El embrión humano en la legislación no tiene un estatus definido. En lo referente a su condición en los debates éticos, no se ha logrado un consenso entre la pluralidad de contiendas de las distintas corrientes bioéticas. Lo cierto es que, en la mayoría de las legislaciones y para eludir los debates éticos, los argumentos se basan sobre todo en datos científicos. Como resultado, la ética se limita al aspecto científico, aunque es importante recordar que la bioética no solo se (...) detiene en este aspecto o en el sociológico. En particular, el enfoque de la bioética personalista invita a considerar al ser humano, incluido el embrión, en su aspecto metaontológico. La visión personalista se basa en la noción de “persona” descrita por santo Tomás de Aquino. ¿Podría este enfoque dar respuestas a los dilemas éticos de nuestros días? Este artículo pretende responder a esta pregunta analizando el tema de la discontinuidad embrionaria y la unidad de la persona desde una reflexión meta-ontológica. (shrink)

La nueva ley de bioética en Francia, propuesta en 2019 y aprobada por la Asamblea Nacional el 29 de junio de 2021, introduce en su artículo primero, relativo a las Tecnologías de Reproducción Artificial (ART por sus siglas en inglés), modificaciones al artículo L. 2141-2 y L. 2141-3 de la ley número 2011-814 de 7 de julio de 2011 relativa a la bioética. Abre así el camino a “cualquier pareja formada por un hombre o una mujer o por dos mujeres (...) o cualquier mujer soltera”. Como resultado, se rompe el vínculo entre el derecho y la bioética. Mientras que el derecho debe proteger el interés individual, la bioética le recuerda al derecho que también debe protegerse el bien común. De ahí las siguientes interrogantes que surgen a raíz de esta nueva ley de bioética: ¿las ART son un derecho para todos? ¿Es legítimo reivindicarlo en nombre de la igualdad? ¿Qué pasa con la justicia? En este artículo me gustaría abordar el tema desde un punto de vista biojurídico, situando el problema en el marco de la filosofía del derecho. (shrink)

History works written in the style of chronicles are used not only for the purpose for which they were written. Chronic works may also contain reflections on the position of the ulema (ʿulamāʾ) at the time of its writing and his view of the scientific world of the period in which he lived. This work is based on the book ʿIqd al-jumān fī taʾrīkh ahl al-zamān written by the celebrated Ḥanafī jurist (faqīh) and muḥaddith Badr al-Dīn al-ʿAynī as a (...) public history book. This article, focuses on the state of ḥadīth science and scholars in the Mamlūks between the years 648-707 (1250-1307) and approaches of al-ʿAynī to these issues based on the work of ʿIqd al-jumān. For this purpose, the work has been examined in terms of certain keywords that allude to the history of ḥadīth through electronic sources. In addition, the work has been completely reviewed with the traditional method in terms of allusions and information about the hadith studies of the Mamlūks period. Eventually, the historical elements of ḥadīth referred to in ʿIqd al-jumān, scientific institutions, different groups of rāwī, different narration methods and classifications made during the period have been identified. In addition, the professional, sectarian and political trends of the muḥaddith of the period in question were focused on. Comparing the information in the sources written in the field of general history with the studies focusing directly on the historical elements of ḥadīth will contribute to compare the similarities and divergences. This study is an example of how to make use of the wafayāt sections in chronicle works. Examining a single book that was not written directly in the field of ḥadīth - even if it contains important information - is not enough to find elements about the history of ḥadīth and to make constructions regarding it. This necessitates the formation of a team that will examine a large number of books using the same criteria. (shrink)

The Tafsīr al-Muqātil (d. 150/767) is the oldest available complete commentary text. In this respect, it has been a focus of attention. In this tafsīr, the references to the Battle of Badr in the explanation of some Makkī surahs are remarkably numerous. Badr was the first war that the Prophet made with the polytheists of Makkah, and it took place in the second year of the migration to Madīna (A. H. 2). The polytheists were far superior to the (...) Muslims in terms of both equipment and numbers. Therefore, the success achieved in this expedition meant a lot not only in terms of survival but also in terms of morale of Muslims. Details of this war are included in Surah Anfāl, and various aspects of it are referred to in other Madanī surahs. It is not difficult to understand the mention of such an important war in Madanī surahs. However, the references to the Battle of Badr -which has not yet taken place- in the commentary of the Makkī surahs, are particularly challenging. In this tafsīr, 66 verses of various Makkī surahs are explained through the Battle of Badr. This study was carried out in order to reveal the