Regarded as a revisionist historian in the West, Patricia Crone, who wrote many books and articles on various subjects of early Islamic history, was a prolific researcher. The place and role of mawālī, in the Umayyad and Abbāsid society, has been one of the special topics she has been interested in since the very beginning of her academic life. Her works with a revisionist perspective have been faced many criticisms by colleagues, especially the western ones, because of her biased view (...) of the sources written by Muslim authors, her methodology, and her results. However, it is obvious that Crone’s studies on mawālī have positively or negatively affected the Eastern and Western academics in Islamic studies. This article’s main purpose is to reveal Crone’s views on mawālī in Isla-mic society and draw an outline without comment as much as possible. The paper consists of three parts. In the first part, Crone’s revisionist perspective and her works on mawālī have been explained. In the second part, her distinctive views on the mawālī and its origin have been discussed. Finally, in the third part, her findings of the position of mawālī in social, political, military, and economic life during the Rāshidun Caliphs, the Umayyads, and the Abbāsids have been introduced. This study, which tackles Crone’s views on mawālī, aims to encourage the further studies on this subject. (shrink)

This paper contributes to the contemporary business ethics narrative by proposing an approach to corporate ethical decision making (EDM) which serves as an alternative to the imposition of codes and standards to address the ethical consequences of grand challenges, like COVID-19, which are impacting today’s society. Our alternative approach to EDM embraces the concept of reflexive thinking and ethical consciousness among the individual agents who collectively are the corporation and who make ethical decisions, often in isolation, removed from the collocated (...) corporate setting. We draw on the teachings of the Canadian philosopher and theologian, Fr. Bernard Lonergan, to conceptualize an approach to EDM which focuses on the ethics of the corporate agent by nurturing the universal and invariant structure that is operational in all human beings. Embracing Lonergan’s dynamic cognitive structure of human knowing, and the structure of the human good, we advance a paradigm of EDM in business which emboldens authentic ethical thought, decision making, and action commensurate with virtuous living and germane to human flourishing. Lonergan’s philosophy guides us away from the imposition of over-arching corporate codes of ethics and inspires us, as individual agents, to attend to the data of our own consciousness in our ethical decision making. Such cognitional endowment leads us out of the ethics of the ‘timeless present’ (Islam and Greenwood in Journal of Business Ethics 170: 1–4, 2021) towards ethical authenticity in business, leaving us better placed to reflect upon and address the ethical issues emanating from grand challenges like COVID-19. The Umayyad State is widely criticized in the West as well as in its own region. Actually, this is normal situation. Because Hijaz Arabs who had no state experience, built a multinational state in short period of time. Yet, this caused serious matters. The fundamental point of the criticism is the payment of tax, also called jizya, which is taken from residents (mawālī) of Khorasan and Transoxania. However, in most studies on this subject, it is understood that the jizya taken (...) from mawālī is combined jizya and kharja, which is different type of tax. Although mawālī was tested for whether it passes religious criteria in critic periods or not, this situation did not last throughout the entire Umayyad history. It was continued for fifteen and twenty years. In this period, it was understood that the jizya tax taken from the mawālī, was caused by the unlawful practices of some regional governors, most of them were non-Muslim local tax officials and all their purpose was to collect the amount of combined jizya. It cannot be said that the Umayyad caliphs officially ordered written instructions in order to take the conceptual sense from the mawālī part. But some Khorasan governors, who detected that taxes were decreasing, blinked at the collection of the jizya from the mawālī.Summary: The tax policies of a state are of great importance for the political, social, and economic stability. A regular tax system minimizes the problems that the state mechanism might face. The establishment of a fair and just tax scheme is undoubtedly possible with a deep-rooted state experience. It is known that the Umayyad state which is the subject of this research has no state experience. Furthermore, ruling to the area which is on 13 million square kilometers and reaching to Kashgar in the East and to South France in the West and governing this multinational structure who are living on these regions, put the Umayyad government in a very difficult condition. With the vast borders and the stoppage of the conquests, some political, social and economic problems were experienced and these problems deeply affected the government. The groups which had argued with Shiites and Khārijites because of some various reasons led the country into collapsing. It is also known that many plague epidemics in the region of Damascus affected the society in a negative way, changing the capital and changing some of the border cities in favor of the Eastern Roman Empire.All these negativities certainly shaken the Umayyad state economically. It is understood from the data that the instability and political uncertainties in the country led to a decrease in the tax rates. For example, the Umayyad caliph ‘Abd al-Malik İbn Marwān period, only half of the tax was collected at the time of Hazrat ‘Umar could be collected. It can be said that the public who avoided the general policies of the state avoided giving tax, in other words, the tax evasion. Also, the increasing migration from village to city and due to that, the vacancy of tribute tax collected land, failure to obtain expected yield because of rent fights on fertile lands, and conversion process in non-Muslim community are included in other reasons of reduction of taxes.In the Umayyad period, the issue of taking the jizya from the mawālī can be considered in this context. We do not have an independent work or research article on how this practice was initiated, how it was and how it was taken from mawālī, and how it was a state policy, and how long it was sustained. The studies that touch on this subject are far from being holistic. Even in the main sources it is seen that the concepts of kharāj and jizya are not fully understood and therefore used interchangeably. This may be considered normal for the first period in which the concepts are not in place. However, in the following centuries, the works that were copyrighted and, except for a few, instead of understanding and explaining this confusion, chose to use the word jizya from these two words which can be used interchangeably in texts. Therefore, this approach has led to the widespread conviction that the Umayyad state has taken jizya from the mawālī in the conceptual sense.Al-Ḥajjāj ibn Yūsuf is claimed to have started the application of taken jizya from mawālī. However, Haccac aimed to provide the regularity of both agricultural products and the kharāj which is taken from farmers because of the status of the soil by sending Sawad villagers who migrated to the big cities and became Muslims by changing their religions. The status of the lands seized was decisive in taxation. According to this, the conquest and the territorial lands were taxed differently, but in some cases the same tax (kharāj) was taken. Non-Muslims who living in the territory of conquest were demanded jizya per capita. The jizya and kharāj tax collected from this category can be expressed as “joint jizya”. Regardless of whether the person is a Muslim or not, the fact that he was demanded from him due to the status of the land was interpreted by some researchers as juristic. However, in times of political instability, it is also a fact that mawālī is demanding jury in addition to the tribute tax. The point that is misunderstood or interpreted is that this practice was carried out throughout the entire Umayyad territory and the history. When examined, this distorted tax concept