Dessen Urheber, Ernst Bloch, war allerdings nicht ins Scheitern, sondern ins "Gelingen verliebt" Für die Philosophie der "konkreten Utopie", die sich strikt vom utopischen Denken im Sinne eines "wishful thinking" abgrenzt, ist die gesellschaftliche Praxis Orientierungspunkt. Die Trias "Solidarität, Allianztechnik, Heimat" markiert ein Ultimum, das latent im Weltprozess vorscheint, aber der Realisierung durch das menschliche Subjekt immer noch bedarf. Ein entsprechendes philosophisches Begriffsinstrumentarium, dem der Gedanke vom "Prius der Theorie, Primat der (...) Praxis" zugrunde liegt, hat Bloch systematisch in seiner Kategorienlehre entwickelt. Gegenstand ist das universelle menschliche Sein als "Noch-Nicht-Sein". Akzentuiert wird die auf dem Prozesscharakter der Materie beruhende Möglichkeit der Veränderung. Dabei umfasst das Denken nicht nur Gesellschaft, Kunst und Religion, sondern auch die Natur - ein Gebiet, das zunehmend zu philosophischer Insichtnahme auffordert. At the beginning of the year, the Draft Common Frame of Reference (DCFR) was published. The text is the result of the work of a broad range of private law scholars from the Member States of the European Union, and it presents itself as an ‘academic’ document, committed to the precepts of scholarship rather than politics. Notwithstanding its unwieldy name, the text is nothing less than the draft of the central components of a European Civil Code. The following article aims (...) to inform the reader about this potentially important document and to initiate further academic debate about it. Following an overview of the genesis and content of the DCFR (Part 1), the discussion focuses on whether, and to what extent, it is based upon consistent and convincing core aims and values (Part 2). The article then proceeds to address, more specifically, the significance of private autonomy, and it examines the extent to which the proposed rules satisfy the requirements of legal certainty and legal clarity (Part 3). Thereafter, the DCFR is measured against the criteria of internal consistency and systematic integrity (Part 4). Also (Part 5) the question is asked whether the Draft critically reflects and convincingly integrates the sources on which it is based (that is the Lando Commission's Principles of European Contract Law and the Acquis Principles, as well as the private law traditions of the Member States). Also deserving of attention is the inclusion of more than 120 definitions of central concepts of private law, which are not to be found in this form or level of detail in either the Lando Principles or the national private laws (Part 6). The article examines how the rules on formation of contract and on mistake, contained in the various transnational model rules that have been published over the past two decades, have taken shape. The approach adopted here is based on an analysis of the ‘textual stratification’ of European private law. The relevant instruments (Convention on Contracts for the International Sale of Goods, Principles of European Contract Law, UNIDROIT Principles of International Commercial Contracts, Draft Common Frame of Reference, Principes contractuels communs) are (...) analysed and compared in their historical sequence. To what extent and why have the texts been transformed in the process? The article demonstrates that there is a very considerable common ground reflecting the state of the art of comparative research in these fields over the past hundred years. It also highlights issues on which consensus must still be reached and it suggests patterns towards reaching such consensus. It is argued that the Principles of European Contract Law, rather than the Draft Common Frame of Reference, should provide the point of departure for future discussions. Russia’s war against Ukraine has grave consequences in several political categories. These include: a reassessment of the school of ‘political realism’, one of whose proponents claims to have predicted the war. Was the West partly ‘responsible’ for the war? Second, to what extent does the war of aggression, as an undeniable violation of law, damage the status of international law and justice? Third, the war is embedded in political developments that stretch back a century. It is examined in its context (...) within American foreign policy since the Wilsonian peace programme, in relation to the dangerous reluctance of the EU to pursue a decisive geopolitical policy towards Russia, and interpreted in the light of Stalinist echoes within Russian politics. We are witnessing a dramatic increase of the percentage of old people in our population- this is what we call the aging of society. The basic question involved in this matter concerns the relationship of the different age groups to each other. What kind of solidarity is demanded from the younger generation and to what extent are they willing to provide it? Many old people, especially the very old ones, have to rely upon help from others for Ionger periods of (...) time. To give them support may be a tough job with only little reward. The people involved are often unable to cope with the situation and it is not uncommon that mutual violence occurs. A prerequisite for real help and support is human attention and a conscious affirmation of life even if it is a dependent one in its last phase. In Switzerland -like in other countries- we only have homes and therapeutical institutions for long-term patients, but not enough people who are really willing to provide true care and counsel. It is necessary to accept that others are individuals and to be aware of alle the facets of life. (shrink)

