This article explores the extent to which a feminist reading of gender mainstreaming is incorporated in the EU political discourse by analysing how family policy and gender inequality in politics are framed in EU policy documents. Gender mainstreaming is treated as an open signifier that can be filled with both feminist and non-feminist content. The article provides a set of criteria to assess whether a feminist reading of gender mainstreaming has been adopted. The frame analysis of EU documents on family (...) policy and gender inequality in politics reveals but a partial adoption of a feminist understanding of gender mainstreaming and only in the area of gender inequality in politics. Discursive dynamics play an important role in shaping the meanings of gender equality. The article discusses the relation between hegemonic discourses on gender equality policies and feminist taboos. It suggests that feminist scholars could paradoxically be trapped in hegemonic discourses on gender equality policies that may lead to taboos about particular approaches to and interpretations of such policies. Three main feminist hegemonic discourses are considered to act as taboos. They deal with the possibility to overcome patriarchy, the role of elites (...) and other groups of actors in processes of gender transformation and the merits of incremental change. The article further discusses the implications of the postulate about hegemonic discourses and taboos on gender equality for feminist knowledge production and reflects on the potential of Bacchi’s notion of ‘reflexivity’ to overcome them. Gender quota do not always go hand in hand with a considerable rise in the number of women elected. Although the number of fe/male representatives elected depends on several factors, we argue that the stipulations of gender quota acts influence to a large extent their impact on the sex ratios in politics. This is not so much due to the share of fe/male candidates parties have to present than to the extent to which a gender quota act anticipates the particularities (...) of the electoral system. A comparative analysis of three prominent cases, the Argentinean, Belgian and French gender quota acts, shows that the more a gender quota rule targets at the specificities of the electoral system in order to promote a gender balance in political representation, the more this rule 'guarantees' a result, even though gender quota acts concern but the input side of the electoral process. A number of attempts have been made to conceptualise legal reasoning along falsificationist lines. This paper criticises a recent one by Bernhard Schlink. After familiarising the reader with falsificationism, I argue that falsificationism is premised on an epistemological asymmetry between singular observation statements and universal hypotheses, and that absent such an asymmetry in the context of statutory interpretation, framing jurisprudence in falsificationist terms is unwarranted and misleading. To get off the ground, legal falsificationism would need to combine with some kind (...) of broadly intuitionist moral cognitivism, but even then, it would still misrepresent what is going on in legal reasoning. The arguments in this paper apply mutatis mutandis to all falsificationist theories of legal and ethical reasoning. I point to some by Albert, Canaris and Larenz. (shrink)

This article provides a state of the art of the growing normative plea for enhanced representativeness, by which we understand a form of representation considering the sociodemographic particularities of society. We look at the Anglo-American plea for group representation and the French debate on parity democracy. Concerned with the structural marginalisation of large numbers of citizens from the political arena, these scholars criticise the abstract concept ofcitizenship and the interpretation of the process of representation as such. The plea for enhanced (...) representativeness faces more than one normative challenge. Dealing with these issues the scholars pleading for enhanced representativeness above all reveal that the issue for or against representation in terms of representativeness is a matter of choice on underlying normative assumptions.
