Este trabalho analisa a Administração Pública e o poder regulamentar das agências reguladoras no Brasil, a partir da Constituição de 1988. Utilizam-se a pesquisa bibliográfica e o método dedutivo. Constata-se que essas agências foram criadas, no Brasil, em um contexto de transformação do Estado, que buscava afastar-se da intervenção direta na ordem econômica e adotar um modelo gerencial, focado mais na fiscalização e regulação dos serviços públicos, do que em sua prestação direta. Os resultados indicam que os limites do poder (...) regulamentar dessas agências, entretanto, é objeto de controvérsia, face aos limites decorrentes do princípio da legalidade. (shrink)

Um estudo filosófico do tempo é possível a partir da pergunta pela singularidade do tempo. Nesse sentido, John Sallis, em seu artigo “Another time”, apresenta Heidegger como aquele que forçou a pergunta pelo tempo em termos de uma possível singularidade. Heidegger, em sua obra O conceito de tempo, aludindo a Agostinho recoloca a questão do tempo a partir do Dasein, identificando-os. Contudo, é na ntenção primeira de Ser e tempo, isto é, intentando-se uma compreensão para Temporalität, o sentido do ser, (...) conceito este não concretizado neste tratado, é que se torna possível problematizar a singularidade do tempo. Para tanto, apresenta- se uma compreensão de Sallis da Temporalität como outro tempo. Em contraposição, pode-se pensá-la de modo imanente à temporalidade do Dasein na sua ocorrência do tempo da ocupação, isto é, do tempo presente ontologicamente compreendido. O tempo de ocupação é pensado por Heidegger como abertura ao mundo que tem seu sentido na autocompreensão enquanto cura. É na compreensão do modo do abrir-se da abertura ontológica que se pensa um tempo enquanto tal. (shrink)

Automated classification of legal documents has been the subject of extensive research in recent years. However, this is still a challenging task for long documents, since it is difficult for a model to identify the most relevant information for classification. In this paper, we propose a two-stage supervised learning approach for the classification of petitions, a type of legal document that requests a court order. The proposed approach is based on a word-level encoder–decoder Seq2Seq deep neural network, such as a (...) Bidirectional Long Short-Term Memory (BiLSTM) or a Bidirectional Encoder Representations from Transformers (BERT) model, and a document-level Support Vector Machine classifier. To address the challenges posed by the lengthy legal documents, the approach introduces a human-in-the-loop approach, whose task is to localize and tag relevant segments of text in the word-level training part, which dramatically reduces the dimension of the document classifier input vector. We performed experiments to validate our approach using a real-world dataset comprised of 270 intermediate petitions, which were carefully annotated by specialists from the 15th civil unit of the State of Alagoas, Brazil. Our results revealed that both BiLSTM and BERT-Convolutional Neural Networks variants achieved an accuracy of up to 95.49%, and also outperformed baseline classifiers based on the Term Frequency–Inverse Document Frequency test vectorizer. The proposed approach is currently being utilized to automate the aforementioned justice unit, thereby increasing its efficiency in handling repetitive tasks. (shrink)

O presente artigo objetiva, ao revisitar a obra Oratio de hominis dignitate composta pelo humanista renascentista Giovanni Pico Della Mirandola, um duplo intento: sustentar que as noções de dignidade e liberdade, presentes nessa obra, se distanciam do pensamento cristão tradicional, de modo crítico, justamente porque derivam de uma leitura filosófica da teologia cristã da criação; e mostrar que a conclusão a respeito da noção de liberdade apresentada por Sartre no pensamento contemporâneo pode ser encontrada de modo germinal, guardada as devidas (...) proporções, na leitura piquiana da criação. Para tanto, exporemos uma breve retomada do contexto histórico-filosófico que permitiu ao filósofo engendrar a Oratio bem como suas pretensões para com essa obra; falaremos, em um segundo momento, como o platonismo religioso de Marsílio Ficino, principal matriz teórica a partir do qual os conceitos de dignidade e de liberdade foram modulados, foi recebido e desenvolvido no pensamento de Pico; e como as influências e as rupturas com pensamento de Ficino e a leitura filosófica da teologia cristã da criação são importantes para recolocar os conceitos de dignidade e de liberdade, permitindo assim entrever, por meio deles, semelhanças com o pensamento satreano. O presente artigo é uma discussão sobre a noção heideggeriana de Überwindung. Seu objetivo é duplo: por um lado, [1] mostrar a perspectiva que tal termo deve ser compreendido; por outro, [2] aprofundar esta perspectiva à luz de comentários ao aforismo I do texto Überwindung der Metaphysik. Para tanto, duas questões são postas: em que perspectiva e que questões estão implícitas quando Heidegger propõe o projeto da Überwindung der Metaphysik?; e por que uma Überwindung contém em si tantos problemas? De (...) modo a discutir e comentar tais questões, o artigo percorre dois caminhos: [1] faz-se uma análise da própria indicação heideggeriana da perspectiva de compreensão da Überwindung der Metaphysik, qual seja, revisitar, a partir de um olhar determinado, a construção da noção de história do ser. Esta, por sua vez, tem