background of the Badr references of the Makkī surahs in Muqātil tafsīr. Muqātil stands out in the Hadith in terms of reliability, and in the Kalām as a widely discussed personality with his various views. Although he has been criticized from various aspects of his Tafsīr, it is generally considered a great authority. His work is easy to understand; it combines narration and insight. The similar of every possible verse has been given. The author's mastering at the Arabic language showed itself in the words of the Qur’ān. Almost no words remained unexplained. Muqātil is closely related to the Arabic language that had been in effect in the era of revelation, and he generally carried out his tafsīr activities by considering the era of revelation. In Muqātil's view of tafsīr, no verse is independent from the experiences of the period, and each verse gains meaning with its context. In his tafsīr, Muqātil draws a view of Badr without alternatives. While other tafsīrs include other achievements of Muslims in addition to Badr, such as the victory of the Battle of the Ditch and the conquest of Makkah, in the tafsīr of Muqātil the difference of Badr as the biggest blow against the polytheists of Makkah is clearly stated. It may not be very convincing to explain his insistence on Badr as random touches and sometimes anachronistic mistakes, given his skill in tafsīr and his command of the Qur’ān in terms of both content and language. Badr stands as a conscious choice, not a mistake in Muqātil. As it can be seen in examining the verses, the forward-looking statements present in the majority of the verses; this emphasis also prepared the ground for Muqātil's explanations. In any case, Muqātil sometimes did not care about falling into historical inconsistency. If we exclude these 5 verses, which can be explained with Badr although they are Makkī, the attitudes of other commentators regarding the emphasis of Badr in the Makkī verses in the remaining 61 verses are as follows: al-Ṭabarī (d.310/923) included the views pointing to Badr in only 3 of the 61 verses in his tafsīr. This shows us that the emphasis of Badr in the Makkī verses was not generally adopted by other early commentators except Muqātil. Because in al-Ṭabarī's tafsīr, the views on tafsīr from the era of Aṣ-ṣaḥābah (the Companions), Tābiʿūn (the second generation following the Companions) and Tābiʿū al-Tābʿīn (the third generation) are mentioned together with isnad (the chain of reporters), except for Muqātil and al-Kalbī. al-Zad̲j̲d̲j̲ād̲j̲ (d. 311/923), who was contemporary of Ṭabarī, included Badr in only two of the 61 verses in his philological tafsīr. In other words, al-Zad̲j̲d̲j̲ād̲j̲ is on a very different line from Muqātil regarding Badr. al-Māturīdī (d. 330/944) included Badr among other explanations in only 4 of the 61 verses in his tafsīr, and did not mention Muqātil's view even among the possible meanings of the other verses. al-Rāzī (d. 606/1210) included Badr in 10 of 61 verses among other explanations. In the remaining 51 verses, he did not find it necessary to mention Muqātil's view along with other possibilities. Apparently, al-Rāzī, like others, did not consider Muqātil's explanations reasonable. Nevertheless, Razi was the commentator who gave greater place to the Badr emphasis of Muqātil in his tafsīr. In this case, how can the passion for Badr, seen in the Muqātil tafsīr, be explained? We think it would be correct to seek the reasons of Muqātil's -sometimes reasonable, sometimes inappropriate, and sometimes anachronistic- explanations of Badr in the importance he gave to this expedition and in the method of relying on concrete data in the interpretation of the Qur’ānic verses. In his view of tafsīr, no verse is independent of the experiences of the period. (shrink)

The subject of this study is the naḳīḍa (opposing) type of poetry competitions between the Meccan poet Ḍirār b. al-Khaṭṭāb (d. 12/633) and the Muslim poet Kaʿb b. Mālik (d. 50/670) from Medina during the Battle of Badr, when the Muslims and the polytheists confronted for the first time. The problem is the questioning of the approaches reflected in the naḳīḍa poems, which were used as a means of propaganda and psychological superiority by the Muslims and polytheists during the (...) Battle of Badr. Naḳīḍa poems, the subject of the study, are important for getting to know the two opposite understandings closely and forming an opinion about the naḳīḍa poems sung during the era of the Prophet Muhammad. Although there are some recent studies on naḳīḍa poems from the era of the Prophet, these studies lacked details and only mentioned general features. The interesting approaches and fine details reflected in the verses, such as Ḍirār b. al-Khaṭṭāb's claims aiming to distract attention and discredit the Muslims of Medina in the face of the unexpected defeat of the Meccan army at Badr that the Battle of Badr was a tribal war between the Meccans and the Medinans, makes this study prominent. On the other hand, Kaʿb b. Mālik's verses reflect the approaches bearing traces of the Islamic faith and draw attention to the fact that the battle