Activists and progressive governments sometimes interfere in the working conditions of sweatshops. Their methods may include boycotts of the products produced in these facilities, bans on the import of these products or tariffs imposed by the home country, and enforcing the host country’s laws that aim at regulating sweatshops. Some argue that such interference in sweatshop conditions is morally wrong since it may actually harm workers. The reason is that the enterprise that runs the sweatshop may choose to lay off (...) some workers as the result of effective interference in order to maintain their profit at the desired level. If successful, this argument would prohibit any interference in sweatshop conditions on moral grounds. In this article, I argue in dissent and build a contractualist argument in favor of the moral permissibility of interference in sweatshops. I base my argument on an ex ante interpretation of T.M. Scanlon’s contractualism. (shrink)

Kates argues that ex ante contractualism fails to defend interference with sweatshops on moral grounds. In this commentary, I argue that Kates does not apply this approach correctly. Ex ante contractualism, indeed, successfully defends interference and thus should still be considered an appealing alternative to other moral approaches for evaluating when and how to interfere in sweatshop conditions to help workers.

One common argument against sweatshops is that they are exploitative. Exploitation is taken as sufficient reason to condemn sweatshops as unjust and to argue that sweatshop owners have a moral duty to offer better working conditions to their employees. In this article, I argue that any exploitation theory falls short of covering all standard cases of sweatshops as exploitative. In going through the most prominent theories of exploitation, I explain why any given sweatshop can either be wrongfully exploitative or not, (...) depending on the exploitation theory being considered and the circumstances of the application. I conclude by suggesting that sweatshop critics had better find other reasons besides the charge of exploitation to protest or interfere with these workplaces. (shrink)

This paper investigates propositional hyperintensionality in counterfactuals. It starts with a scenario describing two children playing on a seesaw and studies the truth-value predictions for counterfactuals by four different semantic theories. The theories in question are Kit Fine’s truthmaker semantics, Luis Alonso-Ovalle’s alternative semantics, inquisitive semantics and Paolo Santorio’s syntactic truthmaker semantics. These predictions suggest that the theories that distinguish more of a given set of intensionally equivalent sentences (Fine and Alonso-Ovalle’s) fare better than those that do not (inquisitive semantics (...) and Santorio’s). Then we investigate how inquisitive semantics and Santorio can respond to these results. They can respond to them by helping themselves to considerations from Hurford disjunctions, disjunctions whose disjuncts stand in an entailment relation to one another. I argue that considerations from Hurford disjunctions are ad hoc modifications merely to predict the expected results. I conclude that the scenarios suggest a need for more fine-grained theories of sentential meaning in general. (shrink)

1980’li yıllarda uygulanan neo-liberal politikalar nedeniyle Sivil Toplum Kuruluşlarının yapmış oldukları faaliyetler önem kazanmış Sivil Toplum Kuruluşları sosyal dayanışma, sosyal yardım ve yoksulluk yardımları gibi pek çok önemli faaliyette bulunmuşlardır. Kocaeli bölgesinde faaliyet gösteren bir Sivil Toplum Kuruluşu olan Değirmendere Sualtı Topluluğu (DESSAT) sosyal sorumluluk kapsamında dezavantajlı kesim olarak nitelendirilen engellilere yönelik 2011-2013 yılları arasında SCUBA dalış eğitimi faaliyetinde bulunmuştur. Bu çalışmada; DESSAT’ın yapmış olduğu SCUBA dalış eğitimlerinin engellilerin kapasite yoksunluğuna etkileri, eğitmenlerin ve dalış faaliyetine katılan engellilerin deneyimleri ve gözlemleri (...) incelenerek belirlenmeye çalışılmıştır. Çalışmanın amacı engellilerin kapasite yoksunluğunu azaltma faaliyetlerinde Sivil Toplum Kuruluşlarının rolleri konusuna dikkat çekerek farkındalık yaratmak, SUCUBA dalış eğitimi faaliyetinin engellilerin kapasiteleri yoksunlukları üzerindeki etkilerini araştırmak ve görüş/önerilerde bulunmaktır. Çalışma nitel bir çalışma olup tematik analiz tekniği kullanılarak yapılmıştır. SCUBA dalış eğitimi faaliyetinin engellilerin kapasite yoksunluklarına etkisinin belirlenmesi maksadıyla dalış eğitmenleri ve sualtı dalışı yapan engellilerle derinlemesine görüşmeler yapılmıştır. Araştırma sonucunda engelliler ve eğitmenlerle yapılan derinlemesine görüşmelerden elde edilen bilgiler değerlendirilmiş değerlendirme sonucunda SCUBA dalış faaliyetinin engellilerin sosyalleşmesine, toplum içerisindeki diğer faaliyetlere katılmasında, kendilerini mutlu ve huzurlu hissetmelerine, özgüvenlerinin artırılmasına, yapabilirlik olarak engellerinin ortadan kaldırılmasına önemli oranda katkısı sağladığı tespit edilmiştir. Prior's puzzle is a puzzle about the substitution of certain putatively synonymous or coreferential expressions in sentences. Prior's puzzle is important, because a satisfactory solution to it should constitute a crucial part of an adequate semantic theory for both proposition-embedding expressions and attitudinal verbs. I argue that two recent solutions to this puzzle are unsatisfactory. They either focus on the meaning of attitudinal verbs or content nouns. I propose a solution relying on a recent analysis of that-clauses in linguistics. Our (...) solution is superior, as it not only avoids the problems faced by previous solutions, but it also brings developments in linguistics in line to solve an old puzzle in philosophy. (shrink)

Fanaticism Fact and Criticism on Being without Criticism in Religious Cult Structures AbstractFanaticism is an inclination that limits correct thought, questioning, criticism, tolerance and liberty. An entity, which doesn’t object to, can’t bear criticism and mental arguments and focuses on unconditional acceptance to what is commanded, has lost the ability to distinguish right from wrong and be doubtful of the information transmitted. Freedom and actions would be inevitably under control of single command if absolute obedience in the form of a religious organization has been come up to faith. For that reason, it is obvious that only certain facts and absolute mistakes are available for cult structures devoid of the ability to think and comprehend. It is difficult for an entity to create a moral and virtuous society since it considers its ideology as absolute reality but it marginalizes other one, doesn’t justify thoughts of the others and can’t tolerate them. Whereas, a society consisting of logical individuals who have high level of jurisdiction could be built if information is selected, investigated and evaluated properly. Hence, oneness belief would be kept safe from intellectual and spiritual manipulation and would become prone to a much more universal acceptance as long as people maintained their moral and intellectual development. Today, common characteristic of wrong thoughts of belief witnessed in Islamic world is obviously being unfamiliar with fundamentals of the religion, imitating other people like a slave, deadening the mind and monopolizing the truth. In our article, in this respect, we will try to analyze both fanaticism phenomenon that prevents intellectual development of the individual and how a falsifying power is those cult structures deprived of criticism skill. He was a prolific scholar, supplying a new countenance to the modern Arabic language in his nearly centennial life period.

