The Aceh Jinayat Qanun, which is often considered violating Human Rights, has become the choice of the non-Muslim minorities as their rational choice. This study aims to analyze non-Muslims’ choice of The Aceh Jinayat Qanun implemented by the Sharia Court in Aceh and its underlying motives. This study relies on field research involving observations, in-depth interviews with Sharia Court judges, Head of the Islamic Sharia Service, Acehnese clerical figures, and Non-Muslims involved in criminal cases handled by the (...) Sharia Courts. This study also analyzes Sharia Court decisions on criminal cases involving non-Muslims and various related documents issued by the Sharia Courts, police, and prosecutors. The study was undertaken between July 2017 and March 2020. The study shows that the Acehnese non-Muslims do not select The Aceh Jinayat Qanun because of its religious values but based on practicality, efficiency, and socio-cultural consideration. The Sharia-based sentences, which have often been conceived as inhuman and violate fundamental human rights, are chosen and become the rational choice for non-Muslims in solving their legal issues. This paper concludes that the implementation of the Sharia on non-Muslim has not always been negative. This paper demonstrates non-Muslims’ interest to choose Sharia-based criminal justice or The Aceh Jinayat Qanun over the Criminal Code. This can be seen as their rational choice over a more efficient, low-cost, effective, and fast legal process offered by The Aceh Jinayat Qanun sentencing system. (shrink)

Interpretation of the Unicity doctrine and teachings regarding sufism of Abdurrauf Singkel, an Indonesian ulama from Aceh; study of an Islamic manuscript.

How do ordinary Muslims deal with and influence the increasingly pervasive Islamic norms set by institutions of the state and religion? Becoming Better Muslims offers an innovative account of the dynamic interactions between individual Muslims, religious authorities, and the state in Aceh, Indonesia. Relying on extensive historical and ethnographic research, David Kloos offers a detailed analysis of religious life in Aceh and an investigation into today's personal processes of ethical formation. Aceh is known for its history of (...) rebellion and its recent implementation of Islamic law. Debunking the stereotypical image of the Acehnese as inherently pious or fanatical, Kloos shows how Acehnese Muslims reflect consciously on their faith and often frame their religious lives in terms of gradual ethical improvement. Revealing that most Muslims view their lives through the prism of uncertainty, doubt, and imperfection, he argues that these senses of failure contribute strongly to how individuals try to become better Muslims. He also demonstrates that while religious authorities have encroached on believers and local communities, constraining them in their beliefs and practices, the same process has enabled ordinary Muslims to reflect on moral choices and dilemmas, and to shape the ways religious norms are enforced. Arguing that Islamic norms are carried out through daily negotiations and contestations rather than blind conformity, Becoming Better Muslims examines how ordinary people develop and exercise their religious agency. Study on acculturation of Islamic brotherhood values in Islamic religious training centers in Nanggroe Aceh Darussalam Province, Indonesia.

The aimed of this study is to examine the differences of level desensitization of violence and stress tolerance based on demographic factors, that is sex and educational level. The participants are 46 teachers (26 males and 20 females) at Nanggroe Aceh Darrussalaam (NAD). Data were collected by using interview and filling the scale to measure the level of violence desensitization and stress tolerance. Two ways ANOVA is used to analyze the data. The result indicated that there are no significant (...) differences between men and women in the level of desensitization of violence ( F= 0,22, p >0,05). The same result also showed in the level of education with F = 0,471, p>0.05 for level of desensitization and F = 0,869, p>0,05 for stress tolerance.  . (shrink)

