Only two weak narrations were reported of Urwa who could live as a Muslim for a few days and was matyred by his tribe. (shrink)

The Egyptian Sufi poet Mohammad ibn Sa‘îd al-Bûsîrî’s (d. 695/1296) work called Qasîdah al-Hamziyah, in which he tells the life of the Prophet, has attracted great attention in Muslim societies. The eulogy, which is met with interest by scholars dealing with the field of poetry and literature, is a text read in daily life in mawlid, ceremonies praising the Prophet, dhikr rings in sufi lodges, hadith lesson circles, and prayers. More than a hundred commentaries, annotations, tahmis, tastir and translations have (...) been written on the work. While many of these studies on Qasîdah al-Hamziyah have been conducted by renowned scholars, there are also scholars who have worked on the eulogy but are not mentioned in biographical sources. The subject of this study is one of the commentaries written about the eulogy and whose name is not found in the biographical sources. The name of the work written by Abdullah al-Shazelî al-Bahrî is Al-Cavâhir al-Seniyye fî Sharh al-Hamziyah. In this article, information was given about the name of the work, its belonging to the author, the date of copyright, its reason, the method of commentary, its style, its content, the sources used, and its features. Also, the critical edition of the three couplets’ commentary was written as a highly representative example. (shrink)

Ḥājj, the ancient religious symbol in the Sami’s, is not only a religious duty for the Muslim individual, but also an important worship that creates a social awareness of the ummah and at the same time creates a serious population mobility in the Islamic geography. With the message of the Prophet, the pilgrimage was restored to its original form, and in the next process, those who were in charge of this region made an effort to enable all Muslims of the (...) world to carry out their duties comfortably and to carry their religious, scientific and social experiences to their own regions. The Maghreb (today’s Morocco) and Andalusia bonded and strengthened with the eastern Islamic world through pilgrimage, science and trade journeys. The Marīnid State started the pilgrimage journeys again with official convoys, which were partially interrupted due to the conquest of Andalusia. They gave great importance to these journeys in order to express their longing for the Prophet and to show their political and social power. In this study, the arduous pilgrimages Marīnid Sultan Abū’l-Ḥasan’s (d. 752/1351) mother Maryam and his sister Maryam bint Saʿīd- lasting at least one year in the 14th century are discussed in the context of diplomatic, social and cultural dimensions the pilgrimage. As a matter of fact, Muslims living in the distant lands of Morocco and Andalusia, where Islam was lived, made their material and spiritual ties with the lands where Islam was born and developed by means of pilgrimage, knowledge and trade. The pilgrimages of these two Maghribi noble women, who succeeded in the Maghrib-Hijaz pilgrimage, have become epic as even the noble men of the Maghrib and Mashriqi noble women rarely dare it. These pilgrimages, which took place during the reign of sultan of Abū l-Ḥasan should be evaluated in terms of the political developments and socio-cultural characteristics of the period. The Sultan has progressed considerably in his aim of becoming the sultan of the western Islamic world with the conquest of the places outside the Maghrib Aqṣā and the jihad he participated in Andalusia. It was during this period that he established multifaceted relations with the holy lands and their sultans. In these relations, the women of the Marīnid sultans, the pilgrimages made almost competing with the lady sultans of the Mamlūks, diplomatic correspondence and Exchange of gifts between the sultans, gifts and al-Masjid an-Nabawi letter expressing longing of those who could not go on the pilgrimage are included. With this subject, the effect of the fact that the pilgrimage is an exciting journey even in the most distant lands, the sultans of the period supported these journeys, as well as the help of the Ṣūfī connoisseurs to the state with their ribāṭ (hospice) for road safety. In the study, first of all, the women's pilgrimage stories were given, and then the pilgrimages of the dynastic women of the Marīnid period were discussed. The gifts sent to the Mamlūk sultans, who were the sultans of the holy lands, and the Qurʾān sent to Mecca, Medina and Jerusalem, which are considered sacred by Muslims, have become important symbols of these pilgrimage journeys. It is remarkable how pilgrimage journeys united all Muslims materially and spiritually during the periods when Muslim state administrators were powerful. Especially the fact that these two Maghribi ladies were carried out easily should be expressed as another important aspect of the issue. (shrink)