is actually concentrated in the area of Transoxania. Although some attempts were made to take the jizya from the mawālī to the country, the Umayyad caliphs have not allowed it. The practice of taking the jizya from the mawālī is actually followed by the killing Qutayba ibn Muslim al-Bāhilī (d. 96/715). This started political instability in the Transoxania and continued by some Khurāsān governors. These governors act according to the provocations of the Turkish governors and tax collectors of the region in order to be able to send their taxes completely. They claimed that the region in the region was not a sincere Muslim and, they continued to take the jizya from them.It can be said that jizya is not demanded as it is taken from non-Muslims in the common meaning from mawālī. Because any Umayyad caliph wrote no written instructions regarding this issue in the sources. It is understood that until the caliphate of ‘Umar b. ‘Abd al-‘Azîz, the Umayyad caliphs were not even aware of this distorted tax policy in the area of Transoxania. To put it once again, this practice was initiated by some Khurāsān governors with the concern that tax revenues might decrease. However, it should not be forgotten that this unfair practice after 96/715 is limited to certain governors. For example, during the tenure of Naṣr b. Seyyâr, the last governor of Khurāsān (120-131 / 738-748), the jizya tax was completely removed from the mawālī. Another activity that shows this action is regional and that was ordered by some governors of Khurāsān. Therefore, this practice does not reflect the Umayyad state policy. This is also apparent in the fact that the Shiites, Kharijites, and those who carried out the Abbasid Revolution for thirty-two years, did not make an anti-Umayyad propaganda with provoking the slave by the way of wrong application. Abū Bakr Ibn Ṭufayl was one of three great Islamic Peripatetics of Andalusia, sandwiched between Ibn Bājja for whom he had both highest encomia and biting censure, and his own illustrious protégé, Ibn Rushd. Özellikle İskenderiye, Harran ve Cündişâpûr gibi şehirlerin fethedilmesinin ve bu şehirlerdeki ilmî geleneğin Müslümanlar üzerinde önemli etkileri olmuştur. Nitekim bu fetihler akabinde Müslümanlar, sadece dinî ilimlerle yetinmemiş, bunun yanında antik düşünce geleneğini ve kadim kültürleri tanımak amacıyla o kültürlere ait eserleri (...) Muhammed’in peygamber olarak görevlendirilmesiyle Mekke’de başlayan ve Medine’de devam eden ilmî faaliyetler, Hulefâ-i Raşidîn döneminde de artarak devam etmiştir. Bu anlamda Müslümanların ilk yapmaya çalıştığı şey var olan bilgi birikimini tanımaya ve anlamaya çalışmak, sonrasında ise geliştirmek ve dünyanın istifadesine sunmak olmuştur.Araştırmamızda bilgiyi elde etme dönemi olarak adlandırdığımız dönem; İskenderiye, Harran ve Cündişâpûr gibi şehirlerin fethedilmesinin ve ardından bu şehirlerdeki ilmî geleneğin Müslümanlar üzerindeki önemli etkilerinin bir tezahürü olarak ilk tercüme faaliyetlerinin başladığı dönemdir. Bu dönemde bilim nerede olursa olsun gidip alma çabası hakim olup; amaç, bilgiyi üreten, ister Yunan, ister Hint, ister Farisî olsun onu elde etmek ve Arapçaya çevirmektir. Bilgiyi sistemleştirme dönemi ise hem tercüme faaliyetlerinin artarak devam ettiği hem de tercüme faaliyetleri neticesinde elde edilen bilginin sistematik hale getirilmeye başlandığı bir süreçtir. Bu süreçte amaç, bilgiyi üreterek, kullanılabilir hale dönüştürmek ve toplumun hizmetine sunmak olmuştur. Yine bu süreçte, bilim hem takdir ve teşvik edilme ayrıcalığını kazanmış, hem de dönemin yöneticileri ve ilim meraklıları, bilginin ışığıyla tüm sorunların çözülebileceği yaklaşımı içinde olmuşlar ve bu yönde adımlar atmışlardır. Beytülhikmeler ve rasathaneler, bu sürecin birer meyvesi olarak ortaya çıkmış kurumlardır. Bu dönemde yapılan tercümeler Müslümanlar arasında derin bir ilgi ve etki meydana getirerek onların bilgi ve kültürünü zenginleştirmiştir; ancak hiçbir zaman özgün kimliklerini kaybetmelerine sebep olmamıştır. Bilakis Müslüman âlimler, kendilerinden önce yaşamış bilginlerin çalıştıkları farklı alanlarla ilgili eserleri inceleyerek istifade etmişler; fakat hiçbir zaman onları mutlak bir otorite olarak görmeyip, yeri geldiğinde eksik ve yanlışlarını ortaya koymuşlar, sonunda da kendi gözlem, deney ve düşüncelerini ortaya koymak suretiyle özgün eserler üretmişlerdir.Özgün bilgi üretme süreci olarak adlandırdığımız bu dönemde ise, yaşadığı yüzyılda ön plana çıkmış ve sonrasında Avrupa bilim dünyası tarafından da tanınmış bazı ilim adamlarından ve çalışma yaptıkları alanlardan hareket etmek suretiyle dönemin ilmî anlamda nasıl bir gelişmişlik seviyesine ulaştığı ortaya konmaya çalışılacaktır. Bu dönemde bir taraftan tercüme faaliyetleri tüm hızıyla devam ederken (VIII.-X. yüzyıllarda) diğer taraftan araştırmalar, kuralları, yöntemleri ve kavramları olan bir niteliğe kavuşmuş ve İslam bilim tarihinin altın çağı yaşanmıştır. This essay is a review of The Nativist Prophets of Early Islamic Iran: Rural Revolt and Local Zoroastrianism, the last book that Patricia Crone wrote before she died, as well as an overview of her career and a tribute to her as a great historian of Islam. In Crone's subaltern history of the Persian plateau, the “nativist prophets” are a series of Iranian divines, seers, and hooligans whose resentment against Arab domination was expressed in recourse to pre-Islamic Persian ideals and (...) beliefs. Islamic orthodoxy was undefined in the early eighth century, Crone shows, and the law had not yet entered every corner of daily life. There was, moreover, no clerical class at the time to correct heresiarchs on the fringes of the empire. Hence, according to the reviewer, one can easily imagine the situation as Crone does, with the truths of the new faith, in the eastern extremities of the caliphate, mixing with the Zoroastrian, Christian, and Manichaean truths already rooted there. Crone bleeds the categories of “Islamic” and “pre-Islamic” into each other, and thus her history is composed less of blocks of time and well-defined identities than of mutable compounds of belief and usage. The reviewer argues that Crone's sense of an unruly proliferation of popular beliefs is confirmed by the latest archaeology, and then he closes with an extended meditation on the relevance of this early Arab-Persian divide to the contemporary political situation of Islam and the Middle East. The spread of Islam from the Arabian Peninsula to the North Africa and al-Andalus in the west, to the Chinese borders and the Indian Subcontinent in the east, helped Muslims to establish close contact with many different cultures. One of the consequences of this is that both the increase in scientific accumulation and the emergence of new needs in military, financial and similar aspects accelerated the studies on geography. Islamic geographers of the first period, not only did they describe the (...) cities to which they travelled but also they depicted the cities about which they could collect data. These first works, which can be considered as a kind of written maps, have some common features, although they are written in different geographies and revealed by different schools. One of these common points is the terminology that they used in depictions of cities. This terminology suggests that there was a common city typology among Muslim geography scholars that stands out in the depiction of cities. In this study, particularly we will try to answer a number of questions such as what the concepts of authors are and what they mean and the relationship between these concepts by examining the uses of authors in their works.SummaryThe depictions of settlements which were designated as madīna in the works of the medieval Muslim geographers have some common characteristics. One of them is the terminology used by the authors in depictions of cities. In this study, particularly I tried to answer a number of questions such as what the concepts of authors are and what they mean and the relationship between these concepts by examining the uses of authors in their works. Then, a common city typology which is prominent in the depiction of cities among the Muslim geography scholars has been put forward. The structural elements that are considered to constitute this typology also revealed the topographic elements of a city at that time.The cities conquered by muslims had a great impact on the emergence of