This article argues that Schmitt’s concept of sovereignty and Gramsci’s notion of hegemony represent two distinct variations on a single theme, namely the idea of the political as the original instituting moment of society. Both Schmitt and Gramsci focused on the sources, conditions, content, and scope of the originating power of a collective will. While the former located it in the constituent power of the sovereign people, the latter placed it in the popular-national will of the modern hegemon. Both thinkers (...) explored the complex and perplexing relationship between radical founding acts and modern democratic politics in a secular age, that is of democratic legitimacy, where with the entrance of the masses into the political sphere, the references to ultimate foundation s of authority and to an extra-social source of political power had begun to appear more dubious than ever. The last section of the article develops a notion of hegemonic sovereignty defined as an expansive and positing democratic constituent prince, aiming, through founding, total decisions, at the overall, radical, explicit, and lucid institution of society. The article briefly shows how the concept of hegemonic sovereignty can solve some problems pertaining to Schmitt’s notion of sovereignty and to Gramsci’s theory of hegemony. In so doing, the article seeks to establish the mutually reinforcing qualities of the two concepts. (shrink)

This short article will seek to explore the causes, and possible solutions, of what seems to be the current freezing of the Turkish constitution-making process that has had some dramatic successes in the 1990s and early 2000s. I make the strong claim that democratic legitimacy or constituent authority should not be reduced either to any mode of power, even popular power, or to mere legality. It is these types of reduction that I find especially troubling in recent Turkish constitutional struggles, (...) where the legal claims of two powers — the government-controlled legislative and the judicial branches — to structure the constitution are not backed by sufficient political legitimacy. In effect these two powers that claim their constituent authorization, rather implausibly in my view, from either the democratic electorate or from an original constituent power, because of their conflict threaten to freeze the constitution-making process that very much needs to be continued and concluded. I end the article by making a suggestion for one possible constitution-making procedure that would be both legitimate and legal. (shrink)

The work of Giorgio Agamben, one of Italy's most important and original philosophers, has been based on an uncommon erudition in classical traditions of philosophy and rhetoric, the grammarians of late antiquity, Christian theology, and modern philosophy. Recently, Agamben has begun to direct his thinking to the constitution of the social and to some concrete, ethico-political conclusions concerning the state of society today, and the place of the individual within it. In Homo Sacer, Agamben aims to connect the problem of (...) pure possibility, potentiality, and power with the problem of political and social ethics in a context where the latter has lost its previous religious, metaphysical, and cultural grounding. Taking his cue from Foucault's fragmentary analysis of biopolitics, Agamben probes with great breadth, intensity, and acuteness the covert or implicit presence of an idea of biopolitics in the history of traditional political theory. He argues that from the earliest treatises of political theory, notably in Aristotle's notion of man as a political animal, and throughout the history of Western thinking about sovereignty, a notion of sovereignty as power over "life" is implicit. The reason it remains merely implicit has to do, according to Agamben, with the way the sacred, or the idea of sacrality, becomes indissociable from the idea of sovereignty. Drawing upon Carl Schmitt's idea of the sovereign's status as the exception to the rules he safeguards, and on anthropological research that reveals the close interlinking of the sacred and the taboo, Agamben defines the sacred person as one who can be killed and yet not sacrificed—a paradox he sees as operative in the status of the modern individual living in a system that exerts control over the collective "naked life" of all individuals. Being concerned with representation, this book is about an idea, a concept, a word. It is primarily a conceptual analysis, not a historical study of the way in which representative government has evolved, nor yet an empirical investigation of the behavior of contemporary representatives or the expectations voters have about them. Yet, although the book is about a word, it is not about mere words, not merely about words. For the social philosopher, for the social scientist, words are not "mere"; (...) they are the tools of his trade and a vital part of his subject matter. Since human beings are not merely political animals but also language-using animals, their behavior is shaped by their ideas. What they do and how they do it depends upon how they see themselves and their world, and this in turn depends upon the concepts through which they see. Learning what "representation" means and learning how to represent are intimately connected. But even beyond this, the social theorist sees the world through a network of concepts. Our words define and delimit our world in important ways, and this is particularly true of the world of human and social things. For a zoologist may capture a rare specimen and simply observe it; but who can capture an instance of representation (or of power, or of interest)? Such things, too, can be observed, but the observation always presupposes at least a rudimentary conception of what representation (or power, or interest) is, what counts as representation, where it leaves off and some other phenomenon begins. Questions about what representation is, or is like, are not fully separable from the question of what "representation" means. This book approaches the former questions by way of the latter. (shrink)

This article examines the meaning and significance of the concept of constituent power in constitutional thought by showing how it acts as a boundary concept with respect to three types of legal thought: normativism, decisionism and relationalism. The concept can be fully appreciated, it suggests, only by adopting a relationalist method. This relationalist method permits us to deal with the paradoxical aspects of constitutional founding creatively and to grasp how constituent power, as the generative aspect of the political power relationship, (...) works not only at founding moments but also within the dynamics of constitutional development. Relationalism realizes this ambition by exposing the tension between unity and hierarchy in constitutional foundation and the tension between the people-as-one and the people-as-the governed in the course of constitutional development. The resurgence of religious movements all over the world, their varying claims to identity and politics, and their success in generating system-transforming effects in both national and world politics have indicated clearly that there is a need to uncover the invisible interconnections between religion and politics. Moreover, the way in which religion has been striking back has taken different forms. From religious and terrorist fundamentalism to multiculturalism, from communitarian claims to the religious state to religion-based civil societal calls for pluralism (...) and freedom, it is possible to see different articulations of the resurgence of religion in the world in which we live. In this context, Turkey constitutes a sociologically illuminating, theoretically challenging and politically timely case study. As a modern republic on the margins of Europe and preparing for accession negotiations with the European Union for full membership, Turkey is both a Muslim society and a strictly secular nation-state. This article suggests, first, that the process of modernization and democratization in Turkey has always faced the problem of establishing a delicate balance between politics and religion, and, second, that in this process the more secularism is used by the state elite to control religion, the less pluralistic and democratic the state has become in governing a society where Islam has always played an important role in the symbolic formation of Turkish identity. What is needed in this context is a ‘democratic secular imaginary’ as a more dialogical, tolerant and accommodating strategy of living with difference, enabling us to understand religious claims to difference in their own right, and to approach them clearly and critically.
