This paper is a critical and comparative legal historical study, which offers a global vision of the U.S. Legal System, according to the religious factor impact and its complex dimensions (e.g. religious liberty, Church-State relations, welfare state & solidarity). The principal goal is the deconstruction of the fake official History, elaborated after the Second World War (e.g. inferences, impostures, fallacies). At the same time, it shows the social development (and the kind of commitment in each period), and how it happens (...) the consolidation of the system thanks to the regulation. In this way, it is possible to pay attention to the American experimental evolution (not lineal or exceptional –as many U.S.hand-books pretend): from colonial Blue Laws (or Sunday regulation), up to the current regulation on freedom of religion and non-discrimination. Also, this paper offers a systematic set of diverse legal sources (e.g. Executive orders & rules, Legislative statutes, Judicial cases & resolutions). Another goal of this paper is the evaluation of the allegedly paradoxical policies and regulations in this field, during the last two Administrations (Clinton and W. Bush); both of them, from extreme views (linked at the end), they used incorrectly the religious factor, and they confused the institutions. The result seems to be a landed in the Postmodernity (less realistic and more speech based). (shrink)

El ensayo consta de tres partes: primera, un breve estudio histórico del surgimiento de las políticas radicales, con especial atención al papel político desempeñado en Europa a lo largo del siglo XVI por las revoluciones sociales inspiradas en el cristianismo reformado. Segunda, una lectura crítica de la secularización como paradigma de modernización que transformó a los dioses movilizadores del radicalismo político. Incluye un comentario del debate entre Karl Löwith y Hans Blumenberg en torno al surgimiento de una concepción moderna de (...) la temporalidad histórica y a la relación entre progreso y escatología. Y una tercera, un apunte filosófico sobre el desplazamiento semántico del término «extremismo» como síntoma del olvido posmoderno de lo político. Finalmente, el análisis histórico de las relaciones entre extremismos y desencantamiento se centra en la importancia que adquiere la ficción como figura del poder político. (shrink)

This is a critical-hermeneutical and historical-comparative study on Political Economy, Economic History and Social Thought, applied to the American utopias in the 19th century and its role in the colonisation of the United States (US) west. This review is based on a heterodox economic approach, used in the disciplines of Religion and Economics. It gives a general view of religious and ideological utopias, as cooperative enterprises of intentional life in farms and workshop, making a comparative analysis of efficiency and sustainability. (...) This study attempts to explain the colonial paradox of American utopias because the last established, with more inversion, they were the first to fall. This study shapes the development of the western territories, from the Quaker’s Holy Experiment framework and its support for the utopias experiments in the expansion to Ohio, Indiana and Illinois. Contribution: This review offers a descriptive and explanatory study on the colonisation of the US west, under the hermeneutical turn from heterodox economic approaches, to deal with some current contradictions and anachronism in the mainstream view. El presente trabajo se enmarca dentro de las reflexiones contemporáneas acerca de la interacción entre el teísmo y el ateísmo. La idea principal que se sostiene es la posibilidad y necesidad de conciliar armónicamente las nuevas visiones de la realidad generadas por los avances tecnocientíficos, los cambios sociales, y el lugar que hoy ocupan la religiosidad tradicional o institucional de índole trascendente y la espiritualidad inmanente producto del naturalismo filosófico. El objeto del trabajo es pues ahondar sucintamente en las causas, (...) fundamentos y problemáticas de la espiritualidad naturalizada. En este sentido, se pretende examinar las limitaciones y dificultades que presentan las increencias pretendidamente espirituales y antirreligiosas basadas en postulados inmanentistas y cientificistas. Se proyecta necesario y fecundo un esfuerzo en el diálogo y conocimiento recíproco por parte de la pluralidad de posiciones existentes, principalmente entre la espiritualidad trascendente y la naturalizada. This article explains the History (past reality), the Historiology (the theories and methods to study the past), and the Historiography (the academic literature) about Cross-Cultural Studies in the U.S.A., from traditional and native subjects (i.e. American Studies), until the current version. It pays attention to religion, as a relevant factor in the evolution of U.S. culture and its model of social relations. En este artículo se explica la Historia (la realidad pasada), la Historiología (las teorías y métodos con los que (...) se estudia dicho pasado), y la Historiografía (la literatura académica al respecto) de los estudios interculturales en los EE.UU., desde las primeras disciplinas tradicionales y nativistas (e.g. Estudios Estadounidenses), hasta los actuales estudios interculturales. Se presta especial atención al factor religioso, pues ha sido muy influyente en el devenir de la cultura estadounidense y en sus relaciones sociales. (shrink)