was between faith and unbelief and the Muslims of Medina were proud of their support for the Messenger of Allah. Undoubtedly, Meccan immigrants participated in the Battle of Badr along with the Muslims of Medina. Even so, Kaʿb b. Mālik does not mention Muhājirs (immigrants) in his verses. This suggests that Kaʿb b. Mālik may have concentrated on responding to the allegations made by Ḍirār b. al-Khaṭṭāb. Document analysis, one of the qualitative method techniques, was used in the study. First, a literature review was conducted to better understand the subject, and the studies related to the field were briefly mentioned. Then, summary information about the concept and background of naḳīḍa is provided. Two call-and-response poems between the Jāhiliyyah period poet Imruʾ al-Qays (d. 545) and ʿAbīd b. al-Abraṣ (d. 555) are included as an example for the first phases of naḳīḍa poems. Then, brief information about the Meccan poet Ḍirār b. al-Khaṭṭāb and the Medinan poet Kaʿb b. Mālik are presented. After the background information, two naḳīḍa poems of both poets were examined and analyzed, and the differences in the Battle of Badr were pointed out. Concepts that are common in the eulogies of the Jāhiliyyah period, such as nobility, being a master warrior, and generosity, draw attention in Ḍirār b. al-Khaṭṭāb's verses. On the other hand, in his verses Ka'b b. Mālik uses terms and expressions brought by Islam such as the Messenger of Allah, there is no Lord but Allah, unbelievers, Hell, and hellfire. In the verses of both poets, there are clues about the commonly used battle orders and war equipment of the period. The opinions are summarised in the conclusion part of the study. (shrink)

This paper deals with the application of the metabolic control theory, especially the measurement of control coefficients, to the threonine pathway inE. coli. The control coefficient of a step on a metabolic flux quantitatively assesses the flux response to the step variations. This concept is particularly relevant both in pathological situations (decrease in the activity of an enzymatic step in the metabolism) and in biotechnologies, where, on the contrary steps are amplified.Measurement of the control coefficients of the steps of a (...) metabolic network makes it possible to know those whose amplification should lead to a simultaneous increase in the fluxes. Cognitive control is not only componential, but those components may interact in complicated ways in the service of cognitive control tasks. This complexity poses a challenge for developing an ontological description, because the mapping may not be direct between our task descriptions and true component differences reflected in indicators. To illustrate this point, I discuss two examples: (a) the relationship between adaptive gating and working memory and (b) the recent evidence for a control hierarchy. From these examples, I argue that (...) an ontological program must simultaneously seek to identify component processes and their interactions within a broader processing architecture. (shrink)

The law of responsibility (compensation), which was formed around the concept of the ḍamān and was developed by the scholars within the system of furû‘ al-fiqh (substantive law) over time, constitutes one of the important parts of Islamic law. Although compensation law (ḍamān) was not addressed as a private subject in the first period fiqh literature, it is seen that the literature on this specific area started to emerge after the early period. It is the Hanafi jurists who first brought (...) together these issues that are scattered in the classical books of fiqh that are related to the law of responsibility. Compensation law took its classical form in the texts of the early periods and was shaped around the views of the founding imams of the Ḥanafī school (madhab). It has later been expanded with the fatwā and interpretations of the Sheikhs (mesāikh) of Hanafi in the type of waqi'at works. These works were a product of the need for the law to adapt to the new conditions. These issues, which are related to the compensation law in the Hanafi school have been covered as a special section (chapter) in the studies that are classified as waqi'at, such as Usrūshanī’s al-Fuṣūl fī al-muʿāmalat (Fuṣūl al-Usrūshanī), ʿImād al-Dīn al-Marginānī’s Fuṣūl al-iḥkām fī uṣūl al-aḥkām and Shaykh Badr al-Dīn’s Jāmiʿal-Fuṣūlāyn. Later, the topics discussed in these works were developed and continued, and ultimately separate works related to this field have been copyrighted. In this study, the kinds of development and expansion which are in the literature and related subjects will be discussed by examining the above-mentioned works. Therefore; first of all, the first examples of Hanafi jurists related the compensation will be analysed comparatively. Afterwards, the place of ad-Ḍamānāt fī al-furūʻ al-Ḥanafīyyah of Fuḍayl Chalābī (d. 991/1583), one of the Zenbillizade’s, will be addressed.Summary: The core idea of the law of responsibility, which constitutes one of the important parts of Islamic law, was stated in the Qur'an and Hadith, and then have