Grice proposed to investigate 'the total signification of the utterance'. One persistent criticism of Grice's taxonomy of signification is that he missed an important category of information. This content, and/or the process of providing it, goes by a variety of labels: 'generalized implicature', 'explicature', 'unarticulated constituents', 'default heuristics', 'impliciture'. In this study we first take a sample of such phenomena and, from the point of view of pure pragmatics, survey the central descriptions of the content expressed and the mechanisms that (...) might deliver these contents. We then, from the point of view of experimental pragmatics, focus on two accounts: Levinson's I-heuristic, and Bach's standardization. We find experimental evidence for the existence of such implicitures, and for the use of language specific standardizations over language neutral background information. (shrink)

From about the fourth to the tenth century Buddhist monks in China engaged in formal, semi-public, religious disputation. I describe the Indian origins of this disputation and outline its settings, procedures, and functions. I then propose that this disputation put its participants at risk of performative contradiction with Buddhist tenets about language and salvation, and I illustrate how some chinese Buddhists attempted to transcend these contradictions, subverting disputation through creative linguistic and extra- linguistic strategies.

Mostly the culture of literacy has taken shape within a realm of freedom, seemingly distant from the needs of the body and the demands of sustenance. At the same time, the world represented within so much of the world’s narrative, both truth and fiction, has been saturated in struggle and deprivation. This article tries to make some sense of this juxtaposition, freedom on one side and necessity on the other: in particular, the pull of past or residual forms of unfreedom (...) in the sphere of literary representation, within and against new or emerging expressions of emancipation, themselves accompanied or countered in modern times by ever-novel styles of exploitation. This essay attempts to explore trademark law and the marks themselves from a semiotic viewpoint to provide a deeper understanding to (trademark) law as a system of signs. Although the language of trademark law may suggest slightly different meanings, for the purpose of this essay “trademark” will refer to an area of law (unless otherwise indicated) and “mark” will refer to the individual sign. The first part of this essay will provide a brief overview of semiotics. Second, it will outline (...) a general look at trademark law as set forth in the Lanham Act. The third section is a semiotic approach to provide a deeper understanding of trademark law. Finally, the essay will analyze a seminal trademark case whilst using semiotics to address legal meaning within the case. Semiotics teaches that no absolute meaning can be found. This essay, then, attempts to secure at least one particular meaning of the Qualitex case and what it means in trademark law today. (shrink)
