Il se traduit par le report quotidien sur le papier des visites effectuées et reçues par sa famille, comptabilité à laquelle n’échappent pas même les jours auxquels il ne se passe rien. The number of available legal documents has presented an enormous growth in recent years, and the digital processing of such materials is prompting the necessity of systems that support the automatic relevant information extraction. This work presents a system for ontology-based information extraction from natural language texts, able to identify a set of legal events. The system is based on an innovative methodology based on domain ontology of legal events and a set of linguistic rules, integrated through inference mechanism, resulting (...) in a flexible approach and scalable approach. A case study with the use of documents from the Superior Court in Brazil is related, with satisfactory results in precision and recall. (shrink)

This article offers a critical view of the process of material constitutionalization of the European citizenship, through an analysis of the transformations of its outer borders in the phase of enlargement. The repositioning and deterritorialization of the inner and outer borders of the EU lead to a decomposition of its judiciary space, which illustrates the way in which borders have become an instrument of governance of Europe’s postcolonial condition. The analysis focuses on the recent legislative transformations introduced in Poland, Romania (...) and Bulgaria in order to adapt their national judicial systems to EU common rules. (shrink)

The article considers the changes that have affected European border regimes of migration control as a testcase for discussing arbitrariness. The argument highlights the limited capacity of notions of arbitrariness defined as a departure from the rule of law to capture the ongoing conflict at the borders of Europe and brings, instead, to the foreground the ambivalent meaning of arbitrariness. By comparing Santi Romano’s classical theory of legal pluralism with recent analyses of legal globalization processes, arbitrariness emerges either as an (...) authoritative attempt to impose a different order on society or as a means to contrast acts of resistance to border regimes. In both cases, arbitrariness forcefully blurs the limits between the ordered and unordered, indicating the paradoxical impossibility of excluding the law’s outside from the legal order. On these premises, the article advocates the importance of reframing the demand for open borders as a call for freedom of those who challenge the pragmatic order of migration regimes. Indeed, arbitrariness is necessarily limited when the legal order recognizes, to an extent, the agency and the claims of subjectivities that resist the dichotomy between inclusion and exclusion. The article presents the first edition of the Chapters on the purity of the soul written by the patriarch of Constantinople, Callistus I , with an italian translation and commentary. Many themes of the Chapters are related to the byzantine ascetical tradition and the teaching of Callistus' spiritual father, Gregory the Sinaite. Others are connected to the theological discussions of the period and the polemics of the patriarch against Nicephorus Gregoras.

For a given numeration system U, a set X of integers is said to be U-star-free if the language of the normalized U-representations of the elements in X is star-free. Adapting a result of McNaughton and Papert, we give a first-order logical characterization of these sets for various numeration systems including integer base systems and the Fibonacci system. For k-ary systems, the problem of the base dependence of this property is also studied. Finally, the case of k-adic systems is developed.

L'artefice della diffusione dei trattati di Egidio Romano in ambiente ebraico fu Yehudah Romano, quasi contemporaneo dell'autore latino ed egli stesso autore di molte opere in lingua ebraica che circolarono nei secc. XIV-XVI. I suoi testi furono parzialmente letti da Pico della Mirandola, per il quale Flavio Guglielmo Raimondo Mitridate tradusse in latino l'inizio del commento all'Opus creationis. Inoltre Yehudah tradusse dal latino alcune opere del corpus aristotelico, facendo ampio uso dei commenti egidiani, e alcune parti dei trattati di Alberto (...) Magno, Tommaso, Angelo da Camerino e del De unitate intellectus di Gundisalvi. L'A. annota che per quanto riguarda alcune discipline, come ad esempio la logica e la retorica, la sola autorità accettata è Egidio. La fedeltà sintattica delle traduzioni di Yehudah fa sì che le sue versioni abbiano un valore quasi equivalente alla fonte primaria per l'ed. critica degli scritti egidiani. (shrink)