accumulated by the contributions of the jurists (fuqaha), as they developed the idea of the law of responsibility within the furû‘ al-fiqh in relation to the systematic of the legal school (madhab) that they belonged to.These issues, which constitute one of the important parts of the law, were addressed by sprinkling among the topics in almost every part of classical fiqh books. In other words, the subject of ḍamān (responsibility) was not considered as a separate subject in the fiqh works of the first period. In this way, it is seen that the literature on compensation law started to emerge in the following periods, and at first several independent sections on this subject, and then separate works specific to this field, albeit limited in number, were written.It is the Ḥanafī jurists who first brought together these issues that are scattered in the classical fiqh books related to the law of responsibility. Compensation law, which took its classical form in the texts from early periods, shaped around the views of the pioneering imams of the Ḥanafī school, has been expanded with the fatwā and interpretations of the Sheikhs (mesāikh) of Ḥanafī in the waqi'at works, which is a product of the need for the law to adapt to new conditions. Firstly, one of the Ḥanafī jurists, Majd al-Dīn al-Usrūshanī (d. 637/1240) dealt with the responsibilities arising from the contract and unfair acts in the 29th section of his book named al-Fuṣūl fī al-muʿāmalat under the title “Types of Compensation Required to be Paid and Their Situation”. The method and system that Usrūshanī started in this work, the Ḥanafī jurisits ʿImād al-Dīn al-Marginānī in the Fuṣūl al-iḥkām fī uṣūl al-aḥkām and Shaykh Badr al-Dīn Ibn Qāḍī Samāwnā in the Jāmiʿ al-Fuṣūlāyn continued to develop the compensation section in their books. Afterwards Fuḍayl Chalābī (d. 991/1583), one of the members of Zenbillizade’s family, enriched these issues and made it an individual work, named ad-Ḍamānāt fī al-furūʻ al-Ḥanafīyyah. Marginānī titled the issues that Usrūshanī had handled in the compensation section and systemised it even more by gathering the fatwās on the related issues under one heading. It is noteworthy to mention that when the compensation sections of both works are compared, the way the subjects handled are exactly the same. But unlike Usrūshanī, Marginānī added the compensation for damages to the fetus in the womb and the responsibility of the person who brought back the fleeing slave at the end of the chapter. On the other hand, unlike them, Shaykh Badr al-Dīn added only the responsibility of the person who found the lost item. Considering that almost all of the topics in the compensation section of Sheikh Badr al-Dīn existed exactly in the compensation section of Marginānī, and that most of them were stated in Usrūshanī’s al-Fuṣūl, it is necessary to say that all of these discussions are based on Usrūshanī as the main backbone of this particular subject and that his work has a unique place in the Islamic legal literature. Chalābī’s ad-Ḍamānāt, is the first work that was written as a separate book in the field of compensation law. Even though in some modern works claim that the work Ghānim al-Baghdādī’s (d. 1030/1620) book named Majma‘ al-ḍamānāt fī madhhab al-Imām al-A'zam Abī Ḥanīfa al-Nu'mān was the first written book in this field; it is known that Chalābī's ad-Ḍamānāt had been written before Baghdādī’s Majma‘ al-ḍamānāt. As a matter of fact, the work of Chalābī had been completed in 984 Hijra, and the Baghdādī’s Majma‘ al-ḍamānāt was completed in 1027 Hijra. Although the subject sequence in Baghdādī’s work is different; this work is regarded as a continuation of the same tradition.An examination of the systematic and the content of the work reveals that Chalabi’s ad-Ḍamānāt is the continuation of the type of writing that Usrūshanī started and developed by Marginānī and Shaykh Badr al-Dīn. When compared with the compensation sections of these works before him, Chalābī has added new compensation issues to his book that are not addressed in these three works; such as partnership, mudaraba, suretyship (kafāla) transfer (ḥawāla), peace, legal disability (hajr), freedom of trade (idhn) and testament. Among the works mentioned above, works out of Shaykh Badr al-Dīn’s Jāmiʿ al-Fuṣūlāyn and Baghdādī’s Majma‘ al-ḍamānāt are available as manuscripts in the libraries. Therefore, these works have not been used much in modern studies on compensation. In addition, the Chalābī's ad-Ḍamānāt is almost unknown. Although there is little information about this work in some bibliographic studies, it is noteworthy to state that this work is not used as a source in contemporary studies written in Arabic on compensation law. The fact that this work is available as manuscripts in Istanbul libraries is probably the reason for this outcome. It is also very difficult to say that this work is known and used sufficiently in studies written in Turkish.Usrūshanī’s al-Fuṣūl fī al-muʿāmalat and Marginānī’s Fuṣūl al-iḥkām are currently in the form of manuscripts, so there is no comprehensive study on the whole work and the compensation