The results of empirical research show that people prefer to help identified individuals rather than unidentified ones. This preference has an important influence on many private and public decisions, for example concerning vaccination or the distribution of healthcare resources. The aim of this article is to define the terms: “identified”, “unidentified”, “statistical”, and then to analyze three philosophical arguments concerning the normative implications of this preference: 1) contractualism ex ante ; 2) fair distribution of chances and risks; 3) principles regarding (...) the concentration of good effects and the distribution of bad effects. I will demonstrate that these arguments, which are related to interesting philosophical problems, such as counterfactuals, are not convincing. (shrink)

Poland, after social-politic-economic transformation in 1989, became a capitalistic, free-market country. In this conditions human being can be perceived as an object, not a subject of economic life. Therefore the import ant issue is to take up problems associated with human subjectivity. And human subjectivity is expressed in his personal dignity.

This article examines the topic of approaches to personal development that aim at achieving the highest possible level. Such approaches are considered here in the context of Kazimierz Dąbrowski “Theory of Positive Disintegration”. The shaping of the personality is accomplished by the dynamic integration and disintegration of the individual, and also by considering his/her five levels of development. The first level is called the stage of primary integration, whilst harmonious secondary integration refers to the highest level of development itself. The (...) discovery of the highest level of personal value in one’s progress is one of the most effective stages in protecting the individual from any unacceptable moral or ethical standards present in society. It is also effective in the resocialisation of cases involving social pathology. Each person has the task of promoting their personal values to the highest level of development. Celem opracowania jest dookreślenie tego, czym jest prywatność. Interesuje mnie prywatność w aspekcie nor¬matywnym, jako coś, co uważamy za nasze dobro; coś, czego się domagamy, co jest naszym prawem, i to nie tylko w sensie moralnym, ale także chronionym prawem pozytywnym. Prywatność jest czymś relacyjnym, i to przynajmniej w dwojakim znaczeniu. Po pierwsze, konstytuowana jest poprzez relację oddzielenia od czegoś - państwa, zakładu pracy (pracodawcy), rozmaitych instytucji. Po drugie, to, co prywatne z punktu widzenia jednych relacji - np. relacji jednostki (...) do państwa, do sprawowanych urzędów - nie musi być prywatne z punktu widzenia pracy zawodowej. Prywatność nie jest oparta na prostej opozycji pomiędzy tym, co społeczne, grupowe, a tym, co osobiste, indywidualne; podmiotem prywatności może być podmiot zbiorowy i nie wobec każdej grupy społecznej można się sensownie domagać prywatności. Prywatność pozwala w pełni dysponować tym, co „moje”. Sfera prywatna daje szczególne możliwości realizacji moich własnych celów, uzyskuję przestrzeń indywidualizacji, realizacji siebie jako niepowtarzalnej jednostki, której też sam jestem autorem. W sferze prywatnej podmioty stają się też podmiotami tworzącymi przestrzeń normatywną, uznając reguły rozpoznawane jako wyraz tego, co naturalne, zastane, i tworząc lub współtworząc z innymi uczestnikami tej sfery własne reguły, realizując przez to istotny wymiar autonomii osoby. Prywatność daje wreszcie przestrzeń dla rozwoju relacji ściśle osobowych, opartych na wyłączności tego, co między osobami się rozgrywa. Mając na uwadze zbieżność dążenia do ograniczania prywatności z wprowadzaniem elementów totalitarnych, można także zauważyć, że ochrona prywatności nie tylko chroni jednostki, ale i potrzebna jest sferze publicznej jako jeden ze środków przeciwko wadom rozwiązań totalitarnych. The German philosopher tried to unite two different philosophical traditions: phenomenology and classical metaphysics. His main achievement was foundation of the new anthropological position based on the phenomenological concept of Sachlichkeit and the ontology of constitution. Asking about the Person in colloquial meaning is asking about the cultural pattern of (...) the Person at the same time. What can be helpful in leaving the cultural pattern of the Person without leaving an essence of problem known as a Person, but difficult to indicate without an example? Answer at this question, will be probably similar with finding an essence of the Person as a pure comprehension. Phenomenology, as a finding of certainty can be a method in that “personalistic adventure”, especially in version of the German phenomenologist – Max Scheler, who was trying to explain comprehension of the Person from the emotional point of view. Emotions, which can be understood as a phenomenon of the Person appearing in the practical function, and creating a culture with its examples of the Person, and finally giving its place in non personal surrounding world. Here appears solution. By using Scheler’s method describing the Person from the emotional side, it seems to be possible to separate the pure comprehension from the cultural pattern of the Person. That shows another reduction, next to well known reductions in Phenomenology. It could be something like an emotional reduction, which separates the Person from non personal structure of surrounding world and not gives a cultural pattern of the Person at the same time. The next move is building a dialogue as a relation between Persons, which defines them as a dialogical subjects. (shrink)

