Abstract

On considère ici l’injustice telle qu’elle est examinée dans la section du « droit abstrait » des Principes de la philosophie du droit de Hegel, où elle prend le sens d’une mise en cause indue d’un titre de propriété. Il apparaît que l’injustice constitue, pour Hegel, le lieu d’affirmation du bon droit, dans la mesure où celui-ci n’est pas autre chose qu’un principe de rectification. La répartition juste des biens ne peut dès lors consister en un état donné mais s’obtient dans la lutte indéfinie menée contre les appropriations injustes.One considers here the injustice as it is examined in the first section of Hegel’s Philosophy of Right, where it takes the form of an undue calling into question of an ownership title. It appears that for Hegel, injustice constitutes the area of affirmation of justice, where it itself is nothing other then a principle of rectification. Just share of the goods cannot consist in a given state, but can only be obtained through an indefinite struggle against unfair appropriation