sua gênese antes mesmo da própria Kehre. Mais especificadamente, na reinterpretação que o próprio Heidegger faz de seu texto Vom Wesen der Wahrheit. A partir desta reconsideração feita por Heidegger e inserida em seu próprio texto, é possível detectar quatro teses fulcrais que traçam essencialmente a metafísica e que justificam a sua superação. São elas: [a] o fato de o ser, originariamente, se velar e provocar, historialmente, o seu esquecimento; [b] a relação entre a verdade do ser e a história, que se desenvolve como história do ser; [c] a ideia de que pertence ao ser um caráter originário de retração de si mesmo e que essa retração é um destino que pertence à história do pensamento metafísico e se configura na própria essência da metafísica; [d] afirmar que a certeza da manifestação da essência coincide com o seu fim. [2] Adentra-se, mediante uma aproximação pari passu, no aforismo I do texto Überwindung der Metaphysik, com intuito de comentar a problematicidade do termo Überwindung quando usado para repensar a metafísica à luz da perspectiva da história do ser. BackgroundFor a long time, in sports, researchers have tried to understand an expert by comparing them with novices, raising the doubts if the visual search characteristics distinguish experts from novices. Therefore, the aim of the present study was to review and conduct a meta-analysis to evaluate the differences in visual search behavior between experts and novices in team sports athletes.MethodsThis systematic review with meta-analysis followed the PRISMA 2020 and Cochrane's guidelines. Healthy team athletes were included, which engaged in regular practice, (...) from any sex or competitive level, specifically classified a priori as expert or novice in the original research. We considered only research published in peer-reviewed journals, with no limitations regarding date or language. It was considered healthy team sport athletes engaged in regular practice. The scenarios could be in situ or film-based. The databases of EBSCO, PubMed, Scopus, SPORTDiscus, and Web of Science were used to perform the searches. The risk of bias was calculated through the RoBANS tool.ResultsFrom a total of 6,257 records, of which 985 were duplicates, titles and abstracts of 5,272 were screened, and 45 required full-text analysis. Of those, 23 were excluded due to not fulfilling the eligibility criteria regarding participants. In the end, 22 studies were selected, however, as two studies were part of the same trial and were analyzed conjointly.DiscussionExperts showed to be older and with more years of practice. The ability to distinguish experts from novices was not so clear regarding the variables analyzed. This could be due to the strategies chosen in each study, which were specific to each scenario, and when grouping all together, it was lost information within non-representative averages. The distinction between experts and novices was not clear, showing a lot of heterogeneity in the included studies. The expert classification itself may have been the conditioning aspect for these results, retaining the doubt and the need for more studies in the field.Systematic review registrationThe protocol was pre-registered in OSF. A potencialidade na filosofia da educação antiga e medieval 1 Resumo: O texto aborda a potencialidade, na filosofia da educação antiga e medieval, como a capacidade de aperfeiçoamento da razão. A noção de paideia conduz essa reflexão, uma vez que perpassa o pensamento educacional desde a antiguidade clássica até a baixa Idade Média. Essa continuidade explicita a tradição da formação integral do homem que considerava os aspectos morais e políticos como uma totalidade indissociável. O encaminhamento teórico segue a concepção de (...) História Social de Braudel (1902-1985), já que o foco é a compreensão da herança teológica e filosófica, que exprime os fundamentos da educação. Para refletir sobre esse legado do conhecimento, três momentos foram estudados: a paideia grega na perspectiva aristotélica e platônica; a patrística, por meio do entendimento de Clemente de Alexandria (150-215 d.C.) e de Agostinho de Hipona (354-430 d.C.); e a escolástica, analisada nas concepções de Hugo de São Vítor (1096-1141) e Tomás de Aquino (1225-1274). Assim, nos autores apresentados, há a permanência da compreensão de que o aperfeiçoamento da razão significava a transformação em ato da potência essencial do homem: a razão. A principal finalidade da educação, portanto, era a formação da consciência de cada pessoa, pois entendia-se que esse era o principal meio para o êxito da vida em comum. Potentiality in the philosophy of ancient and medieval education Abstract: The text addresses the potentiality, in the philosophy of ancient and medieval education, as the ability to improve reason. The notion of paideia guides this reflection since it pervades educational thought from classical antiquity to the low Middle Ages. This continuity explains the tradition of the integral formation of man which considered the moral and political aspects as an inseparable totality. The theoretical approach follows Braudel’s conception of Social History since the focus is on understanding the theological and philosophical heritage, which expresses the fundamentals of education. To reflect on this legacy of knowledge, three periods were studied: the Greek paideia in the Aristotelian and Platonic perspective; patristic, through the understanding of Clement of Alexandria and Augustine of