After the devastating tsunami hit the northern Sumatran coastline in December 2004, the Indonesian province of Aceh found itself at a crossroad. This crossroad intersected the three-decade-long civil war, the move towards peace and the need for post-disaster recovery. This article analyses the gendered politics embedded in Aceh's navigation through this crossroad. First, it argues that both the conflict and the subsequent peace process were marginalised by the international programmes of post-tsunami recovery. Second, it demonstrates that within this (...) marginalisation, women's investments in both war and peace were further neglected throughout the formal peace process. Third, it highlights how the peace process reflected a narrow, masculinist and public sphere agenda that silenced both women and the gendered issues affecting them. In short, this article seeks to unveil the gendered politics of war and peace in post-tsunami Aceh. It does so with the feminist ambition of demonstrating that sustainable and comprehensive peace in Aceh cannot be secured without recognising and accounting for the impact that the conflict has upon gendered identities. Hamzah Fansuri is an important figure in the history of Islam in Indonesia. He is an important figure who is always discussed within the framework of discussing the dynamics of the development of Islam and Sufism in the archipelago. The purpose of this article is to trace the life history of Hamzah Fansuri. Many researchers have not studied the comprehensive history of Hamzah Fansuri’s life. Researching the life history and basic teachings of a Sufi is very important to understand the (...) biographical background of the development of his teachings and to know the principles of the teachings, through his works. There are two important ways to understand the basic teachings of a Sufi. This article, first, examines general considerations and presents a new construction of Hamzah Fansuri’s intellectual life and career and, second, browse the main teachings of Hamzah Fansuri through his works, using an analytical-descriptive-critical method. This qualitative research uses library research. Data collection was taken from various references from the biography of Hamzah Fansuri. According to the findings of this article, Hamzah Fansuri was born in Samudra Pasai, studied in Singkil, and then traveled to the Middle East via Barus. Returning to the archipelago, he made a career in Ujong Pancu, Aceh Besar. Hamzah Fansuri died in Mecca in 1527 AD. Throughout his career, Hamzah Fansuri wrote approximately thirty poems and three works of prose, namely Sharāb al-‘Āshīqīn which describes the process of the spiritual journey, Asrār al-‘Ārifīn which describes the philosophical teachings of Sufism, and al-Muntahī which explains the meaning of Sufi expressions. The article seeks to investigate the intersection of local-based religion legal system and state’s legal system. It focuses on the constitutional debates on the position and the status of Aceh Qanun Jinayat within the Indonesian legal system and how the Indonesian Supreme Court the Islamic penal law based on Aceh’s Qanun in their decisions. Using the legal research approach, this article begins with the background of the Qanun Jinayat implementation in Aceh, then discusses the constitutional debates on (...) the position of the Qanun in the Indonesian legal system and ends with analyses of Supreme Court decisions on the application of the Qanun Jinayat in criminal cases in Aceh. This article argue that Aceh’s Qanun is similar to the other provincial regulation within the Indonesian legal system, which has limited areas to regulate the punishment in criminal cases. However, the paper found that although the Indonesian legal system forbids Aceh’s Qanun holds the penalty more severe than the National criminal law, the Supreme Court seems to accept these practices and use them in their decisions in Aceh’s criminal cases. Muslim reformism, which emerged in West Asia during the closingyears of the nineteenth century, and the early twentieth, was spearheaded byJamal al-Din al-Afghani and Muhammad ‘Abduh. It responded to the socioeconomicand political challenges confronting the Muslim society. Muslimreformism was not only influential in West Asia but also in Southeast Asia.However, most studies on Muslim reform have privileged the “central Islāmiclands” at the expense of its “periphery”. As a result, Muslim reform inMalaysia has been marginalised. Thus, this article, discusses the historiographyof (...) Muslim reform in Malaya. An analysis of the major writings in Englishand Malay identified the major trends, issues, and gaps. It argues that theexisting studies tend to focus on the intellectual history of reform, while thesocial history of the diffusion of reformism has not been adequately analysed.Similarly, most works on reform in Malaysia focus on its development in thecountry alone without embarking upon comparative analysis with other areassuch as West Sumatra, Aceh and Java. Existing biographies of reformistsfocusing on prominent figures such as Syed Sheikh al-Hadi and Sheikh Tahirhave been thoroughly examined while other reformists such as Abu BakarAshaari, Abdullah Maghribi, and Abu Bakar Bakir have not been adequatelystudied. The coronavirus disease 2019 not only will have negative