The guidelines of the >German Medical Association< for doctors treating the dying passed on 11. Sept. 1998 are trying to provide an ethically justified frame for medical decisions conceming the end of life. In certain justified cases they allow non-treatment decisions and allevation of pain and symptoms that might cause the patient's death while they strictly reject voluntary active euthanasia, non-voluntary euthanasia or assisted suicide.

Martin Seel once made a very derogatory comment on Thomas Mann’s ›Doktor Faustus‹, which can also be called »Nietzsche novel«. I take this as an opportunity to appreciate, in a broader perspective, a thinking born from historical experience and cultural sensitivity in the context of Adorno and Nietzsche. Thomas Mann’s confrontation with the ambivalence of modernity, motivated by National Socialism, points to an unsurpassable intellectual imprint that he shares with Adorno’s experience-bound philosophy. Adorno’s theory of art is aptly corrected by (...) Martin Seel with regard to its aesthetic utopia, but at the same time the affirmative potential of art is vindicated. Following Adorno, art is capable of opening up experiences in its own way that can also provide impulses for politics. This can equally be said about Thomas Mann’s ›Faustus‹. (shrink)

‘Mimesis’ is a concept explored in Antiquity as well as in cultural history. It also plays an important role in the Bible. In this article we argue for ‘mimesis’ as a role model for Bible teaching in religious education. In the first part we give some insights into the concept of mimesis, drawing on ancient philosophers (Aristotle, Plato). ‘Mimesis’ does not denote a copy of a prescribed object; instead, the type of depiction and reference brings it into the present in (...) an intensive, creative and productive way. In the second part we want to give some examples for how ‘mimesis’ is used in the Bible itself. Biblical tradition can be described as a ‘mimetic process’. Furthermore, authors like Paul explicitly use the concept of ‘mimesis’, for example in his ethical admonition. Thus, the use of ‘mimesis’ in the Bible inspires directly our teaching on biblical genres, motifs and ways of thinking. The third part gives a draft of how the ‘mimetic didactic’ works, drawing on parables, Gospel writing, Johannine theology and coping with painful fate like Job. Mimetic hermeneutics transforms tradition in applying it into the contemporary situation. This can prove stimulating for contemporary contexts: mimesis is closely connected to tradition, but simultaneously encourages its transmission into the present day with astonishing variability and freedom. This volume focuses on the interrelatedness of morality and language. Apart from explicit ethical statements, implicit NT moral language is analysed in three overlapping aspects based on the interpretation of concrete NT texts: an intratextual level (linguistic and analytic philosophical methods: syntactical form, style and logic), an textual and intertextual level (form criticism, discourse analysis) and an extratextual level (speech act analysis; rhetoric; reader-response criticism). With reference to analytical moral philosophy, the contributions address questions such as: Where does the ethical (...) quality of a statement come from? Which linguistic devices are used to express ethics in the NT writings? In which way does the genre of the text influence its ethical meaning? Which pre- and intertexts are part of the ethical statements, in which way does the text refer to them? Which ethical impact did and do texts have on their readers? Which linguistic and rhetorical style is used to meet the addressees? Why do we consider a text powerful or polemic? Can we speak of an implicit ethical subject in the text from a literary perspective? (shrink)