Talvez o paralelo mais próximo do Logos joanino no Islã seja encontrado na noção da "Realidade Muhammadana" (al-ḥaqīqat al-muḥammadiyya). O termo foi provavelmente usado pela primeira vez por Ibn ʿArabī (d. 1240), mas a explicação detalhada mais antiga do que ela representa foi fornecida por Saʿīd ibn Aḥmad Farghānī (d. 1300), um excelente aluno do principal propagador de Ibn ʿArabī, Ṣadr al-Dīn Qûnawī. Farghānī escreveu um comentário denso, em dois volumes, sobre a famosa qasida de 760 versos de Ibn al-Fāriḍ, (...) Naẓm al-sulûk. Las aleyas coránicas sobre el Paraíso (y en especial Corán, 55: 46-78), así como el Kitdb waJal-firdaws de 'Abd al-Malík b. IIabIb, nos permiten precisar mejor la interpretación "paradisíaca" de Madinat al-Zabrá' y dotarla de sentidos concretos, mostrando sus ventajas sobre otras posibles (aunque no deseebables). Se explica así no sólo la variedad, sino también la asimetría, de las decoraciones parietales del Salón de 'Abd al-Ralimán III, se da sentido a cómo pudieron surgir una serie de relatos en tomo a (...) Madinat al-Zabrá', se puede plantear una nueva interpretación de la decoración en "verde y manganeso" de la cerámica producida en la ciudad y se sugiere otro aspecto más del nombre por el que ésta fue conocida. También se puede establecer una relación con una de las doctrinas atribuidas a Mundir b. Said al-Balítití, cadi de 'Abd al-Ralimán Itt desde 339/950 basta la muerte del califa. El silencio de las fuentes árabes sobre ese simbolismo paradisíaco puede ser puesto en relación con la anécdota de cómo ese mismo MuÑir b. Sa'id censuró la actividad constructora de 'Abd al-Rahmán III. Por último, MadInat al-Zabrá debe ser estudiada siempre dentro del contexto del enfrentamiento político-religioso con los Fatímíes y, más en concreto, con la situación surgida a partir de la derrota del "Hombre del Asno", presentado como figura escatológica (al-Dayyal) por los Fatimies. La vida y obra del polígrafo granadino Lisān al-Dīn Ibn al-Ḫaṭīb (m. 776/1374) sigue siendo fuente de importantes estudios y traducciones habida cuenta de que su prolija producción literaria está repleta de valiosos testimonios históricos y personales que sitúan a su autor como un personaje destacado en la transmisión del conocimiento en el Mediterráneo islámico. En la difusión de su obra y prestigio jugó un papel fundamental la copia manuscrita de su obra al-Iḥāṭa fī aḫbār Ġarnāṭa que Ibn al-Ḫaṭīb envió (...) en vida (768/1366), a través de su hijo ʿAlī, a la ḫānqāh de Saʿīd al-suʿadāʾ de El Cairo, regida por el tremeceno Ibn Abī Ḥaǧala (m. 776/1375). El conocimiento de esta copia ha llegado hasta nosotros a través de otro tremeceno, al-Maqqarī (m. 1041/1632) y su monumental obra, Nafḥ al-ṭīb, en honor al sabio granadino. Gracias a ella sabemos, entre otras cosas, que esta copia fue profusamente consultada y comentada en sus márgenes. Dos autores destacan por encima de los demás: el hijo del autor Abū l-Ḥasan ʿAlī (m. s. IX/XV), y el magrebí Ibn Marzūq (m. 781/1379). A través del estudio y la traducción de las notas manuscritas de este manuscrito cairota, este estudio pretende poner de relieve el valor de los marginalia como fuente documental, así como arrojar un poco más de luz sobre estas dos figuras, junto con al-Maqqarī, como piezas importantes en la transmisión y pervivencia de la obra de Ibn al-Ḫaṭīb en el Oriente islámico hasta al menos el siglo XI/XVII. This article aims at examining the limits of change in the field of worship through a study on the origins of the ḥukm[religious ruling] of Shawwāl fasting that is widely practiced in the different parts of Muslim world. The study, firstly, deals with the evolution of the ḥukm of Shawwāl fasting chronologically among four sunnī schools of law, then analyzes the solitary reports on the topic. It concludes that in Mālikīand Ḥanefīschools, the ḥukm of this specific worship changed within the (...) limits of karāha [reprehensibility], ibāha [permissibility], and nadb [recommendation]. This ḥukm was constructed based on solitary reports which later became a paradigmatic source of religious legitimacy in the Ḥanbalīschool beginning