the terminology used by Muslim geographers in depicting cities. I can say that especially Persian influence; the cities in Iran, Khurāsān which were captured from the Sāsānians and Mā Warāʾ al-Nahr districts was effective. However, geography writers did not restrict using this terminology for only these regions, they also had continued to use in depiction of other regions such as North Africa and al-Andalus. This means that a common language and terminology emerged and started to be used.Geography authors point to five main elements that I have examined in separate titles while describing Islamic cities that they called "madīna". These are kuhandiz, shahristān, rabad, the part so-called “the adjacent agricultural fields / agricultural fields surrounded by wall” by us and the last part rustāq connected to main city center. Depending on ways of development of cities, these elements sometimes developed from inside to out, in other words from center to environment, sometimes surrounded by independent walls and sometimes adjacent to each other. However, a city did not have to have all these elements at the same time. This situation was totally related to development level of city, and the cities which had all these elements were the military, administrative and economically developed centers of the period. From the methodical point of view, it should be noted that the examples given in the study were selected from among the other cities in order to ensure that to understand the subject in best way and ensure that the silhouette on the city typology is seen better. Because it is possible to find examples of each element in all city depictions of Islamic geography writers. Kuhandiz, shahristān/madīna, and rustāq are the elements that can be seen in the pre-Islamic period. It is possible to think of the Islamic period as a period in which these words were conceptualized, new madīnas and rabads were formed, surrounded by walls and rabads were gradually transformed into madīnas. In geography texts, it is seen that there is a concept confusion between kuhandiž and buildings named qalʿa, ḥiṣār and ḥiṣn. However, as some writers hade tried to emphasize, "kuhandiz" had been using for these structures which were previously known as fortress (especially ḥiṣn or qalʿa) due to their proportion to shahristāns / madīnas of city centers, and were notably seen in the regions of Khurāsān and Mā Warāʾ al-Nahr. Kuhandižs represent the centers of pre-Islamic cities and were continued to be used for the same purpose in the early Islamic period. But, these old areas were gradually abandoned due to the development of new parts of settlement under Muslim administration. Shahristāns were residential areas where the majority of people lived. With the Islamic period, the word “shahristān” had been terminologically changed to “madīna” and use of this concept by scientific circles was gradually disappeared in time. At this point, it is one of the issues to be considered in the examination of geography works that the use of “madīna” in Arabic both for the concept of the city in which we examine the structural elements in this article, and for “shahristān” which is one of the elements of the city.As it is understood from the geographical texts, madīna was continued to be established by Muslims in cities for centuries. These are also examples of change in cities as a result of development and housing activities after the conquests. However, we don’t have much information in the geography works about the cities which had more than one shahristān /madīna before the inhabit of Muslims. As far as we can reach, the only example in our resources with multiple madīnas/shahristān belonging to the pre-Islamic period is Bukhara.As in the developed cities of the period such as Bukhara, Samarqand, Marw and Balkh, it is seen a generaly circular fortification wall which usually surrounded main center of cities including kuhandizs, madīnas/ shahristān and mostly later rabads. So, it is more appropriate to consider the areas between these walls and other parts of city (kuhandiz, shahristān/madīna, rabad) as an independent element because of the fact that they were lands with determined borders and were defined by separate concepts. I have used “adjacent agricultural area” for this element for now. Thus, this area constitutes one of the structural elements of the cities.Rustāqs were parts of Persian-Sāsānian urbanization and land administration, and had continued to be partially implemented during the Islamic period. They were the source of livelihood of the cities from foundation stage and were an indispensable tool of the society based on agriculture in that ages. Depending on size, the cities could have dozens of them. As can be seen in the case of Balkh, the rustāḳs especially connected to the big city centers were not composed of one or several villages. Moreover, these rustāqs could contain big settlements called madīna which were their centers. (shrink)

Çocuk evliliği, tarih boyunca farklı toplumlarda bilinen ve uygulanan sosyal bir olgu olsa da son zamanlarda, modern duyarlılıkları giderek daha fazla rahatsız eden bir hal almıştır. Son iki asır öncesine kadar, Avrupa hukuki düşüncesinde çocuklar yargı önünde farklı bir muamele görmelerine imkan veren istisnai bir statüye sahip değildi. Diğer taraftan, İslam hukukunun çocuklara, özel bir hukuki statü kazandırma konusunda bazı öncü adımlar attığını söyleyebiliriz. Nitekim, en eski İslam hukuku kitaplarının bile, insanın fiziksel ve zihinsel gelişim aşamalarına ve her (...) bir aşamada ortaya çıkan hukuki hükümlere dair son derece teknik ayrıntılarla dolu olduğunu görebiliriz. Ancak çocuk hakları konusundaki bu erken farkındalığa rağmen, çocuk evliliği olgusu hem İslam toplumlarında hem de İslam hukukunda kendini gösterebilmiştir. Çünkü, İslam çocuk hukuku, ilk ortaya çıktığı dönemin kültürel şartlarından ciddi şekilde etkilenmiştir. Üstelik bu kültürel şartlar, İslam dünyası boyunca İslam çocuk hukukunun temel zemini olma işlevini sürdüre gelmiştir. Bu çalışma, alimlerin çocuk evliliğini delillendirmek üzere yapageldikleri bazı aşırı yorumları ortaya koymaya ve konuyla ilgili âyetleri metinsel bağlamıyla daha uyumlu bir şekilde okumaya çalışmaktadır.Özet: Her bağlam için geçerli olabilecek, standart bir çocuk tanımı yapmak göründüğünden daha güçtür. Bu nedenle çocuk araştırmaları sahasında çalışan akademisyenlerin, muhtelif sosyal disiplinler tarafından yapılacak herhangi bir çocuk tarifi konusunda memnuniyetsizlik içinde olması doğaldır. Diğer yandan, İslam hukukunda baştan beri ayrıntılı bir çocuk hukuku teorisi mevcuttur. İslam hukuk düşüncesinde, insanlar doğum ile yetişkinlik arasındaki gelişim döneminde üç aşamadan geçerler: Çocukluk (küçüklük), buluğ ve rüşt. Bütün fıkıh mezhepleri, insanın doğumu ile ergenliği arasındaki dönemde küçük çocuk sayılacağı kanaatindedirler. Bu çocukların mallarının en iyi şekilde idare edilebilmesi için yasal temsilcileri bulunmak zorundadır. Fakîhler çocuğun velisinin, özellikle de baba veya baba tarafından dedenin, velâyeti altındaki küçük çocuklar üzerinde mücbir bir yetkisi olduğu (velâyet-i mücbire) konusunda geniş bir fikir birliğine sahiptirler. Buna göre veliler, velâyetleri altında bulunan çocukları uygun gördükleri kişilerle evlendirme yetkisine de sahiptirler. Fakat zaman zaman beşik kertmesi olarak da anılan bu uygulama bir ön sözleşmeden ibarettir. Yani bu sözleşme doğrudan doğruya fiziksel boyutları da olan müşterek bir evlilik hayatını meşru kılmamaktadır. Çünkü cinsel hayatın ancak buluğdan sonra gerçekleşmesi ön görülmektedir. Modernite öncesi İslam tarihi boyunca, İbn Şubrume (ö. 144/761), Ebû Bekr el-Esamm (ö. 200/816) ve Osman el-Bettî (ö. 143/760) gibi bir kaç fakih dışında küçük çocukların evlenmesine kategorik olarak karşı çıkan kimselere pek rast gelinmemektedir.Hanefi mezhebinde, herhangi bir zihinsel özrü olmaksızın buluğa eren erkek ve kız çocuklar evlilik konusunda mücbir velâyetin kapsamı dışına çıkarlar. Bu, evlilik sözleşmelerini bizzat gerçekleştirebilecekleri anlamına gelmektedir. Fakat veli, uygunsuz bulduğu evliliğe karşı dava açarak bunu yargı yoluyla geçersiz kılma yoluna gidebilir. Diğer üç Sunnî mezhep ise erkek ve kız çocuklar arasında bir ayrım yapar: Buluğa eren erkek kendi evlilik akdini yapabilme hakkını elde ederken aynı durumdaki kız çocuklar velâyet altında kalmaya devam ederler. Şâfiʿî mezhebine göre, velâyeti gerekli kılan illet (bekaret) hâlâ geçerliliğini korumaktadır. Dolayısıyla veli, kızları evlendirme konusundaki icbâri yetkisini elinde tutmaya devam etmektedir. Bu durumda kızın rızasının alınması, akdin geçerliliği için şart olmaktan ziyade sadece nezaket gereğidir. Rüşte ulaşmak veya fizyolojik olgunlaşma sürecini tamamlamak ise İslam hukukunda evlilik için şart görülmemiştir.Modern zamanlara kadar geleneksel İslam hukukunun erken evlilik lehinde gösterdiği bu yaklaşımda herhangi bir değişiklik olmamıştır. 1917 yılında çıkan Hukuk-ı Aile Kararnamesi daha önce benzeri görülmemiş bir dizi düzenleme getirmiştir: İlk olarak, evlilik yaşı erkek için on sekiz kız için ise on yedi olarak belirlenmiştir. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Peygamber’e ait resmi bir açıklamayı nakletmemekte; sadece kendi zaviyesinden maruz kaldığı bir durumdan bahsetmektedir. (shrink)