The lack of water, which has arisen due to reasons such as climate change, excessive and misuse, has become a global problem. The reuse of wastewater is considered as an important solution to overcome this problem. With the technology developed for this purpose, wastewater is treated and used in many fields, especially in irrigation of agricultural products and parks and fire extinguishing. There is no information directly related to the methods of treating polluted water in the religious texts. In the (...) past, when today's technological possibilities were not available, fuqaha determined some treatment techniques, but these are about waters exposed to najāsat (filthy things), not about wastewater that contains a large amount of najis elements. As a matter of fact, it seems impossible to clean wastewater with these methods. With the systems developed today, wastewater can be treated at different levels according to their usage areas. Accordingly, the analysis information regarding the output at each treatment level should be evaluated separately when determining the fiqh provision of treated wastewater. In this study, it is aimed to examine the purification methods discussed in fiqh books together with the relevant texts and to determine the criteria taken as basis in purification and to try to determine the fiqh provision regarding the treated wastewater outputs within these criteria. Al-Shāfiʿī’s works contain reports of numerous debates on the epistemological value of hadith reports, but unfortunately rarely name specific opponents or interlocutors or the groups to which they belong. In Jimāʿ al-ʿilm al-Shāfiʿī summarizes the views of scholars whom he considered opponents of hadith under two broad rubrics: those who reject hadith categorically and those who reject only part of the hadith. There have been speculations regarding their identity but only in 2013 was a concrete advance made, when Ahmed El (...) Shamsy identified one of al-Shāfiʿī’s opponents in debate as Ibn ʿUlayya. This study attempts to identify a group of al-Shāfiʿī’s opponents in Jimāʿ al-ʿilm, drawing on Abū l-Qāsim al-Balkhī’s Kitāb al-Maqālāt and other classical works of Islamic theology. (shrink)

İnsanların günlük hayatlarında en çok kullandıkları muamelelerden biri olan alış veriş, toplumların örflerine göre çeşitlilik göstermiştir. Bu sebeple klasik füru fıkıh eserlerinde akitlerin çok bilinenlerine yer verilmiş, diğerleri için de genel şartları sağlaması kaydıyla caiz olabileceği kanaatine varılmıştır. Bununla beraber mezheplerin nasları anlama yöntemleri ve örfi uygulamaları değerlendirme biçimleri, akitlerin sıhhatini değerlendirmelerinde de ektili olmuştur. Mahiyeti itibariyle değişik formları bulunmasıyla birlikte kısaca, ürünün peyderpey alınıp ücretin ürünün tüketilmesinden sonra ödenmesinin taahhüt edilmesi şeklinde tarif edilen isticrâr akdi, İslam hukuk ekolleri tarafından (...) tartışılmıştır. Bu tartışmalar genellikle akdin sıhhat ve kuruluş unsurlarını taşıyıp taşımaması etrafında gerçekleşirken Hanefi fukahası, isticrâr yoluyla yapılan alışveriş işlemlerinin insanlar tarafından sıkça yapıldığını göz önünde bulundurarak bu akdin istihsan yoluyla caiz görülmesi gerektiği kanaatine varmışlardır. Diğer mezheplerde de bu akde benzer gerekçelerle olumlu yaklaşımların bulunduğunu görmekteyiz. Bu çalışmamızda günümüz kırsal kesimde uygulanan ve özellikle finans dünyasında uygulanmaya başlanan ve aynı isimle literatüre girer isticrâr akdini, mezheplerin görüşleri bağlamında değerlendirmeye çalışacağız. İslam düşüncesinde dillerin ortaya çıkışı konusu, dilbilimsel çalışma ve tartışmaların büyük bir bölümünü oluşturmuştur. Bu tartışmalarda en büyük pay usul ve kelâm âlimlerine aittir. Müslümanlar, dillerin ortaya çıkmasıyla ilgili iki teori öne sürmüşlerdir: Birincisi, tevkîf teorisidir. Buna göre dil ilahi bir mevhibe olup insana Allah tarafından öğretilmiştir. Çok kadim olan bu teori Yunan filozofları tarafından da savunulmuştur. İkinci teori ise tevfîk teorisidir. Bu teorinin sahipleri dilin toplumsal uzlaşı ile doğduğunu öngörürler. Bu teoriyi savunanların çoğu, delillerini aklî temele dayandıran Muʻtezile’ye mensup (...) olup metinleri kendi görüşlerine uygun bir şekilde yorumlamışlardır. Bazı âlimler ise bu iki teoriyi uzlaştırmaya çalışmışlardır. Buna göre Cenâb-ı Hak, insana kavram üretme yeteneği vermiş ve bunun için uygun mekanizmalar bahşetmiştir. Fakat yine de dilin ilk kökeninin tevkîfî olması gerekir ki sonradan insan dili gelişim gösterebilsin. Kādî Abdülcebbâr bu konuda farklı bir görüş ortaya atar. Ona göre ilk dil tevkîfî olamaz tam aksine Allah'ın hitabını anlamamız için tevfîkî olması gerekir. Allah'ın insana anladığı bir dille hitap etmesi gerektiği deliline istinaden, Kādî Abdülcebbâr bu teoriyi savunmuştur. Yukarıdaki tartışma dilin ilk kökeni ile ilgilidir. İlk dilden sonra gelen dillere gelince, Kādî Abdülcebbâr onların çıkışı hakkında kesin bir şey söylemez. Yani hem tevkîfî olabilir hem de tevfîkî olma ihtimali mevcuttur. Bu iki ihtimalin hiçbirini destekleyecek bir delil yoktur. Kādî Abdülcebbâr, Allah'ın iradesini anlamak için öngördüğü bu durumun nasıl olması gerektiğini bir örnekle açıklıyor. O, öncelikle bir kelimenin bir lafzı ifade-işaret etmesi gerektiğini ve bunun da mutlaka belli bir maksat için konulmuş olması gerektiğini savunur. İsim, konulduğu şeye niyete bir gayeye uygun olarak işaret etmelidir. Modern dilbilimde ise, yukarıdaki iki teori haricinde birkaç teori daha ortaya atılmıştır. Modern dilbilim kitaplarında büyük yer tutan ve on sekizinci yüzyılın sonunda ortaya çıkan ilk dilin kökeni teorisi; dilin insan türünün özel bir içgüdüsünden kaynaklandığını belirten ve onun doğuştan geldiğini savunan teoridir. Yani insanda, her duyusal ve ahlaki algısını bir kelime ile ifade etmesini sağlayan bir fıtratı vardır. Modern teorilerden biri de, kelimelerin ilk oluşumunun insanın duyduğu doğal sesleri taklit etmesiyle ortaya çıktığını ve bu seslerin kaynağının onlardan isimler türetmeye yönelttiğini savunan taklit teorisidir. Bu çalışmada Kādî Abdülcebbâr’ın dilin kökenine dair özgün teorisi ve teorisini desteklemek için ortaya koyduğu akli deliller ele alınmaktadır. (shrink)