with the eponymous Imām and in the Shāfiʿīlong after the founding authorities. It also claims that it is strongly probable that the solitary reports on the topic go back to a deduced opinion in the age of companions, but then reached to a form of prophetic solitary report in the corpus of hadīth reports. Ultimately, this specific worship that has restricted number of fasting was established with the paradigmatic effect of the approach to solitary reports as the only authentic way of transmitting the sunna, even though it is at odds with the fact that this worship had not been implemented in the first two centuries after hijra, i.e. contrary to the established practice [ʿamal]. Summary: The issue of change of rulings in Islamic law comes up frequently on various occasions, and an increasing number of academic studies are trying to determine the characteristics and limits of this change in numerous books, articles and papers. These studies mostly seem to focus on bringing together the arguments that can be compiled under the title of ‘the flexibility of Islamic law in response to the challenges of modernity’. Although the change of rulings in Islamic law is an undeniable fact, reading it only from the lens of the change in Islamic law depending on the requirements of time is an inadequate reading. The change of rulings in Islamic law has different motives; and the change of time, more precisely the change of custom, is only one of them.On the other hand, another issue that comes up in relation to the change of rulings is the claim that this change can only take place in terms of the rulings regulating the interpersonal relations, i.e. muʿāmalāt. In fact, this claim relies on the abovementioned approach that limits the change in Islamic law with the change of custom. Hence, because other two main areas of Islamic law, worships (ʿibādāt) and punishments (ʿuqūbāt) are not open to change through custom, their rulings will not change at all. This article will try to reveal that the change in rulings might reside in a sort of another change emerged in relation to the sources of these rulings, which is a neglected point. Thus, by exposing that the field of worships which is mostly considered as a closed area for change in rulings is actually open to it, this article will examine the limits of this change.For this analysis, the article deals with the fasting of six days in the month of Shawwāl as an example, which is widely practiced in various parts of the Islamic world. The main evidence on which this fasting is based on is a report transmitted in the considerably authentic hadith sources of Ahl al-Sunnah, which reads as follows “Whoever fasts the Ramaḍān and adds six days from Shawwāl, will get reward of the entire year”. This fasting, which is the subject of a great agreement on its ruling as recommended (mustaḥāb) practice today, was actually regarded as reprehensible (makrūh) by the two great eponymous jurists of the first two schools of law in the second Hijrī century, namely Mālik b. Anas and Abū Ḥanīfa. In his al-Muwaṭṭaʾ,Mālik clearly expresses that he did not recognize any scholar who keeps this fast, and that no [authentic] report has reached him on this. The fact that both Mālik b. Anas and Abū Ḥanīfa declared an opinion on the subject shows that this practice started to appear in the first half of the second ḥijrī century as a practice or as a solitary report (khabar al-wāḥid). However, both imāms have stated that such a specific worship would be makrūh. In spite of these very sharp expressions, the schools of law, which were founded by the followers of these two eponymous scholars, abandoned their views and widely accepted Shawwāl fasting as mustaḥāb. This article examines why this sharp change occurred in a worship in the schools of law and in which way it took place.Accordingly, the fundamental motive in this change is a paradigmatic transformation in understanding and identifying the sunna as a source of normativity. Although an agreement was formed on the validity of solitary reports as a source of knowledge in the second ḥijrī century, it was not yet accepted that these narrations are identical to sunna as a source of normativity. For that reason, both Abū Ḥanīfa and Mālik did not hesitate to reject any solitary report that contradicted a stronger evidence. However, as a result of the extraordinary efforts of Ahl al-Ḥadīth, the epistemic value of solitary reports has reached to an authority equating them to the sunna with a very rapid acceleration as of