Çalışmamızın temel amaçlarından en önemlisi İslâm dünyasının siyasî ve askerî yükselişini belli bir seviyeye getirdikten sonra ilmî çalışmalarda elde ettiği başarısını tespit etmektir. İslam toplumu ilk dönemlerden itibaren öncelikle dini konuların öğrenilmesine ağırlık vermiş, sonrasında ise karşılaştığı diğer medeniyetlerden de etkilenerek pozitif ilimlerle meşgul olmaya başlamıştır. Her ne kadar İslâm’ın ilk yıllarında pozitif ilimlere hasredilmiş çalışmalar olmadığı görülse de ilk hicrî yüzyılın sonlarına doğru bu anlamda önemli çalışmalar ortaya çıkmıştır. Müslümanlar bu zamana kadar öncelikle dinlerini daha iyi anlamaya çalışmışlardı. (...) Bu konuda belli bir birikim elde ettikten sonra özellikle Abbâsîler (750-1258) döneminde pozitif bilimlere ilgi duyan Müslümanlar 4/10. yüzyıla gelindiğinde Müslümanlar pozitif bilimler alanında büyük eserler vermeye başladılar. Bu gelişmenin çok farklı sebepleri olduğu gerçeğini de göz önünde bulundurarak bu makalemizde Müslümanların pozitif bilimlere ilgi duymasının sebepleri üzerine bir değerlendirme yapacağız. Çalışmamızda öncelikle Müslümanların yaptığı çalışmalara ilişkin güncel ve klasik kaynaklarda yer alan bilgiler derlenerek yüzyıllar içerisinde yaşanan değişim ele alınacaktır. Esasında bu gün Müslümanların içerisinde bulunduğu durumun çözümü de kısmen bu dönemin daha iyi anlaşılmasında gizlidir. Hz. Peygamber’in Medine’ye hicretinden sonra henüz bir yıl geçmeden Mescid-i Nebevî inşa edilmiş ve bu esnada Bakī’ Mezarlığı da teessüs etmiştir. Bakīu’l-Garkad, Cennetü’l-Bakī’ gibi adlarla da anılan Bakī’ Mezarlığı’na ilk defnedilen kişinin kim olduğu mevzuunda birbirinden farklı rivayetler bulunmaktadır. Bu hususta, ilk defnedilen sahâbînin Ensar’dan Es’ad b. Zürâre veya Muhacirlerden Osman b. Maz’ûn olduğu şeklindeki rivayetler ön plâna çıkmaktadır. Bu makalede, Osman b. Maz’ûn’un vefat tarihi ile ilgili rivayetler bağlamında onun Bakī’ Mezarlığı’na ilk defnedilen kişi olup olmadığı konusu ele alınmaktadır. (...) Bu makalede ele alınacak rivayetler çerçevesinde ortaya konulacak bilgiler, Bakī’ Mezarlığı’nın teşekkül tarihine ışık tutmuş olacaktır. Bakī’ Mezarlığı’nın teessüsü ve ilk defnedilenlerle ilgili rivayetlerin müstakil olarak analiz edilmemiş olması bakımından konu önem arz etmektedir. Makalede geniş bir literatür taraması yapılmak suretiyle elde edilen malzeme analiz edilmiş ve rivayetlerle ilgili sorunlara işaret edilmiştir. Georgians' acquaintance with Islam was with the first Arab raids. From the first Muslim Arab domination, Georgians started to become Muslims with cultural interaction. Islam spread especially in Eastern Georgia during the time of Muslim Arabs, Seljuks and Mongols. The spread of Islam in Western Georgia started with the Ottomans. The Ottoman Empire's contact with Georgia begins with the conquest of Trabzon by Fatih Sultan Mehmed. When the Ottomans contacted the region, the geography of Georgia was divided into small kingdoms. (...) With the conquest of Trabzon, the Georgian border was reached and in 1479, Acaristan, Borcka and Maçahel surroundings joined the Ottoman lands. On the one hand, Sukhumi was captured from the north. Then, continuing to advance in the region, Yavuz Sultan Selim paid tribute to the Kingdom of Güryel and Imeret (Açıkbaş) in 1508 during his governorship of Trabzon. Thus, the Ottoman borders had reached beyond the Black Sea coast into Western Georgia. As a result of the increasing relations around Adjaria, which came under Ottoman rule, Islamization began to spread rapidly among the people. Contrary to what is claimed, the spread of Islam in the region did not spread from the ruling strata to the lower, but from the popular strata to the ruling strata. This process was surprisingly fast. In the process of Islamization, many mosques, masjids and schools were built in Adjara, especially with the help of the people. The foundations operating in the region and the mosques and masjids serving under them show that, contrary to the claims of Russian and Georgian historians, Islamization took place rapidly at the beginning of the 17th century in Adjara. In this process, many mosques, masjids and schools were built in the region. In this research, based on the numerous Hurufat records belonging to Adjara, Batumi, Gönye, Çürüksu and Maçahel, the Islamization process will be evaluated by making a social reading with the data obtained from the religious structures established in the rural settlements of the Adjara geography and their officials. Sahip olduğu akademik imkânların ve başta İngilizce olmak üzere birçok dilde uluslararası yayınların çokluğu nedeniyle Amerika Birleşik Devletleri’ndeki İslam çalışmaları yoğun, üretken ve dünya genelinde ilgiyle takip edilen bir alandır. Ancak Batı’daki üniversitelerin genelinde olduğu gibi Amerikan üniversitelerinde de İslam felsefesi/tarihi çalışmaları oldukça zayıftır. Bu makalede öncelikle geçmişten günümüze İslam çalışmalarının ABD’deki durumu tasviri bir metotla ortaya konulmakta ve İslam Felsefesinin ABD’deki İslam çalışmaları içerisindeki zayıf konumu sorgulanmaktadır. İkinci olarak Post-Oryantalist süreçte İslam Felsefesi çalışmalarında (...) öne çıkan isimler ve çalışmaları değerlendirilmektedir. Sonuç olarak ABD üniversite sisteminin genel yapısının gereği olarak İslam Felsefesi çalışmaları nicelik bakımından Avrupa ve İslam coğrafyasından daha zayıf olduğu görülmektedir. Bu durumu iki şekilde açıklamak mümkündür. Birincisi alanın Amerikan devlet felsefesinin temel ilkesi olan bilgi-güç hedefi ve alanın politik çıkarlarıyla ilişkisinin zayıflığıdır. Bu durum Post-Oryantalist eğilimin arka planını da oluşturmaktadır. İkincisi ise fenomenolojist yönteme olan ilginin artması ve Amerikan yükseköğretim sisteminde hâkim olan kozmopolitanizm ve interdisiplinerci yaklaşımlardır.Özet: Dünyanın önde gelen üniversitelerinde İslam çalışmaları ve bu çalışmalar içerisinde yer alan İslam felsefesi çalışmalarının önemli bir akademik ilgi alanı olduğu görülmektedir. Bu ilgi ABD’de de yaklaşık 150 yıllık bir geçmişe sahiptir. Son yıllarda Amerika Birleşik Devletleri’nde İslam çalışmalarında sadece ciddi bir artış değil aynı zamanda çeşitlenme de söz konusu olmuştur. ABD’deki İslam çalışmaları ve özelde İslam felsefesi çalışmalarının durumunu birlikte ele alan akademik araştırmalar ise henüz bulunmamaktadır. Son gelişmeleri de dikkate alarak alanla ilgili araştırmaların sürdürülmesi ve İslam felsefesi çalışmalarının da noksan bırakılan izinin sürülmesi gerekmektedir. Bu noktadan hareketle bu makale çalışması, üniversite müfredatlarıyla ilgili araştırmalar, web taramaları ve yazılı materyaller üzerinden gerçekleştirilecek ve ilgili kitaplar, makaleler ve diğer kaynaklar taranarak konu hakkında deskriptif bilgiler sunulacaktır. Bu yöntemin tercih edilme nedeni derinlemesine bir araştırmadan daha çok genel resmi ortaya koymak ve mevcut durum hakkında bilgi vermektir. Sahanın genişliği ve kaynakların çeşitliliği ve konunun daha özel ve yoğun bir çalışma gerektiren yapısı nedeniyle diğer yöntemler tercih edilmemiştir Çalışma iki ana başlıktan oluşmaktadır. Birincisi ABD’deki İslam çalışmalarının konumu ile ilgilidir. Bu başlık altında 18. yüzyıldan itibaren İslam çalışmalarının ABD’deki seyri hakkında bilgi verilmekte ve İslam çalışmalarının günümüzdeki konumu detaylandırılmaktadır. İkinci başlık İslam Felsefesi çalışmalarının İslam çalışmaları içerisindeki ve ABD akademilerindeki konumuyla ilgilidir. Bu başlık altında İslam Felsefesi çalışmalarının geçmişten günümüze kadar gelinen süreçte geçirdiği evreler tasvir edilmekte ve bazı