section. It is possible to see the compensation issues discussed in the work, since Shaykh Badr al-Dīn’s Jāmiʿ al-Fuṣūlāyn, which has been published as printed, was translated into Turkish by an editorial group under the presidency of H. Yunus Apaydın. In addition, Kemal Yıldız, who translated the compensation section in this translation, published this section in Jāmiʿal-Fuṣūlāyn as a separate book with the name of “Sources of the Jāmiʿ al-Fuṣūlāyn and Compensation in the Practice of Ḥanafī School”. Yıldız, first introduced the sources of the Jāmiʿ al-Fuṣūlāyn in the first part of this work and then translated the compensation section from beginning to end by adding his own explanations and evaluations around the subject during the second part. Even though some introductory information about the books of Usrūshanī and Marginānī is presented in Yıldız’s study, the absence of information on the contents of the compensation sections of these books does not allow the opportunity for the researchers to evaluate on the subject wholly. O objetivo dessa pesquisa foi investigar a contribuição de Santo Agostinho para o desenvolvimento da Hermenêutica Jurídica, com a compreensão da influência de sobra obra no pensamento jurídico contemporâneo. Desde aspectos biográficos, foram explorados os principais conceitos do pensamento de Santo Agostinho, a partir do diálogo que esses conceitos realizam com a contemporaneidade e com a hermenêutica moderna. A pesquisa foi realizada a partir do método hipotético-dedutivo, a partir da formulação de hipóteses gerais que permitem a obtenção de respostas potencialmente (...) válidas. Quanto aos meios, a pesquisa foi bibliográfica, com o uso da doutrina delimitada ao tema, para o cumprimento dos fins qualitativos. Chegou-se à conclusão de que a obra de Santo Agostinho mantém a sua relevância na temática da hermenêutica, com a aplicação de vários de seus conceitos no campo de atuação e análise da Hermenêutica Jurídica. The objective of this work is to propose ten efficient scaling techniques for the Wisconsin Diagnosis Breast Cancer dataset using the support vector machine. These scaling techniques are efficient for the linear programming approach. SVM with proposed scaling techniques was applied on the WDBC dataset. The scaling techniques are, namely, arithmetic mean, de Buchet for three cases p = 1,2, and ∞, equilibration, geometric mean, IBM MPSX, and Lp-norm for three cases p = 1,2, and ∞. The experimental results show (...) that the equilibration scaling technique overcomes the benchmark normalization scaling technique used in many commercial solvers. Finally, the experimental results also show the effectiveness of the grid search technique which gets the optimal parameters for the SVM classifier. (shrink)

What nonsense might be, and what Wittgenstein thought that nonsense might be, are two of the central questions in the current debate between those—such as Cora Diamond, James Conant and Michael Kremer—who favour a “resolute” approach to Wittgenstein’s work, and those—such as P. M. S. Hacker and Hans-Johann Glock—who instead favour a more “traditional” approach. What answer we give to these questions will determine the nature and force of his criticisms of traditional philosophy, and so the very shape Wittgenstein’s work (...) has for us, as well as, to some extent, what the lesson of the Tractatus might be. My aim in this paper is to provide a detailed defence of the austere view of nonsense, that lies at the heart of the resolute approach, against a range of influentialcriticisms developed by Hans-Johann Glock and which focus on Wittgenstein’s contextualism. In so doing, I hope also to shed some light on the kind of view the austere view is, as well as how it might relate to certain other crucial aspects of Wittgenstein’s thought. (shrink)

We used functional magnetic resonance imaging to examine the interactive effects of perceived competence and task interest on the cognitive and affective responses to negative feedback. Twenty-four undergraduates performed both interesting and uninteresting tasks and received failure feedback. The participants’ perceived competence in the task was manipulated between subjects prior to scanning with bogus feedback. The results showed that negative feedback processing was contingent upon both perceived competence and task interest. The most adaptive coping mechanism, indicated by activation in the (...) cognitive control network and attenuation in the negative affect region, was identified for the high-competence and high-interest combination. When either competence or interest was low, signals in the cognitive control network were weaker. The most detrimental activation patterns were observed for the combination of low-competence and high interest. Our results reveal the combination of task and learner characteristics that best harnesses the potential benefits of negative feedback and illustrate the neuroscientific mechanisms underlying this observation. If, as the title of this book suggests, the state of Tractatus commentary has at times recently resembled something close to a state