This thesis extends Kit Fine's truthmaker semantics for counterfactuals to indicative conditionals. First, I provide Fine's truthmaker semantics and his extension to counterfactuals. Then I introduce a notion of context state into the semantics and provide the verification-conditions for indicative conditionals by employing this notion of context state. Afterwards, I turn to the logic of indicative conditionals under exact semantics and discuss the principles and inference rules which raise disagreements between variably strict and strict conditionals accounts. The account I provide (...) shows its promise by validating a plausible combination of principles and strikes a balance between variably strict and strict conditional theories. I discuss certain principles in logic of indicative conditionals under exact semantics in detail and show how the present account validates the plausible combination of them. In the end, I draw comparisons between the viable theories for indicatives and the present one, and argue that the present account takes the advantage in several respects. (shrink)

The Enneads are our main source for understanding Plotinus' philosophical architecture. In this work, the philosopher attempted to fully explain his own philosophical doctrine. However, there is a treatise in this work that gives the impression of being outside the philosophical architecture. This treatise, entitled Against the Gnostics, serves two different purposes for researchers. First, we have the opportunity to confirm the philosopher's own teaching through this treatise. Second, through Plotinos' objections to the Gnostics, we witness the heated debates of (...) the time. Also, during this discussion we will have the opportunity to get to know the Gnostics from a philosopher's point of view. In this treatise, Plotinus develops a detailed counter-position to the Gnostics and directly refutes them. These are the main lines: The universe is the product of an evil creator and therefore completely evil; renunciation of earthly life with hatred and contempt for it; the doctrine that salvation from the material world can be granted only to a select group by grace. Plotinos developed both a radical rejection of these questions and solutions on how to understand them. In this paper, I would like to review this rejection on a textual basis for the first time. Ahmed b. Hanbel, vefatıyla neticelenen hastalığı esnasında oğlu Abdullah’tan, şu hadisin el-Müsned’inden çıkartılmasını istemiştir: “Allah Rasûlü ‘Ümmetimi Kureyş’ten şu grup helâk edecek’ buyurunca oradakiler ‘(bu durumda) bize neyi emredersin?’ diye sordular. O da ‘İnsanlar onlardan uzak durup ayrılsalar!’ cevabını verdi”. Ahmed b. Hanbel bu hadisin, diğer rivayetlerle çeliştiğini düşünmektedir. Oğlu Abdullah’a göre bu hadisin çeliştiği rivayetler, Hz. Peygamber’in idarecilere itaat etmeyi ve onlardan kaynaklanan yanlışlara karşı sabırlı olmayı emrettiği haberlerdir. Ahmed b. Hanbel’in tavrı ve bunun sebebi esasen açık ve net (...) gibi görünmektedir. Buna rağmen daha sonra gelen ilim adamları, onun bu tavrı ile ilgili farklı değerlendirmeler yapmışlardır. Bu değerlendirmelerden birine göre İmam’ın tavrı, kendi açıklamasında da dikkat çektiği üzere hadisin şaz olması yani halkın idarecilerle ilişkilerini düzenleyen diğer rivayetlerle çelişmesidir. Bu bakış açısı, İmam’ın açıklamasıyla uyum içinde olmasına ilaveten aynı hadisin Buharî ve Müslim gibi meşhur muhaddisler tarafından nakledilmesi açısından da önemlidir. Zira bu yorumun ulaştığı sonuca göre Buharî ve Müslim’in sadece sahih olan hadisler ihtiva ettikleri iddiasıyla takdim ettiği el-Câmi‘u’s-sahîh isimli eserlerinde, bu şarta uymayan rivayetler de bulunabilmektedir. Bununla birlikte söz konusu hadisin hem sened hem de metni üzerinde yapılan incelemeler şaz iddiasının doğru olamayacağını göstermektedir. Nitekim hadisi nakleden dört ravinin tamamı, içinde Ahmed b. Hanbel’in de bulunduğu münekkitler tarafından güvenilir bulunmuştur. Nitekim İmam, el-Müsned’inde bu ravilerin çok miktarda hadisine yer vermektedir. Hadisin metin açısından da şaz olmadığını söylemek mümkündür. Zira metnin birinci cümlesi olan “Ümmetimin helâki Kureyş’in elinden olacak” şeklindeki tespiti, farklı onlarca hadiste görebilmek mümkündür. Bu hadislerden pek çoğu el-Müsned’de bizzat Ahmed b. Hanbel tarafından da nakledilmiştir. Şaz addedilen kısmın “İnsanlar onlardan uzak dursalar” şeklindeki ikinci cümle olması da pek muhtemel görünmemektedir. Zira zalim idarecilere karşı bundan çok daha şiddetli tepkileri emreden hadislerden onlarcası yine bizzat Ahmed b. Hanbel tarafından nakledilmiş durumdadır. Ahmed b. Hanbel’in, bu hadisi kitabından çıkarmak istemesinin sebebi bağlamında ortaya atılan ikinci iddiaya göre İmam, dönemin yönetimiyle iyi geçinmek amacıyla böyle bir talepte bulunmuştur. Zira bu dönemde Abbasî iktidarı, hadisçileri büyük bir sıkıntıya sokan Mihne sürecine son vermiş, ulemaya karşı yumuşama politikası gütmeye başlamıştır. Ahmed b. Hanbel de yönetimin bu uzlaşma arzusuna olumlu cevap vermiş ve bu çerçevede idareciye karşı sergilenecek sert tutuma işaret eden hadisleri kitabından çıkarmak istemiştir. Fakat bu iddia da yaşadığı dönemde iktidara karşı takındığı tavır sayesinde toplum önderi haline gelmiş Ahmed b. Hanbel gibi bir şahsiyetle uyuşmaz. Zira o idareci ve toplum arasındaki ilişkilerin keyfiyeti ve sıhhati konusunda gerek tavsiyeleri gerekse fiilî tatbikatı ile örnek ve simge haline gelmiştir. Hayatını Hz. Peygamber’in mirası olan hadisleri nakletmeye ve doğru anlaşılmasına hasreden böyle bir şahsiyetin, sırf iktidarla iyi geçinmek adına, sened ve metin itibariyle usûl problemi olmayan rivayetleri el-Müsned’den çıkartılması emrini vermesi çok da doğru görünmemektedir. Bu konuda yapılan üçüncü yoruma göre Ahmed b. Hanbel’in bu hadise yönelik tavrı, manasının istismara müsait olmasıdır. Nitekim İmam’ın bizzat kendisi, ehl-i bid‘attan bazılarının bu hadisi delil getirip iktidara karşı toplumda ayrımcılık yaratacak davranışlara yöneldiğini söylemiştir. Elimizde bu son yorumu güçlendiren başka veriler de vardır. Nitekim o aynı tavrı, iktidara karşı silahlı mücadeleyi emreden başka hadisler hakkında da göstermiş; bunların kitabından çıkartılmasını istemiştir. Bu tavrından anlaşıldığına göre Ahmed b. Hanbel, zalim idareciye karşı, toplumda kargaşa ve fesada sebep olacak fiilî ve silahlı mücadeleye kalkışılmasını istememektedir. Öyleyse denilebilir ki İmam’ın söz konusu hadisle ilgili tavrı, hadisin özellikle “insanların böyle idarecilerden uzak durması” yönündeki ikinci cümle ile ilgilidir. Zira İmam’ın yaşadığı dönemde Mutezile ve Haricîler gibi bazı gruplar böyle hadisleri delil getirerek toplumda tefrikaya sebebiyet vermişlerdir. Bunu bilen ve bizzat gören İmam, böyle grupların toplumsal birlik karşıtı amaçlarına alet edilebilir düşüncesiyle idarecilere karşı “uzak durmaya çalışmak” gibi basit gibi görünen tepkilere yer veren hadislerin bile kitabından çıkarılmasını istemiştir. Sonuç olarak ifade etmek gerekirse onun bu hadis hakkındaki “diğer rivayetlerle çelişiyor” şeklindeki tavrını, “Müsned’imde oluşturmaya çalıştığım ideal idareci-toplum ilişkisi ile çelişiyor” şeklinde anlamak gerekecektir. Nowadays, some of the things that are ḥarāmto be consumed, such as lard, its derivatives and alcohol are used as additives or additional nutrients in products, namely food and cosmetics that people use widely in daily life. The provision of these products, which are accepted as najis(impure), stands in front of us as one of the actual fiqh problems. In order to produce an accurate solution in this regard, the reaction condition and the level of dissolution in the product must (...) be determined. In this article, the level of mutanajjis (contamination) of the products that najisthings