the end of the second century and throughout the third century. This situation led later scholars of schools to abandon the views of the eponymous scholars of these schools on certain topics in favor of certain solitary reports. This was also the process for the change in Shawwāl fasting.This thesis will be put under two headings, a section that tries to determine the periods and processes for the Sunnī schools of law in considering this fasting as mustaḥāb; and another section that provides an evaluation of transmitted reports in relation to the Shawwāl fasting. Accordingly, in the Mālikī and Ḥanafī schools, due to the effect of the reports, the ruling of Shawwāl fasting has been transformed from makrūh into the mustaḥāb as a result of the interpretational activities that started in the fourth ḥijrī century. Shawwāl fasting was accepted as mustaḥāb in the Shāfiʿī school, although there was no transmitted opinion on the subject from the founding imāms, in the fifth ḥijrī century; and in the Ḥanbalī school directly by the founding imām Aḥmad b. Ḥanbal, whose main aim was to follow a concept of religion that puts the transmitted reports at the center. When the reports on the subject are examined, it demonstrates that the mustaḥāb ruling is mainly rooted in a report by Saʿd b. Saʿīd transmitted in the famous hadīth compilations including Muslim’s Ṣaḥīḥ.Yet, this report was criticized in its both chain and text. Combining the facts that the same report with the same chain was also transmitted as the words of the companion in some sources and the verse that declares good deed will be rewarded ten times higher than what it deserves will make the following explanation a valid one: As Mālik put it such a fasting practice was commonly unknown to the Muslim society in the first two centuries after the ḥijra. Sometime after the death of the Prophet, an inference was made probably by a companion(s) as that it would be a good deed if someone who fasted an entire month already and got used to the fasting to fast six more days in order to get a reward of fasting for the entire year according to the verse that rewards good deeds with ten times higher. Since it is a recommended practice in essence, i.e. fasting for the sake of Allah, this inference transformed into a report and easily passed through the filters of hadīth scholars who are linked to a sort of piety promoting worships among people. After the solitary reports gained an authority to the extent that they can rarely be challenged, the followers of later schools of law preferred to get in a process of re-interpreting the opinions of their imāms in order either to reconcile them with the content of report, or at least to show why these imāms actually spoke against this fasting. Eventually, the later scholars of madhhab decided for the standard opinion of the madhhab depending on the reports in favor of the Shawwāl fasting rather than following their eponymous imāms. Mulla Sadrā refers to ancient Greek philosophers in his writings quite often, especially when the subject matter is the soul. In this article, I will address how Mulla Sadra reiterates Avicenna’s summary and analyses of ancient theories of the soul as discussed in Safar 4, Bab 5, and Fasl 5 of, al-Hikmat al-Mutaʿāliya fi asfār al-ʿaqliyyat al-arbaʿa. The source of these discussions, when the structure and basic contents are considered, is Aristotle’s De Anima Book I. Before defining the soul, Aristotle (...) discusses what kind of a science, a science on the soul should be, and afterwards, he evaluates previous theories on the soul as those defining the soul through movement, perception, and life. We observe that this evaluation on previous theories play a preparatory role for his own definition of the soul as perfection and actualization. In a similar manner, in Safar 4, Bab 5, and Fasl 5 of Asfār al-aqliyyat al-arbaʿa, Mulla Sadrā reinterprets and discusses Ancient theories in such a way that the discussion leads us to a theory similar to Mulla Sadrā’s. In the presentation of this chapter, we find out that the soul is immaterial and modulated (tashkīkī) reality and is represented as a unity which is in a constant movement in its substance. The soul is matter in its origin, yet turns into an immaterial reality through substantial movement. In direct disagreement with Aristotelian philosophy, for Mulla Sadrā, movement in substance is possible as well as it is essential in understanding the reality of the soul. When Mulla Sadrā evaluates the ancient discussions