This contribution offers a reflection on the death penalty in the light of OT Law that enforced and sanctioned it only within the scope of the biblical understanding of justice. Starting therefore with the Torah and moving through the Prophets into the New Testament, the reader is called to question the logic behind retributive justice, as it attempts to re-establish the desecrated order. Retributive justice does so by means of a 'just' punishment, by giving everyone one's due, and through the (...) emendation of the culprit. The cross, though, goes well beyond the understanding of God as symmetry and the concept of a 'matching' justice. In Christ's death, the first place cannot be accorded to an order that needs to be set right again; still less can it be given to the suppression of bad subjects. That first place must belong to the human person who cries out for redemption and asks to be re-created in God's image. This would amount to nothing less than a restitutio principii. (shrink)

The Bible is the Word of God as expressed in human language. The goal of the present article is to develop a hermeneutical approach based in the communicative function of language. It first takes up the constitutive elements of the communicative event and the different patterns of representation. It then focuses in the exact operative function of language so as to clarify the relation between the semantic content and its pragmatic usage. Finally, it analyzes the specific characteristic of a biblical (...) text to apply the above communicative process to the analytical interpretation of a literary text. (shrink)

In this paper I outline a theory of legitimacy that grounds the state’s right to rule on a natural duty not to harm others. I argue that by refusing to enter the state, anarchists expose those living next to them to the dangers of the state of nature, thereby posing an unjust threat. Since we have a duty not to pose unjust threats to others, anarchists have a duty to leave the state of nature and enter the state. This duty (...) correlates to a claim-right possessed by those living next to them, who also have a right to act in self-defence to enforce this obligation. This argument, if successful, would be particularly attractive, as it provides an account of state legitimacy without importing any normative premises that libertarians would reject. (shrink)

Crimes against humanity are supposed to have a collective dimension with respect both to their victims and their perpetrators. According to the orthodox view, these crimes can be committed by individuals against individuals, but only in the context of a widespread or systematic attack against the group to which the victims belong. In this paper I offer a new conception of crimes against humanity and a new justification for their international prosecution. This conception has important implications as to which crimes (...) can be justifiably prosecuted and punished by the international community. I contend that the scope of the area of international criminal justice that deals with basic human rights violations should be wider than is currently acknowledged, in that it should include some individual violations of human rights, rather than only violations that have a collective dimension. Hermann Cohen, der Begründer der Marburger Schule des Neukantianismus, hat einen bis dato unterirdischen Einfluss auf den Logischen Empirismus ausgeübt. Seine Konzeption der transzendentalen Methode sowie seine scharfe Polemik gegen den Psychologismus wurden insbesondere von Rudolf Carnap und Hans Reichenbach zum Teil angenommen, aber zugleich auch umgewandelt. Reichenbach’s Analyse der Wissenschaft und Carnaps logische Analyse wissenschaftlicher Sätze sind mit Cohens Ansatz in dem Sinne noch verbunden, dass die Kritik der Vernunft Kantischer Prägung durch die Eruierung der begrifflichen Struktur wissenschaftlicher Theorien (...) ersetzt wird. Trotz offensichtlicher Differenzen handelt es sich doch um einen Zusammenhang, auf den die Forschung weiter einzugehen hat. (shrink)

Saggio sul positivismo giuridico e la sua crisi”. Al hilo del trabajo del citado autor, los participantes reflexionan sobre preguntas centrales para la teoría y filosofía del Derecho contemporánea: ¿cuál es la naturaleza del Derecho? ¿es el razonamiento jurídico eminentemente moral? ¿qué lugar debe ocupar la práctica jurídica en su conceptualización? ¿qué (...) lugar ocupa la fuerza en el Derecho? The article analyzes a few aspects of pope Francis’ governing style and the overall context for the issue of a synodal reform of the Catholic Church in the global world: the meaning of “Ecclesia semper reformanda” in a globalized Church; from episcopal collegiality to ecclesial synodality and the “synodal process 2021-2023; the relationship between pope Francis and the Roman Curia; the troubles with the globalization of the Church; the meaning of governance of the global Church in the age of the (...) sexual abuse crisis. The article frames pope Francis’ most important decisions and choices for the governance of the Catholic Church in the most undisputable feature of the pontificate: the re-positioning out of a strictly European and North American theological and geopolitical axis, in order to embrace the global vocation of Catholicism. This implies some epoch-making shifts for what concerns the role of the Vatican, its relationship with the local churches and the bishops’ conferences, and the idea of church reform. (shrink)