of war, then it has most of all resembled a war of attrition. Against this background, Roger White's "Throwing the Baby Out with the Ladder" makes for refreshing reading. To be sure, White repeats some of the familiar misconceptions of what resolute readers do or must claim that have marred the debate over the adequacies or inadequacies of (...) such an approach to the Tractatus (TLP). But he also introduces some novel and interesting lines of criticism that merit serious attention. Foremost among the latter is White's treatment (in Section III of his paper) of three engaging examples that he sees as making trouble for resolute readers, and for their opposition to the standard idea that the lesson of the Tractatrrs could consist in its communicating, and our grasping, ineffable insights by way of its nonsense-sentences. We tend to take for granted that we know what is involved in belief in other minds, and that the real problem lies in justifying that belief. By contrast, this chapter argues that we misunderstand what belief in other minds involves, and that the problem of other minds has its source in that misunderstanding. My aim is to rethink what belief in other minds involves in terms of what Wittgenstein calls ‘an attitude towards a soul’. Doing so not only undermines (...) the problem of other minds as traditionally formulated, but also has significant consequences for our understanding of the mind itself. One such consequence is that ethical considerations have a much more fundamental role to play in thinking about the mind than is typically believed. (shrink)

Can we perceive others' mental states? Wittgenstein is often claimed to hold, like some phenomenologists, that we can. The view thus attributed to Wittgenstein is a view about the correct explanation of mindreading: He is taken to be answering a question about the kind of process mindreading involves. But although Wittgenstein claims we see others' emotions, he denies that he is thereby making any claim about that underlying process and, moreover, denies that any underlying process could have the significance it (...) is claimed to have for this debate. For Wittgenstein, the question is not “Is this perception?” but “What do we mean by ‘perception' here?” and that question is answered by investigating the grammar of the relevant concepts. That investigation, however, reveals similarities and differences between what we call “perception” here and elsewhere. Hence, Wittgenstein's answer to the question “Can we perceive others' mental states?” is yes and no: Both responses can be justified by appeal to different concepts of perception. Wittgenstein, then, has much to contribute to our understanding of mindreading, but what he has to contribute is nothing like the view typically attributed to him here. (shrink)

Central to a new, or 'resolute', reading of Wittgenstein's Tractatus Logico- Philosophicus is the idea that Wittgenstein held there an 'austere' view of nonsense: the view, that is, that nonsense is only ever a matter of our failure to give words a meaning, and so that there are no logically distinct kinds of nonsense. Resolute readers tend not only to ascribe such a view to Wittgenstein, but also to subscribe to it themselves; and it is also a feature of some (...) readings which in other respects are clearly not Resolute. This paper forms part of a reply to Hans-Johann Glock's work in which he argues (in part) that Wittgenstein in the Tractatus held a view of nonsense other than the austere view. Instead, Glock argues, Wittgenstein there held that there are many logically distinct kinds of nonsense. Here, I outline and defend the austere view, together with its attribution to the early Wittgenstein, against a number of Glock's criticisms, and focussing especially on Wittgenstein's reformulation in the Tractatus of Frege's context-principle. Abstract - The aim of the study is to identify the degree of administrative transparency in the Palestinian higher educational institutions in the Gaza Strip. In the study, the researchers adopted a descriptive and analytical method. The research population consisted of administrative staff, whether academic or administrative, except for those in senior management or the university council. The study population reached 392 employees. A random sample was selected (197). The number of questionnaires recovered was (160) with a recovery rate of (...) (81.2%). The researchers used a questionnaire for the data collection and were treated using SPSS to obtain the results. The results show that there is no significant difference between male responses and female responses due to gender variable. The results also confirm that there is no significant difference between respondents' responses due to the age variable. The results also showed a significant difference between respondents' responses attributed to the university variable. There is a fundamental difference between respondents' responses attributed to the scientifically qualified variable. The results also confirmed a significant difference between respondents' responses attributed to the management