Religion's historical mistrust of sexuality shapes people's behavior by inhibiting liberal sexuality. Still, it is unclear whether this inhibitive role also includes common, normative sexual behavior, particularly in secularized contexts. Moreover, the possible mediating effects emotions, affects, and thoughts have on the association between religiosity and restricted sexuality have never been integrated into a single model. Finally, cross-religious differences in common sexual behavior have still yet to be documented. We addressed these three issues in two studies, with samples of Catholic (...) and Muslim tradition. Consistently across samples, religiosity predicted, either directly or indirectly, less frequent common heterosexual behaviors and masturbation, partly through sexual guilt and inhibition, and/or decreased sexual fantasy and the search for sexual pleasure. However, married Muslims’ religiosity, unlike Catholics’, did not directly undermine fertility-oriented sexuality and the search for pleasure. Religion's role in restricting sexuality seems to be rooted in deep psychological rationale. (shrink)

Beês du manuscrit 34 du Mega Spêlaion, malheureusement perdu. La deuxième partie de l'article contient l'édition du seul ouvrage de Loukas conservé, le Discours aux vierges.

This article takes as its starting point the commonplace that Rousseau’s Emile enabled his contemporaries to discover not only childhood but physical education. Focused on what the pedestal erected for Jean-Jacques somewhat overshadows, a brief historiographic overview and a survey of some major writings on education before Rousseau (by the Abbot Fleury, John Locke, Jean-Pierre de Crousaz and Charles Rollin) will show that the ideas defended by the writer were not innovative in the slightest. But also, and this seems far (...) more important, that these ideas took place in a particular context : the mid-eighteenth century dispute between pedagogues and physicians over the body of the child, which resulted as much from the medicalization of pedagogy as from the educationalization of medicine, at a time when the boundaries between disciplines had not yet been defined. In the context of the ascension to power of physicians, reinforced by the first statistics on child mortality, as will be suggested in conclusion, Rousseau’s advocacy for corporal education gave the initiative back to the pedagogues. (...) 67–134, qui 109–114), importante non solo per la storia dell'eresia dualista in epoca medievale, ma anche per l'utilizzo da parte di Ugo di alcuni testimoni della letteratura agiografica ed edificante bizantina. ObjectiveIn Belgium, people with an incurable psychiatric disorder can file a request for euthanasia claiming unbearable psychic suffering. For the request to be accepted, it has to meet stringent legal criteria. One of the requirements is that the patient possesses decision-making capacity. The patient’s decision-making capacity is assessed by physicians.The objective of our study is to provide insight in the assessment of decision-making capacity in the context of euthanasia for patients with psychic suffering caused by a psychiatric disorder.MethodTwenty-two semistructured interviews (...) with psychiatrists and neurologists were analysed with NVivo, a qualitative analysis software to code and organise transcribed data.ResultsDifferent views and approaches regarding decision-making capacity in the context of euthanasia emerged from the data.Most of the physicians have some knowledge of the cognitive ability approach on decision-making capacity. According to this approach, four abilities constitute decision-making capacity: communication, understanding, appreciation and reasoning. We observed differences in the way these abilities are valued in relation to competence. Some physicians take additional elements into consideration when assessing decision-making capacity.Physicians acquired their knowledge on the subject in many different ways. Most of the physicians reported that decision-making capacity was not part of their training.ConclusionWe conclude that physicians assess decision-making capacity in different ways and that personal values and beliefs influence their approach. As such, a common approach in assessing the decision-making capacity of a patient among the interviewed physicians is lacking. Less arbitrariness could be obtained by consistently implementing the cognitive ability approach. (shrink)

Im Grunde stellt das Buch eine neue (die dritte) Ausgabe, diesmal die echt kritische Ausgabe, der sogennanten Chronik der Meteora (nach den ungenügend bearbeiteten Ausgaben von L. Heuzey und F.I. Uspenskij im 19. Jh.) dar. Außer der Ausgabe mit italienischer Übersetzung (S. 122–139) bietet aber der Herausgeber auch eine ausführliche Einführungsstudie (S. 13–120), sowie ebenso ausführliche historische Kommentare (S. 143–173). Die Ausgabe ist auf Grund der Handschriften aus dem Kl. Barlaam (heute Petrop. Gr.251.I) und Kl. des Hl. Stefan entstanden. Die (...) beiden Handschriften bestehen aus dem Text der Chronik von Ioannina, einem Horismos des Sinan-pasha und dem hier herausgegebenen Text, wobei in der Handschrift Barlaam noch verschiedene Notizen am Ende beigefügt sind.