transforms through istihlāk(physical change) and the provision (hukm) of benefits from such things are examined. The research covers the discussions in the classical period regarding the provision of things, which included najāsah(impurity) and underwent physical change as well as the evaluations of contemporary Islamic jurists. The aim of this study is to contribute to the researches, which will be carried out to determine the provision of products containing ḥarāmelements. As the production is carried out on an industrial scale, such studies are important today in terms of the establishment of “ḥalāl” sensitivity and meeting the needs of people who have this sensitivity to learn the provision of such products.SummaryNowadays, in various sectors, especially food, feed, cosmetics, health and clothing industries, for the purposes of reducing the cost of the product, extending the shelf life, making the product more attractive in terms of color, consistency and aroma, many substances are added to the main material. The fact that some of the substances added are ḥarām(forbidden) such as blood, lard, pest, and ethyl alcohol require the subject to be considered in terms of fiqh. It is important to clarify two issues in order to reach a healthy result in the studies aiming to determine the provision (ḥukm) of the products that are mixed with najis(impure) substance. One of them is the determination of the level of istihlāk(physical change) in the mutanajjis(contamination) things. The second is the determination of the basic principles to be used in determining the provision of the things which najāsahhas undergone the physical change in. In this study conducted within the scope of this purpose and method, the hadīthsrelated to two different issues that are directly related to the subject have been evaluated as the basic textual basis. These are narrations about the cleanliness and pollution status of the contaminated water, and about the availability of fats and oils, which the dead mouse is seen in. It is stated in the narrations about the condition of the water that najāsah involved in, the water will not be najisunless its smell, taste or color changes because of the falling najāsahin it. According to this hadith, which shows the change of description as a measure, the fuqahāʾ(jurists) came to a consensus on the fact that water, which one of its characteristics changed because of najāsahwould be considered mutanajjis. When thishadithis evaluated together with the narrations that indicate the small amount of water is contaminated because of najāsah, in fact, it is seen that while the water is considered to be clean-najis, the situation of the water being affected from najāsahis taken as the basis and aimed to protect human health against the dirty water. At the time when there were not any one of today's microbiological analysis laboratories, the way to understand the pollution status of water was to see if the smell, color and taste of the water changed while taking the amount of the water into account. Since the rate of foreign matter in the water, the level of pollution and the health status of the water can be determined correctly in the laboratory today, operating the modern techniques as well as the measure of qualification change will be appropriate for the purpose of the hadīthsmentioned.In the narrations about the state of the fat, which the dead mouse is found in, it is seen that different operations are requested depending on the fat being solid or liquid. If the fat is liquid, different instructions have been made such as its being poured or used in lighting. Mālikīs, Shāfiʿīs, and Ḥanbalīfaqīhs (jurists) of the first period have ruled that liquids such as vinegar, milk and honey are mutanajjis, whether they are in little quantity or not, and whether their descriptions are changed or not, claiming that the amount of oil and the degree of impact on the dirt is not declared in the hadīths. The Ḥanafīs adopted the provision in the narrations mentioned pointing to a small amount of liquid oil and considered the measure of description change for a large amount of liquid valid. Ẓāhirīs, Ibn Taymiyyah and some of the faqīhsargued that the liquids which one cannot feel the color, taste or smell of the najāsahin are clean, regardless of the amount.These three approaches are open to criticism because the first is limited only to the literal meaning in the narrations and neglects the aims, and the second ignored the non-water fluids’ ability to hide the descriptions of the substance added to them, and the third evaluates the mustahlak substance (that has undergone a physical change) as if it had been istiḥālah(chemically changed). When the narrations related to the subject are examined, it is understood that while the usage of the liquid fat which the dead mouse was seen in as the food was prohibited, in fact, it was based on the foresight that all of the fat is affected by the mouse. It appears to have been ruled out that only the part polluted is the part affected by thenajāsahfor the fact that after the removal of the mouse and the environment from the solid oil exposed to the same contamination, the rest is allowed to be eaten. According to this, it is possible to say that the measure of mutanajjisin the things that affected by najāsahis in the degree of spreading of najāsah.Nowadays it is possible to determine the presence of najisthings in the main material, which is used as additive or addition, by the level of effect of these substances in the product, as well as by the assays. If the najissubstances used for purposes such as brightness, taste, consistency and extending shelf life, perform the expected functions, it means that they protect their presence in the product effectively. In fact, it should be acknowledged that these substances continue to exist effectively in the product, if they perform the targeted function without any chemical change, even the ratio in the product is low or the color, taste and odor are eliminated during the mixture.The faqīhswhile differed in opinion about the mutanajjisof things that the najāsahhad undergone physical changes in, they, in concert, considered the substances, which were not cleaned or could not be cleansed from which that they accept as mutanajjisby their own measurements, khabīs(disgusting), and have accepted the people’s eating of them as ḥarām. Likewise, they did not allow such things to be used in any way touching the body, clothing and containers. They have evaluated the narrations, which requires the spilth the fat that the dead mouse was seen in, as the main basis in this issue. On the other hand, about the use of the mutanajjisthings outside the human consumption area and in such a way that the clothes and body would not be contaminated; the majority of thefaqīhs preferred the mubāḥ provision. They have put forth the narrations as the basis that recommends the usage of the liquid oil in which the mouse was fallen in lighting. These approaches of the fuqahāʾabout the effect of the istihlākon the provision of making use of the things that affected by najāsahare of worth as the basic principles on the subject. It is possible to say that it is not permissible to consume food products containing lard or pork gelatin, and the chicken that has been torn apart while being left in hot water in order to pluck its feathers, and the egg which becomes mutanajjisfor it is boiled up with thenajāsahon, and the using of cosmetic products containing lard when today’s industrial products are evaluated in accordance with these principles. If taken the general opinion that defends that the ethyl alcohol is najis as the basis, the carbonated soft drinks, which are added to alcohol, can also be evaluated in this context. (shrink)