Hippo; and scholasticism, analysed in the conceptions of Hugh of Saint Victor and Thomas Aquinas. Thus, there is a continuing understanding in the authors presented that the improvement of reason meant the actualization of man's essential potency: reason. The main purpose of education was the formation of the conscience of each person, as it was understood that this was the main means for the success of life in common. Neste artigo, ponderamos sobre a concepção educativa de Hugo de São Vítor exposta em sua obra pedagógica _Didascalicon de Studio Legendi _e temos como objetivo compreender o uso da leitura como meio de desenvolvimento do intelecto humano._ _Situados em um período de mudanças importantes para o ocidente medieval, os escritos do autor indicam, aos seus discípulos, os elementos fundamentais para se conquistar o bom estudo. Baseando-nos no conceito de longa duração, examinamos, neste trabalho, alguns aspectos educacionais-sociais importantes para a (...) formação humana contemporânea, já que a História Social nos faz compreender que presente e passado se interligam por meio de características que nos tornam humanos: a memória e os comportamentos que geram civilidade. Em nossa análise do texto, observamos que a _Sapientia_ é considerada, para o autor, como a meta principal da jornada de um estudante e, para ser possível alcançá-la, é necessário que se faça o uso adequado da Filosofia e da Ciência. Essas, por sua vez, quando amparadas pela memória, poderiam proporcionar redução do embrutecimento existente na sociedade e exercitar a amizade do ser humano com seu Criador. A escolha de um bom método de estudo e o uso da vontade também marcam esta concepção educativa medieval, que se destacou por promover a transição do modo de leitura monástico para o escolástico. _Didascalicon_ também é conhecido como um texto que transcendeu a cópia de conteúdo –– prática comum à época –– no qual seu autor expressa, de forma escrita, suas ideias (embebidas de influências agostinianas), e que busca instruir àqueles que procuram o caminho para alcançar a _Sapientia_ –– na qual habita a forma do bem perfeito. El presente libro se inicia con una breve reflexión sobre la actitud de los intelectuales en América Latina ante la coyuntura actual, señalando las aportaciones y confusiones de su dicurso teórico y tratando de rescatar las formas de expresión del pensamiento crítico; psra esto se considera la vigencia de la dialéctica como lenguaje. Además, se pretende incursionar sobre las relaciones entre individuos y colectivo, y sobre cuestiones metodológicas para el estudio de sujetos sociales; se incorporan el problema de análisis de (...) variables desde la perspectiva de las mediaciones, y una reflexión sobre la lógica del discurso económico para mostrar cómo implica el olvido del sujeto. Constituyen estos trabajos un esfuerzo de aplicación de la postura racional de nuevas posibilidades de reflexión teórica que contribuyan a enriquecer el discurso, aunque conscientes de su carácter todavía exploratorio. We compare fork arrow logic, an extension of arrow logic, and its natural first-order counterpart (the correspondence language) and show that both have the same expressive power. Arrow logic is a modal logic for reasoning about arrow structures, its expressive power is limited to a bounded fragment of first-order logic. Fork arrow logic is obtained by adding to arrow logic the fork modality (related to parallelism and synchronization). As a result, fork arrow logic attains the expressive power of its first-order (...) correspondence language, so both can express the same input-output behavior of processes. (shrink)

Kant’s dualism in anthropology and morality is said to be bridged only by means of a teleology that seems to betray the historical constitution of its subjectivity. And yet the Kantianarticulation of problems of theoretical and practical reason can be explored only insofar as they help us understand the correlated issues of the unity of reason, the relation of aesthetics and ethics in the light of the three Critiques, and the teleological conception of history. In this paper, I argue for (...) a teleological reading of the systematic architectonic so as to make sense of the concept of purposiveness as the a priori principle of judgment in its logical, aesthetic, and teleological reflection and of the unifying, a priori principles of each faculty–namely, conformity to law, final purpose, and conformity to purpose or purposiveness – respectively dealt with in the three Critiques. This collection of essays examines the ways in which disputes and controversies about the application of scientific knowledge are resolved. Four concrete examples of public controversy are considered in detail: the efficacy of Laetrile, the classification of homosexuality as a disease, the setting of safety standards in the workplace, and the utility of nuclear energy as a source of power. The text delivers a twofold analysis of negationism. On the one hand, it is taken as an ideological phenomenon characterized by a critique of modernity construed from the outside of its customary assumptions. On the other hand, an objective sort of negationism is found in the historical unfolding of the intrinsic limitations of modern socialization. These are brought forward by attention to the class content of the class character of the institutions regularly evoked by the apologetics of modernity – civil (...) society, science, the State. Progressivism, we