and the criticisms by Avicenna, he finds that the discussion focuses on the source of mobility yet the soul is supposed to be defined as the source of immobility equally. Next in the discussion on movement, he focuses on the necessity of accepting the principle of substantial movement. According to Mulla Sadrā, Avicenna (following Aristotle’s presentation and interpretation) is misleading in his evaluation and criticisms of the ancient theories on the soul mainly because he follows a literalist reading. On the contrary, sources for Ancients’ knowledge is perennial wisdom, and their words on the soul have deeper meanings than what is understood at the first reading. When read with more trustful lenses, it will be manifested that the soul is an immaterial reality for them as well. For example, when they talk about the soul as a sphere, Mulla Sadrā thinks that they want to direct attention to the perfection. When fire is mentioned, the dynamic reality of the soul is brought to light. Mulla Sadrā, adds the principle of gradation (tashkīk) to his presentation and talks about modulation of fire from material fire to the immaterial light (nūr).The lowest level of fire is related to the changes in nature of the soul, the soul responsible of irascible and concupiscent establishes the next level. Once the soul is under total control, then it completes the passage to its incorporeality and becomes light. So this chapter is important in its structure because it allows us to read into how Sadrā’s historical reiteration is influenced by his own theoretical framework on the one hand. On the other hand, thanks to the long lineage of De Anima commentary literature, we can compare Sadrā with Aristotelian readings in this chapter. The interpretative reading of Mulla Sadrā, in opposition to the literalist reading of Avicenna on the ancient theories, also leans on a history of other philosophers before him. In this regard, a lineage of historiography might be traced back to Āmirī, Qādi Saʿīd, and Shahristāni. What the article comes to conclude is that a particular presentation found in Aristotles’ De Anima- Book I is molded in Mulla Sadrā’s hands with a more interpretative version of pre-Socratic theories to such an extent to support Mulla Sadra’s own theories on the soul. As mentioned in the narrations, the messenger of Allah (pbuh) used to recite some prayers known as opening prayers such as Subhaneke, Wejjehtu and Allâhümme Bâid before reciting Fatiha surah while starting the obligatory and supererogatory worships (salat). In this study, it is aimed to find out the reflections of the abovementioned prayers in narrations, and to determine their authenticity and to reveal the reasons why jurisprudential sects preferred different prayers. Benefitting from literature review method, hadith inferences were made, and (...) moving from the books of refutation & corrections and biographies, the cases of the narrators of the hadiths, who took part in the ascription of the narrations, were put forth. After the investigation, it was determined that the narrated narrations about Subhaneke, an opening prayer, were found to have been narrated by eight different prophet companions in their later works through Aisha and Abu Sâ’id al-Khudrî in early hadiths resources; and that all these narrations were week in terms of authenticity. However, it was revealed that the most authentic narrations about the issue were those depending on the practice of Umar. In the hadith resources, it was seen that five different prophet companions narrated some narrations about the Wejjechtu prayer, and that the great majority of these narrations were through Ali, and that most of these narrations were authentic, yet only one reference was found to be weak. On the other hand, it was revealed that the narrations narrated by Abu Huraira between the opening prayer, Allâhümme Bâid, turned out to be genuine in terms of authenticity. For instance, while Hanafis and Hanbalis have preferred reciting Subhaneke during salat, Shafiîs have found it appropriate to recite the prayer Wejjectu in the salat. On the other hand, Malikis have thought that it was obligatory to start the salat with Surah Fatiha, and that it was makruh to recite these prayers in salat. (shrink)