Zira o Allah Rasûlü’nün öldüğünü kesin bir dille reddetmiş, bayılmış olabileceğini söylemiş veya vahiy aldığı anlarda yaşadığı hale büründüğünü savunmuştur. Ona göre Hz. Peygamber ölmüş olsa bile Allah Teâlâ O’nu yeniden diriltecektir. Bu tavır, ilk bakışta, İslâm’ın yaşam ve ölüm olaylarına bakışı ve ayrıca İslâm tarihinde Hz. Ömer ile özdeşleşmiş ideal Müslüman tipi ile çelişiyor görünmektedir. Makalede öncelikle, bazı kitaplarda Hz. Öz: Semantik çalışmalarının tarihi çok öncelere dayandırılmasına rağmen esas IXX. Yüzyılda gündeme alınmaya başlanmıştır. Semantiğin öncüsü olarak da Ferdinand de Saussure’ü göstermemiz mümkündür. Onun özellikle gösterge kuramı bağlamında anlamın oluşmasını anlattığı çalışması bizim makalemizin de bel kemiğini oluşturmaktadır. Bu çalışmada Saussure’ün gösterge kuramından hareketle Allah’ın Hâlik isminin semantik anlamının verilmesi amaçlanmaktadır. Bunun için öncelikle klasik kelamda kelimeye verilen anlamları ortaya koyulup daha sonra da ayetler üzerinden Hâlik ismine semantik anlam verilmeye çalışılmıştır. Böylece kelimeye tarihsel olarak yüklenen anlam ile semantik analizle (...) ortaya çıkarılan orijinal anlam farkı gösterilecektir. Hegel’in, dizgesinde mantık bilimi ve doğa bilimi kısımlarından sonra gelen tin bilimi (tin felsefesi) kısmındaki öznel tin ve nesnel tinden geçerek ulaştığı mutlak tin aşaması, kendini üç aşamada ortaya koymuştur. Bunların ilki sanat ikincisi din ve üçüncüsü felsefedir. Hegel, mutlak tinin gelişiminin ikinci aşaması olan dini de _Din Felsefesi Üzerine Dersler_’inde din kavramı, sonlu dinler ve mutlak din olarak aşamalandırmıştır. 1827 yılındaki _Din Felsefesi Üzerine Dersler_’inde din kavramı Hegel tarafından yine üç aşamada değerlendirilir. Bunlar Tanrı kavramı, Tanrı bilgisi ve külttür. (...) Bu çalışmanın odaklandığı kısım din kavramı dahilindeki Tanrı bilgisidir. Dinde Tanrı olarak ortaya çıkan mutlak tin, bu biçimiyle dinin de tek içeriğidir. Hegel için böylesi bir içeriğe ilişkin bilgi de ne salt iman ya da dolaysız bilgi ile ne de rasyonel teolojinin anladığı akılla olanaklıdır. Tanrı’ya yükseliş dolaysız bilmeden başlayan ama orada kalmayan, duygu, tasarım ve düşünme aşamalarına ilerleyen bir yükseliştir. Bu çalışmada Hegel’in Tanrı bilgisi üzerine sunduğu görüşler gösterilmeden önce Tanrı bilgisine ilişkin kendisinden önceki görüşler ve Hegel’in bu görüşlere getirdiği eleştirilere değinilmiştir. Hegel bu görüşlerden özellikle rasyonel teoloji ile Kant’ın Tanrı bilgisi anlayışına ve Jacobi’de öne çıkan dolaysız bilgiye dayalı anlayışa bir yanıt vermek istemektedir. Çalışmada bu görüş ve eleştirilerin ardından Hegel’in kendi dizgesindeki Tanrı bilgisi anlayışı incelenmiştir. Tanrı bilgisi kapsamında dinsel bilincin üç biçimi yani duygu, tasarım, düşünme biçimleri ve bunların Tanrı ile ilişkisi ele alınmıştır. Bu anlamda çalışmanın amacı da Hegel için Tanrı’ya dair bilginin olanaklı olduğunun ve bunun dinsel bilincin üç biçimi olan duygu, tasarım ve düşünme biçimlerinde incelenebileceğinin gösterilmesidir. Çalışmamızda Kur’ân’da izzet ve mülk kavramlarının nasıl bir üslupla sunulduğu ve tefsir kaynaklarımızda izzet ve mülkün elde edilme keyfiyetine nasıl yaklaşıldığı hususu ele alınmıştır. Bu kapsamda mülk ve izzetin teminine dair âyetler incelenmiş, Fâtır sûresinin 10. âyeti ise diğer âyetlere nispetle daha ayrıntılı biçimde ele alınmıştır. Zikri geçen âyetin çalışmanın merkezinde olmasına bağlı olarak konuyla ilgili kavramsal çerçeveye söz konusu âyetteki kavramlar da dâhil edilmiştir. Bu doğrultuda izzet, mülk, amel, sâlih ve kelime kavramları makalenin sınırlı alanı kapsamında incelenmiştir. Sözü edilen (...) kavramlar incelenirken genel bir çerçeve çizildikten sonra makaledeki teze destek olacak anlam çerçevesi üzerinde yoğunlaşılmıştır. Ele alınan kavramların pek çok çalışmada ele alınmasına binaen söz konusu kaynaklara da değinilmiş fakat sözlükler ve tefsirlerdeki açıklamalar esas alınmıştır. Kavramsal çerçeveden sonra izzet ve mülkün temini hususunda ilâhî meşîet ve ilâhî yasalar eksenindeki anlayışlara yer verilmiştir. Çalışmanın son kısmında özellikle Fâtır sûresinin zikri geçen âyeti ve sâlih amel kavramı çerçevesinde konuyla ilgili tarafımızca değerlendirmelerde bulunulmuştur. Bu değerlendirmelerde âyetlerin vakıa üzerinden tefsir edilmesi anlayışı ve tefsir kaynaklarında bu anlayışı yansıtan yaklaşımlar benimsenmiştir. (shrink)