impacts on religious beliefs, but will also deepen them. Attention to Islamic teachings is significantly important in dealing with the COVID-19 pandemic. Nevertheless, the increased outbreak of COVID-19 in the world shows the need for humanity to pay more attention to religion and theology. Islam prevents diseases and motivates people to adhere to hygiene principles, and Islamic teachings bring about purity and health to people. However, paying attention to God, chanting prayers (...) and focusing on spirituality are key principles in the prevention and treatment of diseases as this material cause is the divine will. Everyone is under the power of the Almighty, and everything is in his hands. Nevertheless, human beings may pass away because of COVID-19 even after passing all these stages. This is, however, related to divine destiny and is beyond the aim of this research study. One of the issues that relate religion to COVID-19 is psychological resilience, which is the topic of this study. This research study aimed at evaluating the role of religion and religiosity in the psychological resilience of 550 Muslim citizens from three cities of Aceh, Semarang and Jakarta, who had recovered from COVID-19. We applied the convenience sampling method to determine the sample size. After the distribution of questionnaires, 536 tools were considered suitable, and data analysis was performed using mean and correlation tests. According to the results, religiosity affected psychological resilience by p = 0.784.Contribution: The results of this study revealed that with increasing attention of people to religious teachings, the psychological resilience to the COVID-19 also increases. ABSTRACT The connection between the unity of God and the multiplicity seen in the universe represents the central concern for the Sufi thinker, Muḥyī al-Dīn ibn ‘Arabī (d. 638/1240). It deeply affected the thought of the Southeast Asian mystic, Ḥamza Fanṣūrī (d. 1590?), and his alleged disciple, Shams al-Dīn al-Sumatra’ī (d. 1630). Traces of this idea, through its popularisation in the poems of Fanṣūrī, exert a powerful influence on the Indonesian intellectual topography to this day. This article investigates the concept (...) of unity and multiplicity, of the One expressed as the many in the phenomenal world, in Ibn ‘Arabī’s Fuṣūṣ al-ḥikam (Ringstones of Wisdom). Through a close textual reading of the chapters of Ādam (Adam) and Ibrāhīm (Abraham) and their various commentaries by the most influential followers of Ibn ‘Arabī, it concludes that the representation of ‘oneness of being’ (waḥdat al-wujūd), which was extensively taught by Fanṣūrī in Aceh, as an erasure of the God-Man divide, is untenable. This paper discusses Al-Rāniri ‘s criticism of the theological conception in Nusantara Sufism which contains elements of pantheism. This paper begins by describing the teachings of Waḥdah shuhūd in Sufism Al-Rāniri. This teaching believes in God, Allah as the only one and only being, while the universe is only a madzhar that testifies to the oneness of Allah Himself. That is why a being other than Allah is not separate, it is neither independent nor one with God. Based on this (...) view, Al-Rāniri criticizes, even kafuses the wujūdiyah followers because they tend to be pantheistic which unites God,Allah and humans. The Sufism teachings developed by Al-Rāniri were able to bring together sharia and Sufism. This teaching can be accepted by the people of the archipelago, Aceh in particular because the people of the Archipelago in the following years were colored by Sunni teachings that uphold the practice of sharia. This paper aims to find the position of Waḥdah shuhūd teachings in the context of Nusantara Islamic studies, especially in the field of Sufism, whose roots cannot be separated from the development of Sufism in the 17-18 century. Therefore, this study uses a descriptive-analytical approach while adhering to the accuracy of the analysis data that has been carried out by previous researchers. (shrink)

Muslim youths must shun free sexual behaviours. However, these actions are highly prevalent, especially among the Muslim youth. This study aimed to determine the effect of qanun (local regulations based on Islamic law), religiosity and religious education on the sexual activity of Muslim youth. The study used a case-control design carried out in the province of Aceh, which applies the qanun, and in the province of North Sumatra, which does not apply the qanun. Researchers interviewed 552 Muslim youths using (...) the snowball method and disseminating online questionnaires; data were analysed through logistic regression using Jeffeys’s Amazing Statistics Program 16 (JASP) with a confidence interval (CI) of 95%. The results of