suggest, the main target of negationism, is the tradition occupied with that apologetics, either promoting an intellectual critique of, or simply overlooking, the afore-mentioned class character, which, however, becomes historically undeniable to the common people, consistently victimized by it throughout modern history. Nursing research using concept analysis plays a critical role for knowledge development, particularly when concerning to broad and foundational concepts for nursing practice, such as dignity. This study aimed to synthesize research concerning concept analysis of dignity in nursing care. Based on a literature review, electronic databases were searched using the terms “dignity,” “human dignity,” “concept analysis,” and nurs*. Papers in Portuguese or English were included. The research synthesis was conducted independently by two reviewers. A total of 35 citations were (...) identified and seven papers were included. Six studies were elected using Walker and Avant concept analysis methodology while one applied the Beth Rodgers evolutionary model. The concept of dignity has been studied by nurses, and its attributes, antecedents, consequences, and similar concepts were synthesized into a definition. Dignity emerged as a fundamental concept in nursing ethics and the main attributes synthesized were personhood, sociability, respect, and autonomy. The antecedents identified were: facilitators—patient focus care, recognition, education, and ethical competence; threats—vulnerability and organizational environment. The consequences were positive coping, empowerment, and dignity preservation. The synthesis of these seven studies using concept analysis provided a clear definition of dignity. These findings challenge future research and education, particularly for the study of undergraduate and postgraduate nursing education programs to enhance skills for preserving patient dignity in clinical practice. Introduction: Motherese, or emotional infant directed speech, is the specific form of speech used by parents to address their infants. The prosody of IDS has affective properties, expresses caregiver involvement, is a marker of caregiver-infant interaction quality. IDS prosodic characteristics can be detected with automatic analysis. We aimed to explore whether pregnant women “speak” to their unborn baby, whether they use motherese while speaking and whether anxio-depressive or obstetrical status impacts speaking to the fetus.Participants and Methods: We conducted an observational (...) study of pregnant women with gestational ages from 26 to 38 weeks. Women were recruited in a university hospital department of obstetrics. Thirty-five women agreed to participate in the study, and 26 audio records were exploitable. We collected obstetrical and sociodemographic data, pregnancy outcomes, anxiety and depressive status using the Covy and Raskin Scales, and life events using the Sensations During Pregnancy and Life Event Questionnaire. Each participant was left alone with an audio recorder with a recommendation to feel free to speak to her fetus as she would have done at home. The recording was stopped after 3 min. Audio recordings were analyzed by two methods: psycholinguist experts' annotation and computational objective automatic analyses.Results: Most mothers reported speaking to their fetuses. We found a correlation between maternal first perceptions of fetal movements and the start of mother's speaking to fetus. Motherese prosody was detected with both annotation and automatic analysis with a significant correlation between the two methods. In this exploratory study, motherese use was not associated with maternal anxiodepressive or obstetrical status. However, the more future mothers were depressed, the less they spoke with their fetuses during the recording.Conclusion: Fetal directed speech can be detected during pregnancy, and it contains a period of prosody that shares the same characteristics of motherese that can be described as prenatal motherese or emotional fetal-directed speech. This means that pregnant women start using motherese much earlier than expected. FDS seems to be correlated with maternal first perceptions of fetal movements and depression scores. However, more research is needed to confirm these exploratory results. (shrink)

Nietzsche's impact on the world of culture, philosophy, and the arts is uncontested, but his political thought remains mired in controversy. By placing Nietzsche back in his late-nineteenth-century German context, Nietzsche's Great Politics moves away from the disputes surrounding Nietzsche's appropriation by the Nazis and challenges the use of the philosopher in postmodern democratic thought. Rather than starting with contemporary democratic theory or continental philosophy, Hugo Drochon argues that Nietzsche's political ideas must first be understood in light of Bismarck's (...) policies, in particular his "Great Politics," which transformed the international politics of the late nineteenth century. Nietzsche's Great Politics shows how Nietzsche made Bismarck's notion his own, enabling him to offer a vision of a unified European political order that was to serve as a counterbalance to both Britain and Russia. This order was to be led by a "good European" cultural elite whose goal would be to encourage the rebirth of Greek high culture. D'entrée de jeu, il situe assez clairement Taylor dans le vaste horizon de la philosophie morale contemporaine. Le