Namaz birçok âyet ve hadisin önemine vurgu yaptığı ibadetlerdendir. Hatta Kur’an’da namazla birlikte anılmak, diğer ibadetler için bir değer ölçüsü olarak görülmüştür. Hz. Peygamber’in sözlerinde namaz, kalbî bir eylem olan imanın görünür ve yaşanır ölçüsü olarak kabul edilmiştir. Namazın terk edilmesi farklı yorumlar olmakla birlikte “küfür” kelimesiyle de ifade edilmiştir. Bu öneminden dolayı namazın kasten terkedilmesi, namaz vaktinin farkında olmadan kaçırılması veya gaflete düşüp namaz içerisinde birtakım yanlışlar yapılması gibi konuları içeren hadisler titizlikle ele alınıp anlaşılmaya çalışılmıştır. Üzerinde farklı yorumların (...) yapıldığı rivayetlerden biri de “kulun kıyamet günü ilk olarak namazdan hesaba çekileceğini” bildiren hadistir. Metnin devamında ise “şayet farzlarda bir eksiklik bulunursa bunların nafilelerle tamamlanacağı” haber verilmektedir. Bu muhtevasıyla rivayet; namazın tembellik ve gaflet eseri terkedilmesi, istemsiz olarak kaçırılması ve kılınırken yapılabilecek birtakım hataların telafisi gibi birçok ihtimale hamledilebilecek bir anlama sahiptir. Makalede söz konusu rivayetin senet ve metnine dönük değerlendirmeler yapılacak ve zikri geçen bu ihtimâllerden hangisine delâletinin daha kuvvetli olduğu tespit edilmeye çalışılacaktır. (shrink)

Bu çalışmamızda Kur’an’da ifadesini bulan tufan, çekirge, haşere, kurbağa ve kan ayetleri ile onların karşılığı olarak Tevrat’ta aktarılan kan, kurbağa, sivrisinek/bit, sinek/böcek, veba/sığır hastalığı, çıban, dolu, çekirge, karanlık ve ilk doğanların ölümü belaları ; rivâyetler, Tevrat verileri ve bilimselci yaklaşım ekseninde ele alınmıştır. Çalışmamızda, Kur’an’da firavun ve âline karşı Hz. Musa’ya dokuz ayet verildiğinden bahsedilmesine binaen bu mucizelerin neler olduğunun ortaya konulması ve ilgili ayet, rivayetler ve Tevrat’taki verilerin tekâbüliyet, nedensellik, tutarlılık, kozmik-büyüsel algı ve bilimsel veriler ekseninde değerlendirilmesi amaçlanmıştır. Bu (...) doğrultuda ilk olarak tefsir kaynaklarımızda dokuz ayetin neler olabileceğine dair ortaya konulan görüşler hakkında bilgi verilmiş ve tarafımızca da değerlendirmede bulunulmuştur. Ayrıca rivâyetler ile Tevrat’taki verilerin tekābüliyeti hususunda gerek ayetteki ilgili lafızların anlamsal çerçevesi gerekse bilimsel veriler üzerinden tarafımızca fikir yürütülmüş, söz konusu veriler; nedensellik ve tutarlılık gibi farklı açılardan değerlendirilmiştir. Konuyla ilgili olarak Doğu’da bilimselci yaklaşımların yok denecek kadar az olmasına bağlı olarak Batılı araştırmacıların Tevrat’taki veriler üzerinden geliştirdikleri bilimselci yorumlar üzerinde durulmuştur. Bu çerçevede dış faktör olarak Ege Denizi’ndeki Thera yanardağının patlaması üzerinde, iç faktör olarak da Mısır’da muhtemelen gerçekleşmiş olan tabii olaylar üzerinde durulmuştur. (shrink)

In recent years, decision-making processes related to medical practices have undergone a change from physician paternalism towards patient autonomy. However, it has been put forward that this situation has changed into or strengthened the parent paternalism for children. Parental paternalism might bring along decisions of refusing the child’s treatment, in such a way to occasionally violate the health right of the child. Paternalistic attitude of parents may also cause physicians to direct towards defensive medicine practices and to display a tendency (...) of avoiding legal liability rather than the benefit of the patient. Coming to the decision of the parent on refusing the child’s treatment together defensive medicine approach of the physician and an environment, where the legal protection mechanisms for the child are not efficient enough, causes serious violations of health rights. International contracts and national law require the protection of the child’s best interest in all cases. In that case, parent’s decision on refusing treatment of the child should be restricted within the scope of the child’s best interest and healthy life right. (shrink)