Za „ojca” filozoficznej kategorii „godności”, która legła u podstaw kategorii prawnej, uznawany jest powszechnie Immanuel Kant. Przypomnieć jednak trzeba, że w bardzo podobny sposób, choć w zasadniczo odmiennym kontekście systemowym, charakteryzował godność Tomasz z Akwinu, pół tysiąca lat wcześniej, uznając ją za fundament bycia osobą. Stąd najistotniejszym i centralnym elementem, tytułowej, klasycznej koncepcji człowieka jest koncepcja godności. Akwinata jest autorem bodaj najbardziej rozbudowanej koncepcji osoby w tradycji filozofii klasycznej. Co więcej zmierzać będę do wykazania, że jego koncepcja lepiej nadaje (...) się do teoretycznego ugruntowania praw człowieka niż koncepcja Kanta. Rekonstruując propozycję Kanta ograniczam się, zasadniczo rzecz biorąc, do analizy Uzasadnienia metafizyki moralności. Interesować będą mnie zagadnienia podstawowe, przede wszystkim – wynikające z różnicy kontekstów systemowych – różnice w pojmowaniu bycia celem samym w sobie. W perspektywie ontologicznej koncentrować się będę na powiązaniu godności z indywidualnością; w perspektywie antropologicznej – na tym, jakiego typu działania stanowią o doskonałości człowieka, jakie działania (czym określone) realizują człowieka jako cel sam w sobie. W szczególności interesować się będę miejscem rozumu i woli w określaniu treści działań (w perspektywie kantowskiej będzie to pytanie o określenie treści powinności; w perspektywie Tomasza – pytanie o treść realizowanego dobra). Zasadnicze pytanie, które leży u podłoża podjętej problematyki antropologicznej, jest pytaniem o to, na ile dla pojmowania godności istotne jest uznanie woli jako w sposób wolny współokreślającej treść powinności (Kant) lub dobra (Akwinata), a na ile woli jedynie podążającej za poznaną powinnością lub poznanym dobrem. Zmierzać będę do uzasadnienia tezy, że koncepcja Akwinaty w ugruntowaniu godności akcentuje wprost indywidualność opartą na wyborze czegoś, co nie jest jednoznacznie treściowo obiektywnie zdeterminowane i co wykracza poza to, co powszechne, poza to, co gatunkowe; natomiast koncepcja Kanta godność wiąże przede wszystkim z tym, co powszechne, gatunkowe i zapoznaje doniosłość indywidualności dla pojmowania godności. "Dignity as a Quality of Person: Types of Dignity – a Proposed Systematisation" This study aims to identify various meanings of the expression (name) “dignity”, with particular emphasis on the meanings of the expression as it appears in the text of the Constitution of the Republic of Poland. The meaning of the name “dignity” is the concept of dignity; in turn, the concept of dignity encompasses dignity of particular types. Twelve different meanings of the expression “dignity” are indicated – twelve (...) different concepts of dignity, and thus twelve types of dignity. Half of them are meanings (concepts) that recognize dignity as something belonging to a human being as a subject of law, and this essay is devoted to this group of meanings. This group of meanings includes three concepts of dignity which encompass dignity as something constitutive of being a person: (1) inherent dignity of the person, (2) dignity established by qualities specific to a thinking being, and (3) dignity as a historically emergent social status of all human beings. Only the first of these three concepts of dignity is adequate to the interpretation of the preamble and art. 30 of the Polish Constitution. The second group of meanings, treating dignity as something with which the human being is endowed, includes concepts which encompass (4) personal dignity (honour and good reputation), (5) dignity as moral excellence, and (6) dignity as appropriateness of attitude or behaviour. The other half of the meanings take dignity as something that belongs to something. These meanings will be considered in the forthcoming essay Godność jako cecha podmiotów zbiorowych i godność jako cecha ugruntowana instytucjonalnie. Typy godności – propozycja systematyzacji [Dignity as an Attribute of Collective Entities and Dignity as an Institutionally Grounded Attribute: Types of Dignity – a Proposed Systematisation]. The Constitution of the Republic of Poland speaks of (1) the dignity of the Nation, (2) the dignity of office or function, and (3) public dignity. The expression “dignity” when designating something belonging to something can also designate (4) the dignity of social status based on belonging to a social group, (5) the dignity of a profession, and – specifically to the Polish language – (6) dignity meaning a surname. The author argues that it is unacceptable to ascribe different concepts of dignity to the expression “dignity” appearing in a specific legal