texte pose bien l'originalité de la conception taylorienne de l'ontologie ; ses idées d'incarnations, d'engagement et la relation incontournable du moi. Sans complaisance, il montre le rôle central que joue cet horizon dans la philosophie morale taylorienne tout en exposant (...) les zones d'ombre où Taylor est moins clair ou moins explicite dans sa pensée. En illustrant clairement le lien entre l'horizon moral et l'identité d'une part, et celui entre les horizons et le dialogue interculturel d'autre part, le livre enrichit les analyses existantes sur le sujet. Il expose le dilemme taylorien entre contexte et universalisme. L'originalité de Taylor réside dans la manière dont il repose ce dilemme conservant en tension ces deux axes; orienter sa vie en fonction du bien nous oblige à naviguer entre deux eaux. La question du dialogue interculturel est naturellement incontournable dans le présent débat avec Taylor. Les considérations sur le "langage des contrastes" et le passage par les écrits de Raoul Fornet-Betancourt sont tout à fait pertinents. En effet, l'interculturalité ou le dialogue interculturel appelle un nouveau langage, mais les conditions de celui-ci? et son statut ontologique d'ailleurs ne sont pas clairement exprimées dans les écrits tayloriens. Et ils peuvent difficilement l'être, car cela demeure pour lui de l'ordre du mystère et du dévoilement. Internal misconduct is a universal problem in prisons and affects the maintenance of social order. Consequently, correctional institutions often develop rehabilitation programs to reduce the likelihood of inmates committing internal offenses and criminal recidivism after release. Therefore, it is necessary to identify the profile of each offender, both for the appropriate indication of a rehabilitation program and the level of internal security to which he must be submitted. In this context, this work aims to discover the most significant characteristics in (...) predicting inmate misconduct from ML methods and the SHAP approach. A database produced in 2004 through the Survey of Inmates in State and Federal Correctional Facilities in the United States of America was used, which provides nationally representative data on prisoners from state and federal facilities. The predictive model based on Random Forest performed the best, thus, we applied the SHAP to it. Overall, the results showed that features related to victimization, type of crime committed, age and age at first arrest, history of association with criminal groups, education, and drug and alcohol use are most relevant in predicting internal misconduct. Thus, it is expected to contribute to the prior classification of an inmate on time, to use programs and practices that aim to improve the lives of offenders, their reintegration into society, and consequently, the reduction of criminal recidivism. Vague notions, such as ‘generally’, ‘rarely’, ‘often’, ‘almost always’, ‘a meaningful subset of a whole’, ‘most’, etc., occur often in ordinary language and in some branches of science. We introduce modal logical systems, with generalized operators, for the precise treatment of assertions involving some versions of such vague notions. We examine modal logics, constructed in a modular fashion, with generalized operators corresponding to some versions of ‘generally’ and ‘rarely’.

The Belnap–Dunn logic is a well-known and well-studied four-valued logic, but until recently little has been known about its extensions, i.e. stronger logics in the same language, called super-Belnap logics here. We give an overview of several results on these logics which have been proved in recent works by Přenosil and Rivieccio. We present Hilbert-style axiomatizations, describe reduced matrix models, and give a description of the lattice of super-Belnap logics and its connections with graph theory. We adopt the point of (...) view ofAlgebraic Logic, exploring applications of the general theory of algebraization of logics to the super-Belnap family. In this respect we establish a number of new results, including a description of the algebraic counterparts, Leibniz filters, and strong versions of super-Belnap logics, as well as the classification of these logics within the Leibniz and Frege hierarchies. In the visual representation of ontologies, in particular of part-whole relationships, it is customary to use graph theory as the representational background. We claim here that the standard graph-based approach has a number of limitations, and we propose instead a new representation of part-whole structures for ontologies, and describe the results of experiments designed to show the effectiveness of this new proposal especially as concerns reduction of visual complexity. The proposal is developed to serve visualization of ontologies conformant to the (...) Basic Formal Ontology. But it can be used also for more general applications, particularly in the biomedical domain. (shrink)

In the graphical representation of ontologies, it is customary to use graph theory as the representational background. We claim here that the standard graph-based approach has a number of limitations. We focus here on a problem in the graph-based representation of ontologies in complex domains such as biomedical, engineering and manufacturing: lack of mereotopological representation. Based on such limitation, we proposed a diagrammatic way to represent an entity’s structure and various forms of mereotopological relationships between the entities.