Each narration or text, as it informs about an event, situation or person in history, has a history that sheds light on both its formation and how it arrived to us. The illumination of this history is at least as important as the content analysis of the information. For this reason, it is necessary both to examine whether the source in which the information is given has survived to the present day as it was created by the author without being (...) exposed to any external intervention, and to analyze the narration in terms of reliability and indication within the integrity of the isnād-text. In that case, when the word “text criticism” is mentioned, an understanding of a specific criticism should come to mind, which includes both critical edition (scholarly editing) of the first source and the critique of the narration by making sound research in terms of isnād and literary criticism (naqd al-isnād wa-l-matn). Due to reasons such as the inability to follow a standard method, the limited number of the copies and/or the distance of the copies from the author in terms of history and commercial concerns, many classical works published with relative verification contain such errors require a re-examination. One of these works is Ibn Hibbān’s (d. 354/965) book al-Majrūhīn. In his work al-Majrūhīn, Ibn Hibbān divided the narrators into two groups according to their reliability and collected the ones that he determined as weak according to his opinion. In this work, he placed Abū Ḥanīfa (d. 150/767) at the top of the list. First, he denounced Abū Ḥanīfa with the following expressions: Sahib al-ra’y, child of slaves, bicker, hypocrite, had little knowledge of hadith, a Murji’ī propagandist, a narrator who was blamed by imams. Then he tried to justify these claims by about thirty narrations from various salaf scholars. These narratives are completely different from the largely intellecutal discussions and criticisms of scholars such as al-Awza'i (d. 157/774), Ibn Abī Laylā (d. 148/765) and Ibn Abī Shayba (d. 235/849) on Abu Ḥanīfa and his school. The narrations compiled by Ibn Hibbān are display insulting and polemical narrations against Abu Ḥanīfa’s personality and reliability. In terms of being a source for later periods, it is important to examine and criticize these narratives in terms of the narration techniques. The al-jarḥ wa-l-taʿdīl is important part of the hadith science. al-Mejrūhīn, one of the leading works of this science is remarkable in many respects. According to this narration Abū Ḥanīfa Nuʿmān b. S̱ābit b. Zūtā b. Māh’ın (öl. 150/767) said, "If a man worships this mule to get closer to Allah, I see no harm in it." According to our analysis, there are the following determinations about the narrators in the chain of this narrative. Ibn Abī Mushir is unknown (majhūl), the narrator who is written as “Mahfūz b. Abī Savba” but his correct name is “Tawba” is matrūk. Ahmad b. al-Walīd al-Mahramī al-Karkhī is weak, and Yahyā b. Hamza, source person, is qadari who narrates from people with munkar al-hadith; but is also considered as a thiḳa narrator. As for Sa‘īd b. Abd al-Azīz, he has nothing to do with the reception and transmission of the narrative. In addition, there is also a break in the chain. First of all, what is expected from a basic work such as al-Majrūhīn, whose subject and purpose is purely a narrator analysis, is that the report in it should be acceptable, at least in terms of isnād. When the narrative in question, which is also included in earlier sources such as al-Fesewī (d. 277/890), is evaluated in terms of both the isnād and the text, one realizes the transformation of an expression circulating in the form of gossip against Abu Ḥanīfa in Damascus around the subject of ʾirjāʾ. ʾIrjāʾ was at the forefront of the heated debates in the second half of the second century into semā form in terms of isnād and text, besides, the word النعل/clog is transformed into البغل/mule. Apart from the weak points of the chain, Sa‘īd b. Abd al-Azīz, who has nothing to do with the reception and transmission of the narrative, has also been turned into the narrator/source of the report with the samā expression. Regardless of the purpose and the criteria of the narration technically, during the conversation with Sa‘īd, Yahyā b. Hamza’s sincere friend and teacher, a special speech in which a common report attributed to Abu Ḥanīfa was expressed, was transformed into Yahyâ’s samā‘ in the form of jazm. As a result, the word “shoe” or “clog” has evolved into mule. It would be a reductionist and over optimistic approach to assume that all this may have resulted from tashīf and tahrīf of the copyists. The narration we discussed is a typical example in terms of showing the effect of the conflict of ideas between Ahl al-Hadīth and Ahl ar-Ra’y on