provision. STRESZCZENIE Opracowanie zmierza do identyfikacji różnych znaczeń wyrażenia (nazwy) „godność”, ze szczególnym uwzględnieniem znaczeń tego wyrażenia występującego w tekście Konstytucji RP. Znaczeniem nazwy „godność” jest pojęcie godności; z kolei pojęcie godności ujmuje samą godność danego typu. Wskazanych zostaje dwanaście różnych znaczeń wyrażenia „godność” – dwanaście różnych pojęć godności, zatem i dwanaście jej typów. Połowa z nich to znaczenia (pojęcia), które ujmują godność jako coś przynależnego człowiekowi jako podmiotowi i tym znaczeniom (i odpowiadającym im typom godności) poświęcone jest niniejsze opracowanie. W tej grupie znaczeń odróżnione zostają trzy pojęcia godności, które ujmują godność jako coś konstytutywnego dla bycia osobą – (1) przyrodzoną i niezbywalną godność osobową, (2) godność opartą na obserwowalnych i zmiennych cechach specyficznych dla istoty rozumnej i (3) godność opartą na historycznie ukształtowanym statusie społecznym przypisanym wszystkim ludziom. Jedynie pierwsze z tych pojęć jest adekwatne do interpretacji preambuły i art. 30 Konstytucji RP. W drugiej grupie znaczeń ujmujących godność jako coś przysługującego człowiekowi są pojęcia ujmujące godność jako cechę osoby – (4) godność osobistą (cześć i dobre imię), (5) godność osobowościową (poziom moralny) oraz (6) godność jako dyspozycja do stosownego sposobu bycia. Druga połowa znaczeń ujmuje godność jako coś przynależnego czemuś lub jako coś o charakterze konwencjonalnym, instytucjonalnym. Te znaczenia będą omawiane w kolejnym opracowaniu Godność jako cecha podmiotów zbiorowych lub cecha ugruntowana instytucjonalnie. Typy godności – Propozycja systematyzacji – Część 2. Konstytucja RP mówi o (1) godności Narodu, (2) godności urzędu lub funkcji, oraz o (3) godności publicznej (godnościach publicznych. Wyrażenie „godność” jako desygnujące coś przynależnego czemuś może także desygnować (4) godność statusu społecznego opartego na przynależności do jakiejś grupy społecznej, (5) godność zawodu oraz – co specyficzne dla języka polskiego – (6) godność jako nazwisko. W kontekście wielości pojęć osoby i ich znaczenia dla sposobu organizowania przez człowieka życia jednostkowego i społecznego, sprawą kluczową jest zwrot w kierunku realistycznego pojęcia osoby. W niniejszym studium przeprowadzono krytyczną analizę kilku wybranych relacjonalnych koncepcji osoby z pozycji tomizmu egzystencjalnego. W efekcie przeprowadzonej analizy potwierdzono założoną hipotezę, iż wybrane relacjonalne koncepcje osoby mają charakter aprioryczny, jednakże tylko w odniesieniu do istoty osoby. Studium odpowiada na pytanie, dlaczego analizowane koncepcje nie wyjaśniają samej istoty realnej (...) class='Hi'>osoby ludzkiej, a tylko wskazują na jej cechy rozpoznawcze, opisując egzystencję i drogi spełniania się osoby. In search of a realistic concept of person In the context of the multiplicity of concepts of the person and their importance for the way in which man organizes his individual and social life, a turn toward a realistic concept of the person is crucial. In this study, a critical analysis of several selected relational concepts of the person from the position of existential Thomism is carried out. As a result of the analysis, the assumed hypothesis was confirmed that the selected relational conceptions of the person are a priori, however, only with regard to the essence of the person. The study answers the question of why the analysed concepts do not explain the very essence of the real human person, but only point to its identifying features, describing the existence and ways of fulfilment of person. The status of the child in the context of contemporary socio-cultural processes that are reflected in the market is the main issue discussed in this paper. It may be surprising to concentrate on children and the market, while the sphere of economic exchange is the scene of such actions as work, production and consumption which seem to be reserved to adult members of the society. Although there are issues – such as kids advertisement and its consequences, and children’s participation in (...) the process of buying – that are discussed, the range of problems that deserve consideration is far wider. The questions analyzed in this paper concentrate on two aspects. First of them is the influence of the market sphere on the life of children as members of the families and the society. The question that should be asked here is whether a child can and should be regarded as any other consumer, or should be protected – e.g. against controversial marketing practices. The second group of problems is connected with the objective way of treating children which leads to formation of something that can be called the markets of children”. Both these sets of issues are the stimulus to analyze the way of understanding a child and its status in the society. It is also done through taking into consideration such issues as current concepts of socialization, antipedagogy, infantilisation and adultisation that influence and shape market processes. Finally the analysis undertaken in this paper leads to an attempt to answer the question whether in the current context children are seen as persons or resources. (shrink)