Paternalistic leadership, which is not Western origin, that combines benevolence and authority, is prejudiced and associated with traditionality by Western researchers. In the context of Hofstede's cultural dimensions, the dominant view in the literature is that the paternalistic leadership is more prevalent in feminine, collective, high power distant, and high uncertanity avoidance organizations. Based on literature, this study analyazes the relationship between these dimensions of culture and paternalistic leadership tendency of employee. For that purpose, research was carried out in Sakarya (...) University, where both traditional and Western administration approaches are assumed to be integrated. As a result of the questionnaire applied to both academic and administrative staff of the university, it was determined that individualism-collectivism, power distance and masculinity-femininity dimensions are effective on paternalist leadership tendency. Also, it was found that there is a statistically significant relationship between the participants’ gender and their paternalist leadership tendency. (shrink)

In this article, the effects of Internet use on the perception of loneliness of university students are investigated. The research sample consists of 202 university students studying medicine at Abant Izzet Baysal University. Demographic questions, “UCLA loneliness scale” and “ Internet Cognitive Status Scale (IBSQ)” were used in the study. The results of the questionnaires were transferred to SPSS and Mann Whitney U, Kruskal Wallis H and Spearman correlation analysis were performed. As a result of the analysis, it was observed (...) that men had a sense of solitude more than girls. It has been determined that internet use and the time allocated to the internet is more in men. In addition, the time allocated to the internet, economic situation, age, according to the variables lived in the perception of loneliness and problem with the use of Internet has been seen to be significantly different. According to the scores of the UCLA scale and the IBSQ scale, 92,1% of students have a mild and moderate sense of solitude and 7,9% have a dense sense of Solitude. 88.1% of students use normal and 11,9% problem-free internet. When the scores obtained from the scales were examined, it was found that the scores obtained from the UCLA scale (35.76±7.84) and the scores obtained from the IBD scale (97.14±31.83) were determined. In the correlation analysis, where the impact of Internet use on loneliness perception of the students was measured, it was concluded that there was a weak correlation (R=0.327 and p=0.000) and therefore the problem of Internet use affected loneliness perception even at a low level. 8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. Court (Shar’iyya) recordings are at the forefront of primary written sources, which contain important documents related to Turkish history, sociology and culture. The court records shed light on city history of the period concerned with rich information and documents. These records are important books in which the documents related to the judicial, administrative, economic, architectural and social structure of a city as well as diplomatic correspondence between the center and the province were recorded. The purpose of this study is to (...) prepare a detailed catalog in addition to the catalog which was made in 1963 and contained only 119 books specifying only the dates covered by the book number. As we have seen in this study, all of the 119 notebooks in the records do not consist of the court registers in the known form. They are the books that include the records of court proceedings, which are different from those of the court, especially after the Tanzimat e.g. Qassam, Enkiha, Zabt al-Da’wa, Permission and so on. The microfilms of the books were presented to the service of researchers in Sivas Ziya Bey Library of Ancient Works. The originals of the books are in the Prime Ministry State Archives.SummaryShar’iyyaregisters are one of the primary written sources about Turkish history, sociology, and culture relevant to our life. They are important notebooks, which are related to the judicial, administrative, economic, architectural and social structure of a city, and also in the form of diplomatic correspondence between the central and provincial posts.After the Anatolian Selçuk (Saljūq) State, which collapsed under the pressure and domination of the Iranian Mongols in the last half of the XIIIth century, a state was established in the Selçuk-Byzantine border in the north-west of Anatolia in XIVth century, which did not even lasted a hundred years and had a reign in three continents. In the Bursa inscription, which dated to 1337/8, the second Ottoman Sultan (Sulṭān) Orhan was titled as the mujahedeen (warrior), the sultan of the veterans, son of veteran of veteran. The fact that Orhan carring these titles shows that since the earliest times, the Ottoman sultans considered themselves as the leader of the religious war against the infidels. Since the first years of the establishment of the Ottoman State, the Sharīʿa ruled on the establishment of administration and for this reason, they established institution of the Shaykh al-Islām(the chief juristconsult). Firstly, by appointing a subaşı(subashi, an Ottoman gubernatorial title) to the conquered places, then it gradually began to establish judicial courts from the smallest areas.In the XVth century, the number of qāḍī increased in parallel with the increase in their jurisdiction as a result of the expansion of the Ottoman Empire, and the proliferation of the administrative units called sancak, (sanjaq, division of a province) and so the failure of oneqāḍīto satisfy court affairs of an entire sanjaq. New districts arose from some of the former large districts. As a result of this in the XVIth century, the administrative system of the sanjaq's Tımar system and at the same time a geographical integrity of the districts/provinces to see the legal work of a qāḍī to pass by the districts and sub-district as a legal caused to occur two legal definitions that is legal and military administrative. Records of qāḍīs, which is called as sicilemerged because it was their duty to record their works and orders issued to them and the answers and the provisions given to them.The courts of Shar’iyyaserved as primary general courts (maḥākim-i ʿumūmiye) until the declaration of the Tanẓīmāt in the Ottoman Empire and heard the suit at legal, criminal, administrative, military, financial and all kinds of cases. Tanẓīmāt period, or rather Maḥmūd II and the period following him, the judicial organs in terms of reorganization was a circuit that was on the scene.In this way, which was occurred in the judicial system, records which were kept in the Meşihat (Mashīkhat) began to diversify depending on this change. Since in the registry books, which we call classical, all correspondence between the central and provincial offices were recorded. Records such as pleas, letters of patent, verdicts, order of the high, bonds etc. could be found in these documents.These records, which are one of the most important sources of an Ottoman city history, were kept in the museums and libraries of the cities until recently. A few years ago, these records, with a correct decision, were collected in the Prime Ministry Ottoman Archives and it was preserved and presented to the use of researchers by transferring them into digital. The Sivas Court building as it is known in history is now in the Pāshābeg quarter and known as the Court Bazaar in these days. There is no clear information about when the court was built in Sivas. In time, changes have occurred in cities and we are losing the historical side of them. In addition, the fact that people acted in an unconscious manner that would harm the historical texture was the biggest factor in disappearance of material remains. With the remaining physical materials available, we can only access crumb information and we can only