this study indicated that qanun ( p < 0.001; Exp B = 4.628), always prayed five times every day in the last 3 months ( p = 0.027; Exp B = 1.616), and looking for various information about Islamic topics ( p = 0.01; Exp B = 1.747) is associated with the prevention of sexual activity of Muslim youth. Qanun affected the prevention of sexual activities among youth; these activities were 4628 times higher in areas that do not have qanun for preventing sexual activities in Muslim youth. Muslim youth looking for various information about Islamic topics also affected the prevention of sexual activity among youth – it was 1747 times higher than those who did not seek information about various Islamic topics on preventing sexual activity in Muslim youth. Muslim youth in qanun areas were proven to have a lower sexual activity. Furthermore, Muslim youth with high religiosity (those who pray diligently and look for various information about Islamic topics) were proven to be able to prevent sexual activity. Therefore, it is necessary to increase the religiosity of Muslim youth. Contribution: This article is expected to explain the impact of qanun, religiosity, religious education and the prevention of sexual activity among Muslim youth. This research is expected to be one of the solutions that can be applied to prevent sexual activity in Muslim youth, which is occurring increasingly. (shrink)

The existence of Dayah as an Islamic educational institution in Central Aceh District has a major role in the development of diversity in community. Step by step, the educational institution is developing, both in quality and quantity. Departing from this reality, this paper uses a phenomenological approach, examines the modernization of Darul Mukhlisin’s integrated Dayah educational system, which includes the Dayah education sub-systems. The modernization of the education system is characterized by changes in the aspects of objectives, Teungku and (...) Santri Dayah, implementation of an integrated curriculum, the treasury of contemporary books, use of active strategies and varied methods, environmental changes, the application of test and non-test evaluation types, and so forth. Thus, the existence of Darul Mukhlisin was able to become a bastion of religious education in producing religious cadres and religious generations in Central Aceh. (shrink)

The Acehenese Islamic educational institution, dayah, has played a major role in institutionalisation of Islam among the Acehness. the development of diversity in community. As a traditional institution, the dayah system has developed and successfully translated principles of modernity through the establishment an integrated educational system. This article examines the modernization of Darul Mukhlisin in Central Aceh and its characteristic in modernising its educational system. The modernization of the education system is characterized by changes in the aspects of objectives, (...) Teungku and the students of dayah, implementation of an integrated curriculum, the treasury of contemporary books, use of active strategies and varieties of educational methods, environmental changes, the application of test and non-test evaluation types, and so forth. This article further argues that the Darul Mukhlisin has been successfully adopting the dayah system into modern principles of modern management in educational institution. The Darul Mukhlisin resorts as an important agent for religious education, producing learned Muslims who contributes to the development of the Acehness. (shrink)

Bersamaan dengan buku di atas (On Heaven and Earth: Pope Francis on Faith, Family, and the Church in the Twenty-First Century), saya telah membaca kumpulan pikiran dan renungan seorang Amerika Latin yang lain, warga Brasil, novelis Paolo Coelho, yang novel-novelnya telah menyebar ke seluruh dunia dalam puluhan terjemahan. Paolo Coelho, bersama istrinya, banyak berpengalaman karena suka berkeliling dunia, setelah pada masa mudanya ia melewati banyak perlawanan dari orangtuanya, bahkan mengalami paksaan masuk ke rumah sakit jiwa, lalu hidup sebagai hippie, dijebloskan (...) ke dalam penjara, dan gagal sebagai pengarang. Dengan dukungan perempuan yang kemudian menjadi istrinya sampai sekarang, ia menekuni kembali panggilan awalnya untuk menjadi pengarang. Akhirnya, ia mulai diakui dalam dunia sastra internasional. Novelnya yang simbolis, Sang Alkemis (1988), membuka jalan itu baginya............... Jarang saya jumpai pemikir Amerika Latin yang menampilkan sistematika berpikir seperti yang terjadi selama berabad-abad di benua Eropa Utara dan dunia Anglosakson. Beberapa puluh tahun yang lalu Steven McKenzie menjadi editor sebuah kumpulan karangan yang berjudul To Each Its Own Meaning: An Introduction