level variable. The results also confirmed a significant difference between respondents' responses due to variable years of service. The research reached a number of recommendations, the most important of which is: The necessity of Palestinian universities to adhere to the application of transparency standards in all university activities. The need to benefit from regional and international experience in the application of transparency systems within universities and to examine the possibility of applying these systems in our universities. As well as the need to engage in the program of teaching transparency in universities, as it is confirmed that only five universities participated in this experiment. The importance of raising awareness among the employees of Palestinian universities to clarify the foundations of building transparency and its dimensions to represent the active supporter through workshops and seminars. This paper is about what might be called the philosophical tradition of ethics, and Wittgenstein’s opposition or hostility to that tradition. My aim will be to argue that ethics, or a large part of what we think of as ethics, is nonsense, and in doing so I shall be developing the line of argument that I take to lie behind Wittgenstein’s claim in the Tractatus Logico-Philosophicus that there can be no ethical propositions. That argument has its basis in the simple (...) thought that value is not arbitrary or accidental, and what I shall show is how thinking through what is involved in that thought leads to a radically different conception of the possibilities open to ethical thinking than that which is assumed within the prevailing conception of ethics today. What are the limits of the imagination in morality? What role does fiction play in moral thought? My starting point in addressing these questions is Tamar Szabo Gendler's ‘puzzle of imaginative resistance’, the problem of explaining the special difficulties we seem to encounter in imagining to be right what we take to be morally wrong in fiction, and Gendler's claim that those difficulties are due to our unwillingness to imagine these things, rather than our inability to imagine what is logically (...) or conceptually impossible. Using a wide range of examples, I argue that there is no puzzle of imaginative resistance and that to think that there is such a puzzle is to miss almost entirely the role fiction plays in moral thought. That, however, does not mean that there are no limits to what we can imagine in morality. In fact, I argue, the imagination is limited in morality, as elsewhere, by what is logically or conceptually possible. Together, those claims suggest that fiction and the imagination play a fundamental role in shaping our conception of the moral landscape. The paper concludes by drawing some of the consequences of these views for the nature of moral thought. (shrink)

Suppose one is persuaded of the merits of noncognitivism in ethics but not those of expressivism: in such a case, a form of moral fictionalism, combining a descriptivist account of moral sentences with a noncognitivist account of the attitudes involved in their acceptance or rejection, might seem an attractive alternative. This paper argues against the use of moral fictionalism as a strategy for defending noncognitivism in ethics. It argues, first, that the view is implausible as it stands and, second, that (...) it does not enjoy the benefits over standard—expressivist—noncognitivism both that it claims to enjoy and that make up the principal rationale for the view. The paper then turns to the grounds for noncognitivism itself before showing how far the criticisms developed extend to alternative forms of moral fictionalism and developing independent objections to each. Two views are central to ‘New’ or ‘Resolute’ readings of Wittgenstein’s Tractatus: that Wittgenstein did not hold that some insights are ineffable; and that Wittgenstein did hold an austere view of nonsense . Adrian Moore, in his paper ‘Ineffability and Nonsense’, offers an argument that seems to show that austerity in fact involves a commitment to the existence of ineffable understanding, and so that Resolute readers cannot hold both and . Hence, Resolute readers would have to give up one or (...) other core commitment. Neither option is attractive. Against Moore’s argument, I show that austerity does not involve commitment to ineffable understanding. (shrink)

This paper argues that Wittgenstein holds that ethical propositions are nonsense, in that they lack any meaning whatsoever, that they are redundant, in that the work they are intended to do is already being done by other features of our language, and that they are harmful, insofar as they prevent us from appreciating what is of genuine ethical significance in our lives. Its aim is to outline a sense in which Wittgenstein can be seen to be trying, through the elimination (...) of “ethical propositions”, to reconnect us with the ethical commitments embodied in our ordinary “non-ethical” language, and so the ways in which ordinary language might be taken to be ethically revealing.