make predictions. In this evaluation, the biggest materials are the documents and notebooks, which are the memory of city dates. However, it is understood from the records that there is a foundation belonging to this court and some of the court's repair and maintenance works were carried out by this foundation. As it is understood from a document dated 14 August 1798, one of the repairs was sponsored by Ḥüseyin Efendī. In an inscription dated 1906, which was found during the renovation of the basement of an apartment building owned by the General Directorate of Foundations in May 2018, the location of the building was previously known as the Sivas Muftī 's Office.In this study, a total of 240 registry books belonging to Sivas were prepared as in a catalog system. In this study, we have seen that a great deal of records have been lost, burnt or destroyed in a certain way through history. The burn marks in the records of 79 is a striking example in this regard. The book number 139, which is not shown in Osman Ersoy's work, is a record book in classical form. An important case in this study is that the register number 206, which is registered to Sivas, belongs to the province of Burdur and it is also a registry book in classical form. The need for renewal felt in various fields with the Tanẓīmat, and the changes and modernization activities realized in accordance with it, and the nature and boundaries of these activities are important issues that determine the period's intellectual agenda. Some of the proposals for a solution to save the state are related to the renewal of religious thought. The bad situation in the Ottoman Empire stems from the way religion is understood, not from religion itself, and one of the names (...) that produce ideas about the necessity of changing this way of thinking is Ḥüseyin Kāẓım Kadri. He believes that Fiqh and Exegeticsshould be based on the work of updating the content of Islamic Sciences within the framework of contemporary needs. Claiming that the basic need of society is not Science of Kalām but Catechism, Kadri claims that the attempt of the science of Kalām, regulated to respond to the needs of the age will not result in even will cause religious conflict among people. In this article, Ḥüseyin Kāẓım Kadri'sintellectual background, his suggestions for the renewal of religious thought and his objection to the new Science of Kalām are discussed.Summary: What defines the history of late Ottoman period is the concept called change. There have been reform attempts in order to canalise the military, economic, socio-cultural change and transformation due to political turmoil starting from the end of the 16th century and beginning of the 17th century. Basic argument regarding these reforms finds its base on Qanūn al-Qadīm and the idea of returning to Sharia. Along with the Declaration of the Imperial Edict of Reorganization (Edict of Gulhane) the previous reforms which were made earlier changed dimension and westernization became a government policy. During the ongoing process, the change in terms of Westernization became a current issue within every segment of Ottoman society. Need for innovation in various areas, and therefore the change and modernization movements and accordingly these movements’ nature and boundries set the intellectual agenda of the era. Some of the suggestions are associated with renewal of the religious thought which are to keep the State from difficult situation it is in. Solutions proposed in this context creates a rich intellectual discussion environment within Western, Islamist, and Turkist intellectuals. Islamists in general terms are of the opinion that the difficult situation Ottoman is in does not stem from the religion itself but the way of understanding religion; and they are of the opinion that this way of thinking should be altered; when they bring about their suggestions, it is seen that the way of thinking is their starting point. What causes the Islamists fall apart within themselves is the nature of renawal. Islamist intellectuals, supporting the idea which is the content of islamic knowledge should be updated according the needs of era, suggest various ideas in terms of which dicipline should be in charge for the needs in question. While some intellectuals are of the opinion Kalām should be prioritised, some are of the opinion Fiqh and Exegetics should be prioritised. Ḥüseyin Kāẓım Kadri, who wrote under the pseudonym of Shaykh Muḥsin-i Fānῑ ez-Ẓāhirῑ, is one of these intellectuals coming up with an idea. Kadri suggests a renawal in thinking based upon Fiqh and ExegeticsḤüseyin Kāẓım Kadriis one of the most prominent intellectuals of Constitutional Period. Working as a governor of an Ottoman province, deputy, and minister and engaging in journalism, Kadri compiles a series of work in religion, language and agriculture. All of his efforts are to find ways of saving Ottoman from its difficult situations. Thus, Kadri questions the quality of the knowledge which was brought about in religious thinking and proposes solutions. What lies under his solution is the need for a dicipline for society’ s practical problems. He bases his opinion on opposition to new theology movement. According to Kadri, ever since Kalām was codified, it has never been useful to Muslims, on the contrary it has impaired the Muslims. Renowation of Kalām creates nothing but problem. In his opinion, due to using Greek philosophy content and method, Kalām is not a dicipline authentic to Muslims, besides it is a harmful dicipline which aims to damage the essence of Islam.One of the reasons why Kalām is out of Islamic thinking tradition is because of the Mu'tazila wises are the founders of this dicipline. Kadri is of the opinion that the wises/intellectuals belonging to this school and their theories regarding to understand the existence do not contribute to the field of faith. Admitting the function of Ahl-al Sunnah school generated after the Mihna Period, Kadri states the insufficient side of that function. To him, hence the subjects such as substance (cevher) –accident (araz), hudûth-eternality, wujud (vücûd)-nothingness (adem) etc have been discussed but at that time the subject in question could not be renovated in regard to needs. Another criticism of Kadri raised against Kalām is he considers this field the reason why Muslims are divided. Especially during the times when Muslims need to be in unity and solidarity, Kadri is worried about new discursion which will occur due to the renovation of Kalām attempts. This concern of Kadri causes him to object Kalām with a pragmatic motive.Kalām which is called Usulu'd-Din is another reason why Ḥüseyin Kāẓım Kadriis against Kalām. In his opinion, theologians complicates the subjects such as amalgation and adjectives of Allah instead of making it clear with ijtihad. Kadri who considers offering proof in terms of faith as faithlessness is of the opinion that faith is not a matter of reason but a matter of sense which has no doubt among people. Criticising the struggle for the enquiry of faith, Kadri puts an emphasis on the significance of the reinterpretation of the principles, for example in the field of Fiqh which deals with the practical area and says it is the most prominent religious duty. He also criticises the imitation of the past and remarks the importance of reason in Fiqh. As an alternative to Ilm-i Kalām, he claims a new Catechism and adds, it is going to provide the religious knowledge people need. It is an ideological contrast of Ḥüseyin Kāẓım Kadrito think Kalām is the reason for all the misfortune Muslims encountered. This opposition causes him to ignore all the accumulation in Kalām field. Moreover, it is the reason why he makes emotional deductions conflicting with historical facts. Kalām plays a role just like the other fields who could not contribute to Islamic Thinking and its renovation process in accordance with the needs of time. However, it is not realistic and reasonable to think Kalām is the only one responsible. (shrink)
