This study examines the role of codes of ethics in reducing the extent to which managers act opportunistically in reporting earnings. Corporate codes of ethics, by clarifying the boundaries of ethical corporate behaviors and making relevant social norms more salient, have the potential to deter managers from engaging in opportunistic financial reporting practices. In a sample of international companies, we find that the quality of corporate codes of ethics is associated with higher earnings quality, i.e., lower discretionary accruals. Our results (...) are confirmed for a subsample of firms more likely to be engaging in opportunistic reporting behavior, i.e., firms that just meet or beat analysts’ forecasts. Further, codes of ethics play a greater role in reducing earnings management for firms in countries with weaker investor protection mechanisms. Our results suggest that corporate codes of ethics can be a viable alternative to country-level investor protection mechanisms in curbing aggressive reporting behaviors. (shrink)

Robots are increasingly envisaged as our future cohabitants. However, while considerable progress has been made in recent years in terms of their technological realization, the ability of robots to inter-act with humans in an intuitive and social way is still quite limited. An important challenge for social robotics is to determine how to design robots that can perceive the user’s needs, feelings, and intentions, and adapt to users over a broad range of cognitive abilities. It is conceivable that if robots (...) were able to adequately demonstrate this, humans would eventually accept them as social companions. We argue that the best way to achieve this is using a systematic experimental approach based on behavioral and physiological neuroscience methods such as motion/eye tracking, electroencephalography (EEG), or functional near-infrared spectroscopy (fNIRS) embedded in interactive human-robot paradigms. This approach requires understanding how humans interact with each other, how they perform tasks together and how they develop feelings of social connection over time, and using these insights to formulate design principles that make social robots attuned to the workings of the human brain. In this review, we put forward the argument that the likelihood of artificial agents being perceived as social companions can be increased by designing them in a way that they are perceived as intentional agents that activate areas in the human brain involved in social-cognitive processing. We first review literature related to social-cognitive mechanisms involved in human-human interactions, and high-light the importance of perceiving others as intentional agents to activate these brain areas. We then discuss how attribution of intentionality can positively affect human-robot interaction by (a) fostering feelings of social connection, empathy and prosociality, and by (b) enhancing performance on joint human-robot tasks. Lastly, we describe circumstances under which attribution of intentionality to robot agents might be disadvantageous, and discuss challenges associated with designing social robots that are inspired by neuroscientific principles. According to the so-called strong variant of Composition as Identity (CAI), the Principle of Indiscernibility of Identicals can be extended to composition, by resorting to broadly Fregean relativizations of cardinality ascriptions. In this paper we analyze various ways in which this relativization could be achieved. According to one broad variety of relativization, cardinality ascriptions are about objects, while concepts occupy an additional argument place. It should be possible to paraphrase the cardinality ascriptions in plural logic and, as a consequence, relative (...) counting requires the relativization either of quantifiers, or of identity, or of the is one of relation. However, some of these relativizations do not deliver the expected results, and others rely on problematic assumptions. In another broad variety of relativization, cardinality ascriptions are about concepts or sets. The most promising development of this approach is prima facie connected with a violation of the so-called Coreferentiality Constraint, according to which an identity statement is true only if its terms have the same referent. Moreover - even provided that the problem with coreferentiality can be fixed - the resulting analysis of cardinality ascriptions meets several difficulties. (shrink)

He taught in Naples and Rome, then for the ten years 1939-1948 at the University of Pennsylvania. The work of Giorgio Agamben, one of Italy's most important and original philosophers, has been based on an uncommon erudition in classical traditions of philosophy and rhetoric, the grammarians of late antiquity, Christian theology, and modern philosophy. Recently, Agamben has begun to direct his thinking to the constitution of the social and to some concrete, ethico-political conclusions concerning the state of society today, and the place of the individual within it. In Homo Sacer, Agamben aims to connect the problem (...) of pure possibility, potentiality, and power with the problem of political and social ethics in a context where the latter has lost its previous religious, metaphysical, and cultural grounding. Taking his cue from Foucault's fragmentary analysis of biopolitics, Agamben probes with great breadth, intensity, and acuteness the covert or implicit presence of an idea of biopolitics in the history of traditional political theory. He argues that from the earliest treatises of political theory, notably in Aristotle's notion of man as a political animal, and throughout the history of Western thinking about sovereignty, a notion of sovereignty as power over "life" is implicit. The reason it remains merely implicit has to do, according to Agamben, with the way the sacred, or the idea of sacrality, becomes indissociable from the idea of sovereignty. Drawing upon Carl Schmitt's idea of the sovereign's status as the exception to the rules he safeguards, and on anthropological research that reveals the close interlinking of the sacred and the taboo, Agamben defines the sacred person as one who can be killed and yet not sacrificed—a paradox he sees as operative in the status of the modern individual living in a system that exerts control over the collective "naked life" of all individuals. The paper takes into consideration the different degrees of power and control that can be exercised by the mediator/arbitrator. This issue is investigated with particular regard to such aspects as the nature of the ADR procedure adopted, the cultural context in which the procedure takes place, and the formulation of specific legal norms. The analysis both of a few arbitration rules and some data from real arbitral proceedings shows great reliance on the arbitrator’s discretion and use of common sense, which (...) is in line with the idea itself of arbitration. Moreover, the high degree of power autonomy enjoyed by the arbitrator during the whole procedure derives from the presupposition that the parties accept the arbitrator’s personal opinion and final judgment and from the fact that the majority of the disputes in international commercial arbitration are of a technical and complicated nature. The analysis also shows that the legal background of most arbitrators tends to surface even when they are involved in alternative dispute resolution proceedings and is clearly visible in the orderly allocation of turns and the strict control over the procedures to be followed. Especially when arbitrators are lawyers or judges, they tend to promote a feeling of belonging to the same professional community, which induces a greater spirit of cooperation and a lowering of the control level. The essays consider figures in the history of philosophy (Plato, Plotinus, Spinoza, Hegel) and twentieth-century thought (Walter Benjamin, Heidegger, Derrida, Deleuze, the historian Aby Warburg, and the linguist J.-C. We can no longer speak of a state of war in any traditional sense, yet there is currently no viable theory to account for the manifold internal conflicts, or civil wars, that increasingly afflict the world's populations. Meant as a first step toward such a theory, Giorgio Agamben's latest book looks at how civil war was conceived of at two crucial moments in the history of Western thought: in ancient Athens (from which the political concept of stasis emerges) and (...) later, in the work of Thomas Hobbes. The importance of the comparative notion of versimilitude, or truthlikeness, for a realist conception of knowledge follows from two modest ‘realist’ assumptions, namely, that the aim of an enquiry, as an enquiry, is the truth of some matter; and that one false theory may realize this aim better than another. However, there seem to be two ways in which one (false) theory can realize this aim better than another. One (false) theory can be closer to the truth than another either (...) by being preponderantly more accurate in its predictions or by providing more comprehensive information about the system (or class of systems) at issue. This paper presents a model-theoretic approach to the analysis of the comprehensiveness-related component of the comparative notion of versimilitude.