isimlerin ve eserlerinin değerlendirmesi yapılmaktır. İncelemeler sonucunda ABD’deki İslam çalışmalarının geçmişinin yaklaşık 150 yıla tekabül etmesine rağmen yeterli seviyeye ulaşmadığı görüldü. Hâlbuki sahip olduğu Müslüman nüfus, akademik imkânlar ve başta İngilizce olmak üzere birçok dilde uluslararası yayınların çokluğu nedeniyle ABD’deki İslam çalışmalarının beklenenden daha yoğun, üretken olması beklenirdi. Ancak buna rağmen Daha çok Fenomenolojist ve İnterdisipliner yaklaşımın tercih edildiği Amerikan üniversitelerinin akademik kadro çeşitliliği ve başta İngilizce olmak üzere farklı dillerdeki yayın yelpazesinin genişliği ve son yıllarda yeni bir durum olan sosyal medyaya açık akademik faaliyetler ABD’nin İslam çalışmaları alanındaki etkinliğini giderek arttırmaktadır. Geçmişte İslam çalışmalarında öncü rolü oynayan İngiltere, Fransa, Almanya ve Hollanda gibi ülkelerde öteden beri oryantalist eğilimi temsil eden bu tür çalışmalar günümüz ABD üniversitelerinde interdisipliner ve multidisipliner bir format kazarak devam etmektedir. ABD’deki İslam çalışmaları üzerinde yoğunlaşan akademik çalışmalara göre İslam çalışmalarına yön veren en önemli etken oryantalist eğilimlerdir. Bunun yanında 11 Eylül olaylarının sonucunda da artan bir ilgiden söz etmek gerekmektedir. Bu ilgi sadece alanda yeni istihdam imkânlarının oluşmasına değil aynı zamanda araştırmacı sayısının da artmasına neden olmuştur. Çalışmamın ikinci kısmını oluşturan ABD üniversitelerindeki İslam felsefesi çalışmalarının genel durumuna bakılacak olursa bu çalışmaların sosyoloji, antropoloji ve kültür çalışmaları gibi alanlarda görülen çeşitliliğe de sahip olduğunu söylemek oldukça zordur. ABD üniversitelerindeki İslam felsefesi çalışmaları İslam çalışmaları genel çatısı altında sürdürülmektedir. Bu alandaki çalışmalar başlarda daha çok oryantalist eğilimi temsil eden Philip Hittî, Leo Strauss, Muhsin Mehdî, Fazlurrahmân, İsmâil Râci Fârukî, Mâcid Haddûrî, Moshe Pearlmann, gibi önemli isimler tarafından sürdürülmekteydi. Günümüzde Charles Butterworth, Seyyid Hüseyin Nasr, Oliver Leaman, Dimitri Gutas, Robert Wisnovsky, Frank Griffel, John Walbridge ve daha birçok isim yeni eğilimin temsilcileri olarak alanla ilgili çalışmalarını sürdürmektedir. Bu araştırmacılar, Amerikan akademik siteminin bir sonucu olarak sadece İslam felsefesi değil aynı zamanda İslam bilim tarihi, İslam tarihi ve medeniyeti, İslam ve Batı vb. alanlarda da yayınlar yapmakta ve İslam çalışmalarının sürdürüldüğü çeşitli üniversitelerde dersler vermekte ve lisansüstü seviyede öğrenciler yetiştirmektedir. Bu noktadan hareketle diyebiliriz ki İslam felsefesi çalışmaları ise diğer İslam çalışmalarına kıyasla daha da zayıftır. Bu durumun sebeplerini şu şekilde açıklamak mümkündür:1-Amerikan devlet felsefesinin temel ilkesi olan bilgi-güç hedefi ve alanın politik çıkarlarıyla ilişkisinin zayıflığı. Bilimlerle kurulan bu politik çıkar ilişkisi Post-Oryantalist eğilimin arka planını da oluşturmaktadır. 2-Amerikan Üniversitelerinde fenomenolojist yönteme olan ilginin artması ve Amerikan yükseköğretim sisteminde hâkim olan kozmopolitanizm ve interdisiplinerci yaklaşımlar.3-Amerikan üniversitelerindeki Yakın Doğu, Ortadoğu ve İslam Çalışmalarında İslam felsefesi dersleri felsefenin ya da felsefe tarihinin bir parçası olarak müfredatta yer alması. Amerikan üniversitelerinde standart müfredat sistemi yaygın olmadığından İslam felsefesi ile ilgili dersler bölümden daha çok ders veren hocanın ilgisine ve isteğine bağlı olarak verilmektedir.4-Kıta Avrupası’nda görülen katı oryantalist eğilimlerin nisbeten azlığı ve ABD devlet politikalarının gereği olarak şekillenen havuz usulü müfredat.5-Bazı İslam felsefesi uzmanlarının alanı terk ederek daha çok aktüel tartışmalara yönelmesi ve daha çok Müslümanların geri kalmışlığı sorunundan hareketle üretilen problemlere odaklanması. Son olarak İslam felsefesi çalışmaları Müslümanların genelinin ilgilendiği bir disiplin olmadığı için üniversite dışında İslam felsefesi çalışmalarının yürütüldüğü kurumsal yapılar ABD’de de henüz teşekkül etmemiştir. Bazı bölümlerde İslam Felsefesi İslam düşüncesi tarihinin bir alt dalı olarak varlığını sürdürmektedir. Ancak İslam felsefesi müstakil bir alan olarak kendisine henüz ABD üniversitelerinde yer bulamamıştır. USA’da artan İslam çalışmalarının yeterli düzeyde olmasa da dünyadaki islam çalışmalarına yön verebilecek noktaya ulaştığını söylemek mümkündür. (shrink)

After the death of Prophet Muhammad (p.b.u.h), one of the most significant debated topics of Muslims was the institution of caliphate. This institution caused crucial argumentations through the ages from Abu Bakr to Abd-al-Majid who was the hundreth khalifa. Some prominent issues in that regard as follows: How khalifa comes to power, who becomes khalifa, whether he is descended from Quraysh or not, which kind of traits khalifa should have, and how khalifa should behave in certain circumstances. While these arguments (...) were going on, caliphate was maintained based on the reign under some certain dynasties’ responsibilities after the Rashidun (rightly guided) Caliphs. Umayyads, Abbasids and Ottoman Dynasties were the most well-known ones of these dynasties. Throughout history, even though caliphate passed in one another’s hands among aforementioned dynasties, none of them did attempt to abolish this position. However, Turkish Muslims who became defeated with European occupation of non-western territories decided to abolish caliphate for the sake of modernization activities within the period of transition from imperialism to nation state. This decision brought about a trauma, which was much more critical than former argumentation around the position in Muslim world. Many congresses were organized in Islamic world in order to recover from this trauma. While this kind of quests were continuing, Muhammad Hamīdullah proposed “High Caliphate Council” in relation to rearrangement of caliphate in accordance with the conditions of Islamic countries. This proposal offers an applicable model to today’s modern nation states by establishing unity among them and leaving aside their conflicts and differences. This proposal offers a resolution of much-discussed matters of the position within the limits of principals. It also draws attention by showing a possibility of Islamic union in contemporary Islamic thought. Summary: The matters of who undertakes the management of societies, how rulers come to power and in what manners the rulers maintain the management have been discussed throughout history. It is seen that rulers adopted kingdom as regime before the period of the Prophet Muhammad (p.b.u.h). There was also two-person management. The discussions about this matter were also seen around khalifas who were the rulers of Muslims after the death of Prophet Muhammad (p.b.u.h). Some debated issues in that regards as follows: Who becomes khalifa, how he is elected, which traits he should possess, and so on. Caliphate continued its existence despite the discussions until the first quarter of the 14th Hijra era. Abolition of caliphate was a trauma for Muslims undoubtedly. From Anatolia to Egypt and from India to the Balkans, many attempts were carried out to recover from this trauma. However, this matter was oversimplified in the conditions of that period since it became a topic which was hushed over in just congresses and conventions. One of the people who wrote on this topic, which maintains its vitality even today was Muhammad Hamīdullah. He was an important Islamic scholar, a lawyer and a historian in Indian geography. Hamīdullah did deal caliphate by indicating its history broadly. The distinctive feature of Hamīdullah from others who wrote on this topic is that he also presented a considerable offer to solve the matter. In this sense, Hamīdullah experienced the trauma in his own life as all muslims did it with the abolition of caliphate. Hence he mentioned this matter in his writings in the mood of care and dignity of a scientist and also in feeling of a heartbroken muslim. Hamīdullah made clear that the method of election of the ruler differed throughout history. Indeed, the verses of Holy Qur’ān, the applications of the Prophet Muhammad (p.b.u.h) and the differences of Four Great Chaliphs on coming to power testified this claim. According to Hamīdullah, it is quite normal that the method of regime can vary according to the conditions of societies. He recommended acting