the narrations. Abū Ishāq al-Ṣaffār was one of scholars of the Western Qarakhānids’ period who followed the Kalām thought of al-Māturīdī (d. 333/944). His theological works Talkhīs al-adilla and Risāla fī al-kalām, his method in kalām, and frequent reference to his works by Ottoman and Arab scholars indicate that al-Ṣaffār is a respected and authorative Māturīdī theologian. The article focuses on his defense of the kalām. By adding a long introduction to Talkhīs about the naming, importance, and religious legitimacy of the science (...) of kalām, Saffār asserted that the kalām should be learned. When systematical vindication of the science of kalām is examined, it is understood that al-Ṣaffār is the first theologian who reserved a private and voluminous part for defensing the kalām among Ḥanafī-Māturīdīs. Even though he does not state its systematic, it can be understood that vindication of kalām in al-Ṣaffār divides into three parts as of explanation, demonstration and refutation. Al-Ṣaffār’s defending the science of kalām shows that there were opposite thoughts against kalām in the 4th/10th and 5th/11th centuries throughout in Transoxania. In this period Aṣḥāb al-Ḥadīth and Ikhwān al-Ṣafāʾ were the opposite fronts of kalām. In addition, he was trying to go beyond the oppositions of Ḥanafī jurists. His vindication is consistent and has scholarly depth because it is able to be against a strong opposition. -/- SUMMARY: Abū Ishāq Ibrahīm b. Ismāil Zāhid al-Ṣaffār al-Bukhārī is a scholar belonging to the Ḥanafī theological tradition which was improved by the contribution of Ḥanafī theologians who used thinking system of Abū Ḥanīfa (d. 150/767) as base and adopted Abū Manṣūr al-Māturīdī (d. 333/944) and his thoughts in historical process. The contents of his theological works Talkhīs al-adilla li-qawāʿid al-tawḥīd and Risāla fī al-Kalām, the method that he used, and references to his works made by Ottoman and Arab scholars indicate that he is an important Māturīdī theologian. The article focuses on his defense of the science of Kalām. -/- In Talkhīs al-adilla, there are two sections including the subject of naming, and importance and necessity of Kalām discipline. Here, the necessity of learning Kalām and its value are defended in detail. -/- Besides, rumors “Abū Ḥanīfa turned away from the science of Kalām in his doomsdays” and that “He prohibited to make occupation with Kalām completely” are evaluated. -/- When systematical vindication of the science of Kalām is examined, it is understood that al-Ṣaffār is the first theologian who reserved a private and voluminous part for defensing the Kalām among Ḥanafī Māturīdīs. Even if Abū Manṣūr al-Māturīdī, Abū al-Yusr al-Bazdawī (d. 493/1100) and Abū Muʿīn al-Nasafī (d. 508/1115) defend that the science of Kalām is not wrong for religion; yet, the vindication of Kalām does not take a place under a separate title and in a detailed manner in any of Māturīdī theologians works. -/- The method that al-Ṣaffār used when he is defending the science of Kalām, differs from strategy of Abū Ḥanīfa. While Abū Ḥanīfa has mentioned that there is a need for the science of Kalām under these new circumstances, al-Ṣaffār has defended theologians who were charged with being Ahl al-Bidaʿ, by trying to prove that the prophets especially the Prophet Ibrāhīm, even the Companions of the Prophet Muḥammad (Ṣaḥāba) and the Successors of the Companions (Tābiʿūn) scholars use their minds and make arguments in religious matters. In this respect, he emphasizes that the Qurʾān orders to think and discuss gently, not to be stay in silence: “And dispute with them, using what is best” (16.125-126). Therefore, he states that this discipline which took a mission to explain and defend the creed of Islam (ʿaqīda), cannot be characterized as an innovation (bidʿah) or illicit. -/- His vindication method can be defined as a more developed type of method that Abu’l-Ḥasan al-Ash’arī’s (d. 324/935) used in Risāla fī istiḥsān al-khawḍ fī ʿilm al-kalām. Even though he does not state its systematic, it can be understood that vindication of Kalām in al-Ṣaffār divides into three parts as of explanation, demonstration and refutation: -/- a) Explanation: Explaining the necessity and importance of the science of Kalām by giving information about its definition, names, value and place among other principles. -/- b) Demonstration: Revealing the religious basics of the science of Kalām from the Qurʾān, the Sunna of the Prophet Muḥammad, the Companions of the Prophet, and the