This essay is an interpretation of the work of Jean-Luc Godard: Histoire du cinéma. There are two main objectives of the text. First, to analyze audio-visual mediations on the political construction of memory. Therefore, I will study the way Jean-Luc Godard´s films articulate the cinematographic history of the Twentieth century, inspired by a central motif: the idea of failure and mourning. Secondly, I´d like to establish a dialogue between the ‘pathologies of memory’ – as reported by Godard in critical connection (...) with the mass-media comsuption regime – and the ‘policies’ of the images and montage, proposed by Walter Benjamin an his ‘dialectics of seeing’. El ensayo consta de tres partes: en la primera, se establece una breve genealogía de la afinidad entre el nacimiento de la Filosofía de la historia y la noción de Progreso. En la segunda, se extraen algunas consecuencias políticas del hecho de que la idea de Progreso se tradujera como pura aceleración del tiempo histórico. Finalmente, se problematiza la idea de la muerte del Tiempo en tanto efecto postmoderno de la aceleración del Progreso. Y se realiza una crítica a las (...) prácticas políticas que, tras la postmodernidad, volvieron a destacar las relaciones entre experiencia histórica y eficacia racional, sustituyendo los ideales emancipatorios ilustrados por meros ideales securitarios. Commentators believe that the COVID-19 pandemic reveals the inconveniences of capitalism and that the end of “neoliberalism” could be near. In this article we show that a capitalist ethics is capable to deal with the challenges of pandemics and comes with important advantages such as the prevention of overreactions. We apply both utilitarian and rights-based ethics to the case of epidemics in general and COVID-19 in particular. First a libertarian natural law ethics is used to assess the government interventions in (...) the Corona pandemic. We maintain that these interventions cannot be justified from a libertarian point of view despite of the possible objections that are discussed such as the “potential threat argument”. Moreover, the utilitarian argument in favor of government lockdowns is evaluated. The negative effects of lockdown on mental health, addictions, domestic violence, etc. have to be taken into account. The utilitarian argument in favor of lockdown is far from convincing, as economic calculation is not possible. (shrink)

This is a Political Economy study on migrants-citizens relations management in the United States of America, with special attention to the religious factor and the pendulum effect. There is a model switch, from integration policies to official persecution, under a high social opportunity cost. Also, there is a split between the State and civil society, causing civil disobedience and sanctuary network across the country. The paper focuses on the development of the Sanctuary Movement, as a case of popular action against (...) to the power elite policies and their sanctions. There was a revival of this movement during the values crisis or 2008 recession, but at the same time there was a critical division into the movement, with higher tension for the migrants. (shrink)

El profesor Juan Carlos Bayón ha sostenido que el positivismo incluyente resultaría inaceptable por apoyarse en la idea de una convención social de seguir criterios no convencionales: si hubiera acuerdo sobre el contenido de esos criterios, ellos resultarían convencionales, y sin acuerdo, no habría práctica social convergente y, por ende, no habría en realidad una regla convencional. Así, el positivismo incluyente quedaría enfrentado a un dilema: o bien resulta indistinguible del positivismo excluyente, o bien no es una postura convencionalista en (...) absoluto. Este trabajo evaluará la posibilidad de una salida al dilema. Para ello, se efectuará un análisis de las diversas versiones del positivismo incluyente y sus límites a la luz de la objeción planteada. También se intentará demostrar la viabilidad de un contraargumento centrado en los alcances de la tesis de la convencionalidad, que bloquearía la acusación de inconsistencia teórica esgrimida en su contra. Professor Juan Carlos Bayón has argued that Inclusive Legal Positivism should be rejected because its plausibility depends on the idea of a social convention to follow nonconventional criteria of validity. In his view, if there were agreement on the content of these criteria, it would be impossible to sustain its non-conventional character; and without agreement, there would not be a common social practice, and thus no social rule would exist. Therefore, Inclusive Positivism faces a dilemma: being indistinguishable from Exclusive Positivism or not being a genuine form of conventionalism at all. This article evaluates a possible way out of this dilemma. It explores the different versions of Inclusive Legal Positivism and its limits, and tries to build an opposing argument grounded on the scope of the conventionality thesis that would rescue Inclusive Legal Positivism from the accusation of theoretical inconsistency. Este trabajo analiza los aspectos más destacados de la polémica entre Juan Carlos Bayón y Eugenio Bulygin acerca de las lagunas jurídicas, el principio de prohibición y el alcance de la discreción judicial. En esta disputa, Bulygin defiende cuatro tesis centrales, enunciadas en Normative Systems : una cuidadosa distinción entre normas y proposiciones normativas es esencial para resolver el problema de las lagunas jurídicas, la versión débil del principio de prohibición no sirve para mostrar que no existen lagunas, la versión (...) fuerte del principio de prohibición es verdadera solo cuando el sistema es completo, y en casos de lagunas jurídicas, los jueces tienen discreción para resolver estas situaciones. Sin embargo, Bayón señala que el problema no es la falta de distinción entre normas y proposiciones normativas sino el desacuerdo acerca de cuándo una solución jurídica es concluyente. La diferencia entre soluciones prima facie y concluyente es esencial porque en ciertas situaciones, el derecho no da una respuesta pero tampoco deja espacio para la discrecionalidad judicial. Según Bayón, en estos casos el principio de prohibición "todo lo que no está prohibido está permitido" juega un papel fundamental. Este trabajo muestra que los argumentos de Bayón son insuficientes para rechazar las tesis clásicas defendidas por Bulygin. In this paper I analyze the most relevant aspects of the controversy between Juan Carlos Bayón and Eugenio Bulygin about the existence of legal gaps, the so called "principle of prohibition" and the scope of judicial discretion. In this debate, Bulygin defends four classical theses advanced in his wellknown book, Normative Systems : a careful distinction between norms and norm propositions is actually needed in order to solve the problem of legal gaps, the analytical truth of the weak version of the principle of prohibition cannot guarantee the completeness of legal systems, the strong version of the principle of prohibition is true only if legal systems are complete, and judges have discretion in cases of legal gaps. However, Bayón claims that the problem is not the lack of distinction between norms and norm proposition but rather the identification of conclusive legal solutions. Conclusive legal solutions must be distinguished from the prima facie solutions provided by explicitly enacted norms. According to Bayón, the difference between conclusive and prima facie solutions is essential in legally irrelevant cases; in such cases the principle of prohibition plays an essential role because it entails the rejection of judicial discretion. In this paper I claim that the arguments advanced by Bayón fail to provide a sound ground for discarding the classical theses defended by Bulygin. (shrink)