based on timeless rules rather than the changes that vary according to conditions and places. He also stated that the regime which Islam approves is a combination of kingdom and democracy in his lines dealing with methods of regime. To him, kingdom is the method of regime of empire. Empire is the regime in which various nationalities live together with all their differences and interact with one another intensely and in which the rulers rule over wide borders. On the other hand, Islamic world lost its edges of empire, changed its regime and divided to nation states after the decline of the Ottoman Empire and Mughal Empire which were established by Muslims. On the contrary, westerners attempted to establish a head empire several times after building nation states in Europe. Some of them are UN, NATO, EU, to name but a few. In our opinion, in the transition process of Muslim rulers from empire to nation state, Hamīdullah made an offer to accomodate Islamic law in state law, Islamic politic and administrative principles in politics and administration practices, Islamic education system in education system, and principles of Islamic economics in economic decisions of government using the Prophet Muhammed’s life as a base. He also explained to Muslims that the method of regime can be changed and the essential matter is to apply Islamic management principles in such a new situation. He played a role in clearing the way for Muslims by indicating that the method of Islamic regime can be changed according to conditions but the principles of Islam are unalterable. To the writer of these lines, Hamīdullah intimates that it is not so true to stick to the form of the process in Muslim territories in which a compulsory transition from the empires or multinational social structures to the nation state structures have been experienced for the last two ages. However, the first matter to dwell on should be whether the ruler of the government behaves in accoradance with the principles of Islam or not. To Hamīdullah, the second matter is that even though Muslim countries had to enter in the process of becoming nation states, Muslims should make an effort to establish supra-state associations as required by Islam. In this respect, Hamīdullah’s proposal is “High Caliphate Council”. This council is a considerable offer presented to Muslim countries in the age when a universal caliphate is not possible and Muslims head towards a unified state form all over the world. Today, this offer recommends countries of which great majority is Muslims and in which Muslims are minority to meet on a common ground rather than conflict because of differences among them. The High Caliphate Council is an institute consists of presidents or hereditary administrators as leading and regular members and so it avoids regional competition. It is established by Muslim presidents who shares the chair alternately. Based on this, all Muslim presidents play a role altogether in this council without need to be Sunni, Shia, or from Quraysh. The High Caliphate Council is a reflection of a dream, which started a century and half a century ago but is required more today. It is also a reflection of the discourse of “Islamic Union” in Contemporary Islamic Thought. The Caliphate Council and International Islamic Legists’ Association, which is the first practical step of the council can be seen as the theory of a new world order based on the unity principle of Islam. Hamīdullah does not consider this order not only in the range of belief but also with the aim of institutionalizing ‘ijmā (consensus of Islamic legists) and qiyās(legal analogy). He stated that International Islamic Legists’ Association, which is a scientific institution could not be established beforetime by Muslims spread on three continents due to lacking of communication among them. However, thanks to today’s possibilities, the establishment of such association is easier today. Hamīdullah found dynamic solutions such these two institutions for the realization of caliphate, which is a religious necessity. This study concluded to refute the claim that there is a historical gap in the development of economic thought, whereby the early pioneers of Muslim economists were able to lay many intellectual foundations for the science of economics. This study sheds light on a period that was intentionally or unknowingly ignored; to reveal the historical roots of Islamic economics, and to reveal the missing link in the development of economic thought, from the first Hijri century to the fifth Hijri century, (...) as this study sought to refute the claim of Western leadership in economic thought through the contributions it offered to Muslim thinkers who preceded Western economists by several centuries. Muslim economists have inaugurated several rules of economics, and have used methods of economic analysis to monitor some economic phenomena. They have delivered these achievements to humanity through the scientific edifices in Andalusia. Likewise, the author of this study does not claim that Muslim scholars have dealt with all economic issues. He does not claim that Muslim scholars laid down all the rules of economics and have left nothing. He acknowledges that Muslim economists have not dealt with many modern economic issues, such as credit, financial derivatives, cryptocurrencies, and the like, but he confirms the contribution of Muslim scholars to the development of economic thought. Parents in Arab society did not take any responsibility for their children in the pre-Islamic era. The husband, as the head of the family, used to treat family members as his servants and forced them in the direction of his interests. No matter the rationale behind it, the burial of daughters in the pre-Islamic era is an outrageous and ill-treated tradition. In this study, it is possible to see which tribes in the Arab society started this repellent custom and which (...) ones were more common. In the society, it is possible to find that there were conscientious and virtuous people trying to prevent these events which can be called as a shame of this humanity, which does not approach the events with the value judgments of that day. Before shedding light on the motivations behind this tradition in the Jahiliyyah Arab society, the examination of the treatment towards daughters in other parts of the World in the same era, would be meaningful in terms of enlightening the phenomenon. This study aims to crystallize the causes, extent, and responses by wise people towards the burial of daughters in the pre-Islamic and Prophetic era.Summary: The burial of daughters or their slaughter in a variety of ways was not unique to the Arabs. At that time people and animals in many parts of the world were sacrificed to give thanks to the gods and to ease their anger. When the killings of girls are considered, Arab society comes to mind. In that time, other countries and nations in the world were not different from the Arabs. During this period, daughters were killed in different ways, not through the burial of living alive.During the Jahiliyya period, among the Arabs who murdered the children of the boys, the girls, and children who were considered to be the weakest members of the family were conducted with this treatment. Men who were the head of the family could tolerate having one or a maximum of two girls. When the number of girls increased, they regarded it as a matter of honour so that when a new daughter was born, the inevitable attempt was to murder her.In the Arabian peninsula - rich merchant families exceptional - families were trying to survive with scarce opportunities. The food and clothing materials used were usually exported and extremely expensive. Therefore, there was a necessity for male members of the family who would provide for the family. From this perspective, so many sons meant dignity. The economy of the day was based on looting and pillaging except for the trade of the elite. Therefore, one had to be strong. The birth of a daughter meant shame, sadness and grief instead of joy and happiness for them. The man would wait excitedly for good news. If the baby was a boy the family rejoiced. However, if it was a daughter the father would be upset. When a person said, “She was a daughter” she could not know what to do with her shame and how to hide from people.When the Arab tribes were examined in general, the burial of daughters