Successors of the Companions thus specifying that it is legitimate for religion. -/- c) Refutation: Replying the claims having aim to weaken the value of Kalām principle and its religious legality. -/- Al-Ṣaffār describes ‘the science of Kalām’ as ‘Knowing the Real with the evidences which help to reach the absolute information’. By allocating the concept of 'Ḥaqq', he repeats the definition of Kalām as “it is to know God with certain evidences” in a part of his work, and “it is to know the principles of religion (uṣūl al-dīn) with certain evidences” in another part. He describes Kalām as “Knowing ḥaqq / God / uṣūl al-dīn by depending on evidence”, and tries to prove that it is wrong to consider a science which performs the stated duty, as illicit and abominable and thus turn away from it. -/- Al-Ṣaffār thinks that it is right to call this principle as ‘Kalām’ because of the certain evidences leading to the truth that this science has used. This thought was defended by other theologians as well. -/- For example, according to Saʿd al-Dīn Masʿūd al-Taftazānī (d. 792/1310) it seems like to say “This is the word (kalām), not the other knowings” by the way of the power of evidences used in Kalām.Thus, it is appropriate to give name Kalām for this science which based on certain evidences. -/- Al-Ṣaffār’s explanations revealed in scope of vindication of the Kalām are adopted by some of following scholars. Ḥusām al-Dīn al-Sighnāqī (d. 714/1314) in his book called al-Tasdīd sharḥ al-Tamhīd fī qawāʿid al-tawḥīd quotes Saffâr’s explanations as the same. -/- Al-Ṣaffār indicates that the method told in the Qurʾān is to reply questions about religion, beliefs and rejection instead of remaining in silence. The duty taken on by Kalām is this vindication activity performed by the prophets whose examples are described in the Qurʾān and which is legal and demanded. His way of thinking and vindication of the Kalām resembles that of Abū Manṣūr al-Māturīdī. Al-Māturīdī says, “Prophets and we were ordered to invite infidels to Islam. When this invitation happens, the respondents will ask for evidence and explanation, and discussion will be inevitable. Therefore, discussing and talking about subjects of Kalām is not objectionable”. -/- Thoughts of al-Māturīdī and al-Ṣaffār regarding the vindication of the Kalām were repeated by Nūr al-Dīn al-Ṣābūnī (d. 580/1184), and Fakhr al-Dīn al-Rāzī (d. 606/1210) later. According to al-Ṣābūnī, the evidences put against deniers and especially the discussion made by the Prophet Ibrāhīm to defend his own belief, prove the legality of Kalām discipline. Likewise, according to al-Rāzī, the duty of Kalām is just an activity performed already in the Qurʾān and ordered to the prophets. At this point of view, since the prophets were leading to Kalām, banning this activity is nonsense. -/- According to al-Ṣaffār, the reason for why Abu Hanifa avoids his son Hammād from these discussions is that Abu Hanifa does not like discussions based on obstinate. Otherwise, it cannot be that Abū Ḥanīfa prohibits to learn Kalām and make discussion about Kalām. According to him, this behavior of Abū Ḥanīfa results from that people discussing with him are ignorant about the subject of Kalām, discussion turns to an obstinate, and coming to an end of discussion seems impossible. This comment of al-Ṣaffār is quoted in Miftāḥ al-saʿāda wa-miṣbāḥ al-siyāda by ʿIṣām al-Dīn Aḥmed b. Muṣṭafā Tashköprüzāde (d. 968/1561) and in Minaḥ al-rawḍ al-azhar fī sharḥ al-Fiqh al-akbar by ʿAlī b. Sulṭān Muḥammad al-Qārī (d. 1014/1606) as same as his words. -/- Al-Ṣaffār’s defending the science of Kalām shows that there were opposite thoughts against Kalām in the 4th/10th and 5th/11th centuries throughout in Transoxania.In this period Aṣḥāb al-Ḥadīth and Ikhwān al-Ṣafāʾ were the opposite fronts of Kalām. In addition, he was trying to go beyond the oppositions of Ḥanafī jurists (fuqahāʾ). Because some of the Ḥanafī jurists thought that Abū Ḥanīfa forsook occupation with the science of Kalām and even he prohibited his son to have interest in this discipline. But some of Ḥanafī theologians such as al-Māturīdī, al-Nasafī and al-Ṣaffār protested this thought which describes Abū Ḥanīfa as a banner for Kalām. -/- His vindication is consistent and has scholarly depth because it is able to be against a strong opposition. -/- His book Talkhīs al-adilla li-qawāʿid al-tawḥīd is a unique source in terms of containing vindication of the Kalām in detail and also influencing the approaches of the next period scholars.
