The nineteenth-century appraisal of Whewell's philosophy as confused, eclectic, and metaphysical is still dominant today. Yet he keeps reappearing on the agenda of the historians and philosophers of science. Why? Whewell continues to be a puzzle. Historians evade the puzzle by deeming him to have had no serious philosophy but some interesting ideas and/or to have been socially important. Menachim Fisch's recent study offers promise of a new appraisal. But Fisch's account leads back to the puzzle. Fisch poses the question (...) well, promises a new answer, but does not provide one. The puzzle will remain until the strength of Whewell's turn away from empiricist problems to Kantian ones has been appreciated. (shrink)

Factual statements that might qualify for the status of law statements are classed from various philosophically relevant standpoints (referents, precision, structure of predicates, extension, systemicity, inferential power, inception, ostensiveness, testability, levels, and determination categories). More than seven dozen of not mutually exclusive kinds of lawlike statements emerge. Strictly universal and counterfactually powerful statements are seen to constitute just one kind of lawlike statements; classificatory and some statistical laws, e.g., are shown not to comply with the requirements of universality and counterfactual (...) force. Conditions for lawlike statements to be called laws are then examined, and a liberal criterion of lawfulness is finally proposed, which reads thus: A proposition is a law statement if and only if it is a posteriori (not logically true), general in some respect (does not refer to unique objects), has been satisfactorily corroborated for the time being in some domain, and belongs to a theory (whether adult or embryonic). It is claimed that criteria of laws change alongside with the emergence of new usages of the term 'law', and that by adopting a liberal criterion of lawfulness we would conform to contemporary usage and would cease inhibiting the search for regularities in the sciences of man. En este trabajo hago una comparación sistemática entre las dos teorías de la confirmación más populares en la actualidad: el método hipotético-deductivo y el bayesianismo. En primer lugar, enumero los cinco problemas fundamentales de la teoría hipotético-deductivista. Estos son el problema de las hipótesis estadísticas, el del grado de confirmación, el de la conjunción irrelevante, el del holismo epistemológico y el de las hipótesis alternativas. Luego, hago una presentación general de la epistemología bayesiana y muestro de qué manera estos problemas (...) resultan tratables en el marco bayesiano. Finalmente, concluyo que los tres primeros admiten una solución satisfactoria, sobre la base de algunos supuestos razonables. Los dos últimos, en cambio, todavía son problemas abiertos para la teoría bayesiana de la confirmación. Bayesians often affirm they have produced the best available theory of confirmation. In particular, they claim to have superseded the venerable hypothetico-deductive method. In this paper I intend to assess that claim by making a systematic comparison between both theories of confirmation. I begin by listing the main problems of hypothetico-deductive confirmation. I then show that this conception is incompatible with Hempel's conditions of adequacy for qualitative confirmation. I expound the Bayesian theory of confirmation with some detail in order to show that this theory is able to solve three out of the five fundamental problems of hypothetico-deductive confirmation. largue that the remaining two problems are still open questions for the Bayesians.