was not extended to the whole population. The question of murdering the girl by burying her child was common among Bedouin Arabs who lived in the desert rather than the city. It was extremely difficult to see this tradition in the tribe of Quraish, which were regarded as the masters of the Arabs. When we look at the sources of Jahiliyya and Islamic history, it is observed that the examples of this outrages customs were generally realized in the near term. It is understood that the memory of society is not rich enough to comment. The main reason for this is that Arab society has not a written culture.For the Jahiliyya Arabs, her daughters were ashamed. If they married their daughters even before they had married their daughters into adultery, seeing it as lighter than their children. One of the main reasons was jealousy. The data show that this style was applied more intensely among the Bedouin tribes and especially the tribes of Temim, which is considered to have started the process of burying girls. It is also said that the most jealous tribe of the Arabs is the Rebia tribe. Because of this feature, it is accepted that the first burial of the girl was started in this tribe.Although the Arab society before Islam was known by the atrocities of ignorance and weakness, there were people who were not completely dead and consciously dead. Even though they buried girls alive in society, some people who were disturbed by this rite that destroyed human dignity were trying to prevent ignorant and cruel fathers. The most well-known of the these was the famous poet Ferezdak, grandfather Sasaa b. Naciye.One of the main reasons for the behavior of burying girls alive before Islam was the fear of poverty. Most of them were living in the midst of starvation, and they were considering their daughters as burdens for the family. So they were burying their daughters because of poverty and hunger.One of the reasons for the murder of girls was the sense of honour. In Jahiliyya when a man marries a woman does not come to mind this sense, while marrying his own daughter to someone else sees this as a matter of dishonesty and and he says “it was more sweet to me to bury my daughter with my own hands rather than to marry my daughter. The idea of honour among the Arabs was the idea that their daughters and women would one day be in the hands of the enemy and thus would become a concern for themselves.One of the attributes of the nobles of Arabs was pride and vanity. If someone become arrogant to him and he doesn’t reply, he would be considered a coward. This arrogance dominated the movements of the people of the ignorance. In their eyes, it was so bad to marry someone who was not equal, that they were more likely to die than marrying someone. They were doing this because they had a bit of compassion for them. According to them, girls could not shoulder the heavy burden of life. There were many ways to kill the girl before Islam. But the most common of these was to push him into a hole he had dug before and to throw soil over her and bury her alive. The most commonly used method of killing girls by dumping them in the pits, though, was that they were drowned in the water or strangled. (shrink)

The judgeship is one of the oldest professions in history. In the Hebrews, which is a divinely based legal system, judgeship arised and practiced both by the Torah and later by the contributions of jurists. In the Torah, which is the main source of Hebrew law, it is mentioned that the other prophets and Moses were authorized both as rulers and judges. Moreover, judges are ordered to make fair judgments on the basis of protecting the weak and prohibited of bribery. (...) We see that there are similar or even the same provisions in Islamic law. In Islamic law, it is seen that both the previous prophets and the last prophet Muhammad have the powers as prophet, ruler and judge. Moreover, in the Qur'an, judges are ordered to make judgments fairly, avoid bribery and without favoring any litigants. In this study, the rules of ancient Hebrew law and the Islamic law will be compared. Since the subject is limited to judges and courts, first the status and appointment of judges will be explained, then the courts and the trial procedure will be compared, and afterwards the responsibilities of judges and the qualifications required to be appointed as a judge will be discussed. In this respect, the rules in Hebrew law will be compared with Islamic law only in the light of the information given, and the more detailed rules in Islamic law will not be cited because they don’t have equivalents in Hebrew law. In the middle of the 17th century, Sheikh Wang Daiyu was one of China’s most famous Muslim scholars after Muhammad bin Abdullah bin Elias in China in the late Ming and early Qing dynasties. and at a time when the sheikh lived, Islam in China was evolving progressively after it had had a weak presence, so Sheikh Wang Daiyu started writing books and scholarly articles in which he employed some Confucian terms... to explain Islamic ideas from the Holy Qur’an and (...) the Sunnah of the Prophet. He thus took upon himself the role of missionary caller to Islam, as well as the mission of spreading its culture by aiming to reconcile Confucian ideas with Islamic ones. The Sheikh systematically presented his ideas about the progress of Islam at that time in China. The present study mainly focuses on the biographical account of the Sheikh, on his scholarly and non-scholarly works, and on how he sought to reconcile Chinese culture with Islamic culture. We hereby seek to demonstrate that, during his time and owing to his efforts, Islam gained momentum in China, and that this momentum was achieved through the accommodative and integrating approach of Sheikh Wang Daiyu between the Arabo-Islamic culture and Chinese culture. Also, this study aims to get the world to understand China better, and thus musters the national advocacy of "Chinese storytelling" approach, in introducing the Chinese Muslim scholars who, for over a millennium, advocated Islam and strove to spread it and its culture, and, thus, we hope to draw attention to the contributions they have made within the national legacy of China. And in order to be able to conduct this research as fully as possible, we used the historical method and the analytical method, and the study is committed to covering and encapsulating the following: An examination of the Sheikh’s biographical account and his scholarly writings; A study of the challenges that Islam faced during his time; And an assessment of the Sheikh’s approach in fusing together Chinese and the Arabo-Islamic Civilizations. Öz: Bu çalışmama İslam’da bireyin kamuya karşı sorumluluk alanı ile bağlantılı bir ilkesini; “Emr-i bi’l- Ma’ruf ve Nehyi Ani’l-Münker”i İslam İnanç Ekolleri içerisinde nasıl algılandığını ve nasıl uygulandığını ele alacaktır. Bundaki amacım birey- kamu ilişkisinde, bireyin özgürlük alanlarının ihmal edildiği yönündeki varsayımımdır. Bu girişten sonra, çalışmada İslam inanç ekollerinin konuya ilişkin yaklaşımları ve bu yaklaşımlarına kaynak teşkil eden metinlere yer verilecektir. Çalışmamızda ekollerin kronolojik tarihlerini göz önünde bulunduran bir sıralama takip edeceğiz. Bundaki amacımız özellikle “Emr-i bi’l- Ma’ruf (...) ve Nehyi Ani’l- Münker” ilkesinin ekollerde ele alınışının erken dönem İslam Siyasal Tarihi ile önemli oranda bir ilişkisi olduğu anlayışımız sebebiyledir. İslam siyaset kuramının birlikte yaşam, özgürlük ve adalet iddia ve idealleri çerçevesinde konuya İslam teolojik mezhepleri yakın ilgi göstermişlerdir. Ekollerin “Emr-i bi’l-Ma’ruf ve Nehyi Ani’l-Münker” ilkesine yoğun ilgilerine karşın, farklı yaklaşımlar gösterdikleri de söylenebilir. İslam geleneği içerisinde bu kurucu ilke birey özgürlüğü ve kamu düzeni arasındaki gerilimler nedeniyle politik yorumları da beraberinde getirmiştir. “Haricî” ekoller her bir Müslüman için gereken bir sorumluluk olarak yorumlamış ve “ayn-i vacib” olduğunu dile getirmişlerdir. Diğer ekoller ise bu ilkeyi ” kifa-i bir vucûb” olarak kabul etmişlerdir. Diğer yandan Mu’tezile ekolü bu ilkeyi usulu’l-hamse’ den biri olarak kabul etmiştir. İslam siyaset geleneğinin önemli bileşenlerinden olan ilke mezhepler arasında farklı uygulamalara konu olmuştur. (shrink)

