On Typology and Deontics of Private Institutes of Law. In continuation of my treatise "Grundlegung zu einer Strukturtheorie des Rechts" Part I of this paper develops a typology of the fundamental patterns of institutes of law belonging to the relations of persons to move (movable or fixed)) assets. In Part II some reflections deal with the deontics of Gestalten of actions (in the sense of Part I) and related models in economics.

A Hobbesian Model. If ever possible the modelling of the abstract pattern of the item of a philosophical theory belongs, alas!, to its interpretation. In the case of the Hobbesian theory of the natural right and the natural laws (Lev c. XIV, XV) the mathematics of the covenant-model and of its interpretation by an model of preferences and utilities is a neglect task till now. Its performance shows certain shortcomings of the Hobbesian theory.

In weitem Bogen behandeln die Griechischen Studien wichtige Momente der griechischen Geschichte von ihren Anfängen bis ins 4. Jahrhundert v. Chr. Besondere Aufmerksamkeit gilt zunächst - in Zusammenarbeit mit dem Basler Alttestamentler Klaus Seybold - dem Vergleich mit der parallelen Entwicklung in Israel / Juda, um das Charakteristische der griechischen Geschichte zu profilieren. Einen weiteren Schwerpunkt bildet das 4. Jahrhundert v. Chr. mit Studien zur Beurteilung der athenischen Demokratie und zur Bewertung des Tyrannen Dionysios von Syrakus als Wegbereiter der hellenistischen (...) Monarchie. Die letzten drei wissenschaftsgeschichtlichen Beiträge gelten vor allem Jacob Burckhardt und Ulrich von Wilamowitz-Moellendorff. (shrink)

Reminiscing on the fact that E. Schrödinger was rooted in the same physical tradition as M. Planck and A. Einstein, some aspects of his attitude to quantum mechanics are discussed. In particular, it is demonstrated that the quantum-mechanical paradoxes assumed by Einstein and Schrödinger should not exist, but that otherwise the epistemological problem of physical reality raised in this context by Einstein and Schrödinger is fundamental for our understanding of quantum theory. The nonexistence of such paradoxes just shows that quantum-mechanical (...) effects are due to interference and not to interaction. This line of argument leads consequently to quantum field theories with second quantization, and accordingly quantum theory based both on Planck's constant h and on Democritus's atomism. (shrink)

Die Herausforderung durch "das Neue" hat sich zu Beginn des 21. Jahrhunderts noch einmal entscheidend verschärft. Bio-, Nano- und Medienwissenschaftler verkünden zum wiederholten Male Veränderungen, die das Gesicht und die Ordnung der "Welt" tiefgreifend umgestalten werden. Futurologen sprechen sogar von einer "zweiten Evolution", die sich bereits jetzt ankündige. Die Wahrnehmung des Neuen ist aber selbst eine historische Variable. Deshalb werden in diesem Bande zwei paradigmatische Typen von Gesellschaften auf ihren Umfang mit dem Neuen hin untersucht: eine traditionale, die Antike, und (...) eine modernisierende, die Renaissance. Inhaltlich geht es in beiden Bereichen um Fragen der Kunst- und Literaturtheorie, der ästhetischen und politischen Praxis, der gesellschaftlichen Herausforderungen, die das Neue begleiten, bis hin zu dem direkten Vergleich zweier herausragender Gestalten der beiden Epochen: Augustus und Cosimo di Medici. Dabei werden in den Aufsätzen von Altertumswissenschaftlern und Spezialisten für die Renaissance Konzepte unterschiedlicher historischer Gesellschaften nach ihren mentalen Dispositionen und Methoden befragt, um Traditionsbrüche, Innovationen sowie Imaginationen "des Neuen" zu reflektieren. Some notices to Thibaut's Science of Pandects. For A. F. J. Thibaut, the main concern was a "philosophical" approach to the interpretation and systematization of the positive Roman Law in his time. In his eyes, the object of a subjective right is an action, not a thing or person. Therefore he was cautious not to use abstractions, definitions, and deductions from "dreamt" postulates. Regarding the logical texture of an institute of private law as a "Gestalt", it follows that the "equity (...) of the reason," of a law, for different cases, is the same thing as that "Gestalt". The "philosophical" interpretation of a law is then an interpretation in respect to its "Gestalt". Although Thibaut's main concern was the interpretation of the positive Roman Law in his time (the "Gemeinrecht") he did not disregard the history of Roman Law before and especially after Justinian. From Einstein's point of view, his General Relativity Theory had strengths as well as failings. For him, its shortcoming mainly was that it did not unify gravitation and electromagnetism and did not provide solutions to field equations which can be interpreted as particle models with discrete mass and charge spectra, As a consequence, General Relativity did not solve the quantum problem, either. Einstein tried to get rid of the shortcomings without losing the achievements of General Relativity Theory. Stimulated by papers (...) of Weyl 465) and Eddington 194), from 1923 onward, he believed that, to reach this goal, one has to transit to space–times which possess more comprehensive geometrical structures than the Riemann space–time. This was the beginning of a decade's lasting search for a unitary field theory. We describe this exciting part of the history of physics, discuss achievements and failures of this development, and ask how these early attempts of a unified theory strike us today. Taking into account the fact that the Equivalence Principle only speaks for a geometrization of gravitation, we consider an alternative way to give those non-Riemannian structures which were introduced by the unitary field approach a physical meaning, namely the meaning of a generalized gravitational field. This is interesting since there are arguments in favor of such a generalization of General Relativity Theory, e.g., the problems the latter theory meets with if one tries to quantize it and to unify gravitation with other interactions.