The fundamental rules which should be followed by Notary Public are: honesty, reliability, detachment and impartiality, as well as keeping the professional secret. As a crucial participant in creating and carrying into effect legal structures of free market, Notary Public performs public functions. Therefore, he or she is authorized to give an official character to declarations of persons being their clients. In view of the foregoing, the notary should secure such documents in trading abiding by the rules and regulations of (...) the governing law and ethics. With a view to a special role of the profession in question in economic trade, The National Notary Board passed a Notary Public Code of Professional Ethics, by virtue whereof a Notary shall with their attitude and actions give a good character to their profession and mind its dignity and honor. Any breach of the above – mentioned rules results in the Notary’s liability. Notary Public, as a person whose functions play a crucial role in legal trade and who is trusted by the parties, is responsible for correctness and precision of their activities. Their liability as clients’ confidant may result in civil, legal, disciplinary and tax liability. (shrink)

Artykuł dotyczy zagadnienia wolności indywidualnej i problemu zagrożeń, jakie może pociągać za sobą hołdowanie niektórym jej odmianom. Klasycznie pojmowana wolność, zwana negatywną, utożsamiana z brakiem zewnętrznego przymusu, może stać w opozycji do tak zwanej wolności pozytywnej. To ostatnie pojęcie definiowane jest na ogół poprzez możność, co przywodzi na myśl jego związek z pojęciem władzy. Punktem wyjścia rozważań stała się analiza wybranych aspektów obu wolności. Rozróżnienie tych dwóch fenomenów jest istotne dla zrozumienia niektórych procesów zachodzących we współczesnej wspólnocie politycznej. Konsekwentne odwoływanie (...) się do paradygmatu tzw. wolności pozytywnej może bowiem przynosić trudne do przewidzenia konsekwencje w postaci uzasadnianej ideologicznie ingerencji w wiele sfer ludzkiego działania. Za szczególnie brzemienne w skutki należy uważać konotacje tzw. wolności pozytywnej i równości. W istocie bowiem wolność pozytywna, a szczególnie jej postulat szerzenia równości, staje się pretekstem dla zwiększania zakresu politycznego panowania. Może to wyrażać się w dążności do urzeczywistniania aspiracji jednych grup społecznych kosztem innych. Takie podejście siłą rzeczy stoi w opozycji do poglądów upatrujących fundamentów społecznego porządku w prymacie wolności negatywnej i obowiązywaniu zasad sprawiedliwości. Wspomniana ingerencja instytucji państwa w ludzkie działanie, będąca skutkiem propagowania niektórych aspektów koncepcji „wolności do” może grozić redukcją podmiotowości moralnej osób. (shrink)

Książka Grzegorza Hołuba Understanding the Person. Essays on the Personalism of Karol Wojtyła zawiera próbę rekonstrukcji filozofii osoby w ujęciu Karola Wojtyły. Zawiera omówienie następujących zagadnień: geneza filozofii osoby u K. Wojtyły, jego epistemologia i metafizyka osoby, stanowisko w kwestiach świadomości, emocji, działania i godności osoby. Wieloaspektowość i wszechstronność opracowanych zagadnień pozwalają nie tylko zrekonstruować personalistyczną teorię K. Wojtyły, ale również wytyczyć kierunki jej dalszego rozwoju – metafizykę osoby, analizę fenomenologiczną, osoba w kontekście neuronauk. Do (...) tych kierunków można dodać teorię sieci społecznych. Narzędzie to pozwoliłoby na poszerzenie teorii personalistycznej o społeczny, praktyczny wymiar relacji międzyludzkich i praktyczną analizę fenomenów takich, jak np. wolność, odpowiedzialność, solidarność, miłość czy sprawiedliwość. The teaching of John Paul II clearly articulates the strain of human rights. The Pope initiates a dialogue with the Enlightenment tradition and develops the theological and philosophical foundations of the culture of human rights. Karola Wojtyła’s personalistic thought appears to be a very coherent and reliable key to understand the doctrine of human rights. Wojtyła stresses subjectivity and non-reducibility of the person as a concrete human „I.” It is both autonomy and transcendence that constitute dignity of the person towards (...) other personal and impersonal beings. When we ask what it takes to be a person, the criteria we impose usually leave questions outstanding about some merits of the human species. This paper discusses the questions that concern the status of the very young or the unborn, and the extra problems that arise when we consider children born with savage mental or physical impairments. The paper exploits the notion of potentiality to suggest that the title of “person” is relatively unimportant, since our ethical obligations to infants (...) and foetuses can be shown to be as stringent as are those to any adult; and introduces the idea of “an Aristotelian loss” to explain the extent of our obligations to the impaired. It is suggested in conclusion that the development of IVF techniques adds no extra dimensions to this problem. The article is adapted from a chapter of a forthcoming book on personal identity.