Psikolojinin bir bilim dalı olarak ortaya çıktığı 19. yüzyıla kadar, insana dair sorunlar, felsefi bir yorumla ele alınmıştır. Zaman içinde pozitivizm, materyalizm gibi felsefe akımlarının yön vermesiyle psikoloji bilimi kendine ait kavram ve yöntemlere sahip olmuştur. Bu süreçte bilimde hâkim olan paradigmaların etkisiyle din, uzun bir dönem bilimsel araştırmaların dışında tutulmuştur. Bilim adamalarının dine karşı olumsuz tutumlarına rağmen, Hıristiyan din adamaları felsefe ve psikoloji gibi alanlardaki bilimsel gelişmeleri yakından takip etmişlerdir. Kilise hizmetleri çerçevesinde geleneksel olarak sürdürülen “pastoral care” faaliyetlerinin psikoloji (...) ve psikoterapi alanlarındaki gelişmelerden etkilenmesiyle bugünkü dini danışma ve rehberliğin temeli olan “pastoral care and counseling” kavramları ve yöntemleri ortaya çıkmıştır. 1960’lardan sonra dünya genelinde bir yayılma eğilimi gösteren dini danışma ve rehberlik konusu, son yıllarda Türkiye’deki dini kurum ve akademik çevrelerin de ilgi odağı haline gelmiştir. Bu makalede, konunun İslam kültürü içindeki realizasyonu ile ilgili çalışmalara katkı vermek amacıyla dini danışma ve rehberliğin temel kavramları ve tarihi arka planına odaklanılmıştır. Modern yaşam biçimi toplumsal değişimi hızlandırmakla kalmamış bireysel ihtiyaçları da bir hayli değiştirmiştir. Yaşanan hızlı değişim ve farklılaşan ihtiyaçlar bir takım psikolojik problemleri beraberinde getirmiştir. Buna bağlı olarak insanı olumsuz etkileyen ve hastalanmasına yol açan psikolojik süreçler incelenmeye başlanmıştır. Öte yandan değişimden hayatın değer ve inanç sistemleri de etkilenmiş, kurumsal dini yapılarda ve din hizmeti anlayışlarında önemli değişme ve gelişmeler meydana gelmiştir. Bu sebeple bir taraftan yeni ortaya çıkan olay ve durumlar karşısında dinin bakış açısını ve tutumunu öğrenme ihtiyacı, diğer taraftan yaşanan acı ve krizler karşısında psikolojik yardım ve manevi destek gereksinimleri giderek artmıştır. Kısacası din, insanların kendi başlarına hareket etmekte zorlandığı, rehberliğe ihtiyaç duyduğu bir alan olmuştur. Dini danışma ve rehberlik alandaki ilk çalışmalar, tamamen bir Hıristiyanlık faaliyeti olarak ortaya çıkmış olduğu için bu alana ait ilk kavramlar da Hıristiyan kültürü ile yakından ilgilidir. Dini danışma ve rehberliğin temel kavramlarından olan “pastoral care” genellikle rahip ya da papazların özellikle kilise dışında yürüttükleri dini danışmanlık ve rehberlik hizmetlerini ifade etmektedir. Günümüzdeki dini danışma ve rehberlik hizmetlerinin temelini, Hıristiyan din adamlarının verdiği manevi destek, öğüt ve tavsiye anlamındaki pastoral care faaliyetleri oluşturmaktadır. Ayrıca kavramların, Mesih ve teslis inancı; günahsızlık ve günahların kefareti, lütuf yoluyla kurtuluş öğretileri; papazların yanılmazlığı ve ruhbanlık anlayışı; itiraf müessesesi ve kilisenin statüsü gibi Hıristiyan teolojisine ait kökenleri bulunmaktadır. Pastoral care ve pastoral counseling birbirlerinden bir dereceye kadar ayırt edilebilen yardım şekilleridir. Aralarındaki farklılık, papazların insanlarla çalışırken, ilgili psikolojik dinamikler yerine kendilerinin ahlaki duruş mesafelerinden kaynaklanır. Bu nedenle ikisi arasında en geniş ve kapsayıcı pastoral faaliyet, kesinlikle pastoral care çalışmalarıdır. Bu çalışmalar, resmi ve gayrı resmi konuşmalar, diyaloglar ve diğer iletişim etkileşimleri ile gençler, çiftler, yetişkinler ve çeşitli diğer gruplarla daha fazla ya da az yapılandırılmış genel ilişkilerdir. Pastoral counseling olarak adlandırılan yardım ilişkileri ise pastoral care faaliyetlerinin genel ve her yerde uygulanabilirliğinden farklı şekilde, bireylerin belirli bir yerde ve belirli bir süre tahdidi çerçevesinde yapılandırılmış olan yardım faaliyetlerini içerir ki, böyle bir yardım sürecinde papazın dikkatini ve zamanını gerektiren durumlar söz konusudur. Burada ayırt edici nokta, bireyin psikolojik durumu ve sorunlarının daha fazla olmasıdır. Dini danışma ve rehberliğin kurumsal bir hizmet alanı olarak ortaya çıkışı, reform hareketleri ve sanayi devriminin Batı Avrupa ülkelerinin sosyal dokusu ve dini kurumların yapılanması üzerinde yaptığı değişimle doğrudan alakalıdır. Nitekim Katolikler ve özellikle Ortodokslar yeni gelişen psikolojik danışma faaliyetlerinde daha temkinli bir tutum takınırken Protestanlar dini destek ve yardım hizmetlerinde yeni psikolojik teori ve teknikleri kucaklama eğilimi göstermişlerdir. 15. yüzyıldan itibaren oluşan, insana, Tanrı’ya ve âleme bakıştaki farklılaşmanın gerçekleştiği süreç, 18. yüzyılda “aydınlanma” olarak adlandırılan köklü bir değişimi beraberinde getirmiştir. Doğaüstünün doğayla, dinin bilimle, tanrısal buyruğun doğa yasasıyla, din adamlarının filozoflarla yer değiştirmesi ve dini inanca toleransın azalması ile karakterize edilen bu dönemde, din ve maneviyat konusu, psikolojik araştırmalar ve klinik deneyler dışında tutulması gerektiğine inanılan, kişilere özgü, bilim dışı, bilinmez bir özel alan olarak görülmüştür. Psikolojinin bir bilim dalı olarak ortaya çıktığı dönemde bilimsel sahada hâkim olan paradigmanın etkisiyle bilim adamaları her ne kadar din ile sağlıklı bir ilişki kuramadıysa da; özellikle Amerika ve Avrupa’da kilise hizmetleri çerçevesinde “pastoral care” faaliyetlerini yürüten din adamları, modern psikiyatri ve psikoterapi birikiminden etkili bir şekilde yararlanmışlardır. Kilise faaliyetlerinin psikoloji alanındaki gelişmelerden etkilenmesiyle papaz ve rahiplerin dini konulardaki yardım çalışmaları hem kilise içinde hem kilise dışında daha profesyonelce yürütülen faklı bir boyut kazanmaya başlamıştır. Papazların yetiştirilmesinde danışma psikolojisi ve klinik psikolojinin yöntem ve kurallarının kullanılmaya başlamasıyla “pastoral counseling” alanı gelişme göstermeye başlamıştır. Abraham Maslow’un “kendini gerçekleştiren kişiler” hakkındaki araştırmasına kadar (1962) ilgiye layık görülmeyen din ve maneviyat, bu araştırma sonucunda, karşılanması gereken nihai bir ihtiyaç ve önemli bir motivasyon olarak fark edilmiştir. Alanda son yapılan araştırmalar, din ile ruh ve beden sağlığı arasında önemli ilişkilerin olduğunu ortaya koymaktadır. Danışmanlarca, danışanların dini inançlarının danışma sürecine dâhil edilmemesi; danışanın kimliğinin işe yarayan önemli bir bölümünü yok saymakla eş anlamlı kabul edilmektedir. Bu gelişmelerin sonucu olarak bugün başta ABD ve diğer gelişmiş ülkelerde birçok Tıp Fakültesi ve Psikoloji bölümleri, programlarına dini danışmanlıkla ilgili dersler koymaktadır. 20. yüzyılın başından beri Hıristiyan Batı dünyasında uygulanmakta olan pastoral care and counseling faaliyetleri, toplumsal değişmenin küresel etkileri ve gittikçe benimsenen modern yaşamın farklılaşan ihtiyaçlarına bağlı olarak son yıllarda Türkiye’deki akademik çevrelerin ve ilgili kurumların ilgi odağı haline gelmiştir. Dini danışma ve rehberlik, kültürümüzde henüz yabancı bir kavram ve kurumsallaşmamış bir hizmet alanı olarak kabul edilse de; Hz. Peygamber’den (s.a.v) bu yana sürdürülen din hizmetlerinin en önemli bölümünü, özü dini rehberlik olan irşat faaliyetleri oluşturmaktadır. Ancak günümüzde modern psikolojik yardım disiplinlerinin ilke ve yaklaşımlarından destek alan yeni irşat modellerine ihtiyaç vardır. Dini danışma ve rehberlik, amaç, ilke, yöntem ve yaklaşımları ile toplumda oluşan yeni ihtiyaç ve beklentileri karşılamaya yönelik sürdürülen çabalara önemli katkılar sağlayacaktır. (shrink)

Abstract:During recent years, the principle and practice of employment-at-will have been under attack. While progress has been made in eroding the practice, the principle still governs the philosophical assumptions underlying employment practices in the United States, and, indeed, EAW has been promulgated as one of the ways to address economic ills in other countries. This paper will briefly review the major critiques of EAW. Given the failure of these arguments to erode the underpinnings of EAW, we shall suggest new avenues (...) for approaching employment issues to achieve the desirable goal of employee dignity and respect. This article presents a response to Richard Rorty's paper "Is Philosophy Relevant to Business Ethics?" The author questions Rorty's views on the depreciation of the role of philosophy in applied ethics, and outlines four reasons why philosophy retains its relevance. The author addresses the role of moral reasoning in the development of the moral imagination. The author also concludes that humans have the means necessary to make moral progress and are capable of moral reasoning, and need only to develop a (...) strong moral imagination. (shrink)