to Biblical Criticism and their Application (1993). Dalam bunga rampai itu dibahas metode-metode penelitian lama yang berfokus pada latar belakang sejarah teks (penelitian sumber, sejarah tradisi, jenis sastra, peredaksian), cara-cara penelitian literer yang lebih baru (seperti penelitian strukturalis, pasca-strukturalis, naratif, atau reader’s respons) dan beberapa yang lain (penelitian ilmu sosial, kanonik, atau retorika). Dalam dua puluh tahun sejak terbitan itu (...) banyak pendekatan baru berkembang, misalnya, dalam symposia pertemuan para pakar Alkitab nasional dan internasional, dan dalam banyak monograf, bunga rampaidan artikel Jurnal. Untuk membantu pembaca mengikuti perkembangan cepat itu, kini McKenzie & Kaltner menerbitkan New Meanings for Ancient Texts. Mereka memilih sembilan pendekatan yang makin berpengaruh dan meminta kepada pionir-pionir utama setiap pendekatan untuk memberi deskripsi pendekatannya yang jelas bagi non spesialis dan mengilustrasikannya dengan meneliti satu atau beberapa teks contoh. Judul bab dari beberapa di antara kesembilan pendekatan itu barangkali segera ditanggap pembaca, karena sudah lebih lama dikenal. Misalnya, “Psychological Biblical Criticism” (D. Andrew Kille, pp. 137-154) dan “Ecological Criticism” (Norman Habel, pp. 39-58). Pendekatan-pendekatan ini agaknya dimuat di sini karena mengalami pergeseran paradigma dalam beberapa dasa warsa terakhir. Juga tidak baru di telinga pembaca akademis adalah “Postcolonial Biblical Criticism”(Warren Carter, pp. 97-116) dan “Postmodernism” (Hugh Pyper, pp. 117-136). Postmodernisme yang membongkar cerita-cerita besar seperti sejarah keselamatan Alkitab dan mau menyadarkan pembaca bahwa banyak jawaban kita selama ini sesungguhnya kurang pasti daripada dikira, meluas di dunia tafsir Barat; sedangkan penelitian Alkitab pascakolonial yang meneliti hubungan dominasi dan subordinasi dalam teksteks Alkitab dan dampaknya dalam sejarah kolonialisme dan lanjutannya dalam masa pasca-penjajahan, sekarang ini menjadi sangat aktual dalam distorsi relasi antara Selatan dan Utara. “New Historicism” (Gina Hens-Piazza, pp. 59-76) tidak lagi mencoba merekonstruksi realitas sejarah di belakang teks (seperti dilakukan oleh Historical Criticism), tetapi dengan cara yang multidisipliner meneliti teks sebagai representasi dari realitas kultural, sosial, politik, dan sebagainya, sambil melepaskan distingsi antara literatur dan sejarah, juga antara pengarang dan pembaca, antara arti dulu dan arti sekarang. Dekat tetapi berbeda dengan itu “Cultural-Historical Criticism of the Bible” (Timothy Beal, pp.1-20) meneliti bagaimana kata, kiasan, objek dan ide dalam Alkitab menerima bentuk dan artinya dalam konteks kebudayaan tertentu yang memproduksikannya atau mereproduksikannya. “The Bible and Popular Culture” (Linda Schearing and Valerie Ziegler, pp. 77-96) kurang berfokus pada Alkitab sendiri tetapi menganalisa bagaimana teks-teks tertentu berfungsi dalam ungkapan-ungkapan budaya rakyat, lelucon, iklan, komik, seni, film, dll., juga mengingat pergeseran yang kini terjadi dari budaya teks tertulis ke apropriasi visual. “Disability Studies and the Bible” (Nasya Junior and Jeremy Schipper, pp. 21-38) dan apa yang disebut “Queer Criticism” (Ken Stone, pp. 155-176) meneliti Alkitab dari situasi kelompok-kelompok tertentu, entah mereka orang-orangcacat yang banyak muncul dalam teks-teks Alkitab yang dapat dimengerti lebih baik dari dalam pengalaman invaliditas; atau mereka yang dari sudut seks dan jender berada dalam posisi yang tidak menguntungkan atau bahkan ditolak. Di sini a.l. tempatnya penelitian Alkitab komunitas gay and lesbian, dan lebih awal feminisme......................... Apakah bunga rampai tentang pelbagai pendekatan baru ini penting untuk seorang yang sudah cukup puas dengan metodenya selama ini atau yang menerima Alkitab sebagai buku yang mempunyai otoritas terhadap dirinya dan jemaatnya? Keberatan (kita) yang sudah lama diajukan terhadap pendekatan tersebut, pada akhir setiap karangan dengan jujur dikemukakan dan diberi tanggapan singkat. Membaca contoh-contoh penafsiran dalam bunga rampai ini, saya sering merasa diajak ke dalam suatu perjalanan yang berbelit-belit. Tetapi setelah beberapa tikungan muncul juga pemandangan menarik dan berharga yang belum pernah saya perhatikan selama ini. Selain itu, setiap artikel mulai dengan pengantar umum tentang, misalnya, fenomen postmodernisme, ilmu ekologi, atauqueer criticism yang sudah lebih lama dikembangkan di akademi umum, dan baru sekarang mulai dipakai juga untuk analisa teks-teks biblis. Pengantar-pengantar itu saja memberi gambaran menarik tentang masalah-masalah yang dewasa ini digumuli dalam komunitas global. Setuju atau tidak, mengetahuinya penting untuk keduanya.
